FEDERAL RULES OF EVIDENCE: 801-03, 901 Rule 801. Definitions The following definitions apply under this article: (a) Statement. A "statement" is (1) an oral or written assertion or (2) nonverbal conduct of a person, if it is intended by the person as an assertion. (b) Declarant. A "declarant" is a person who makes a statement. (c) Hearsay. "Hearsay" is a statement, other than one made by the declarant while testifying at the trial or hearing, offered in evidence to prove the truth of the matter asserted. (d) Statements which are not hearsay. A statement is not hearsay if-- (1) Prior statement by witness. The declarant testifies at the trial or hearing and is subject to cross- examination concerning the statement, and the statement is (A) inconsistent with the declarant's testimony, and was given under oath subject to the penalty of perjury at a trial, hearing, or other proceeding, or in a deposition, or (B) consistent with the declarant's testimony and is offered to rebut an express or implied charge against the declarant of recent fabrication or improper influence or motive, or (C) one of identification of a person made after perceiving the person; or (2) Admission by party-opponent. The statement is offered against a party and is (A) the party's own statement, in either an individual or a representative capacity or (B) a statement of which the party has manifested an adoption or belief in its truth, or (C) a statement by a person authorized by the party to make a statement concerning the subject, or (D) a statement by the party's agent or servant concerning a matter within the scope of the agency or employment, made during the existence of the relationship, or (E) a statement by a coconspirator of a party during the course and in furtherance of the conspiracy. -
Core Principles of the Legal Profession
CORE PRINCIPLES OF THE LEGAL PROFESSION Resolution ratified on Tuesday October 30, 2018, during the General Assembly in Porto Preamble The lawyer’s role is to counsel, conciliate, represent and defend. In a society founded on respect for the law and for justice, the lawyer advises the client on legal matters, examines the possibility and the appropriateness of finding amicable solutions or of choosing an alternative dispute resolution method, assists the client and represents the client in legal proceedings. The lawyer fulfils the lawyer’s engagement in the interest of the client while respecting the rights of the parties and the rules of the profession, and within the boundaries of the law. Over the years, each bar association has adopted its own rules of conduct, which take into account national or local traditions, procedures and laws. The lawyer should respect these rules, which, notwithstanding their details, are based on the same basic values set forth below. 1 - Independence of the lawyer and of the Bar In order to fulfil fully the lawyer’s role as the counsel and representative of the client, the lawyer must be independent and preserve his lawyer’s professional and intellectual independence with regard to the courts, public authorities, economic powers, professional colleagues and the client, as well as regarding the lawyer’s own interests. The lawyer’s independence is guaranteed by both the courts and the Bar, according to domestic or international rules. Except for instances where the law requires otherwise to ensure due process or to ensure the defense of persons of limited means, the client is free to choose the client’s lawyer and the lawyer is free to choose whether to accept a case. -

The National Domestic Violence Prosecution Best Practices Guide is a living document highlighting current best practices in the prosecution of domestic violence. It was inspired by the Women Prosecutors Section of the National District Attorneys Association (NDAA) and a National Symposium on the Prosecution of Domestic Violence Cases, hosted by the NDAA and Alliance for HOPE International in San Diego in October 2015. The two-day national symposium included 100 of our nation’s leading prosecutors re- envisioning the prosecution of domestic violence cases in the United States. Prosecutors and allied professionals are encouraged to continue developing this guide by contributing information on emerging best practices. NDAA recognizes that funding, local rules, or other state laws or local restrictions may prevent an office from adopting the various approaches suggested. Kim Under Federal Rule of Evidence 404, the character evidence rule, it is well established that evidence of character generally is not admissible to show that a person acted in conformity with that char- acter on a particular occasion. No consensus exists, however, as to whether the character evidence rule should also apply to corpora- tions. In this article, Professor Kim argues that the ban on character evidence should not be extended to corporations. Professor Kim be- gins with a discussion of various rationales offered to support the character evidence rule, emphasizing Kantian conceptions of human autonomy. She then examines varying definitions of “character” and concludes that character may best be regarded as a reflection of the internal operating system of the human organism. Next, Professor Kim turns to an analysis of the personhood of corporations and de- termines that corporations are persons and moral actors with the ca- pacity to possess character. This corporate character is separate and apart from the character of the corporation’s individual members and reflects the internal operating system of the corporate organization. Finally, Professor Kim suggests that the human autonomy ra- tionale for the character evidence rule does not apply with equal force to corporations. She then concludes with an examination of the prac- tical implications of excluding corporations from the protections af- forded individuals under Rule 404. The force of these penetrating observations has not been dulled either by time's attrition or by Congress' adoption of the Federal Rules of Evidence in 1975. -

CRIN takes full responsibility for any errors or inaccuracies in the report. I. What is the legal status of the Convention on the Rights of the Child (CRC)? A. What is the status of the CRC and other relevant ratified international instruments in the national legal system? The CRC was signed by Mexico on 26 January 1990, ratified on 21 November 1990, and published in the Federal Official Gazette (Diario Oficial de la Federación) on 25 January 1991. In addition to the CRC, Mexico has ratified the Optional Protocols relating to the involvement of children in armed conflict and the sale of children, child prostitution and child pornography. All treaties signed by the President of Mexico, with the approval of the Senate, are deemed to constitute the supreme law of Mexico, together with the Constitution and the laws of the Congress of the Union.1 The CRC is therefore part of national law and may serve as a legal basis in any proceedings before the national courts. It is also part of the supreme law of Mexico as a whole and must be implemented at federal level and in all the individual states.2 B. Does the CRC take precedence over national law The CRC has been interpreted to take precedence over national laws, but not the Constitution. According to doctrinal thesis LXXVII/99 of November 1999, international treaties are ranked second immediately after the Constitution and ahead of federal and local laws.3 On several occasions, Mexico’s Supreme Court has stated that international treaties take precedence over national law, mainly in the case of human rights.4 C.
