NOTICE OF MINISTERIAL INFRASTRUCTURE DESIGNATION MADE UNDER THE PLANNING ACT 2016 I, the Honourable Steven Miles MP, Deputy Premier, Minister for State Development, Infrastructure, Local Government and Planning, give notice that under section 38 of the Planning Act 2016, I made the Ministerial Infrastructure Designation (MID) for the Southern Redland Bay Wastewater Treatment Plant on 24 June 2021. The MID will take effect from 25 June 2021. Description of the designated premises The MID applies to premises located at 38 Longland Road, Redland Bay, QLD 4165 formally described as Lots 2 and 3 on RP223470, Lot 1 on SL3427, Lot 254 on S31102 and Part of unallocated State land (Serpentine Creek). Type of infrastructure for which the premises were designated The infrastructure is described under Schedule 5, Part 2 of the Planning Regulation 2017, as: • Item 17: water cycle management infrastructure. Requirements included in the MID The MID includes requirements in relation to the location and scale of the development, stormwater management, bushfire management, external works, filling and excavation, biting insect management, rehabilitation management, acoustics, odour, lighting, flora and fauna, marine plants, waterway barrier works, reconfiguring a lot, refuse plant/ screening, operational management and construction management. NOTICE OF THE MAKING OF TEMPORARY LOCAL PLANNING INSTRUMENT No. 2 of 2021 – COLMSLIE ROAD INDUSTRY PRECINCT (TLPI 02/2021) BRISBANE CITY COUNCIL LOCAL GOVERNMENT AREA I, the Honourable Steven Miles MP, Deputy Premier and Minister for State Development, Infrastructure, Local Government and Planning, notify that I have made TLPI 02/2021 in accordance with section 27(3) of the Planning Act 2016 and the Minister’s Guidelines and Rules September 2020. TLPI 02/2021 will have effect on 29 June 2021 and will have effect for a period of two years unless repealed sooner. Purpose and General Effect TLPI 02/2021 is a temporary local planning instrument under section 23 of the Planning Act 2016. Under section 23(3) of the Planning Act 2016, a temporary local planning instrument may suspend or otherwise affect the operation of another local planning instrument but does not amend or repeal the instrument. The purpose of TLPI 02/2021 is to: • continue to protect the integrity of land in the Industry zone within the area identified as the Colmslie Road Industry Precinct (CRIP) for new and existing industry uses and enable new investment in industry to occur within the CRIP to provide economic benefits to the region and local area • ensure incompatible non-industrial uses do not undermine the viability of and continued and future operation of, established and envisaged industrial development • protect the effective operation of established and envisaged industrial uses by avoiding encroaching incompatible non- industrial development that may generate reverse amenity impacts. Location of Area to which TLPI 02/2021 Applies TLPI 02/2021 applies only to part of the Brisbane City Council local government area, namely the land identified as within the TLPI boundary on the CRIP which is shown in Figure A of the TLPI. Short Title 1. This order in council may be cited as the Administrative Arrangements Order (No. 1) 2021.

Administrative Arrangements 2. (1) The public business of the State is distributed among Ministers as set out in the Schedule.

(2) Each Minister is to administer the matters set out in the Schedule next to the Minister’s title as follows: (a) the matters connected with the public business of the State listed under the heading ‘Principal Ministerial Responsibilities’; (b) the legislation listed under the heading ‘Acts Administered’; and (c) the administrative units listed under the heading ‘Administrative Units’.

(3) Information in the Schedule under the heading ‘Responsible Heads’ is included for information only and does not form part of this order.

Repeal of earlier Administrative Arrangements 3. The Administrative Arrangements Order (No. 2) 2020 is repealed.

Commencement 4. This order commences on 1 July 2021.

Senior officers - employment conditions

Directive 02/21 Effective date: 1 July 2021 Supersedes: 11/17

1. Purpose This directive sets out the requirements for appointment and the employment conditions for senior officers and employees seconded to or acting as senior officers.

2. Authorising provisions This directive is made pursuant to sections 53(1)(b) and 119 of the Public Service Act 2008 (PS Act).

3. Application 3.1 This directive applies to employees engaged under Chapter 5, Part 2 of the PS Act, and by secondment to or acting at the senior officer classification level. 3.2 Schedule 1 of this directive also applies retrospectively to employees who were appointed to, engaged or acting in a senior officer role at any time during the period from 1 September 2019 to 1 July 2021, for service at the senior officer classification level during that period, provided that on 1 July 2021 the employee is employed by a government entity as defined in section 24 of the PS Act.

Directive

4. Principles 4.1 Senior officers: (a) play an important leadership role in Queensland public sector agencies, and are a critical talent pathway to executive leadership roles (b) make a valued contribution, providing a bridge between an agency’s strategic leadership and operations, connecting activities to purpose, and driving outcomes (c) work collaboratively across the sector, enabling connected policy and service delivery agendas to improve community outcomes.

4.2 The Queensland Government is committed to maximising permanent employment, including for employees at the senior officer classification level. This directive provides for the appointment and fair remuneration of senior officers and for the review of public service employees acting as senior officers for permanent appointment to their role. 4.3 Under the Human Rights Act 2019 decision makers have an obligation to act and make decisions in a way that is compatible with human rights, and when making a decision under this directive, to give proper consideration to human rights.

5. Appointment as a senior officer 5.1 Where a role is assessed as being within the work value range (720 – 819) for senior officers under the approved Job Evaluation Management System (JEMS), an appointment to or engagement in the role must be at the senior officer classification level. 5.2 Appointing a public service employee to a higher classification level (a) Clause 5.2 applies to: (i) a public service officer who is seconded to a higher classification level as a senior officer in the department in which the employee is substantively employed. (ii) a public service employee (including a fixed term temporary employee) who is assuming the duties and responsibilities of a higher classification level as a senior officer in the department in which the employee is substantively employed. (b) Clause 5.2 does not apply to a person engaged as a senior officer under section 122 of the PS Act, even if the person holds a substantive appointment as a public service employee. (c) An employee in clause 5.2(a) may make a written request to the chief executive to appoint the employee to the senior officer role as a public service officer after: (i) the employee has been performing in the senior officer role for a continuous period of at least one year (ii) each one-year period after a written request made under clause 5.2(c)(i). (d) An employee may make an additional request if the role becomes a substantive vacancy. (e) When deciding the request, the chief executive must consider: (i) whether the employee is eligible for appointment to the senior officer role having regard to the merit principle (ii) the genuine operational requirements of the department. (f) The chief executive must decide the request, and provide a written decision, within the required period – 28 days after the request is made unless there is agreement between the employee and the chief executive to extend the period. (g) If the chief executive does not make a decision within the required period, the chief executive is taken to have refused the request. (h) Any requirement to advertise a role in a directive dealing with recruitment and selection does not apply when permanently appointing an employee under clause 5.2.

(i) Affected employees registered for priority transfer under the directive about supporting employees affected by workplace change must be considered for placement prior to making a decision to appoint a senior officer under clause 5.2. (j) An employee eligible for review under this clause has a right of appeal under section 194(1)(a) of the PS Act where: (i) the chief executive decides not to permanently appoint the employee to the higher classification level, and (ii) the employee has been continuously engaged at the higher classification level as a senior officer for at least two years. (k) Continuous period for the purposes of this directive, means a period of unbroken engagement, including periods of authorised leave or absence, in the same senior officer role, in the same agency. A period of engagement at the senior executive service classification level may be considered an authorised absence where the employee returns to the same senior officer role.

6. Hours of work and attendance 6.1 The usual full-time work hours of a senior officer are a minimum of 72.5 hours per fortnight1. However, to perform the role effectively, a senior officer may be required to work additional hours as appropriate. 6.2 Hours of work arrangements must consider and seek to manage a senior officer’s health and well-being. 6.3 A senior officer’s manager may approve reasonable time off without debit to a leave account where they consider the senior officer has regularly worked in excess of usual hours. 6.4 A senior officer may be required by their chief executive to undertake official duties for the whole or part of a public holiday, as warranted in the circumstances. 6.5 Senior officers are not entitled to additional compensation for work performed outside of usual hours (including public holidays). 6.6 A senior officer may access flexible work arrangements with the approval of their manager. Flexible work arrangements may relate to the pattern of work, the place of work and the work arrangements used. 6.7 A senior officer may be engaged on a part-time work arrangement. An approved part-time work arrangement constitutes the usual hours of the senior officer. A part-time senior officer is entitled to the benefits and entitlements of a full-time senior officer on a pro-rata basis. 6.8 A senior officer who is unable to attend work or perform their duties is to report the fact to their manager as soon as possible.

7. Remuneration package and benefits 7.1 Senior officers will receive remuneration in accordance with Schedule 1 or the relevant Stage of Schedule 2 of this directive, according to the effective dates of each of those Schedules or Stages. 7.2 When appointing a senior officer or engaging a person to act as a senior officer, the chief executive will determine the relevant senior officer pay-point to be paid (that is, pay-point 1, 2 or 3), commensurate with the person’s skills and expertise. 7.3 A pay-point increase for a senior officer is tied to achieving and exceeding agreed performance objectives. At each annual performance review, the senior officer’s manager must consider and recommend a single pay-point increase if there is evidence of sustained high performance. 7.4 A recommended senior officer pay-point increase will take effect once approved by the chief executive. 7.5 A senior officer may elect, through a signed agreement with their chief executive, to receive the following remuneration package benefits via in-house salary packaging at no administration cost to the senior officer: (a) the payment of employee superannuation contributions (b) the payment of subscriptions for membership of professional or occupational associations (c) a benefit of another kind approved by the Commission Chief Executive, Public Service Commission. 7.6 A remuneration benefit agreed in clause 7.5 must not exceed the percentage of superannuable salary that would apply if the senior officer were to access the agency’s fee for service salary packaging scheme. 7.7 A senior officer may also access other salary packaging items from their agency’s provider in accordance with the rules and charges associated with using that service. 7.8 A person acting in a senior officer role may access the remuneration package benefits in clause 7.5 when the cumulative period of consecutive acting appointments exceeds 12 months.

8. Technological support Where determined by the chief executive, a senior officer is to be provided with an official smartphone device and any other technological support necessary to enable the senior officer to fulfil their duties to the satisfaction of the chief executive. A senior officer is entitled to reasonable personal use of the smartphone or other technological support in accordance with departmental policy.

9. Application of award provisions and directives of industrial relations Minister 9.1 A senior officer is entitled to the benefits and allowances set out in the following award provisions and directives of the industrial relations Minister, as though the senior officer was covered by such award provisions and directives, subject to the amendments and/or conditions noted below: (a) clauses 20 (Personal leave) and 21 (Parental leave) of the Queensland Public Service Officers and Other Employees Award – State 2015 (b) the directive about hours, overtime and excess travel, only to the extent that it provides for the overtime meal allowance (c) the directive about recognition of previous service and employment for long service, sick and paid parental leave purposes (d) the directive about leave without salary credited as service, except to the extent that it provides for salary increments (e) the directives about long service leave, recreation leave (except to the extent that it provides for Christmas/New Year compulsory closure), sick leave, study and examination leave, special leave and paid parental leave (f) the directive about higher duties, except that: (i) the minimum period means ‘more than three days’ (ii) the relevant percentage is 100% (iii) the clauses dealing with payment of increments during relieving periods and the recognition of higher duties on appointment do not apply (iv) the calculation of the higher duties allowance will be to SO1 pay-point, unless otherwise determined under clause 7.2. Where an existing senior officer undertakes duties in a senior officer classified role in another department at a higher senior officer pay-point, maintenance of that higher pay-point is not automatic on return to their home department. (g) the directive about motor vehicle allowances that references the relevant modern award being the Queensland Public Service Officers and Other Employees Award – State 2015 (h) the directive about court attendance and jury service (i) the directives about travelling and relieving expenses (j) the directive about locality allowances (k) the directive about critical incident entitlements and conditions, except to the extent that it provides for overtime, flexitime or time off in lieu (l) the directive about leave and travel concessions for isolated centres (m) the directive about early retirement, redundancy and retrenchment. 9.2 A senior officer may be provided with benefits under the directive about transfer and appointment expenses. Alternatively, transfer and appointment expenses may be paid in accordance with a proposal approved by their chief executive and supported by a certificate from the chief executive that the total quantum of expenses under the proposal will be no greater than the reimbursement that would have been payable under the directive.

Christmas/New Year compulsory closure 10.1 A senior officer, including when on recreation or long service leave, is to be granted leave on full pay without debit to any leave account for those days during the Christmas/New Year compulsory closure period that are not public holidays or weekend days (granted leave days). A senior officer on any other form of leave does not qualify for the granted leave days. 10.2 Where a senior officer is on approved recreation or long service leave on any of the granted leave days, the senior officer’s relevant leave balance is to be adjusted to reflect the granted leave days instead of the recreation or long service leave. 10.3 A chief executive may, in exceptional circumstances, determine that an individual senior officer does not qualify for the granted leave days. Where a chief executive makes such a determination, the senior officer is required to apply for leave if they are not otherwise required for work.

ADOPTION OF DIAMANTINA SHIRE COUNCIL PLANNING SCHEME 2021 Notice is hereby given under the Planning Act 2016 that the Diamantina Shire Council, on 21st June 2021, resolved to adopt the Diamantina Shire Council Planning Scheme. The commencement date for the Diamantina Shire Council Planning Scheme 2021 is 9th July 2021. The purpose and general effect of the Diamantina Shire Council Planning Scheme 2021 is to shape and manage development in the Diamantina Shire Council area over the next 20 years. The Diamantina Shire Council Planning Scheme 2021 will replace the previous Planning Scheme utilised by Council. A copy of the Planning Scheme will be available for inspection and purchase at the office of the Diamantina Shire Council at 17 Herbert Street, Bedourie. I, the Hon. Yvette D’Ath MP, Minister for Health and Ambulance Services, Leader of the House hereby:

1 Provisions to facilitate the transfer of Functions to the Central Queensland Hospital and Health Service 1.1 Freehold Land (s 273A(2)) Transfer to the Service the State’s (represented by Department of Health) right, title and interest in the parcel of freehold land described as Lot 93 on SP100503, title reference 50198762, effective at the Effective Time. 1.2 Conditions (s 273A(4)) The transfer under clause 1.1 is subject to these conditions: (a) The transfer is subject to: (i) all Existing Occupancy Rights; and (ii) the right of the State (represented by Department of Health) and those authorised by the State (represented by Department of Health) to access the Transferred Property at any time after the Effective Time for the purpose of carrying out Major Capital Works (but except in the case of an emergency the State (represented by Department of Health) must give the Service reasonable prior notice) and access for any other purposes under the Act. The Service is bound by such rights with effect from the Effective Time and must comply with the terms and conditions of such rights. From the Effective Time the Service must perform all obligations in respect of the Existing Occupancy Rights which were obligations of the State (represented by Department of Health), at the cost of the Service. (b) The Service is entitled to all payments from the Existing Occupiers with effect from the Effective Time on the same basis as applied at the Effective Time. (c) Unless the rights described in clause 1.2(a) include an express right for the Service to relocate the Existing Occupants then the Service may not relocate any of the Existing Occupants without the consent of such occupant. 1.3 Transfer of Fixed Assets (including Building Services Plant and Equipment) (s273A(2)) As a consequence of the transfer of the interests in the Transferred Property, transfer to the Service the State’s (represented by Department of Health) right, title and interest in the Fixed Assets (including the Building Services Plant and Equipment) in respect of the Transferred Property, effective at the Effective Time. 1.4 Transfer of Ancillary Instruments and Performance Securities (s 273A(2))

(a) To the extent that they may lawfully be transferred, transfer to the Service the State’s (represented by Department of Health) right, title, interest and liabilities associated with: (i) all Ancillary Instruments; (ii) all Associated Agreements; and (iii) all Performance Securities, that relate to the Transferred Property, with effect from the Effective Time other than any such instruments, contracts, agreements which are Excluded Agreements. (b) With effect from the Effective Time, to the extent that any warranty or contractual or statutory right relating to the construction or operation of the improvements on the Transferred Property held by the State (represented by Department of Health) is not transferred or is not capable of transfer, the State (represented by Department of Health) holds such rights on behalf of and for the benefit of the Service and, if requested by the Service in writing, must enforce such rights at the cost of the Service. (c) The Service must not do or permit anything to occur which would void any warranty or contractual or statutory right relating to the construction or operation of the improvements on the Transferred Property held by the State (represented by Department of Health) which is not transferred or is not capable of transfer. 1.5 Condition of Assets (s273A(4)) The transfer under clause 1.1 is subject to these conditions: (a) The Service accepts the Transferred Property on an as is basis at the Effective Time. (b) From the Effective Time, the Service must (at the cost of the Service) do all things reasonably necessary to carry out all repairs and maintenance (other than Major Capital Works, unless agreed with the State (represented by Department of Health)) to the Transferred Property to keep the assets to a standard adequate for service. (c) After the Effective Time, if the Service carries out works to the Transferred Property which were compliant with all relevant building codes at the Effective Time but as a result of the works carried out by the Service, upgrades are required to address current building codes, then the Service will be responsible for the cost of the upgrades. 1.6 Documentation (s273A(4)) The transfer under clause 1.1 is subject to the condition that as soon as is reasonably practical after the Effective Time, the State (represented by Department of Health) must deliver or make available to the Service (to the extent not previously provided to the Service) all existing records relating to:

(a) the improvements constructed on the Transferred Property; and (b) the Existing Occupancy Rights in respect of the Transferred Property, to the extent that they are in the possession or control of the State (represented by Department of Health) and can be readily made available and provided to the Service. 1.7 Excluded Assets and Excluded Agreements Notwithstanding any other provision of this Transfer Notice, Excluded Assets and Excluded Agreements are not transferred by this Transfer Notice.

2 Pre and Post Effective Time Proceedings and Liabilities (s 273A(4)) The transfers under clauses 1.1, 1.3 and 1.4 are subject to these conditions: (a) Notwithstanding the transfer of the Transferred Property or any contract, agreement or instrument to the Service pursuant to the other terms of this Transfer Notice: (i) rights, obligations and liabilities which have given, or may give, rise to a cause of action with respect to: (A) the Transferred Property or any asset, contract, agreement or instrument transferred to the Service pursuant to this Transfer Notice; or (B) any contract, agreement or other instrument for which this Transfer Notice makes provision as to the manner in which such contract, agreement or other instrument applies to the Service, are retained or transferred, as the case may be, such that any demands, claims and legal proceedings that are being, or may be, made or taken by or against the State (represented by Department of Health) in respect of the Transferred Property or any such asset, instrument, contract or agreement: (1) are to be continued, made or taken by or against the State (represented by Department of Health) if the cause of action accrues prior to the Effective Time; and (2) are to be made or taken by or against the Service if the cause of action accrues on or after the Effective Time; and (ii) the Service is the successor in law to the State (represented by Department of Health) with respect to those causes of action identified in clause 2(a)(i)(B)(2), effective as from the Effective Time; and (b) The State (represented by Department of Health) and the Service

must execute such instruments and make such applications to such relevant courts as is necessary to record the substitution of the Service for the State (represented by Department of Health) with respect to those causes of action identified in clause 2(a)(i)(B)(2).

3 Designation of Transfer or Other Dealing (s 273A(4)) The transfers under clauses 1.1, 1.3 and 1.4 are subject to the condition that the designation for the transfer or other dealing as to all relevant assets and liabilities including the relevant assets and liabilities provided for in clauses 1 and 2 of this Transfer Notice are to be accounted for as: (a) a non reciprocal transfer or other dealing; (b) a contribution by or distribution to owners by way of an adjustment against contributed equity in the relevant entity: and (i) to the extent that this would cause the transferor’s contributed equity to reduce below $0, the balance is to be adjusted against the transferor’s accumulated surplus; (ii) to the extent that this would cause the transferor’s accumulated surplus to reduce below $0, the balance is to be recognised as a expense; and (c) the value attributed to the transfer or other dealing is the carrying value of the item as recorded in the accounts of the transferor, or the amount as agreed by the transferor and the transferee, immediately prior to the Effective Time, or as otherwise determined by me in writing.

4 No non Queensland assets affected Notwithstanding any other provision of this Transfer Notice, nothing effects a transfer of any asset or property of any kind whatsoever which is physically outside the State of Queensland as at the time that the transfer effected by this Transfer Notice would otherwise take effect.

5 Definitions and Interpretation 5.1 Definitions In this Transfer Notice: “Act” means the Hospital and Health Boards Act 2011; “Ancillary Instruments” means: (a) guarantees or warranties or deeds of guarantee or warranty given for the benefit of the State (represented by Department of Health) by any manufacturers, suppliers, subcontractors, consultants or other third parties, that relate to: (i) services provided in connection with the planning, development,

design, construction or commissioning of the Transferred Property and any Building Services Plant and Equipment forming part of the Transferred Property; or (ii) works or services supplied in connection with, or goods incorporated in, the Transferred Property or the Building Services Plant and Equipment. (b) deeds of consent, confidentiality or non-disclosure in respect of the Transferred Property, (c) but do not include rights or securities in relation to the rectification of defects in connection with the carrying out of Major Capital Works; “Associated Agreements” means all contracts, arrangements, understandings, heads of agreement or similar entered into by the State (represented by Department of Health) that relate only to the Transferred Property and which are not transferred pursuant to another provision of this Transfer Notice; “Building Services” means any hydraulic, mechanical, electrical, communications, security, transport, medical gases and fire protection services or systems provided to a building, including water storage and supply, fuel storage, oil storage, gases (including medical gases) storage, garbage compacting, drainage, sewerage, information and communications technology, assistance call, emergency warning, public address systems, air conditioning, ventilation, escalators, lift services, pneumatic tube systems, fire protection, power generation, UPS and emergency power, lighting and building management systems; “Building Services Plant and Equipment” means the plant and equipment, wires, ducting and other means of providing Building Services or Utilities to or within a building constructed on the Transferred Property; “Department of Health” includes Queensland Health; “District” means the Central Queensland Health Service District; “Effective Time” means immediately before midnight at the end of the day upon which this notice is signed by the Minister for Health and Ambulance Services, Leader of the House; “Excluded Agreements” means any contract, arrangement, understanding, heads of agreement or similar to the extent transferred under a prior transfer notice; “Excluded Assets” means: (a) assets on the Transferred Property: (i) which are owned by an Existing Occupant and are in the nature of tenant’s fixtures and fittings; or (ii) which are owned by a third party (even if at common law they are fixtures); and

(b) any assets transferred under a prior transfer notice; “Existing Occupancy Rights” means any lease, licence or other occupancy right in respect of the Transferred Property (whether registered or unregistered) granted by the State (represented by Department of Health), the District or the Service prior to the Effective Time, but do not include any lease, licence or other occupancy right granted by the State (represented by Department of Health) in favour of the Service; “Existing Occupants” means occupants under the Existing Occupancy Rights. “Fixed Assets” means all fixed assets owned by the State (represented by Department of Health) comprising improvements made to the Transferred Property but excluding the Excluded Assets; “Functions” means those functions of a Hospital and Health Service under section 19 of the Act, including delivering those services stated in the service agreement for the Hospital and Health Service; “Health Services Act” means the repealed Health Services Act 1991; “Health Service District” has the meaning given to the term ‘district’ in the Health Services Act immediately prior to its repeal; “Hospital and Health Service” means a Hospital and Health Service established under section 17 of the Act; “Major Capital Works” has the meaning given to the term “major capital works” in the Act; “Performance Securities” means any indemnity, bank guarantee, security bond, deposit and other securities for the performance of obligations given in favour of the State (represented by Department of Health) in respect of the Transferred Property or Ancillary Instruments but do not include rights or securities in relation to the rectification of defects in connection with the carrying out of Major Capital Works; “Service” means the Central Queensland Hospital and Health Service; “State” means the State of Queensland; “Transferred Property” means any interest transferred to or vested in the Service pursuant to clause 1.1 of this Transfer Notice; “Utilities” means water, electricity, gas, waste disposal, telecommunications and other utilities; words that are defined in the Act have the same meaning where they are used in this Transfer Notice. 5.2 Interpretation Where assets, instruments or liabilities are referred to in this Transfer Notice as being held by (or, in the case of liabilities, owed to) the State (represented by

Department of Health) this will include any such asset, instrument or liability notwithstanding that it may be otherwise described as being held by: (a) Queensland Health; (b) the State (represented by Queensland Health); (c) the State (represented by Department of Health); (d) Department of Health; (e) the State (represented by the District); (f) the District; (g) the State (represented by a facility within the District); (h) a facility within the District; or (i) any prior name given to Queensland Health, Department of Health, the District or a facility within the District. A reference to a contract or instrument which is to be transferred to or to be applied for the benefit of a relevant transferee, includes any variation or extension effected (whether in writing or otherwise) prior to such transfer or application.
