MAROONDAH CITY COUNCIL Notice of Intention to Amend Road Management Plan In accordance with the Road Management Act 2004 (Act), Maroondah City Council gives notice that it proposes to amend its Road Management Plan (RMP). The RMP details the standards in relation to, and the priorities to be given to, the inspection, maintenance and repairs of roads, road related infrastructure and pathways to which the RMP applies. The purpose of the review, consistent with the role, function and responsibilities of Council as a Road Authority under the Act, is to clarify the work process, update references, revise selected intervention standards, revise selected response times and make miscellaneous updates where required. Electricity Industry Act 2000 GENERAL RENEWABLE ENERGY FEED-IN TERMS AND CONDITIONS These are the general renewable energy feed-in terms and conditions for ERM Power Retail Pty Ltd ABN 87 126 175 460 (referred to as ‘we’, ‘our’ or ‘us’) and are published in accordance with section 40G of the Electricity Industry Act 2000 (‘Act’). They apply to each person or entity that is one of our current electricity retail customers in Victoria (referred to as ‘you’ or ‘your’) that has a small renewable energy generation facility (as defined in the Act) (‘facility’) at a premises and meets the eligibility requirements for the scheme for purchase of small renewable generation electricity as set out in section 40G and associated sections of the Act (the ‘Scheme’). These general renewable energy feed-in terms and conditions are effective 2 months from the date of this notice. 1. We will pay or credit you for all excess electricity generated by a small renewable energy generation facility (as defined in the Act) at your premises (‘the facility’) and exported from your premises to the electricity grid with the same frequency as we bill you for electricity supplied to your premises. Our obligation to pay or credit starts once the facility has been properly installed and metered in accordance with all relevant regulatory requirements and with the consent of the electricity distributor. Our obligation to pay or credit ends when you are no longer our retail electricity customer, when you fail to meet the eligibility requirements in clause 6, or when the Scheme ends (whichever is earlier). If for any reason we do not receive a credit from the electricity distributor for the exported electricity, our obligation to pay or credit you does not apply. 2. You must pay all costs associated with installing the facility, including any connection costs and the cost of installing and maintaining any necessary additional metering. 3. You do not need to transfer any renewable energy certificates to us. 4. We will pay or credit you at no less than the rate per kilowatt hour determined by the Essential Services commission or as is otherwise required under the Electricity Act 2000 (Vic.) (the ‘Feed-in Tariff Rate’) for excess electricity exported to the electricity grid. We may vary the Feed-in Tariff Rate by notice to you, provided that the Feed-in Tariff Rate must not at any time be less than any minimum rate determined by the Essential Services Commission. The notice will be given as soon as practicable and in any event no later than the next billing and payment cycle. 5. If requested by you, we must make a request to the relevant distributor to connect your small renewable energy generation facility to the distributor’s distribution system as soon as practicable (and no later than one business day) after receiving from you all documentation required under the Electricity Safety Act 1998 and all documentation reasonably required by us or the relevant distributor. 6. You are eligible for the Scheme only if you are a qualifying customer with a qualifying solar energy generating facility at your premises. ‘Qualifying customer’ and ‘qualifying solar energy generating facility’ have the meanings given in the Act. You must notify us if you are no longer eligible for the Scheme due to a change in circumstances in relation to your facility or your premises. 7. We must base our payment or credit on an exact reading of your NEM-compliant meter that records the supply of electricity from your premises to the distribution system. We must use our best endeavours to ensure that the meter is read at least once in every 12 month period. However, we will not be in breach of this clause if we are unable to read a meter in any relevant period as a result of you breaching clause 14 or some other event outside our 520 G 13 30 March 2017 Victoria Government Gazette

control. A NEM-compliant meter is a meter that is compliant with the Australian Energy Market Operator (‘AEMO’) Metrology Procedure as published on the AEMO website from time to time. 8. If we are not able to reasonably or reliably base a feed-in tariff payment or credit on a reading of the meter, we will not make a payment or credit unless the relevant distributor estimates the generation in accordance with applicable regulatory instruments. 9. We will review a feed-in payment or credit to you at your request, to be conducted on the basis specified in clause 29 of the Energy Retail Code or the relevant clause in any amended version of the Energy Retail Code. 10. If we seek to bill you to make up overpaying or over-crediting you for electricity supplied by you, we will proceed on the basis specified in clause 30 of the Energy Retail Code or the relevant clause in any amended version of the Energy Retail Code. 11. If we have underpaid or under-credited you for electricity supplied by you, we will credit the amount on your next bill. 12. If an event occurs which is outside the reasonable control of either of us (i.e. a force majeure event) and either of us breaches these terms and conditions due to this event only, the breach is to be dealt with on the basis specified in clause 17 of our Market Contract Terms and Conditions or the relevant clause in any amended version of those terms and conditions. 13. For the purpose of reading the meter that records the supply of electricity from your premises to the distribution system and for connection, disconnection, reconnection and repair, you must allow either, us, the responsible person or a representative of us or the responsible person safe, convenient and unhindered access to your premises and to the meter that records the supply of electricity from your premises to the distribution system. We, the responsible person or the representative (as relevant) will carry or wear official identification and, on request, must show that identification to you. 14. You must inform us as soon as possible of any relevant change to your contact details. 15. On request, we must provide you with reasonable information on any feed-in tariffs we may offer you. This information must be given within 10 business days of your request, and if you request it, in writing. 16. We will retain your historical feed-in payment or crediting data for at least two years. The termination of these terms and conditions does not release us from this obligation. 17. We will process your request for historical data relating to these terms and conditions in the same manner as a request for historical data relating to a supply of electricity to you under clause 28 of the Energy Retail Code or the relevant clause in any amended version of the Energy Retail Code. 18. A complaint by you in relation to these terms and conditions will be handled by us in accordance with clause 16 of our Market Contract Terms and Conditions or the relevant clause in any amended version of those terms and conditions. 19. These terms and conditions continue until the first to occur of any of the following: a. you terminate the contract (which you may do at any time); b. you no longer occupy your premises; c. if we and you enter a new feed-in contract in respect of your premises, the expiry of any cooling-off period in respect of the new feed-in contract; or d. if you terminate the these terms and conditions because you want to enter a feed-in contract with another retailer, the date when the other retailer becomes responsible for the feed-in contract; or e. if our contract with you for the supply of electricity to your premises is terminated with regard to the premises having been disconnected, the date when you no longer have a right under the Energy Retail Code to be reconnected; Victoria Government Gazette G 13 30 March 2017 521

f. if you are no longer eligible for the Scheme (whether due to a change in circumstances in relation to your facility or your premises or because of a change in the Scheme) or the Scheme is repealed, the date that you cease to be eligible for the Scheme or the date of repeal of the Scheme. 20. Termination of these terms and conditions does not end your electricity retail contract with us. 21. If these terms and conditions end or are terminated and you have not entered into a new feed-in contract with us or another retailer, you must ensure that no small renewable energy generation is exported to the distribution system from your facility or your premises. We may take appropriate action (including arranging for the disconnection of the meter) to ensure that no small renewable energy generation electricity is exported from your facility. 22. You are responsible for your facility and its use. We are not responsible for any act, omission, default or negligence of any third party including the distributor. You agree that we will not be liable for any loss damage or injury that may be caused by your facility or its use. 23. You must install adequate protection devices to protect your facility from faults (including without limitation, power surges) on the distribution system. 24. A notice, consent, document or other communication given by us under these terms and conditions will be given in a manner specified in clause 3F of the Energy Retail Code or the relevant clause in any amended version of the Energy Retail Code. 25. To the extent permitted under the Act, we may vary these terms and conditions by the gazettal of replacement terms and conditions under the Act or by notice from us to you where we reasonably believe the variation is needed in connection with a change to the Scheme or the Act. Plant Biosecurity Act 2010 ORDER PROHIBITING OR RESTRICTING THE ENTRY OR IMPORTATION INTO VICTORIA OF MATERIALS WHICH ARE HOSTS OF FIRE ANT I, Gabrielle Vivian-Smith, as delegate of the Minister for Agriculture, being of the reasonable suspicion that the exotic pest fire ant exists within Australia but outside Victoria, make the following Order: 1 Objective The objective of this Order is to prohibit, restrict or impose conditions upon the entry or importation into Victoria of materials which are hosts of fire ant. 2 Authorising provision This Order is made under section 36(1) of the Plant Biosecurity Act 2010 (the Act). 3 Commencement This Order comes into force on the day of making. 4 Definitions In this Order – ‘fire ant’ means the exotic pest red imported fire ant,Solenopsis invicta (Buren). ‘host material’ means any material capable of harbouring fire ants including plants, plant products, agricultural equipment and used packages, but excludes tissue culture, bare rooted plants washed free of soil and seedlings in plugs/cells. 5 Prohibitions, restrictions and conditions The following prohibitions, restrictions and conditions are specified in relation to the entry or importation of host materials. (a) The entry or importation into Victoria of any host material is prohibited. (b) Sub-clause (a) does not apply if the host material – (i) was grown on, sourced from or last used on a property that is located in a State or Territory or part of a State or Territory for which an area freedom certificate, issued by an officer responsible for agriculture in the Stateor Territory where the host material was grown, sourced or last used, is currently in force certifying that the State or Territory or part of the State or Territory is known to be free of fire ants; or (ii) is accompanied by a plant health certificate, assurance certificate or plant health declaration, certifying or declaring that the material has been treated in a manner described in the Schedule to this Order; or (iii) enters Victoria under and in accordance with a permit issued by an inspector and there is compliance with any conditions or requirements set out in the permit. 6 Verification of consignments Host material imported into Victoria which is required by clause 5(b)(ii) to be accompanied by a certificate or declaration must be: (a) presented to an Inspector for inspection; or (b) presented for verification by a person accredited to do so by the Department of Economic Development, Jobs, Transport and Resources. 7 Expiry This Order remains in force for a period of 12 months after the date of making. Schedule Host material must – 1) be grown or sourced from a property located more than 5 km of a known or suspected infestation of fire ants; or 2) be grown on, or sourced from, a property – a) which has been inspected within the last 28 days and found free of fire ants; and b) which has not shared host material with another property known to be infested with fire ant unless that host material has been given approved treatment; and c) where the host material has been stored in a manner to prevent infestation; and d) where the host material has been inspected and found free of fire ants; or 3) in the case of containerised, potted and root-balled plants, trees and propagules, be – a) stored in an isolated secure area, more than 5m from plants that have not been treated in accordance with sub-clause (b) or (c); and b) for food plants and fruit trees, with fruits removed, treated, not less than 48 hours prior to dispatch, in accordance with any label instructions and AVPMA permit, with – i) 30–40 ml of a 500 g/L chlorpyrifos concentrate per 100 L of water as either a drench treatment, or by full immersion in a prepared dip, or ii) 16 ml of a 12.5 g/L cyfluthrin concentrate per 10 L of water as a drench treatment. c) for ornamental nursery plants, other than food plants or fruit trees, treated, not less than 48 hours prior to dispatch, in accordance with any label instructions and AVPMA permit, with, – i) 30–40 ml of a 500 g/L chlorpyrifos concentrate per 100 L of water as either a drench treatment, or by full immersion in a prepared dip, or ii) 16 ml of a 12.5 g/L cyfluthrin concentrate per 10 L of water as a drench treatment, or iii) 2 g/kg bifenthrin granular insecticide at 10–25 ppm per cubic metre of potting media; or iv) 100 g/kg chlorpyrifos granular insecticide (suSCon Green) at 1 kg per cubic metre of potting media; and d) inspected and found free of fire ants; or 4) in the case of any earth and landscaping material, including potting media and organic mulch, be – a) treated by – i) heating the entire mass to a minimum temperature of 65.5°C using steam or dry heat; or ii) fumigating with a product containing 1000 g/kg methyl bromide, at the rate of 48 g/m³ at 21°C for at least 24 hours; or iii) in the case of diagnostic samples, freezing to at least -20°C for at least 24 hours; and b) produced, stored, handled and consigned in such a manner that would prevent infestation or destroy all life stages of fire ants; and c) remain packed in the original sealed bag or container in which it was first commercially packed; or 544 G 13 30 March 2017 Victoria Government Gazette

5) in the case of hay and straw, be – a) treated by – i) fumigation with a product containing 1000 g/kg methyl bromide at a rate of 48 g/m³ at 21ºC for at least 24 hours, and ii) stored, handled and consigned after treatment so as to prevent infestation with fire ants, and iii) Inspected and found free of fire ants, and iv) dispatched within 28 days of treatment; or b) processed by hammer milling where – i) the property has been inspected not less than seven days prior to consignment and found free of fire ant, and ii) the material is – (A) passed through a mesh of not more than 50 mm in size; and (B) passed over a mesh of not more than 3 mm in size to remove small particulates; and (C) immediately bagged into vacuum sealed bags; and (D) inspected at the rate of 1 in 50 bags to ensure they are properly sealed; or 6) in the case of turf, be – a) treated by cover spraying, at least 48 hours before lifting, with a solution containing 500 g/l of chlorpyrifos applied at the rate of 2 L/ha; and b) despatched within 28 days of treatment; or 7) in the case of agricultural equipment and used packages, be – a) cleaned free of soil and organic matter by – i) brushing; or ii) high pressure water; or iii) steam; and b) inspected and found free of soil, organic matter and fire ants. Notes: Section 38 of the Act provides that it is an offence for a person to cause, permit or assist any plant, plant product, plant vector, used equipment, used package, earth material or beehive to enter Victoria in contravention of an importation order under section 36. The maximum penalty of 60 penalty units applies in the case of a natural person, and 300 penalty units in the case of a body corporate. Objective The objective of this Order is to prohibit, restrict or impose conditions upon the entry or importation into Victoria of materials which are hosts of tomato potato psyllid and zebra chip. 2. Authorising provision This Order is made under section 36(1) of the Plant Biosecurity Act 2010 (the Act). 3. Commencement This Order comes into force on the day of making. 4. Revocation The Order made under section 36(1) of the Plant Biosecurity Act 2010, prohibiting or restricting the entry or importation of tomato potato psyllid host material into Victoria, and published in Government Gazette G8 on 23 February 2017 at pages 263–264 is revoked. 5. Definitions In this Order – ‘host material’ means any host plant, and any agricultural equipment or packages used in the cultivation, processing, packaging or transport of any host plant. ‘host plant’ means any plant or plant product belonging to the family Amaranthaceae, Asclepiadaceae, Asteraceae, Brassicaceae, Chenopodiaceae, Convolvulaceae, Cupressaceae, Fabaceae, Lamiaceae (formerly Menthaceae), Malvaceae, Pinaceae, Plantaginaceae, Poaceae, Polygonaceae, Ranunculaceae, Rosaceae, Salicaceae, Solanaceae, Violaceae, Zygophyllaceae. ‘tomato potato psyllid’ means the pest Bactericera cockerelli (Sulc). ‘zebra chip’ means the bacterium Candidatus Liberibacter solanacearum. 6. Prohibitions, restrictions and conditions The following prohibitions, restrictions and conditions are specified in relation to the entry or importation of host materials. (a) The entry or importation into Victoria of any host material is prohibited. 6. Saving of existing transactions If a transaction happened in relation to an Old Body before this Order takes effect in respect of that Old Body – (a) the transaction shall continue in the same way as it would have continued if this Order had not been made; and (b) the transaction may be given effect to, or enforced or completed, by or in relation to the New Body in the same way as it would have been given effect to, or enforced or completed, by or in relation to the Old Body if this Order had not been made. 7. Keeping financial accounts and reports The Secretary, Department of Health and Human Services must ensure that financial accounts are kept and reports are provided to the Secretary, Department of Justice and Regulation for the purposes of the Financial Management Act 1994 for the period commencing 1 July 2016 and ending on 31 March 2017 in respect of a function under an Act or Regulation specified in the Schedule that is transferred as if the function had not been transferred. 8. Victoria University Act 2010 APPOINTMENT OF GOVERNOR IN COUNCIL MEMBER TO THE VICTORIA UNIVERSITY COUNCIL SCHEDULE TO THE ORDER IN COUNCIL 1. Appointment Arrangements This appointment is part-time. 2. Period of Appointment The period of appointment is from 1 April 2017 to 31 December 2019 (both dates inclusive). 3. Duties and responsibilities of the position Pursuant to section 8 of the Victoria University Act 2010 (Act), the Council is the governing body of the University and has the entire direction and superintendence of the University. Its primary responsibilities include appointing and monitoring the performance of the Vice-Chancellor, approving the mission and strategic direction, overseeing and reviewing management, overseeing and monitoring academic activities, and approving any significant commercial activities. 4. Termination Arrangements Pursuant to section 12(5)(a) of the Act, a member of the Council appointed by the Governor in Council may, at any time, be removed by the Governor in Council. 5. Payment Provisions Pursuant to section 16 of the Act, the Minister may fix the remuneration of a member. 6. Superannuation Obligations Superannuation will be paid in accordance with the Commonwealth’s Superannuation Guarantee (Administration) Act 1992. 7. Travel and Personal Expenses arrangements All members of the Council are entitled to reimbursement of reasonable travelling and personal expenses. 8. Leave Arrangements There are no leave provisions for this part-time statutory position. 9. Prior Service The appointee has served on the Victoria University Council since 21 October 2014. Plant Biosecurity Act 2010 ORDER DECLARING CONTROL AREAS IN VICTORIA FOR THE CONTROL OF GRAPE PHYLLOXERA Order in Council The Governor in Council, under section 19(1) of the Plant Biosecurity Act 2010, makes the following Order – 1. Purpose The purpose of this Order is to declare control areas in Victoria for the purposes of preventing the spread of the pest grape phylloxera from the control areas to other parts of Victoria. 2. Authorising provision This Order is made under section 19(1) of the Plant Biosecurity Act 2010. 3. Commencement This Order comes into operation on the day it is published in the Government Gazette. 4. Revocation The Order made under section 19(1) of the Plant Biosecurity Act 2010 on 12 April 2016, declaring areas in Victoria to be control areas for the purpose of preventing the spread of grape phylloxera, and published in Victoria Government Gazette G15 on 14 April 2016 at pages 732–737, is revoked. 5. Definitions In this Order – ‘grape phylloxera’ means the pest Daktulosphaira vitifolii (Fitch); ‘host material’ means host plants; and earth material, package or used equipment associated with the cultivation, harvesting, handling, transport or processing of host plants; ‘host plant’ means plants and plant products of the genus Vitis, including potted vines, cuttings, rootlings, grapes, grape marc, grape must and germplasm. 6. Declaration of control areas for preventing the spread of grape phylloxera to other parts of Victoria (1) The area described in the Schedule 1, known as the North East Phylloxera Infested Zone, is declared to be a control area for the purpose of preventing the spread of grape phylloxera to other parts of Victoria. (2) The area described in the Schedule 2, known as the Nagambie Phylloxera Infested Zone, is declared to be a control area for the purpose of preventing the spread of grape phylloxera to other parts of Victoria. (3) The area described in the Schedule 3, known as the Upton Phylloxera Infested Zone, is declared to be a control area for the purpose of preventing the spread of grape phylloxera to other parts of Victoria. (4) The area described in the Schedule 4, known as the Mooroopna Phylloxera Infested Zone, is declared to be a control area for the purpose of preventing the spread of grape phylloxera to other parts of Victoria. (5) The area described in the Schedule 5, known as the Maroondah Phylloxera Infested Zone, is declared to be a control area for the purpose of preventing the spread of grape phylloxera to other parts of Victoria. (6) The area described in the Schedule 6, known as the Whitebridge Phylloxera Infested Zone, is declared to be a control area for the purpose of preventing the spread of grape phylloxera to other parts of Victoria. 562 G 13 30 March 2017 Victoria Government Gazette

7. Prohibitions, restrictions and requirements to apply in a control area (1) For the purpose of preventing the spread of the pest grape phylloxera from a control area described in clause 6, the removal of any host material from a control area is prohibited. (2) Subclause (1) does not apply to a person who removes table grapes from a control area described in clause 6 that have been treated for the control of grape phylloxera in accordance with the Act. Schedule 1 – North East Phylloxera Infested Zone The area of land bounded by a line commencing at the intersection of the boundaries of the parishes of Dueran East, Toombullup and Whitfield South, Note: Section 20(1) of the Act provides an offence for a person who causes or permits the movement of any plant, plant product, used package, used equipment or earth material into or from a control area or within a control area or within a specified part of a control area contrary to any prohibition or restriction in an order declaring an area to be a control area if the person knows or may reasonably be expected to know that the place has been declared to be a control area, unless the person is authorised to do so under a permit issued by the Secretary. The maximum penalty for this offence is 60 penalty units in the case of an individual and 300 penalty units in the case of a body corporate. Under section 20(2) of the Act, it is an offence for a person to transport, move or take any plant, plant product, used package, used equipment or earth material into or out of a control area, past a sign posted on or within sight of a public highway passing in or out of a control area contrary to a prohibition in an order if the sign indicates that the movement of those items into or out of the control area is prohibited. A penalty of 10 penalty units applies. Section 20(3) of the Act provides that a person who contravenes any prohibition or restriction in an order declaring a place to be a control area, where that person is not liable for the offence in section 20(1) of the Act, is guilty of an offence and is liable to a penalty not exceeding 10 penalty units in the case of an individual and 60 penalty units in the case of a body corporate, unless the person is authorised to do so under a permit issued by the Secretary and complies with the conditions of that permit.
