O R D E R:

The Tahsildar, Pedakurapadu Mandal has filed Form-A(1) under Rule-4 of the RFCT LA R&R () Rules, 2018 for the exemption of Chapter-II & III of the Principal Act (I.e., Act No. 30 of 2013) to an extent of Ac. 1.40 cents in Survey Number 66-C of Mussapuram Village for providing house sites under “Navaratnalau-Pedalandariki Illu” scheme.

In accordance with the provisions contained in Section 10-A of the Act; a notification in Form-A(2) was issued under Rule-4 of the RFCT LA R&R (Andhra Pradesh) Rules, 2018 and exempted the provisions of Chapter -II & III of Principal Act (i.e., Act NO.30 of 2013) and it was published in the State Gazette No W.No.02, dt. 10.01.2020. Further errata proposals are initiated due to non receipt of written consent from the previous pattadar and therefore processed the Form-C proposals to the revised Sy.Nos. 92-A1, 92-A2 and 98-A to an extent of Ac.1.28 cents.

Thereon, the Tahsildar, Pedakurapadu has filed Form-B, B(1) and B(2) and the Land Acquisition Officer cum Revenue Divisional Officer, Guntur has submitted Form-C Notification after verification of the land with land owners willingness for voluntary acquisition (sale) of land, Combined Sketch, FMB, Copy of Adangal, copy of RSR. After due verification, a Public Notice by way of Notification in Form-C was issued calling for objections to the acquisition if any, and claims from all the persons interested/affected within the 15 days from the date of publication of the said Form-C in the District Gazette No.252, dt. 31-01-2020 (which was published on 31-01-2020). The said Notification in Form-C was also got published in (1) Village Secretariat/Ward Secretariat (2) Gram Panchayat Office (3) Tahsildar, Pedakurapadu Office and (4) MPDO Office, Pedakurapadu and also informed the public by beat of Tom-Tom in the village of Mussapuram, Pedakurapadu Mandal. No objections have been received within the stipulated time.

Negotiations:

As per Rule 8 of the RFCT LA R&R (Andhra Pradesh) Rules, 2018 Negotiations Committed constituted with the following Officials to have negotiations with the land owner/owners for finalization of the payment compensation of the land. 1) The District Collector, Guntur 2) The Joint Collector, Guntur 3) The Revenue Divisional Officer, Guntur – Convener of the Committee, 4) Executive Engineer of a works Department (Other than the Requisition Department) 5) Representative of the requisition Department i.e., The Tahsildar, Pedakurapadu Mandal.

The Revenue Divisional Officer, Guntur cum Land Acquisition Officer has submitted Market value proposals under Section-26 of the Principal Act (Act 30 of 2013) i.e., Average Sale Price and Basic Value particulars per acre. The Average sale price is Rs. 7,94,021/- per acre. The Basic Value is Rs.7,50,000/- per acre as per Registration and Stamps Department authenticated letter dt. 18.1.2020 & 30.1.2020. The Average Sale of Rs. 7,94,021/- is higher than the Basic Value of Rs. 7,50,000/-. The compensation is comes to Rs.19,85,052/- per acre including Factor Value 1.25 + 100% Solatium as per RFCT LA R&R Act, 2013 as follows:-

The Negotiation Committee examined the grading of land besides locality of the land and since the land is adjacent to Village Cheri and having Road Connection, the committee have opined that it may just and proper to enhance the land compensation to a tune of Rs.22,00,000/- per acre. Accordingly, the Land Compensation per acre is fixed @ Rs 22,00,000/- per acre.

An extent of Ac.0.07 cents is proposed for acquisition in Sy.No.98-A. But, during field enjoyment survey it requires another Ac.0.03 cents of land for the formation of approach road with a width of 30 links to the land proposed for acquisition in Sy.No.98-A becomes Ac.0.10 cents and the total extent becomes Ac.1.31 cents in Sy.Nos. 92-A1, 92-A2 & 98-A of Mussapuram village. The land owner has given his consent for the proposal.

The land owner is agreed to receive the land compensation as fixed supra by the Negotiation Committee. The apportionment is fixed based on Revenue Records, Title and enjoyment of land and after preparation of Sub-Division Record. The Notified Survey Number 92-A1, 92-A2, 98-A in Form C and Gazette is sub divided as Survey Number 92-A1A, 98-A1 to an extent of Ac.1.31cents as per pre- scrutinized record as follows:-

After Completion of the negotiations carried out and settlement reached as narrated supra, with land owners, an agreement in Form-G-III has been entered to that effect by the District Collector/Authorized Officer RFCT LA R&R (Andhra Pradesh) Rules, 2018 (Act No. 22 of 2018) which shall be published in District Gazette forthwith. Further, the “Nil” R&R Award as proposed by the Revenue Divisional Officer, & Land Acquisition Officer is approved.

The Revenue Divisional Officer, Guntur & Land Acquisition Officer is hereby directed to take further action for disbursement of the amount arrived under negotiation to the respective land owner as per procedure by obtaining details of bank accounts and other required documents after due verifying with the concerned Bank Manager whether or not the bank account is in force at the earliest and also complete incorporation of changes in the relevant records.
