In Alberta, the recent trend has been for the Assembly to convene rather quickly after the election. Certainly, the government-designate wants to meet the Assembly soon. It is reported that the government wants the Assembly to convene on May 21. One reason why the Assembly does not come back sooner is that those people who receive the most votes on election night, do not become members right away. Under legislation, the official count is announced ten days after polling day and then there is an eight-day period when individuals can seek a judicial recount. If the period ends on a day when an office is closed (e.g. the court house) then it carries over to the end of the next day it is open. This year it means that individuals do not become members until May 7. After that, members must be sworn-in before they can take their seats in the Assembly. The first order of business when the Assembly sits after an election is to elect a Speaker. As the previous Speaker did not seek re-election, there will be a new Speaker. By convention, the Lieutenant Governor (the Crown’s representative) will not meet the Assembly to deliver the Speech from the Throne until there is a Speaker. It is worth noting that besides presiding over the Assembly, the Speaker is also the guardian of the Assembly’s rights and privileges, which has historically been asserted against the Crown over hundreds of years of Westminster style parliamentary democracy. Since 1993, the Speaker has been elected by secret ballot of the members. The process is set out in a Schedule to the Standing Orders. The voting continues with one nominee dropped off the ballot every round, until one candidate receives more than half the votes cast. The results are never made public and the ballots are destroyed. The same procedure is used for the election of the Deputy Speaker and the Deputy Chair of Committees. Together, the three are known as Presiding Officers. After the election of the Presiding Officers, the Lieutenant Governor delivers the Speech from the Throne, which outlines the government’s plans for the session. It should be noted that after an election, a new legislature is formed.
