Home Advantage in European International Soccer: Which Dimension of Distance Matters?

Nils Van Damme and Stijn Baert Abstract The authors investigate whether the home advantage in soccer differs by various dimensions of distance between the (regions of the) home and away teams: geographical distance, climatic differences, cultural distance, and disparities in economic prosperity. To this end, the authors analyse 2,012 recent matches played in the UEFA Champions League and UEFA Europa League by means of several regression models. They find that when the home team plays at a higher altitude, they benefit substantially more from their home advantage. Every 100 meters of altitude difference is associated with an increase in expected probability to win the match, as the home team, by 1.1 percentage points. The other dimensions of distance are not significantly associated with a higher or lower home advantage. By contrast, the authors find that the home advantage in soccer is more outspoken when the number of spectators is higher and when the home team is substantially stronger than the away team. The language of Article 135 of the Labor Code of the Russian Federation (LCRF) specifies that wages of an employee are set out in an employment contract, and that “stimulation payments and supplements and bonus systems shall be established by collective agreements, agreements…”. As a result, the LCRF does not make the establishment of a bonus scheme obligatory per se, but rather states that where it exists, it shall form part of a contract and one which may be of a collective nature. If Bonus Regulations were established by the club and, as an annex to the employment contract, were incorporated therein, the Bonus Regulations constitute the document that binds the parties as to the manner in which they should be paid out. Their existence, and the fact that they provide for the payment of bonuses establishes that the payment of bonuses is mandatory by contract. 2. There can only be one correct interpretation if a bonus scheme is to achieve its goal of motivating the team to achieve the desired results. For incentive schemes of this kind to provide the necessary motivation, those striving to achieve this goal must be able to expect that payment of the bonus must be certain upon obtention of the result. -

Article R57 para. 3 of the CAS Code gives the Panel the discretion “to exclude evidence presented by the parties if it was available to them or could reasonably have been discovered by them before the challenged decision was rendered”. However, in accordance with the legal doctrine, such provision should be applied with caution, so as not to impinge upon the fundamental principle of de novo review by the CAS, only in those cases where the adducing of pre-existing evidence amounts to abusive or otherwise unacceptable procedural conduct by a party. 2. Neither article 57 of the Labor Code of Russia, nor article 7.1 of the FUR Regulations determine that the salary determined in an employment contract must be included in the salary determined in an annex. These provisions merely determine that a basic salary must be set out in the employment contract, but this does not prevent parties from determining that the salary agreed in the employment contract is payable in addition to the amount referred to in an annex. In addition, article 7.4 of the FUR Regulations does not determine that a player’s total remuneration must be established in annexes, rather, it provides that “the basic salary, additional payments and stimulating payments can be established directly in the text of the employment contract or, by parties’ wish, as an annex (additional agreement) to the employment contract”. -
