JUSTIFICATION FOR GRANTING CONSENT

The broad land use principle of the re-use of this existing and substantial industrial building is supported within national planning guidance contained within Planning Policy Statement 4; Planning for Sustainable Economic Growth and Regional Spatial Strategy Policies YH6. YH7 and E7. The application site sits within its own extensive landscaped grounds, which ensures that only filtered views into the site occur. The alterations to both the external elevations and the construction of the new external storage areas will not adversely impact upon the visual character or amenity value of the landscape. The application site will not generate significant volumes of traffic over and above the former use of the site and the site itself is considered to be in close proximity to the classified road network. Whilst it is acknowledged that nearby residential properties will be sensitive to any noise generated at this site, as a consequence of its rural location. Previous applications for B2 (General Industrial Use) have been restricted to hours of operation and noise controlling conditions. These can again be applied to the normal hours of working at the site. The additional flexible working hours to cover the seasonal demands of the business have the greatest potential to harm amenity and a balanced planning view point is required in this instance. The environmental health team have confirmed that subject to conditions any such impact can be suitably controlled, however some disamenity may occur through forklift truck movements in the external yard area. Whilst residents may be aware of such movements, it would be over a limited period of time. In this instance the economic benefit of the re-use of the building would outweigh any perceived harm.

JUSTIFICATION FOR GRANTING CONSENT

The proposed development will represent the loss of an existing community facility protected by saved Harrogate District Local Plan Policy CFX. It has however been demonstrated, through an effective marketing campaign, that there is no reasonable prospect of securing a viable alternative community use. The scheme does nevertheless retain some community benefit through the retention of parking spaces for the adjacent doctors surgery. The proposed re-use and conversion of the premises is considered acceptable under the provisions of the Harrogate District Local Development Framework Core Strategy Policy SG3 and Saved Harrogate District Local Plan Policy C16. Although Policy SG3 identifies a preference for economic development uses or affordable homes rather than for marketing homes, the applicants have demonstrated that an affordable home would not be economically viable in this location. The restricted access in close proximity to existing residential property ensures that the site would be unsuitable for economic use. Policy EC12 of Planning policy Statement 4: Planning for Sustainable Economic Growth accepts that residential conversion rather than for economic purposes may be more appropriate in some locations and for some buildings. The building is recognised as of local interest within the Tockwith Conservation Area Appraisal and the scheme of conversion will retain the buildings character, whilst preserving the character of the locality. In the absence of any material considerations to set aside the provisions of the development plan approval of the application can be supported.

JUSTIFICATION FOR GRANTING CONSENT

The proposals to convert this former mistal to a one-bedroom holiday cottage provide an acceptable level of accommodation and an outside seating area and parking provision within the farmyard. The holiday cottage will be seen as part of the group of buildings; farmhouse, barn conversion and agricultural buildings, and will not harm the Special Landscape Area. The proposals comply with the policies in the Regional Spatial Strategy, the policies in the Local Development Framework Core Strategy (adopted 2009) and the saved policies in the Harrogate District Local Plan (2001, as altered 2009) and there are no material considerations in this instance that warrant setting aside local planning policies.
