VOTERS MAKE SELECTIONS IN PRIMARY RACES

Voter turnout was light (19.7%) for Tuesday’s Primary Election and there were many uncontested races in both the House and Senate. The only contested Senate race involving an incumbent was Senate District 12 with sitting Senator running against Harrison County Commissioner . Cann was supported by the business community as well as the CAWV. Romano garnered support from labor and trial lawyers. He won by a margin of 56% to 44%. He will face Republican Mike Queen in the General Election. All 17 Senate districts will have a competitive race except Senate Minority Leader Mike Hall, R-Putnam, who is running unopposed in the 4th District.

Five veteran delegates were defeated. Mark Hunt, D-Kanawha, , D-Harrison, Tim Kinsey, D-Wayne, Ted Tomblin, D-Logan, and Larry Kump, R-Berkeley, were all defeated. Kump was challenged by 17-year-old , the daughter of Sen. , R-Berkeley. Del. Ruppie Phillips, D-Logan, and Del. Ted Tomblin, D-Logan, were tied for second place in the two-seat 24th District at 2,013 votes each, but later numbers show Del. Phillips as winning. The number one vote getter in the race is , a former House member. CAWV’s political action committee, HUB/PAC supported Dels. Hunt, Kump, Kinsey, Phillips, Tomblin and Sen. Cann.

HUB/PAC only endorsed candidates that had opposition in their primary races. HUB/PAC- supported House candidates who are running for the first time and won their race include Geoff Foster, R-Putnam, (CAWV member Foster Supply), , R-Wood (son of retiring Del. ), Josh McGrath, D-Mason, Chris Stansbury, R-Kanawha, Brad White, R-Kanawha, and Vaughn Sizemore, R-Kanawha. The CAWV also supported former Senator Frank Deem who running for the House on the Republican ticket in Wood County. Two CAWV members came close to winning nomination on Tuesday. , Atlas Towing and a former Wood County Delegate, and Chris Elswick, a lawyer with Steptoe & Johnson in their Wheeling office, both ran good campaigns but fell outside the number of seats available. Most all House races will be contested in the fall election.

“I thank every member who contributed to HUB/PAC,” said CAWV President Phil Weser. “It is important to elect senators and delegates who will make sure the CAWV’s voice is heard in the Legislature. Your continued support of our efforts is critical for the upcoming General Election,” he said. NATIONAL RACES SET FOR FALL

The nominees for the open Senate seat have become official, with Rep. Shelley (R) and Secretary of State Natalie Tennant (D) easily capturing their nominations. Neither one faced a competitive primary. Republicans are betting West Virginia is one of their best chances at a pickup, with Sen. Jay Rockefeller (D) retiring. With Rep. Capito running for Senate, her open seat in 2nd Congressional district attracted the attention of seven Republican candidates. In such a crowded field, no one candidate was considered the frontrunner, though former Maryland State Senator Alex Mooney and former U.S. International Trade Commissioner were among the more well-known candidates. Mooney won with 35 percent of the vote, almost 13 points ahead of the next closest candidate. Mooney was supported by the Senate Conservatives Fund and other tea-party oriented groups. Democrats had their own two way primary with former state party chair Nick Casey winning with almost 60 percent of the vote.

Rep. Nick J. Rahall (D) defeated his primary opponent Richard Ojeda by a 65% to 35% margin. Political pundits think he will need to consolidate his base to hold off a strong challenge from state Sen. Evan Jenkins who did not have a primary on the Republican side. Rep. David McKinley (R) and state Auditor Glen Gainer (D) did not have primary opposition and they will square off in the 1st Congressional District race.

SCHOLARSHIP GOLF OUTING, MAY 30, SANDY BRAE GOLF CLUB

Space is still available during the annual CAWV Golf Outing being held Friday, May 30, at Sandy Brae Golf Club in Clendenin. "Over 300 CAWV members and guests played in last year’s event, which sold out very early," said Golf Chairman Bob Brookover. "Due to the tremendous number of golfers in recent years, we are limited to 20 "Sixsomes" for both the 7:30 a.m. and 1:30 p.m. starting times." CAWV MEMBERS TO TAKE CAPITOL HILL

CAWV members will go to Capitol Hill June 11 to meet with West Virginia’s Congressional Delegation that investing in infrastructure is right for the nation and right for West Virginia. The federal-aid highway reauthorization bill, reauthorization of the Clean Water and Safe Drinking Water SRF loan programs, funding for modern schools and other important public works projects all need attention in Congress. WAYNE COUNTY VOTERS APPROVE SCHOOL BOND

It took three attempts, but voters in Wayne County have approved an $18 million school construction bond — a key component in a larger $42 million package. That package includes construction of a new Ceredo-Kenova Elementary School and a new Crum Elementary School and will also pay for additions and renovations at Wayne High School. The unofficial vote totals in Wayne County in Tuesday’s primary election were 4,192 votes for the bond and 3,265 against the bond — a 56 percent to 44 percent split. In addition to the $18 million bond, the state School Building Authority has allocated another $18 million for the school projects while much of the final $6 million will come from an improvement fund Wayne County and the Wayne County Board of Education started last year. The most recent bond rejection came in 2012 when voters soundly defeated a proposed $30 million bond.

WRRDA LEGISLATION INCLUDES WATER/WASTEWATER INFRASTRUCTURE PROVISIONS

AGC and its coalition partners in the Water Infrastructure Network have been engaged in an 18- month campaign to include significant clean water provisions in the final conference package of the Water Resources Reform and Development Act. Those efforts successfully secured several provisions that improve the Clean Water State Revolving Fund (CWSRF).

The CWSRF will now be more flexible in its loan terms, allowing lower interest rates, principle forgiveness, and extended repayment periods of 30 years. The provisions will also expand eligible SRF funding uses to include implementation of watershed plans, water conservation, stormwater recapture, and technical assistance to small and medium treatment works. The Clean Water SRF provisions were in neither the House- nor Senate-passed WRDA Bills. Unfortunately, in addition to the reauthorization language, the bill also permanently extends (for the CWSRF) the Buy American language that was previously in the appropriations compromise from earlier this year. That appropriations provision was set to expire at the end of September.

The WRRDA legislation also creates a Water Infrastructure Finance and Innovation Authority (WIFIA), just as the Senate version of the bill did. This would be a pilot project for making loans and loan guarantees directly from the federal government to eligible water resources and water/wastewater projects. The projects receiving this assistance would be selected at the federal level, unlike the SRF program, and projects that are financed in whole or in part with any sort of tax-exempt financing are ineligible for WIFIA assistance. The same Buy American provisions as described above will apply to these projects as well.

JOINT UTILITY COMMITTEE RECEIVES FUNDING UPDATES, DISCUSSES INDUSTRY ISSUES

The CAWV Joint Utility Committee met on Thursday, May 15, at the offices of the Water Development Authority and West Virginia Infrastructure and Jobs Development Council in Charleston. Committee members received updates from funding agencies and discussed several industry issues. Jim Ellars, executive director, West Virginia Infrastructure and Jobs Development Council, presented an updated report on funds they have available for commitment during Fiscal Year 2014. The amounts are split into two categories, funds available for loans and funds available for grants, and take into account several projects that were funded by the IJDC board at their last meeting. The report shows a total of $24,418,042 of uncommitted funds available for loans and $5,077,060 available for grants. He noted that they have recently funded several large projects that were not originally on IJDC’s radar. Chris Jarrett, executive director, West Virginia Water Development Authority, noted that by funding those projects that the IJDC did not expect to be coming to the board for funding, the IJDC may have to turn away some projects that would normally get funded because the dollars will not be available. Mr. Jarrett also noted that with the legislature recently taking half, or $20 million, of this year’s funding to help balance the state budget it may be a few years before some projects get funded. He noted that loan dollars are usually harder to award as most projects request grant money in order to avoid having to request rate increases that would be required for the majority of projects if low interest loans were used to do the construction. He noted that several projects with Abandoned Mine Lands funds are also in jeopardy of losing some of their funding and may be coming to IJDC for additional funds. The Office of Surface Mining has put a hold on projects with AML dollars to research how the AML funds were awarded. In order for a project to receive AML funds the water quality must have been directly affected by a mining operation in that community. This could be a big issue for since currently 32 projects have some AML funds committed.

Kathy Emery, Engineer Chief, West Virginia Department of Environmental Protection, reported that the WVDEP has now funded $1 billion in water and waste water projects. Ms. Emery also reported that have obligated 99 percent of their funds for this fiscal year and her goal is to spend 99 to 100 percent of their funds available each year.

Committee members also discussed the Federal Buy American Mandate. That mandate states that any project using State Revolving Funds for any portion of the project must meet a Buy American Certification. The certification states that all iron, steel and precast concrete used on a project must be manufactured in the United States. The mandate does not include manufactured goods such as pumps, controls, etc. The mandate went into effect for all projects whose plans were approved after January 17, 2014. There is also a waiver process for items not produced in the U.S. and for small items that amount to less than five percent of the total project amount. Members also heard from Kelly Workman, Manager, Project Development for the West Virginia Development Office, on the Sam.gov registration requirements. Her office had recently stated that contractors that work on projects that contain Small Cities Block Grant money must register through the SAM.gov site. After some discussions with the CAWV the Development Office has decided not to require the registration at this time and will study the issue to see if it will be required in the future. The purpose of the registration is to make sure a contractor on a project is not on the debarment list.

PROTECTING WORKERS FROM HEAT STRESS- PART TWO

Exposure to heat can cause illness and death. The most serious heat illness is heat stroke. Other heat illnesses such as heat exhaustion, heat cramps and heat rash, should also be avoided. There are precautions employers should take any time temperatures are high and the job involves physical work.

HOW YOU CAN PROTECT YOURSELF AND OTHERS

Know signs/symptoms of heat illnesses, monitor yourself, use the buddy system.

Block out direct sun and other heat sources.

Drink plenty of fluids. Drink often and BEFORE you are thirsty.

Avoid beverages containing alcohol or caffeine.

Wear lightweight, light colored, loose-fitting clothes.

Be aware that poor physical condition, some health problems (such as high blood pressure or diabetes), pregnancy, colds and flu, and some medication can increase your personal risk. If you are under treatment, ask your healthcare provider.

WHAT TO DO WHEN A WORKER IS ILL FROM THE HEAT

Call a supervisor for help. If the supervisor is not available, call 911.

Have someone stay with the worker until help arrives.

Move the worker to a cooler/shaded area.

Remove outer clothing.

Fan and mist the worker with water, apply ice (ice bags or towels).

Provide cool, but not ice-cold drinking water, if able to drink.

DOT CONTINUES TO PROJECT HIGHWAY TRUST FUND SHORTFALL IN AUGUST

The U.S. Department of Transportation maintains its projection that the Highway Trust Fund will shortfall in August, according to the latest update of the agency’s Highway Trust Fund Ticker. Transportation Secretary Anthony Foxx introduced the Ticker in January. It is designed to provide a monthly update on the HTF’s remaining balance.

Last month, the DOT offered the same projection on when the HTF will run dry: late August. The HTF provides funding to the majority of surface transportation projects in the U.S., and the DOT could slow reimbursements to state and local agencies to prevent the shortfall. Additionally, Transportation Secretary Anthony Foxx previously said that if the HTF, along with other problems with the nation’s transportation system, isn’t fixed, it could cost 700,000 jobs. In the ticker update, the DOT notes that the Highway Account started fiscal year 2014 with about $1.6 billion, and $9.7 billion was transferred from the General Fund. Since then, the account’s cash balance has dropped by nearly $3.2 billion to $8.7 billion, according to Federal Highway Administration (FHWA) data through April 25. PENNSYLVANIA’S HIGHWAY PROGRAM INCREASES, THANKS TO FUNDING LEGISLATION

The Pennsylvania Legislature passed its first-ever comprehensive multimodal transportation funding bill that greatly expands the state’s highway construction and maintenance program. The following appeared in the May 14 issue of the Pennsylvania Highway Information Association’s E-Motion: “PennDOT puts out $217 million projects during April” – The effects of Act 89 continue to spike Penn DOT Lettings in 2014. PennDOT bid a little over $217 million in projects in April, bringing the year-to-date total to over $667 million. At this same point in 2013, PennDOT only bid $336.3 million in lettings. At this pace, PennDOT would end 2014 with over $2 billion in lettings. With the recent enactment of the transportation funding bill there is reason to see this trend continue. Act 89, which will implement a $2.3 billion comprehensive transportation funding plan over the next five years, will result in PennDOT coming close to $2 billion in construction lettings in 2014. PennDOT finished 2013 with $1.6 billion in lettings. As in year's past, PHIA will continue to track contract lettings on a monthly basis.

SENATE PASSES TRANSPORTATION BILL OUT OF COMMITTEE

Thursday the Senate Environment and Public Works Committee (EPW) unanimously approved S. 2322, the MAP-21 Reauthorization Act. The AGC-supported bipartisan bill is the first step towards reauthorizing current transportation funding legislation and identifying the revenue needed to provide for a robust long-term transportation bill.

The legislation – which is the highway portion of the surface transportation reauthorization – provides current funding plus inflation for six years through fiscal year 2020. It also maintains current funding formulas and increases the amount states will receive each year. The annual funding for federal-aid highways is below:

The bill is far less comprehensive than MAP-21, considering many of the reforms in MAP-21 have yet to be implemented. The bill does, however, make some incremental improvements to accelerating project delivery, as well as creating new categorical exclusions. In addition, the bill creates a new multimodal freight formula program, which will start in 2016 and is funded at $1 billion per year over five years. The bill would provide $400 billion annually for projects of national and regional significance, which was initially authorized as part of MAP-21 but was never funded. Also, the bill originally provided $1 billion annually for the TIFIA credit assistance program, but that number was decreased by $250 million as part of an amendment to restore funding for highway research programs. The proposed bill would also direct the U.S. Department of Transportation to carry out a study to examine alternative financing mechanisms to preserve the user-fee structure and maintain long-term Highway Trust Fund solvency. The next steps within the Senate are for the other committees of jurisdiction to act. The most critical of the three is the Finance Committee, which has been tasked with finding the revenue to pay for the bill. Through the Hardhats for Highways campaign, AGC continues to focus on ensuring revenue is available in the Highway Trust Fund to avoid insolvency – projected as early as July of this year – and to provide for the long-term reauthorization of MAP-21 prior to the expiration of the bill on Sept. 30, 2014.

Charleston, West Virginia is the site for the American Association of State Highway and Transportation Officials Subcommittee on Maintenance annual meeting. It will be held July 27 through July 31. This is the annual national meeting of well over 200 roadway and bridge engineers and officials from all fifty states, Puerto Rico and Canada. The West Virginia Division of Highways is this year’s host.

Kyle Stollings, Director of the WVDOH’s Maintenance Division, has reached out to the CAWV and Asphalt Pavement Association of WV to seek help with sponsorships. Our organizations have always helped sponsor AASHTO meetings when they come to West Virginia because it helps showcase West Virginia and it supports the men and women of the West Virginia Division of Highways who are helping to put on this year’s meeting.

There are two ways to help sponsor this year’s program. One, AASHTO has developed sponsorship levels of $2,500, $3,500, $6,000 and $8,000. Companies that would like to select one of these levels get to set up a display table at the meeting, get complimentary registration and an ad in the program. Companies can also purchase a full-page, half-page or quarter-page ad in the program. The sheet detailing the sponsoring levels and corresponding benefits is attached with this mailing.

There is a second option for contributions. Companies that don’t want to partake of the AASHTO levels can make a contribution to the CAWV. These dollars will be pooled and the total contributions will be used to help the WVDOH offset some of the costs of the annual meeting. The names of all members who contribute will be provided to the WVDOH so they can acknowledge the support given by industry.

Kyle, his staff, and AASHTO personnel have developed a great program for the Charleston conference. In addition to the many technical and work group meetings, there is time for attendees to see West Virginia specific attractions, including a tour of the WV Turnpike Memorial Tunnel which is used to simulate emergency situations, mock disasters, tunnel fires and terrorist events.

Sponsorship of the Subcommittee on Maintenance conference is a great way to support the WVDOH’s Maintenance Division.
