Riesenfeld sympo- sium on "Fifty Years in the Making: World War II Reparation and Restitution Claims." The participants gathered for this symposium at Boalt Hall provide a wonderful collection of voices from government, the bar and the academy on a host of difficult issues concerning Holocaust claims. The discussion regarding Holocaust reparation claims has focused prima- rily on the theoretical and policy implications of these claims or on specific lawsuits that have been filed against foreign corporations. However, this paper will focus on issues related to the the implementation of settlements for these claims. For example, once an agreement has been reached between the parties, how is this agreement implemented? What are the legal difficulties that arise? Just as Norbert Wiuhler and Karen Heilig have provided insights into the imple- mentation process for German slave labor claims,' this paper will focus on Swiss banks, and in particular the measures taken by the Independent Commit- tee of Eminent Persons ("Volcker Commission") established to resolve claims to Holocaust-era Swiss bank accounts. 2 Section I of this paper will provide a brief historical analysis of Holocaust claims against Swiss banks to address the fundamental question of why this process did not occur earlier.3 Section II will introduce procedures utilized by * Associate Professor of Law, Pepperdine University School of Law.     THE WIESENTHAL REPORTS * * * In 1998, in my capacity as Historical Consultant to the Simon Wiesenthal Center, Los Angeles, I was commissioned to prepare two reports on the Swiss Government’s official attitude toward Jewish refugees arriving in neutral Switzerland, from the late 1930s through 1945. The initial Report dealt with the slave-labour camps--which were in fact created specifically for Jewish refugees, along with legislation passed to enact them and further supporting measures. The public outcry resulting from the subsequent publication of my first report in January, 1998, and then from its sequel in June of 1998, crescendoed into a wave of self-conscious national outrage against the American historian who had dared publish Switzerland’s long kept dark secret at last. For the first time the official wartime policy of anti-Semitism invoked by elected Swiss national leaders was exposed for all the world to see. With the release of this fully documented historical reality, Swiss public opinion once again closed ranks, forming a textbook national consensus controlled and orchestrated by the Swiss national press, radio and television, their frenzied patriotism protesting this uncomfortable revelation of their hitherto carefully buried national “patriotic” past and close support of the Third Reich. In particular Swiss national media denied the well documented historical facts, blaming everything as usual on a non-existent “international world Zionist plot” (just as Hitler had done decades earlier). There was during World War II, as there remains to this day, no room or respect for individual thought or belief in Switzerland. Switzerland was, and remains, a nation ruled by “consensus.” Everyone had to be a loyal unquestioning patriot.

Part I provides background information on the claims, including the relevant Swiss law, obstacles encountered by earlier claimants, and the Swiss Government’s early resolution attempts. Part I also outlines frameworks of international arbitral and adjudicatory forums employed to resolve international disputes. Part II discusses the attempts of the Swiss banks, Swiss Government, U.S. Congress, private individ- uals, and independent organizations to resolve claims to dormant Swiss bank accounts. Part III argues that the current mechanisms are inappropriate for handling claims on dormant Swiss bank accounts and proposes an alternative mechanism that is better designed for settling claims based on its ability to offer final resolution to both claimants and banks. This Note concludes that the only effective way to settle the dispute over dormant Swiss bank accounts is to implement this propsed hybrid forum for the final resolution of claims.
