Public Protector Sets Date For Public Hearings On Horse Racing Public Protector Adv Busisiwe Mkhwebane has confirmed that the public hearings into the complaint of maladminis- tration of horse racing in Gauteng, first announced in May 2018, will now commence on Tuesday, 4 September 2018. The matter arises out of a complaint lodged by Ms Phindi Kema in January 2012 against the Gauteng Provincial Gov- ernment for corporatising the industry, establishing Phume- lela and exceeding its authority by allowing the transferring of 5 racetracks located outside of Gauteng into the owner- ship of the public company without following the appropri- ate procedure and public participation process. The complaint was lodged with then Public Protector Adv Thuli Madonsela who, in 2012, found there was a prima facie case of malparactice. It was subsequently investigated over the past six years, and her successor, Adv Mkhwebane has decided to finalise the last part of the investigation through a public hearing. The “Corporatisation” of racing came about at the -be hest of the Gauteng Provincial Government in 1997, which designed and oversaw a structure which has subsequently overseen a decline in the Sport and a reduction of 85,000 jobs with the sale of many tracks and losses in breeding farms and stables. It is also believed that the structure permitted the found- ing principles to be distorted and cause what many people think to be the capture of the industry by individuals such as Markus Jooste. The Public company Phumelela issued a cautionary an- nouncement to the JSE regarding a restructuring plan in a release dated 18 July 2018. The Public Protector's office is calling in key government de- partments including the DTI, Department of Sport and Gaut- eng Provincial Government to testify or make submissions. The National Horseracing Authority, as the sport’s regula- tory body, has been asked by the Public Protector to pro- vide contact details for those being called to testify which includes six current or former directors of Phumelela.

By the July, 6 months later, the 6kgs for 3yo’s becomes 2kgs, and by the follow- ing MET it’s 0,5 Kg. So the slope is much steeper in the beginning as 3yo’s and tapers to flat by 4 ½ yo and the discussion is mostly about 3yo’s vs 4yo’s in handicaps. It’s also worth remembering that this years 3yo’s are next years 4yo’s by which I mean if there was a bias for one group, everyone gets a turn. The handicappers are assessing every run so 99% of the time there is no need to use the presumption of future development and penalising horses before a race at the weights. If a horse is making the WFA development, the ratings will pick it up and those that don’t, ratings likewise will show that. Taking WFA out of the rating system does NOT eliminate WFA, which happens as a force of nature. It just forces horses to show what their individual development actually is rather than assum- ing that it will be made according to steps in an ancient table.
