On September 25, 2003, an agent of the Commission’s Buffalo Office inspected radio station WENY-FM located in Elmira, New York, and observed the following violation(s): a. 47 C.F.R. § 11.35(a): “… Additionally broadcast stations …. must determine the cause of any failure to receive the required tests specified in §§ 11.61(a)(1) and (2). Appropriate entries must be made in the broadcast station log as specified in § 73.1820 and § 73.1840 …. , indicating reasons why any tests were not received.” WENY-FM logs did not contain entries determining the cause of any failure to receive weekly tests from LP-1, WNKI, for the periods June 4 to June 19, 2003 and August 21 to September 10, 2003. b. 47 C.F.R. § 11.61(a)(2)(A): “Effective January 1, 1997, AM, FM, and TV stations must conduct weekly tests of the EAS header and EOM codes at least once a week at random days and times.” WENY-FM did not transmit weekly tests for the periods June 17 to July 4, 2003; July 29 to August 14, 2003; and August 27 to September 10, 2003.

We boarded our coach bus early in the morning – the Class of 2021 likes to travel in style!! Our morning activity was the Buffalo Bicycle “Wing Tour” - and yes, we all traveled around on bikes, even our advisors – they made sure they didn’t lose any students by bringing up the rear. Our afternoon activity in Buffalo was a visit to the Buffalo Zoo. The Buffalo Zoo has some of the world's most exotic, endangered, and even local wildlife! But then again, so does the WCS Class of 2021!! We then made a stop for Ice Cream . Mrs. Tronetti has taught us that Ice Cream makes everything better!! We ended our day in Buffalo at the Walden Galleria where we shopped ‘til we dropped and then had dinner at Dave & Busters. This must be what heaven is like because we could Eat & Play at the same time!! It’s amazing to discover how competitive the folks you’ve been in school with all these years are over a game!! The WCS Class of 2021 would like to thank the Whitesville Community for supporting all their fundraisers throughout the years which enabled us to create Memories for a Lifetime as we all spread our wings and get ready to fly .

In accordance with Sections 309(a) and 310(d) of the Communications Act of 1934 (the 1934 Act), the Commission issues new radio broadcast licenses and approves the assignment and transfer of those licenses only when those actions are consistent with the public interest, 1 convenience, and necessity. Pursuant to its public interest authority, the Commission historically has sought to promote diversity and competition in broadcasting by limiting by rule the number of 2 radio stations a single party could own or acquire in a local market. In Section 202(b) of the Telecommunications Act of 1996 (the 1996 Act), Congress directed the Commission to revise its 3 local radio ownership rule to relax the numerical station limits in the ownership rules. In the almost six years since the Commission implemented this congressional directive, the local radio market has been significantly transformed as many communities throughout the country have experienced increased consolidation of radio station ownership. In this proceeding, we seek to examine the effect that this consolidation has had on the public and to consider possible changes to our local radio ownership rules and policies to reflect the current radio marketplace.
