RESUME OF WORK TRANSACTED BY THE TAMIL NADU LEGISLATIVE ASSEMBLY FROM 23RD MAY, 2011 TO 10TH JUNE, 2011 AND FROM 4TH AUGUST, 2011 TO 14TH SEPTEMBER, 2011.

The Fourteenth Tamil Nadu Legislative Assembly was constituted on the 14th May, 2011 after the General Elections held to the Tamil Nadu Legislative Assembly on the 13th April, 2011.

I. SUMMONS

Summons for the First Session of the Fourteenth Tamil Nadu Legislative Assembly were issued to the Members of the Legislative Assembly on the 19th May, 2011 in S.O.Ms.No. 58, Legislative Assembly Secretariat, dated the 19th May, 2011 to meet at 12.30 p.m on the 23rd May, 2011.

II. DURATION OF THE MEETING

The First Meeting of the First Session of the Fourteenth Legislative Assembly commenced on the 23rd May, 2011 and was adjourned sine-die on the 10th June, 2011 and the Second Meeting of the First Session of the Fourteenth Legislative Assembly commenced on the 4th August, 2011 and was adjourned sine-die on the 14th September, 2011.

III. SITTINGS OF THE ASSEMBLY

The Tamil Nadu Legislative Assembly sat for 32 days during the period from 23rd May, 2011 to 10th June, 2011 and from 4th August, 2011 to 14th September, 2011 on the following days:-

IV. PROROGATION

The First Session of the Fourteenth Tamil Nadu Legislative Assembly was prorogued with effect from the 25th October, 2011 vide S.O.Ms.No.173, Legislative Assembly Secretariat, dated the 25th October, 2011.

V. APPOINTMENT OF SPEAKER PRO-TEM

Dr. C.K. Thamizharasan, Member, Legislative Assembly representing Kilvaithinankuppam Assembly Constituency was appointed as the ‘Speaker Pro-tem’ by the Governor, in exercise of the powers conferred by clause (1) of Article 180 of the Constitution of India. He was also appointed as the person before whom oath or affirmation may be made and subscribed by the Members of the Legislative Assembly under Article 188 of the Constitution of India. He took the oath in the name of God in Tamil before the Governor at 9.00 A.M. on the 22nd May, 2011 at Raj Bhavan, Guindy and signed the Roll of Members in the Assembly Chamber in the presence of the Secretary on the 23rd May, 2011.

VI. OATH OR AFFIRMATION

On the 23rd May, 2011, 228 Members made and subscribed the oath or affirmation before the Speaker Pro-tem in the Legislative Assembly Chamber.

Thiru N.R. Sivapathy and Thiru. R. Manoharan took the Oath in the name of God before the Speaker Pro-tem in the Legislative Assembly Chamber on the 27th May, 2011. 3

Thiru. M. Karunanidhi and Thiru. Duraimurugan took the oath solemnly affirming their allegiance to the Constitution of India before Hon. the Speaker in his chamber on the 30th May, 2011.

Out of 232 Members, 177 Members took the oath in the name of God and 55 Members solemnly affirmed their allegiance to the Constitution of India. 231 Members made and subscribed the oath or affirmation in Tamil and One Member in English. The names of Members who made and subscribed the oath or affirmation are shown in the Annexure-I (Page No.59).

Under Article 333 of the Constitution of India, the Governor of Tamil Nadu nominated Dr. (Tmt.) Nancy Ann Cynthia Francis, as a Member of the Fourteenth Tamil Nadu Legislative Assembly representing the Anglo-Indian Community on the 4th July, 2011. (G.O.Ms.No.573, Public (Election-III) Department dated 4th July, 2011).

The Member took the oath in English in the name of God before Hon. the Speaker in his chamber on the 14th July, 2011.

VII. ELECTION OF SPEAKER AND DEPUTY SPEAKER

The election of Speaker and Deputy Speaker were held on the 27th May, 2011.

On the 27th May, 2011, the Speaker Pro-tem read out to the Assembly the name of the Member who had been validly nominated for the office of the Speaker together with those of his proposer and seconder.

Thiru D. Jayakumar was conducted to the Chair by Hon. Thiru O.Panneerselvam, Leader of the House and Thiru Vijaykant, Leader of the Opposition.

Hon. the Speaker, thereafter conducted the election of the Deputy Speaker. He read out to the Assembly the name of the Member who had been validly nominated for the office of the Deputy Speaker with those of his proposer and seconder.

VIII. APPOINTMENT OF THE LEADER OF THE HOUSE, CHIEF GOVERNMENT WHIP AND RECOGNITION OF THE LEADER OF OPPOSITION

Hon. Thiru O. Panneerselvam, Minister for Finance was appointed as Leader of the House for the Fourteenth Tamil Nadu Legislative Assembly with effect from the 21st May, 2011 - vide S.O. Ms.No.61, Legislative Assembly Secretariat, dated 21st May, 2011.

Thiru P. Mohan, M.L.A. was appointed as the Chief Government Whip with effect from the 21st May, 2011 - vide S.O.Ms.No.62, Legislative Assembly Secretariat, dated 21st May, 2011.

Hon. the Speaker recognised Thiru Vijaykant, M.L.A. belonging to the Desiya Murpokku Dravida Kazhagam Legislature Party as Leader of the Opposition in the Fourteenth Tamil Nadu Legislative Assembly with effect from 27th May, 2011 - vide S.O.Ms.No.69, Legislative Assembly Secretariat, dated 27th May, 2011. 5

XI. QUESTIONS

During the Session, 9,022 Notices of questions were received and admitted, out of which 3,969 were treated as Starred questions and 2,963 were treated as Unstarred questions. 106 Starred questions were answered on the floor of the House. Answers to 175 Unstarred questions were placed on the Table of the House. Though 23 Short Notice Questions were received and admitted, only one Short Notice question was answered on the floor of the House.

XII. GOVERNOR’S ADDRESS AND MOTION OF THANKS THEREON

His Excellency, Thiru Surjit Singh Barnala, Governor of Tamil Nadu addressed the Members of the Fourteenth Tamil Nadu Legislative Assembly in the Legislative Assembly Chamber, Secretariat, Chennai-9 at 10.00 A.M. on Friday, the 3rd June, 2011.

‘Tamizh Thai Vazhthu’ and ‘National Anthem’ were played at the commencement and at the end of the Governor’s Address, respectively.

The Motion of Thanks to the Governor’s Address was moved by Thiru Pollachi V. Jayaraman and seconded by Thiru R. Kamaraj on the 7th June, 2011.

The discussion on the Motion of Thanks took place in the Assembly for 4 days viz., 7th June, 2011, 8th June, 2011, 9th June, 2011 and 10th June, 2011. 34 Members including the Leader of Opposition took part in the discussion. Hon. the Chief Minister replied to the debate on the 10th June, 2011.

One hundred and twenty five amendments to the Motion of Thanks were received, out of which one hundred and eighteen were admitted and the remaining were disallowed. 10

On the 10th June, 2011, Tvl. P. Dillibabu, S.P. Muthukumaran, R. Ramamurthy, A. Soundararajan, K. Balakrishnan and V. Muthukumar moved the amendments standing in their names. At the end of discussion on the 10th June, 2011, the amendments moved by the above Members were deemed to have been withdrawn by leave of the House and thereafter, the original Motion of thanks to the Governor’s Address was adopted in the House on that day.

XIV. CALLING ATTENTION STATEMENT

On the 10th September, 2011, Tvl. A. Soundararajan, Selvi. K. Balabharathi, K. Balakrishnan, K. Thangavel, A. Laser, P. Dillibabu, R. Annadurai, G. Beem Rao, R. Ramamurthy and P. Mahalingam called the attention of Hon. Minister for Higher Education regarding the need to stop collection of exorbitant fees than that specified by the Government in private Engineering and Medical Colleges. Hon Minister for Higher Education and Hon. Minister for Health made their statements on the floor of the House on the same day. 11

Selvi J Jayalalithaa, On the matter relating to the Chief Minister death sentence awarded to the three persons in Rajiv Gandhi assassination case, the Chief Minister informed that as a Chief Minister of a State, she did not have the power to annul the death sentence awarded to Santhan, Murugan and Perarivalan in the Rajiv Gandhi assassination case, or put their execution on hold, after the rejection of their mercy petitions by the President. In the letter dated 5.3.1991 from the Union Home Ministry, it has been stated that once the President has rejected a mercy petition, all future application in this behalf should be addressed to and would be dealt with by the President of India.

Selvi J Jayalalithaa, The State owned Tamil Nadu Chief Minister Arasu Cable TV Corporation would launch its operations throughout the State of Tamil Nadu, except Chennai, from 2nd September, 2011. XVII. FINANCIAL BUSINESS

The Revised Budget for the year 2011-2012 was presented to the Legislative Assembly by Hon. Thiru. O. Panneerselvam, Minister for Finance at 10.40 a.m on Thursday, the 4th August, 2011.

The General discussion on the Budget took place for five days on the following dates:

XX. ANNOUNCEMENTS BY HON. SPEAKER

(1) On the 7th June, 2011, Hon. the Speaker announced in the House that questions were being received from Members and sent to the departments concerned for furnishing replies and that Rule 32 of the Tamil Nadu Legislative Assembly Rules which provides that the first hour of every sitting be available for “Questions and Answers” be suspended with the permission of the House and that there would not be “Questions and Answers” hour for some days.

He also announced that answers to questions should be furnished within 42 days as per the Rule 45 of the Tamil Nadu Legislative Assembly Rules and has also requested the Hon. Ministers to instruct the Secretaries to Government, Departments of Secretariat to send the replies to the questions expeditiously.

(2) On the 7th June, 2011, Hon. the Speaker announced in the House that the Members of the House should switch-off their Cell Phones before taking their seats in the House.

(3) On the 9th June, 2011, Hon. the Speaker announced in the House the schedule for the conduct of elections to elect Members by single transferable vote for the Committee on Estimates, Committee on Public Accounts, Committee on Public Undertakings and Committee of Privileges. (17) On the 7th September, 2011, Hon. the Speaker announed in the House that the Hon. Minister for Electricity and Prohibition and Excise would reply to the debate in respect of Demand No.37-Prohibition and Excise (Home, Prohibition and Excise Department) on 8-9-2011.

(18) On the 8th September, 2011, Hon. the Speaker announced in the House that Hon. Minister for Transport would reply to the debate in respect of Demand No.25- Motor Vehicles Acts- Administration (Home, Prohibition and Excise Department) and Demand No.48-Transport Department on 10-9-2011.

(23) On the 14th September, 2011, Hon. the Speaker announced in the House the statistical details of the important events and business transacted by the Fourteenth Tamil Nadu Legislative Assembly during its first and second meetings of the first session. XXI. PRIVILEGE MATTER On the 5th September, 2011, Hon. the Speaker suo-moto referred to the Committee of Privileges under Rule 226 of the Tamil Nadu Legislative Assembly Rules for examination and report on the matter of privilege against Thiru. T.R.B. Rajaa, M.L.A., for allegedly videographing the proceedings of the Assembly using his mobile phone. XXII. FELICITATIONS (1) On the 23rd August, 2011, Hon. the Speaker felicitated the Government headed by Hon. the Chief Minister as it completes 100 days in office today and announced that the House would celebrate the occasion on 24th August, 2011. 42

(2) On the 24th August, 2011, Dr. C.K. Thamizharasan, Thiru. U. Thaniyarasu, Thiru. P.V. Kathiravan, Thiru. R. Sarathkumar, Dr. K. Krishnasamy, Dr. M.H. Jawahirullah, Thiru. M. Kalai Arasu, Thiru. M. Arumugham, Thiru. N.R. Rengarajan, Thiru. A. Soundararajan and Thiru. S. Ramachandran, Deputy Leader of the Opposition complimented Hon. the Chief Minister on completion of 100 days rule of the Government during her third term as Chief Minister. Hon. Minister for Tourism, Hon. Leader of the House and Hon. the Speaker also offered their felicitations. Hon. the Chief Minister through her thanks giving speech reciprocated the warm greetings showered upon her by the Members.

(3) On the 30th August, 2011, Hon. the Speaker, on behalf of Hon. the Chief Minister and Members of the House conveyed his greetings to the Muslim people on the eve of Ramzan festival.

(4) On the 8th September, 2011, Hon. the Speaker, on behalf of Hon. the Chief Minister and Members of the House conveyed his greetings to the people celebrating Onam festival.

XXIII. ORIENTATION COURSE TO MLA’S

An orientation course for the newly elected Members was conducted by the Legislative Assembly Secretariat at the Conference Hall, Namakkal Kavignar Maligai, Secretariat, Chennai on 4-8-2011 which was presided over by Thiru D. Jayakumar, Hon. Speaker. Hon. Thiru. O. Panneerselvam, Minister for Finance (Leader of the House) inaugurated the course. Thiru K. Shanmugam, I.A.S., Principal Secretary to Government, Finance Department highlighted the different aspects of the Budget. Thiru. A.M.P. Jamaludeen, Secretary, Tamil Nadu Legislative Assembly briefed the newly elected Members about the various devices of the Parliamentary procedures under the Tamil Nadu Legislative Assembly Rules and conventions of the House. 43
