The City is in receipt of a Site Plan Review Application [SPR 20-26] & Special Exemption Permit [SEP 21- 04] from the applicant, Russ & Barr, Inc., Russ Dibartolomeo. A Preliminary Site Plan review for the proposed uses at the subject site 761 W. Huron. The submitted Site Plan Review proposes to renovate the existing structure to operate mixed-use retail and office spaces, and mini storage rental units located in the southern portion of the property.

Preliminary Site Plan The subject property,is a developed and derelict property, and a former bank facility. The property is presently designated the C-1 Local Business zoning district, the proposed retail and office uses are permitted by-right within the C-1 Local Business District. The proposed Mini-Storage use is not permitted within the C-1 Local Business District, to operate a Mini-Storage use a C-3 Corridor Commercial District zoning designation is required. Furthermore, the Mini-Storage use in the C-3 Corridor Commercial requires a Special Exemption Permit and Public Hearing by the City of Pontiac Planning Commission.

The Planning Division has conducted a Preliminary Technical review and recommends a Two-Step Site Plan Process, in accordance with the City of Pontiac Zoning Ordinance. This process entails a preliminary Site Plan Review and simultaneous Special Exemption Permit Review to be conducted and approved by the Planning Division.

Preliminary Site Plans expire one year after the date of the preliminary approval, unless the final site plan for the project has been submitted to the Planning Department for review prior to the expiration date.

Final Site Plan Review would be conditional and granted pending compliance with all Site Plan Review criteria identified below, the City of Pontiac Zoning Ordinance, and approval of the required Zoning Map Amendment, changing the subject property zoning designation from C-1 Local Business district to C-3 Corridor Commercial District. Special Exemption Permit Review

The applicant has made petition for a Special Exemption Permit to permit a Mini-Storage use at the subject property. The subject site is currently zoned C-1 Local Business, which does not permit the Mini-Storage use by-right, or by Special Exemption Permit. Final approval and issuance of a Special Exemption for a Mini-Storage use is conditioned to, and requires a Zoning Map Amendment, from the current C-1 zoning designation to C-3 Corridor Commercial, in addition to compliance with the below Zoning Ordinance Criteria for Mini-Warehouse uses, Section 2.519.

A. Fencing. The perimeter of the storage area shall be fenced. The fence shall have a minimum height of eight feet, and decorative fencing shall be used in the front yard. An entrance gate shall be provided with a minimum access width of 12 feet, with either electronic or manual control. B. Buildings. 1. In the C-3 District. All storage units shall be located in one building. The building may not use metal or cinder block as its primary building material and shall be designed consistent with other commercial buildings in the vicinity of the site. C. Indoor Storage Only. All items shall be stored inside an enclosed facility

Special Exemption Permit Review Requirements

When considering any petition for Special Exemption Permit, the Pontiac Planning Commission must consider the criteria of Section 6.303 of the City Zoning Ordinance, which states:

The Planning Commission shall review each application for the purpose of determining that each use on its proposed location will:

1. Be harmonious with and in accordance with the general principles and objectives of the comprehensive master plan of the City of Pontiac. [Meets]

2. Be designed, constructed, operated and maintained so as to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity by way of size, character, or location. [Meets]

3. Not change the essential character of the area in which it is proposed, and not adversely affect the development or redevelopment of the surrounding neighborhood. [Meets]

4. Not be hazardous or disturbing to existing or future uses in the same general vicinity and will be a substantial improvement to property in the immediate vicinity and to the community as a whole. [Meets]

5. Be served adequately by essential public facilities and services, such as highways, streets, police, fire protection, drainage structures, refuse disposal water and sewage facilities and schools. [Meets]

6. Not involve uses, activities, processes, materials, and equipment or conditions of operation that will be detrimental to any person, property or general welfare as a result of producing excess traffic, noise, smoke,Jumes, glare, or odors out of proportion to that normally prevailing in the particular district. The City of Pontiac is in receipt of application ZMA 21-04 for a Zoning Map Amendment [rezoning] per Section 6.802 of the Zoning Ordinance for parcel Number 64-17-33-407-035, -036, -037. The subject site is located at the intersection of Midway Ave. and S. Sanford St. The subject property is currently zoned R-1 Single Family Dwelling, the applicant requests a rezoning from R-1 to C-1 Local Business, and proposes neighborhood grocer and the current abandoned building.

Master Plan According to the City's 2014 Master Plan Update any new economic prospects on which to build a sustainable destiny with new commercial and industrial development is a major land use objective. It is with this spirit that is embedded in the Master Plan update.

The subject site is planned as Traditional Neighborhood Residential. These areas allow a range of building styles and uses with the Local Business & Commercial uses clustered on major uses. This designation includes most of the City's traditionally single-family neighborhoods

Existing Zoning Districts Properties to the north, east, south and west are zoned R-1 One Family Dwelling District. The current residential zoning make-up of the area is consistent with the City of Pontiac Master Plans and the Future Land Use Plan.

1 Rezoning Criteria The Pontiac Planning Commission must consider any of the following criteria [section 6.804, A-J] that apply to the rezoning application in making findings, recommendations, and a decision to amend the Official Zoning Map [Section 6.804]. Additionally, the section also stipulates that the Pontiac Planning Commission may also consider other factors that are applicable to the application, but are not listed among the ten criteria. To assist in the evaluation of these and other criteria, we offer the following findings of fact for your consideration. The ten stated criteria are listed below with our findings:

1. Consistency with the goals, policies and objectives of the Master Plan and any sub-area plans. If conditions have changed since the Master Plan was adopted, consistency with recent development trends in the area shall be considered. [Meets]

2. Compatibility of the site's physical, geological, hydrological and other environmental features with the uses permitted in the proposed zoning district. [Meets]

3. Evidence the applicant cannot receive a reasonable return on investment through developing the property with one (1) or more of the uses permitted under the current zoning. [Meets]

4. Compatibility of all the potential uses allowed in the proposed zoning district with surrounding uses and zoning in terms of land suitability, impacts on the environment, density, nature of use, traffic impacts, aesthetics, infrastructure and potential influence on property values. [Meets]

5. The capacity of the City's utilities and services sufficient to accommodate the uses permitted in the requested district without compromising the health, safety and welfare of the City. [Meets]

6. The capability of the street system to safely and efficiently accommodate the expected traffic generated by uses permitted in the requested zoning district. [Meets]

7. The boundaries of the requested rezoning district are reasonable in relationship to surroundings and construction on the site will be able to meet the dimensional regulations for the requested zoning district. [Meets]

8. If a rezoning is appropriate, the requested zoning district is considered to be more appropriate from the City's perspective than another zoning district. [Meets]

9. If the request is for a specific use, rezoning the land is considered to be more appropriate than amending the list of permitted or special land uses in the current zoning district to allow the use. [Meets]

We are interested in ending one of the main issues in the urban communities around the country which are FOOD DESERTS, described as an area that has limited access to affordable and nutritious food by placing a community market in Pontiac. This market will provide healthy and nutritional items at a reasonable cost while providing jobs for local residents. This market is central to community health and well-being. We will host classes on healthy cooking and living, including ways to improve nutrition among kids and seniors. We want to help increase the healthy food intake of our community. The City is in receipt of a Site Plan Review Application [SPR 21-13] from the applicant, Chad Asman, on

behalf of RLA Studio. The submitted Site Plan dated 5/25/21, located at 616 W. Huron, proposes to

construct a new commercial building, and to establish a commercial office for the benefit of business

operations related to Hope Against Trafficking.

Existing Site Conditions The subject property, 616 W. Huron, was formerly a multi-family structure, which maintained three

residential units. The structure was determined to be Noticed and Condemned on October 31, 2008. On

July 16, 2014, the Board of Appeals resolved for the structure to be demolished. On January 22, 2021

the property owner made application to the Department of Building & Safety for Demolition Permit

[PD210002]. The aforementioned property is zoned C-1 Local Business, and is currently a vacant parcel.

Proposed Use The applicant has proposed to construct a new commercial office building on the subject property, at

the intersection of Murphy St, and the W. Huron Corridor. The Office Use is permitted by right in

accordance with the City of Pontiac Zoning Ordinance. New Construction developments require Site Plan

In accordance with your request, our office has reviewed the Preliminary Site Plan Engineering for the above referenced project as submitted by La Rocca Construction {ULC Plans Dated 02/01/2021), The plans have been reviewed for conformance with City Ordinance Site Plan requirements. Our comments at this time are limited to general observations with regard to the proposed storm water management system, a preliminary floodplain review, and proposed water and sanitary sewer lead extensions. A more detailed review will be provided at the time of engineering plan submittal in accordance with the City of Pontiac ordinances and requirements. Our comments related to this review are as follows:

STORM WATER

1. The project Engineer has provided preliminary detention calculations on Sheet 2 of 3 of the Site Clvil Engineer Plan for a 10-year storm event for sizing the proposed storage system. This system is designed to discharge into an existing storm drain located in Auburn Avenue R.O.W. In accordance with City ordinance requirements, the Applicant shall be solely responsible to determine the feasibility of the proposed discharge point and downstream conditions from the stormwater outlet. The emergency overflow route for the drainage areas and calculations showing proper restrictor size and emergency overflow capacity wlll need to be included in the Engineering submittal once Site Plan approval is granted. 2. The final storm water management system shall be designed to meet all City Engineering Design Standards

WATER AND SEWER SERVICE CONNECTION

1. The Project Engineer is proposing to Install a new publlc waterline for a new hydrant and utilize existing service leads for the new building. These Items are under the jurisdiction of the Oakland County Water Resource Commission {OCWRC) and can be addressed at the time of Engineering Plan submittal once Site Plan approval is granted. NFE only recommends that the Engineer reach out to OCWRC now to determine the feasibility of using these existing service leads prior to final Engineering Plan submittals or If new taps will be required.

Based on our review and the above review comments, we find the plans acceptable for preliminary engineering purposes. If the Site Plan ls recommended for approval by the Planning Commission, Engineering Plans shall be submitted to the City of Pontiac for a more detailed review.
