1 Uncorrected/Not for Publication-24.03.2021 DC-PSV/4Z/7.00 ी 1 Uncorrected/Not for Publication-24.03.2021 DC-PSV/4Z/7.00 ी भूपेन्दर् यादव (कर्मागत): कमेटी को यह पावर है िक...(यवधान)... कमेटी को यह पावर है िक वह annual report को देख सकती है, Demands for Grants को देख सकती है, िकसी law के बारे म िवचार कर सकती है, लेिकन वह सरकार के day-to- day administration म interference नहीं कर सकती है। ...(यवधान)... आपने िदली िवधान सभा की ...(यवधान)... आपने िदली िवधान सभा की िजस कमेटी के बारे म कहा है - आप एक बात बताइए, मान लीिजए अगर कोई criminal incident होता है और कमेटी उसका investigation करने लग जायेगी, तब िफर executive police का क्या होगा? अगर िवधान सभाओं की कमेटी day-to-day administration का काम करने लग जायेगी, तो आप ही बताइए, आप federal structure की balancing बता रहे ह, न्यायपािलका, िवधाियका और कायर्पािलका, इनकी समरूपता कहाँ से होगी? इसिलए एकदम सही amendment लेकर आये ह िक कमेटी के जो Rules ह, वे लोक सभा के अनुसार होने चािहए। ...(यवधान)... चौथे पर तो आपको कोई आपि है ही नहीं। म आपको यह कहना चाहूँगा िक िदली की जो Union Territory है, उसका अपना एक unique feature है। िदली भारत की राजधानी है, हम यह जानते ह। हम इस बात को बहुत अच्छी तरह जानते ह िक िदली के िकसी भी कार के administration और governance से के न्दर्ीय सरकार की भी िजमेदारी रहती है, लेिकन िदली के लोग को उनकी िवधान सभा चािहए थी और इसके िलए संघषर् भी भारतीय जनता पाटीर् तथा हमारे खुराना जी और हमारे सािहब िंसह वमार् जी 2 Uncorrected/Not for Publication-24.03.2021 जैसे नेताओं ने िकया, उसके कारण आज िदली म िवधान सभा आयी है। ...(यवधान)... यह भारतीय जनता पाटीर् का एक लबे समय से संघषर् था। िदली की Metropolitan Council म भी हम आये थे, क्यिक हम चाहते थे िक िदली म लोग को िवधान सभा का अिधकार िमले और यह उसी का पिरणाम था िक िदली म िवधान सभा बनी, लेिकन िदली म जो िवधान सभा बनी है, उसको पूरे अिधकार िदये गये ह। इसिलए जब यह पूरा िवषय आया, तो जो amendments आये ह, वे amendments सीिमत ह। पहला िवषय एकदम बहुत पटता के साथ समझ लेना चािहए िक Executive Government means, Lieutenant Governor ही U.T. म होता है। आप दो तरह की balancing कै से खड़ी कर सकते ह? ...(यवधान)... आप दो तरह के balancing systems और दो क्षेतर् के िलए अलग-अलग system कै से कर सकते ह? जब गोवा भी Union Territory था और िमज़ोरम भी Union Territory था, तो वहाँ भी Lieutenant Governor को same power थी। इसिलए अगर Lieutenant Governor के मामले म, आप कल यह कह दगे, अगर यह ambiguity पैदा हो जाये, िंसघवी साहब, िक जो 2 Lieutenant Governors ह, उनको 2 classes declare कर दो, तब तो िफर आप कल Governors म 3 नये classes declare कर दगे िक बड़े राज्य का गवनर्र, छोटे राज्य का गवनर्र। जब हमने अपने संिवधान की यवथा म संघ, राज्य और के न्दर्शािसत देश रखे ह, तो उनके जो Executive heads ह, वे संिवधान के अनुसार ही होने चािहए, जो संिवधान के अन्तगर्त िलखा गया है। यह तो पहला िवषय हुआ। 3 Uncorrected/Not for Publication-24.03.2021 दूसरा िवषय, जब िदली को के न्दर्शािसत देश का दजार् िदया गया, तब इसे के न्दर्शािसत देश का दजार् देते समय भी तीन चीज़- आपने खुद भी िलट म पढ़ा है िक तीन चीज़- Public order, police और land, इन पर िकसी भी पाटीर् को असहमित नहीं है और यह एक्ट 1991 से चल रहा है, इन पर िदली िवधान सभा को अिधकार नहीं िदया गया है। क्य नहीं िदया गया, क्यिक िदली का एक unique feature है। आज के वल भारत की राजधानी, िदली भारत के federal structure का एक तीक है - िदली का जो structure है, इसका जो िवकास है, इसका जो development है - इसिलए िदली की सरकार िनिचत रूप से जनता ारा चुनी हुई सरकार है और जनता ारा चुनी हुई सरकार को बनाना, चलाना, शासन करना, यह बहुत आवयक है। ...(यवधान)... लेिकन जनता की सरकार का जो head, Lieutenant Governor है - मुझे यहाँ पर कोई पट रूप से बताये िक यह समया कहाँ से पैदा हुई? यह समया यहाँ से पैदा हुई िक ...(यवधान)... ी उपसभापित: कृ पया बैठ कर न बोल। ...(यवधान)... ी भूपेन्दर् यादव: यह समया यहाँ से पैदा हुई िक Article 239AA का Section 4 यह कहता है िक जो सारे िनणर्य ह, वे सारे िनणर्य Lieutenant Governor के नाम पर िलये जायगे, लेिकन जब Rules का formation आया, Act आया, तो उसम एक अन्तर नज़र आया। वह अन्तर यह नज़र आया िक Lieutenant Governor को कब inform िकया जाएगा - decision लेने के बाद या decision लेने से पहले या decision लेने के बाद उसको लागू करने के िलए? 4 Uncorrected/Not for Publication-24.03.2021 आज िदली म यह जो सरकार है, यह क्य नहीं बताती िक बार-बार िनणर्य को Lieutenant Governor से िछपा कर संघीय यवथा का अपमान और लोकतंतर् का अपमान करने काम इन्हने ही िकया है? ...(यवधान)...
