Appeal Decision Site visit made on 10 February 2020 by T J Burnham BA (Hons) MSc MRTPI an Inspector appointed by the Secretary of State Decision date: 4 March 2020

Appeal Ref: APP/W9500/W/19/3238113 Whorlton House Farm, Whorlton Lane, Whorlton, North DL6 3HT • The appeal is made under section 78 of the Town and Country Planning Act 1990 against a refusal to grant approval required under Schedule 2, Part 6, Class A of the Town and Country Planning (General Permitted Development) Order 2015. • The appeal is made by Mr J Martin against the decision of North York Moors National Park Authority. • The application Ref NYM/2019/0062/AGRP, dated 15 November 2018, was refused by notice dated 27 March 2019. • The development proposed is a livestock building and handling area.

Decision

1. The appeal is dismissed.

Procedural Matter

2. The proposal relates to works for the erection of a building within an agricultural unit in excess of 5 hectares. Sub-paragraph 2 of paragraph A.2- Conditions, requires amongst other things, the developer to apply to the local planning authority for a determination as to whether the prior approval of the authority will be required as to the siting, design and external appearance of the building. In this case the evidence does not indicate that there is disagreement in relation to design or external appearance.

Main Issue

3. The main issue therefore is the visual impact of the proposed development on the surrounding area having regard to its siting.

Reasons

4. The site sits within the North York Moors National Park. The building would be relatively large in size measuring approximately 30m in length, 12m in breadth and 3.65m in height, constructed from concrete panels with Yorkshire boarding with a corrugated fibre cement sheet roof. It would be set a significant distance to the north east of and isolated from the existing farm steading, within an open countryside setting.

5. The site is on elevated ground and the building would be clearly visible from some points on the public right of way which runs to the south east of the proposed site. The landscape is largely devoid of any buildings, other than what appear to be very occasional, relatively small and inobtrusive agricultural structures. The proposal would therefore, because of its siting, be intrusive and

dominant when taking into account the prevailing characteristics of the local landscape. For this reason, prior approval should not be granted.

6. Development plan policies may be relevant in prior approval cases but only insofar as they relate to the matters under consideration. In relation to this case, the development plan contains material that is relevant to the planning judgement to be made, and consequently I have taken it into account as a form of evidence in relation to the prior approval matters.

7. The development plan comprises the North York Moors National Park Authority Local Development Framework Core Strategy and Development Policies (2008) (LDFCSDP). Policy 12 relates to proposals for new agricultural buildings. Amongst other requirements it details that their siting shall be physically related to existing buildings associated with the business unless there are exceptional circumstances relating to agricultural necessity for a more isolated location. Amongst other aims, Core Policy A of the LDFCSDP states that priority will be given to conserving and enhancing the landscape of the National Park. Such objectives align with the requirement of the National Planning Policy Framework to afford great weight to conserving and enhancing landscape and scenic beauty in National Parks. The policy background is not therefore supportive of the proposal.

8. Various concerns have been raised by the appellant in relation to the keeping of livestock at the existing building on the steading, including issues relating to surface water flooding and the proximity of residential accommodation not associated with the steading. I do not doubt that these problems exist, however the evidence presented is relatively limited. On the basis of that before me I am not persuaded that there are no means by which any current issues on the steading could not be addressed or that the issues identified would represent circumstances which would justify the proposal in such a remote location in light of the harm that I have identified arising from the siting of the building.

Other Matters

9. Concern has been raised as to the handling of the matter by the Council although the evidence supplied is limited and the process appears to have been handled within the required timescales. The Council has confirmed that concern relating to disturbance to bat foraging habitat if the building was lit at night did not form part of the reason for refusal. Given that the appeal is dismissed there is no reason to consider matters relating to biodiversity further within this decision.

Conclusion

10. For the reasons above, prior approval should not be granted.

Appeal Ref: APP/W9500/D/19/3243220 Little Shortwaite, Leaholm, Whitby YO21 2AA • The appeal is made under section 78 of the Town and Country Planning Act 1990 against a refusal to grant planning permission. • The appeal is made by Mr Charles Davies against the decision of North York Moors National Park. • The application Ref NYM/2019/0640/FL, dated 18 September 2019, was refused by notice dated 29 November 2019. • The development proposed is demolition of existing single storey extension and construction of a two-storey extension.

Decision

1. The appeal is dismissed. Preliminary Issue

2. In the interests of clarity, I have used the description from the Appellant’s appeal form in the banner headline above.

Main Issue

3. The main issue is the effect of the proposed extension on the character and appearance of the existing property and the wider area.

Reasons

4. The appeal property is an attractive stone house with pantile roof. Sitting below the level of the road it is accessed from, but clearly visible from it, being an isolated property set in undulating countryside.

5. The dwelling is located in the north western corner of the appeal site within a restricted garden, enclosed by low stone walls and a post and wire fence to the rear, forming the shared boundary with the field beyond. To the south part of the same site is a stable and wood store.

6. The current property is a simple utilitarian design being linear in plan form, with a narrow span and steep pitched roof, the eastern end of the building being single storey with matching details to the main building.

7. The extension, the subject of this appeal would introduce a significant addition which would change the simple plan form and create a somewhat ungainly addition to the host building.

8. The extension would be visible from both the road and a public footpath which connects to the road opposite the site entrance. Despite the ridge line being set below that of the main house, the depth of the extension and lower pitch of roof for the rear element would create a large and incongruous addition which would dominate the original property.

9. I recognise that the front elevation would only be visible from distant or oblique views and is to a large extent shielded by the stable building to the south. The introduction of the large window opening on the front elevation, however, would draw the eye and make this a prominent feature on this principle elevation.

10. Whilst lowering the ridge and setting the front elevation back from the original are positive steps, they are not enough in themselves to make the extension subservient to the original dwelling.

11. Despite the use of sympathetic materials and being set back from the road and avoidance of overlooking other dwellings, the bulk of the proposal would be prominent and dominate the original dwelling. Whilst reasonably localised in its extent, the effect of the scheme would be to diminish unacceptably the character and appearance of the host dwelling with consequent harm to the character and appearance of the area.

12. The appeal scheme would thereby run contrary to the principles of the North York Moors Core Strategy and Development Policies No. 3 and No. 19 (2008) and the North York Moors Design Guide Part 2, which seek to ensure that new developments preserve or enhance views into and out of sites and the scale, massing, proportion, form, and design features are compatible with the original dwelling or its setting in the landscape.

Other Issues

13. The appellant has referred me to a number of other extensions granted permission in the area. I am, however, not aware of the full circumstances in these cases and in any event, I must consider the appeal scheme on its own merits. The existence of apparently similar development in the locality does not overcome the harm I have identified.

Conclusions

14. For the reasons set out, and having considered all other matters raised, I conclude that the appeal should be dismissed.

Appeal Ref: APP/W9500/W/19/3234103 Land north of Saltergate Car Park, Lockton • The appeal is made under section 78 of the Town and Country Planning Act 1990 against a grant of planning permission subject to conditions. • The appeal is made by Ms Larraine Burgess against the decision of North York Moors National Park. • The application Ref NYM/2018/0834/CU, dated 19 December 2018, was approved on 29 January 2019 and planning permission was granted subject to conditions. • The development permitted is the change of use to siting of a refreshment van. • The condition in dispute is No 1 which states that: The permission hereby granted is valid only for five years from the date of this permission and the use shall be discontinued and the site restored to its former condition before this consent expires. • The reason given for the condition is: To ensure compliance with Sections 91 to 94 of the Town and Country Planning Act 1990 as amended.

Decision

1. The appeal is dismissed. Main Issue

2. The main issue is whether or not it is necessary and reasonable for the development to be granted planning permission for a temporary period.

Reasons

3. The appeal relates to an area of hardstanding immediately adjacent to the Saltergate car park within the North York Moors National Park to be used for the stationing of a refreshments van. The site lies between a field-gate and the public, pay and display car park. The car park, which appears well used by visitors to the area, sits in a relatively high, largely open part of the landscape, with long views across to the Hole of Horcum, which is itself a Site of Special Scientific Interest (SSSI).

4. In assessing this appeal, I acknowledge the argument made by the appellants, that their use is a long-standing one, and that the current permission is no different than that previously permitted, but merely more specific.

5. However, I must take into account that at the time of this application, the appellants’ previous temporary permission appears to have been expired for some two years. In that time, permission was granted for another refreshments van in the same car park, albeit in a different location. I note that permission for that other refreshments van was also granted for a temporary period, although the reasons for, and suitability of that decision and condition are neither before me to consider nor appropriate for me to comment on further.

6. There has therefore been a material change in the circumstances and context to this permission since previous temporary permissions were granted. I consider that in light of that second permission, it is necessary and reasonable for this permission to be temporary. This will allow the effects of the permission, particularly in terms of potential highway safety issues and any conflict between pedestrians and vehicles, now in combination with another similar permission, to be assessed.

7. This would, in my view, conform with the requirements of Core Policy A and Development Policy 14 of the North York Moors Core Strategy and Development Plan Document 2008, which seek, amongst other things, to ensure that development conserves and enhances the special qualities of the National Park, provides satisfactorily accessible opportunities to understand, be aware of and enjoy those qualities, and not generate increased levels of activity which would detract from the experience of visitors.

8. I also consider that this is consistent with the guidance in the Planning Practice Guidance (the PPG) and the National Planning Policy Framework on conditions and temporary permissions, as well as the great weight which the Framework gives to conserving and enhancing landscape and scenic beauty in National Parks.

Other Matters

9. The Council have indicated in the Questionnaire that the appeal site is in or adjacent to an SSSI or other internationally designated site. I have had regard to the nature of the site, the proposal and its spatial relationship to the designated sites, the history of uses on the site and the lack of objection from Natural . I consider that the proposal would not be likely to have a significant effect on the environment. I also do not consider that the proposal is likely to have an adverse effect on the SSSI or other internationally designated sites either individually or in combination with any other effects.

Conclusion

10. For the reasons given above I conclude that the condition meets the tests in the PPG, and it is necessary and reasonable for the development to be granted planning permission for a temporary period. The appeal should therefore be dismissed. S Dean

The rooflight was a like for like replacement of one that already existed which was installed prior to the Article 4 Direction and therefore is permitted. The tiles were not harmful. 16255 Possible unauthorised siting of Complaint received January 2020 that caravans in field- High Straggleton caravans were being stored in a field (field Farm, Newholm, Whitby. 362) to the west of High Straggleton Farm, Sandsend. Caravans were being over wintered in an elevated position, visible from Cliff Lane and main road between Whitby and Sandsend. Long planning history associated with the site and a recent enforcement notice in relation to alleged unauthorised siting of touring caravans at the site was quashed at appeal in 2016 (Enf ref- 3/2015).

The 1961 permission states ‘if the caravans are left in position at any other time (i.e. outside the period 1 March to 31 October- Winter) they must not be used for human habitation during such time’. Implications were that touring caravans can remain on site all year round as long as there is no human habitation outside the specified months. 16185 Possible unauthorised temporary Complaint made in December 2019, site parking of touring caravan. Wrench visited and caravan had a notice in the Green, Hackness. window saying that it had not been abandoned. Case was passed onto the highways department to deal with, and when site was revisited in March 2020 the caravan had been moved. 16161 Unauthorised shed/ hairdressers. Complaint made on 02/12/2019, site visited Thornton Le Dale 11/12/2019 and again on both 05/02/20 and 17/03/2020. Development measured to be 2.54m tall to base, or 2.87m to ground level, and therefore marginally outside the size for permitted development under Class E of GPDO (2.5m). Owner consulted and told the officer that the shed would be used as a hairdressers (2 days a week, by appointment only). Pond is adjacent to an existing pond which was created without planning permission over 4 years ago (so now exempt from the need for an application). 15620 Alleged unauthorised erection and Complaint received June 2019 regarding occupation of fishermens sheds. increased levels of holiday activity arising Port Mulgrave from holiday chalets in a wooded area close to the sea at Port Mulgrave. Site visited June 2019 and a number of huts found to have been in place for more than 10 years. The sheds have been adapted over the years and there was evidence of some on-going repairs. There was no evidence of any permanent residence but evidence of habitation on a temporary basis which is likely to be consistent with their previous uses. The aerial photographs from 2009 and 2014/2015 show the presence of the huts and sheds in the position under the cliff face. It was not considered that legal action would be required in this case as the development/uses are immune from enforcement. 12864 Addition of conservatory to static Enquiry received November 2016 relating to caravan and culverting of a conservatory to the rear of static caravan watercourse, Birk Brow Service and alleged culverting of a watercourse. Station, Charltons, Saltburn-By-The- The Authority had granted permission in Sea. 2015 for a certificate of proposed lawfulness to confirm the siting of a caravan for ancillary residential use within the curtilage of an existing dwelling would not amount to material change of use, so no development would take place. Regarding culverting, complainant advised that work would likely have required planning permission but may not be expedient to pursue.

The conservatory on the caravan is not deemed to be harmful. No further action. 11940 Rubble/Aggregate piled up next to Site observed as part of the assessment of Listed structure, Hackness Pinfold, unauthorised siting of shepherd’s hut, 2016. Broxa Lane, Hackness. Landowner stated that temporary siting of a fairground slide was taking place in the listed sheep pound. Enforcement Officer requested this to be removed and landowner agreed. Site revisited March 2020 and slide found to have been removed.
