Local government in is Provision and Maintenance of Community established under the Local Government Act Facilities, Infrastructure and Assets 1995, and is the third sphere of government. Local government is responsible for delivering Community Buildings a wide range of economic, human, recrea onal Playgrounds and property services as well as developing Bindoon Library and Little Free Libraries and maintaining essen al community infrastructure. The maintenance of our Parks and Gardens con nues to be performed at a good standard. We have also con nued with a larger road program to try and increase the standards of our roads. This year we replaced Flat Rocks Bridge, u lised shire and Blackspot funding to fi x blackspots on Muchea East Road, Chi ering Road, Wandena Road and Mooliabeenee Road. Large works were performed on Muchea East Road in part thanks to Regional Road Group Funding. We also built a large sec on of footpath on Archibald Street in Muchea with the rest to follow next year.

COMPLIANCE WITH THE DISABILITY SERVICES ACT 1999, SECTION 29(2) The ‘dra ’ Disability Access and Inclusion Plan 2018-2022 was presented to Council in March 2018 for approval to be adver sed. Public comment period opened end of March 2018 and closed in May 2018. The feedback was presented back to Council in July 2018, where it was adopted by Council.

RECORD KEEPING The State Records Act 2000 requires the Shire to have an approved Record Keeping Plan which details the way the Shire keeps its records. The Shire’s Record Keeping Plan was reviewed in January 2014 and is scheduled for review during 2019.

FREEDOM OF INFORMATION Access to informa on/documents may be granted to members of the community under the Freedom of Information Act 1992. An Informa on Statement is available along with applica on forms on the Shire’s website. The statement is a guide on the Freedom of Informa on (FOI) process and also lists the types of documents available outside of FOI. During 2018-2019, the Shire received two Freedom of Informa on applica ons. One applica on was completed within the me-frame prescribed by legisla on, and one was withdrawn by the applicant. The two applica ons that were carried over from 2017-2018 were completed. Freedom of Informa on legisla on provides for extensions of me beyond the 45 day me-frame. Extensions of me must be agreed by both par es. There were no such applica ons were completed in accordance with agreed extended me-frames.

NATIONAL COMPETITION POLICY In 1995 the Council of Australian Governments entered into a number of agreements, collec vely known as the Na onal Compe on Policy. Local Government is aff ected mainly where it operates signifi cant business ac vi es which compete, or could compete, with private business sector business. Local Government will also be aff ected where local laws unnecessarily aff ect compe on. The Shire is required to comply with certain policies contained with the Na onal Compe on Policy Statement, and report on the progress in connec on with the Na onal Compe ve Neutrality Principles and review of Local Laws. During the fi nancial year the Shire met its obliga ons under the Na onal Compe on Policy. The Shire con nues to monitor Council policies and local laws for an -compe ve prac ces. The Shire does not operate signifi cant business ac vi es which compete or could compete with private business sector business.

COMPETITIVE NEUTRALITY Local Governments are required to apply the principle of compe ve neutrality to all business ac vi es genera ng user- pays income in excess of $200,000. The principle of compe ve neutrality is that government businesses should not enjoy a compe ve advantage, or disadvantage, simply as a result of their public sector ownership. Annual reports must show that a public benefi t test has been conducted for all signifi cant business ac vi es to determine if compe ve neutrality is in the public interest. The Shire does not have business ac vi es which generate user-pays income in excess of $200,000.

REGISTER OF POLICIES In accordance with the Local Government Act 1995, Sec on 2.7(2) Council is to determine the Shire’s policies. The Shire’s Register of Policies were reviewed internally. This document is available on the Shire’s website (www.chi ering. wa.gov.au/documents/publica ons).

DELEGATION AUTHORITY REGISTER In accordance with the Local Government Act 1995, Sec on 5.46 the Chief Execu ve Offi cer is to keep a register of delega ons. This register is to be reviewed every fi nancial year. The Shire’s Delegated Authority Register was reviewed by Council in January 2019 and is available on the Shire’s website (www.chi ering.wa.gov.au/documents/publica ons).

COMPLIANCE WITH THE PUBLIC INTEREST DISCLOSURE ACT 2009 There were no Public Interest Disclosures reported to the Shire of Chi ering during the repor ng period.

COMPLIANCE WITH THE LOCAL GOVERNMENT (RULES OF CONDUCT) REGULATIONS 2007 There were two Rules of Conduct breaches received where one Elected Member was found to be in breach of the Regula ons.

LOCAL LAWS The Local Government Act 1995 requires all exis ng Local Laws to be reviewed every eight years. As part of this process the inten on to review Local Laws is adver sed in the media giving residents and ratepayers the opportunity to comment on any proposed changes, addi ons or dele ons to the Shire’s Local Laws. There were no local laws reviewed or implemented during 2018-2019.

PAYMENT TO EMPLOYEES The Local Government (Administration) Regulation 19B requires the annual report to contain details of the number of employees of the local government en tled to an annual salary of $100,000 or more in bands of $10,000 for each such band over $100,000.
