Faulder said he had requested specific evidence from the prosecution in order to more effectively prepare a defense and that the District Attorney’s Office had not responded. “This is a medical marijuana case and the evidence I’ve requested goes directly to a motion to suppress and to providing an affirmative defense at the prelim,” Faulder said. Faulder said California law allows him to make a motion to suppress and provide an affirmative defense at the preliminary hearing. He said he cannot do that without the evidence he has requested. Deputy District Attorney Scott McMenomy said he had responded, object- ing to Faulder’s request for evidence. McMenomy said he is not required to turn over the requested evidence until Hamburg enters a plea. Mendocino County Superior Court Judge Ronald Brown scheduled a hearing for 1:30 p.m. today to discuss what evi- dence Faulder wants from the prosecution. Hamburg, a local medical marijuana activist, has been charged with marijuana possession in connection with the Oct. 25 service of a search warrant on her Boonville Road home by the Mendocino County Sheriff’s Office.
