Western Division Conference & Deal Making ICSC 20 WESTERN13 DIVISION CONFERENCE & DEAL MAKING TITLE Lights... Camera... Action! LOCATION San Diego Convention Center - San Diego, CA DATE September 18 – 20, 2013 SCENE DIRECTOR DIRECTORY ICSC 2013 Western Division Conference & Deal Making Lights ... Camera Action! ... Lights… Camera… Action! I would like to welcome you back to San Diego for the 2013 Western Division Conference & Deal Making. As an industry, we have weathered the challenges of the last several years and have made great strides to get the “lights” back on. I think the call for “action” is louder than it has been for years. No matter what role you play in our ever-changing industry, I think best practices demand continuously refreshed information, knowledge, judgment and most importantly, strong relationships. In a world that is often focused on “digital,” I believe our industry is still primarily “analog” in that it still has a very human element to it. We are all vitally engaged in our business and yet, at the same time, are completely aware of our interdependence with others in our industry. That is why we gather in person here and at other ICSC meetings. This year, we are re-issuing the Western Division Conference with a special “Director’s Cut” – a panel of trustees and industry icons who will provide top-level retail, development and capital markets insights; a “Deal or No Deal with P3?” session which will include a panel and guest speaker to provide valuable insight on how to get development projects off the shelf and in the ground; a Next Generation session as well as four Special Industry Groups (SIGs) on Wednesday afternoon; the convenience of having the General Sessions on the same floor as the Deal Making; numerous networking opportunities at various social functions; and of course, the opportunity to meet with key industry leaders and make those deals! I would like to thank our Conference co-chairs, Ken Gatt and Ken Hira – and all of the dozens of volunteers who have worked to make this conference a hit. I hope you enjoy the conference and take advantage of a fresh script and new opportunities at this must-attend event in San Diego. BRUCE D. Travis insists he's a sexpert, but if there's a degree on his wall, I haven't seen it. Travis: I‘m your middlest brother, Travis McElroy. Griffin: [over-enunciating] I‘m your sweet baby brother, and 30 under 30 media luminary, Griffin McElroy. Travis: [sighs] I‘m so… I can‘t… I can't contain myself anymore hearing that, um, um, uh, amazing enunciation. Justin: Crisp. Travis: And that diction. Griffin: Had the Waterpik for a little over two weeks or so, sitting in the Amazon box. And I looked at it every day and said, ―Not yet. Not yet. Not yet.‖ But I had about ten minutes to kill just before recording, and I got in there, and I just super soaked the heck out of it. Justin: I uh, I had a lot of trepidation the first time I used my Waterpik.

  • The BLURRED LINES ARE REALLY NOT SO BLURRY
The BLURRED LINES ARE REALLY NOT SO BLURRY. By Bill Pere We've all heard by now that a jury decided that "Blurred Lines" by Alan Thicke and Pharrell Williams was an infringement ion the song "Got to Give It Up" by Marvin Gaye, and awarded 7.3 million dollars in damages. You've probably also heard lots of voices on either side saying that the verdict was right or wrong. There really is no issue here. The verdict wrong because the jury untrained in music law, received no less than 47 pages of instructions from the judge, ( see them here: http://www.scribd.com/doc/258437531/Pharrell-Williams-Robin-Thicke-v- Gaye-jury-instructions-Blurred-Lines-trial-pdf#scribd) which were in many cases unclear, complicated or contradictory. So it is no surprise that the jury disregarded their instructions and the laws that applied to the case, and it did not help that they reportedly did not "like" the behavior of defendants. But legally, this was pretty straightforward. Yes, the two songs sound extremely similar. No question about that. However, they were supposed sound similar. And making them very similar in the way that it was done here does NOT constitute any type of copyright infringement. Period. There are two different kinds of copyrights that belong to a song. The first is actual SONG copyright, which is just melody + lyric (the 'c' copyright). That is the legal definition of a song, and that is all that Marvin Gaye claimed when he submitted his lead sheet for registration. All the other parts associated with a song, i.e.
