Local CIL Presentation to Local Spending Board Members Date – 16 August 2021 Officer – Joanna Ghazaleh Aims & Objectives ▪ What is CIL? ▪ What is Local CIL? ▪ Agreed Governance ▪ Apportionment ▪ Consultation Requirements ▪ Bidding Process ▪ CIL ‘Pots’ & Projections ▪ Appointing a Chair – Strategic CIL Task Group ▪ Going Forward 2 : 02 September 2021 What is CIL? ▪ The Community Infrastructure Levy (CIL) is a planning charge, introduced by the Planning Act 2008, as a tool for local authorities in England and Wales to help deliver infrastructure to support the development of their area. ▪ Introduced CIL in Spelthorne in 2015. ▪ Levy on all new residential development, charged on the additional floorspace created at a prescribed rate per square metre. ▪ Apportionment as follows – ▪ 80% spent on appropriate strategic infrastructure ▪ 15% must be spent in the local community where development has taken place ▪ 5% towards administrative costs Local CIL ▪ As required by the CIL Regulations, 15% of CIL collected is to be allocated to the local community where development has taken place. ▪ Local CIL is to be applied as follows: • towards the provision, improvement, replacement, operation or maintenance of infrastructure; or • towards anything else that is concerned with addressing the demands that development places on an area ▪ The levy can be used to increase the capacity of existing infrastructure or to repair failing existing infrastructure, if that is necessary to support development Agreed Local CIL Governance ▪ In order to allocate CIL based on development within the different areas, 15% will be apportioned across the set areas based on the amount of development that has taken place. ▪ Calculation based on the net increase in dwellings on an annual basis. A CIL amount per unit will be set each year based on CIL receipts collected. ▪ The amount available to each Zone will be based on payments received, not payments demanded. ▪ Where no local projects have been identified, the Local Spending Board can agree to nominate a sum of money out of its funds to be spent on a specific strategic project, should that bid be agreed by the CIL Task Group. Local CIL Areas ▪ Local CIL will be apportioned in line with the designated Local Plan Settlement areas. These areas are identified as follows – ▪ Ashford ▪ Shepperton, Laleham & Charlton Village ▪ Staines ▪ Stanwell & Stanwell Moor ▪ Sunbury & Upper Halliford ▪ The Wards within each of the Settlement areas are as follows – ▪ Ashford - Ashford Common, Ashford East, Ashford Town ▪ Shepperton, Laleham & Charlton Village - Laleham & Shepperton Green, Shepperton Town ▪ Staines - Staines Ward, Staines South, Riverside & Laleham ▪ Stanwell & Stanwell Moor - Stanwell North, Ashford North & Stanwell South ▪ Sunbury & Upper Halliford - Sunbury Common, Sunbury East, Halliford & Sunbury West Local CIL Spending Board Areas Local CIL Consultation Requirements ▪ The CIL Regulations state ‘Consultation should be at the neighbourhood level. It should be proportionate to the level of levy receipts and the scale of the proposed development to which the neighbourhood funding relates.’ ▪ Recommended that Ward representatives use current consultation channels available to them in order to meet this criteria – using existing links to their communities, such as Member/Resident Forums. ▪ The Council is required to set out clearly and transparently their approach to engaging with neighbourhoods using their regular communication tools for example, website, newsletters, etc. 8 : 02 September 2021 The Bidding Process ▪ Bidding rounds will take place once per annum, with an estimated time frame of August – March for application submissions. ▪ The application form, guidance and criteria will be available on the Spelthorne website. Projects must meet the CIL requirements and only complete and detailed applications will be valid. ▪ It is recommended there is an officer level reviewing process in order to demonstrate due diligence. Valid and deliverable bids will be put forward to the decision-making body. ▪ The proposed deadline for the initial application round will be the 31st March 2022, at which point an initial Officer review will be conducted ahead of Member consideration. ▪ We envisage final decisions made by Summer 2022. Future Projections ▪ Estimated to received £1m per annum in CIL. ▪ Conservative figure, likely to increase once Local Plan allocations have been confirmed, and we strive to meet our housing target. ▪ Based on a £1m per annum collection rate this would equate to £150,000 in Local CIL, which is to be apportioned over the 5 settlement areas. ▪ Although initial figures are substantial this reflects the accrual of Local CIL over 5/6 years. ▪ Future annual sums unlikely to be substantial, however money must be allocated to local projects in a fair and transparent manner. 12 : 02 September 2021 Going Forward ▪ Applications for Local CIL to now be promoted through ▪ Spelthorne Website ▪ Existing Communication Channels – such as Member/Resident Forums ▪ Notice Boards / Publications ▪ Each Local Board to appoint a Chairperson to sit on CIL Task Group (Strategic Spend) ▪ Meetings to be arranged for Spring 2022 once Application round has closed. 13 : 02 September 2021 Any Questions?.
