seeking the lawsuit’s dis- missal, county attorney’s say he didn’t meet requirements for the job because he has no high school diploma or com- mercial driver’s license. According to the county, Moore was fired on July 16, 2010, for “his excessive unex- cused absenteeism and abuse of sick leave.” “We had a legitimate non- discriminatory basis for termi- nating him. There was still a period of time where it was a hostile work environment,” Shillinger said. A settlement was mediated Monday before Tuesday’s County Commission approval. The case was sched- uled for trial Aug. 8 before U.S. District Court Judge James King in Key West. Shillinger said that’s why the settlement couldn’t wait until the Aug. 17 commission meeting. “We need to get it ratified so the judge doesn’t spend any time getting ready for trial. The judge won’t take it off the docket unless there’s a signed agreement,” he said. Moore will receive $98,500 from the county. Shillinger said it behooved the county to settle the case. “We were going to spend money one way or the other, defending the case or paying him,” he said, noting the county has a $100,000 insur- ance policy against the cost of defending lawsuits. The county already spent $50,000 defending the Moore case, which Shillinger said would be reimbursed. So the settlement will cost the coun- ty $48,500.
