MEMORANDUM To: All Parties–Northern Pass Docket–NHSEC No. 2015-06 From: Mike Iacopino, Counsel, Site Evaluation Committee Date: November 10, 2017 Re: Exhibit List–Close of Record ********************************************* I have attached an unofficial exhibit list. I am sending this list to all the parties in the Northern Pass docket. This list represents a combination of the exhibits from various sources. The parties submitted most exhibits contained in this list after the first or second prehearing conference. Some exhibits on the list were submitted just before or after the testimony of witnesses. Sometimes, the exhibits were used during the cross exam or redirect examination of a witness. And some exhibits were passed out during the course of the proceeding. My staff compiled the attached unofficial exhibit list during the proceedings. The last part of the adjudicative proceeding, prior to deliberations, will be to close the record. The presiding officer will identify all exhibits considered part of the official record of the proceeding. The Subcommittee will consider only the official record of the proceeding during the deliberative phase. The purpose of sending this list is first to make sure that it is complete. At certain points during the proceeding, the parties were exchanging exhibits through the Sharefile discovery site. The Subcommittee does not have access to that site. If exhibits were exchanged on that site without sending a copy to Pam Monroe or myself it is possible that they did not make it onto this list. Each party should make sure that I have included all of their exhibits on this unofficial list. Second, please make sure that the exhibit designation number on the list is the same you have for each of your exhibits. Sometimes there is error in the assignment of exhibit designation numbers. During deliberations, the Subcommittee members should be all referencing the same exhibit by the same number. I would like to resolve those issues early on. Less important but still helpful, if you know that any of your exhibits duplicate the exhibits of another party please let me know. Review the list. If there are objections to any exhibits or motions to strike any exhibits or any evidentiary issue with the submission of exhibits we will deal with those issues as soon as possible after the testimony of the last witness. Once those issues are resolved the record will be closed. See N.H. CODE ADMIN. RULES, Site 202.26 (set out on next page.) Once the record is closed, the briefing schedule will commence and we will enter the deliberative phase of the proceedings. /mji Site 202.26 Closing the Record. (a) At the conclusion of a hearing, the record shall be closed and no other evidence, testimony, exhibits, or arguments shall be allowed into the record, except as allowed by (b) below. (b) Prior to the conclusion of the hearing, a party may request that the record be left open to accommodate the filing of evidence, exhibits or arguments not available at the hearing. (c) If the other parties in the proceeding do not object, or if the presiding officer determines that such evidence, exhibits or arguments are necessary for a full consideration of the issues raised in the proceeding, the presiding officer shall specify a date no later than 30 days after the conclusion of the hearing for the record to remain open to receive the evidence, exhibits or arguments. (d) If any other party in the proceeding requests time to respond to the evidence, exhibits or arguments submitted, the presiding officer shall specify a date no later than 30 days following the submission for the filing of a response. (e) If any other party in the proceeding requests the opportunity to cross-examine on the additional evidence, exhibits or arguments submitted, the presiding officer shall specify a date no later than 30 days following the submission for a hearing at which cross-examination on the additional evidence, exhibits or arguments submitted shall be allowed. (a) A party may request by written motion that the record in any proceeding be re-opened to receive relevant, material and non-duplicative testimony, evidence or argument. (b) If the presiding officer determines that additional testimony, evidence or argument is necessary for a full consideration of the issues presented in the proceeding, the record shall be reopened to accept the offered testimony, evidence or argument. (c) The presiding officer shall specify a date no later than 30 days from the date of receiving the additional testimony, evidence or argument by which other parties shall respond to or rebut the newly submitted testimony, evidence or argument.
