FOREWORD 1. The theme of the 1st European Conference on Nationality, organised at the headquarters of the Council of Europe in Strasbourg on 18 and 19 October 1999, was “Trends and Developments in National and International Law on Nationality”. 2. The Council of Europe has been dealing with issues relating to nationality for over thirty years. Indeed, since 1963 both the Committee of Ministers and the Parliamentary Assembly have adopted numerous international instruments in this field (e.g. conventions, resolutions and recommendations). It is with the adoption on 14 May 1997 of the European Convention on Nationality (ETS 166) that the Council of Europe has made a fundamental contribution to the development of international law in this area. This Convention, which was opened for signature on 6 November 1997, consolidates, in a single text, the important issues relating to nationality. 3. The aim of the Conference, which was open to all persons with a professional interest in nationality matters, was to assist States to work together to find peaceful solutions in the field of nationality and to promote stability in the European States, as well as to consider important nationality issues for both individuals and States. 4. After the opening speeches by Mrs Cornelia SONNTAG-WOLGAST, Secretary of State in the German Ministry of Interior and Mr Hans Christian KRÜGER, Deputy Secretary General of the Council of Europe, debates took place for two days on the following subjects: - The European Convention on Nationality: is a European Code on Nationality possible? After the presentation and debates on the above seven reports, a session was devoted to the proposals for further follow-up action by the Council of Europe and, in particular, by its Committee of experts on nationality (CJ-NA), a subordinate committee to the European Committee on Legal Co-operation (CDCJ). These proposals were made by Mrs Margaret KILLERBY, Head of the Division of Private Law, Directorate General for Legal Affairs (DG I) of the Council of Europe. And adopted by the conference, finally, the main conclusions of the Conference were presented by the General Rapporteur of the Conference, Mr Roland SCHÄRER and adopted by the Conference. These conclusions referred in particular to the various interventions which were made during the Conference, highlighting the main ideas and suggestions expressed by the different speakers. 6. The closing speeches of the Conference were made by Mrs Lena NYBERG, Secretary of State in the Swedish Ministry of Culture and Mr Guy DE VEL, Director General of Legal Affairs, Council of Europe. 7. This text contains in particular the opening and closing speeches, the reports and papers presented by the Rapporteurs and the participants in the Conference, the proposals adopted by the Conference and the main conclusions of the Conference by the General Rapporteur. 7 OPENING SPEECHES 8 9 OPENING SPEECH By Hans Christian KRÜGER Deputy Secretary General of the Council of Europe Mrs State Secretary, Ambassador, Ladies and Gentlemen, It is a great honour for me to welcome you to the Council of Europe and to open this Conference on nationality issues. Nationality – the legal bond between the individual and the State – is an essential factor at all levels of human life. Each of us, as individuals, would be deprived of an important part of our most fundamental rights if we did not have a nationality. Nationality is also an integral part of the identity of the State. But just as the identities of States are very different, so are the ways in which States have chosen to determine their nationals. If States were isolated from each other and if they co-existed in a static international community with little interaction between their populations, the determination of nationality might be an easy task of theoretical relevance only. But this is not the case. In our world there is increasing interaction between States, there are State successions and other kinds of change of sovereignty, there is growing movement of persons and there are

    The Effect of Birthright Citizenship on Parental Integration Outcomes∗ Ciro Avitabile,† Irma Clots-Figueras,‡ Paolo Masella§ Preliminary Please do not circulate without permission September 2009 Abstract The large increase in migration flows and recent ethnic riots in several coun- tries have stimulated a lively debate on how to regulate the social status of newcomers and their descendants and promote their integration with the local community. Citizenship laws vary over time and across countries. However, there is no evidence on the effect of such laws on the level of integration of non natives and their children.     Program for the Study of Germany and Europe Working Paper Series No. 00.5 The Legal Construction of Membership: Nationality ∗ Law in Germany and the United States by Mathias Bös Institute of Sociology University of Heidelberg D-69117 Heidelberg Abstract The argument of this paper is that several empirical puzzles in the citizenship literature are rooted in the failure to distinguish between the mainly legal concept of nationality and the broader, poli- tical concept of citizenship. Using this distinction, the paper analysis the evolution of German and American nationality laws over the last 200 years. The historical development of both legal structures shows strong communalities. With the emergence of the modern system of nation states, the attribution of nationality to newborn children is ascribed either via the principle of descent or place of birth. With regard to the naturalization of adults, there is an increasing ethni- zation of law, which means that the increasing complexities of naturalization criteria are more and more structured along ethnic ideas. It argues that only by abandoning its long-held prejudice against dual citizenship can Germany increase the naturalization rate of all foreigners in its country, not just those from Turkey. Introduction On October 31, 1961, the Federal Republic of Germany and the Republic of Turkey signed an agreement to promote the expedited hiring of Turkish citizens for jobs in Germany.1 The reason for this: In the late 1950s and early 1960s, the German economy was flourishing—the “economic miracle” (Wirtschaftswunder)—and experiencing a labor shortage. One of the solutions was a series of agreements with countries in North Africa, Southeast Europe and the Balkans for the provision of cheap labor, much of it unskilled and all of it thought by Germany to be temporary in nature—therefore, the euphemism “guest workers” (Gastarbeiter).2 Fifty-seven years later, Turks are the largest ethnic minority group in Germany, numbering nearly three million residents; only approximately 246,000 of them hold German citizenship.3 This Article focuses on the reasons for this low figure, the steps taken by both German and Turkish governments to deal with this binational population, and the problems that have arisen.

    INTRODUCTION Assessing the Consequences of the 1999 German Citizenship Act Triadafilos Triadafilopoulos Political Science, University of Toronto This special issue of German Politics and Society offers a retrospective look at the German Citizenship Act (Staatsangehörigkeitsgesetz, StAG), which passed in 1999 and came into force in 2000.1 The law was and continues to be under- stood by many academics, policymakers, and lay commentators as consti- tuting a “paradigm shift” in German citizenship policy and, by extension, prevailing conceptions of German nationhood. The introduction of the law of territory (jus soli), in particular, was greeted as a welcome acknowledge- ment of Germany’s de facto status as a modern immigration country. Chil- dren born and raised in Germany would no longer be rendered permanent foreigners as a consequence of the dominance of the law of descent (jus san- guinis) in the Reichs- und Staatsangehörigkeitsgesetz (RuStAG), 1913. Proponents assumed that the reduction of the residency requirement for naturalization would also allow greater numbers of long settled immigrants to assume the rights and privileges of German nationality. Just as importantly, Germany would join the European mainstream as regarded citizenship policy. The stigma associated with its traditionally ethnic conception of nationhood would give way to a more positive, civic identity. The passage of more than a decade since the law’s introduction has enabled the contributors to this special issue to test these assumptions. How novel was the 1999 reform? Did it truly mark a shift in paradigms? Has it brought Germany into the European mainstream as regards citizen- ship policy? How well has it functioned as a means of integrating immi- grants? Has it helped shape a more welcoming political culture, in which migrants are provided the opportunity to truly belong to Germany as Ger- mans?
