Right to Work (Immigration Act 2016)

You will need to produce ALL the documents requested from 1 of the 10 sections in Table A or 1 of the 6 sections in Table B. It is your responsibility to ensure you have provided the correct documentation from the categories below. In some cases we will ask the to carry out further checks which will delay the application process. We will not issue or renew any licences until the Immigration check has been cleared. Information correct as of 30 April 2021.The list of documents is based on those prescribed to show evidence of a right to work.

Proof of your right-to-work after 1 July 2021. Following , you will need to prove that you have a right-to-work in the UK, even if you have provided these documents before.

List A: No restrictions on right to work in the UK. 1. A passport showing the holder is a British citizen or a citizen of the (UK) and ( and Dhekelia, , , British Antarctic Territory, British Indian Ocean Territory, British Virgin , , , , , , , , Ascension , South and the South Sandwich Islands, ) having the right of abode in the UK. 2. A current Biometric Immigration Document (Biometric Residence Permit) issued by the Home Office to the holder indicating that the person named is allowed to stay indefinitely in the UK, or has no time limit on their stay in the UK. 3. A current passport endorsed to show that the holder is exempt from immigration control, is allowed to stay indefinitely in the UK, has the right of abode in the UK, or has no time limit on their stay in the UK. 4. A current immigration Status Document issued by the Home Office to the holder with an endorsement indicating that the named person is allowed to stay indefinitely in the UK or has no time limit on their stay in the UK, together with an official document giving the person’s permanent National Insurance number (National Insurance card) and their name issued by a Government agency or a previous employer (P45 or P60). 5. A full birth or adoption certificate issued in the UK, which includes the name(s) of at least one of the holder’s parents or adoptive parents, together with a) an official document giving the person’s permanent National Insurance number (National Insurance card) and b) their name issued by a Government agency or a previous employer (P45 or P60). (a and b can be one document) 6. A birth or adoption certificate issued in the Channel Islands (, , , Herm, , Jethou, Brecqhou [Brechou], the or , together with, an official document giving the person’s permanent National Insurance number (National Insurance card) and their name issued by a Government agency or a previous employer (P45 or P60). 7. A certificate of registration or naturalisation as a British citizen, together with an official document giving the person’s permanent National Insurance number (National Insurance card) and their name issued by a Government agency or a previous employer (P45 or P60).

List B: Restrictions on right to work in the UK. We will issue the licence (subject to statutory limitations) up to the expiry date of the permission to work. We will need to check the immigration status each time you apply to renew or extend your licence. 1. A current Biometric Immigration Document (Biometric Residence Permit) issued by the Home Office to the holder which indicates that the named person can currently stay in the UK and is allowed to do the work in question together with (Tier 1 – own business - official Registration document from Companies House https://www.gov.uk/government/organisations/companies-house Please bring an official document showing your registration or if self-employed - registration document from HM Revenue and Customs (HMRC). A current Immigration Status Document containing a photograph issued by the Home Office to the holder with a valid endorsement indicating that the named person may stay in the UK, and is allowed to do the type of work in question, together with an official document giving the person’s permanent National Insurance number and their name issued by a Government agency or a previous employer together with (Tier 1 – own business - official Registration document from Companies House https://www.gov.uk/government/organisations/companies-house Please bring an official document showing your registration or if self-employed - registration document from HM Revenue and Customs (HMRC). An Application Registration Card issued by the Home Office stating that the holder is permitted to take the employment in question, together with a Positive Verification Notice from the Home Office Employer Checking Service. 6. A Positive Verification Notice issued by the Home Office Employer Checking Service to the employer or prospective employer, which indicates that the named person may stay in the UK and is permitted to do the work in question.
