Dear Mr. Petalas:

Pursuant to 11 CFR § 111.4,1 am writing to make a complaint on the unlawful campaign activities of Kinzler for Congress and Illinois Families First. Based on the clear facts in this matter, I request the Federal Election Commission ("FEC" or "the Commission") undertake an immediate investigation and enforcement action to address serious violations of the Federal Election Campaign Act ("FECA") and FEC regiilations.

Part 1; A Pattern of Serious Illegal Acts by Illinois Families First AdTransciipt#! Beginning on March 3,2016, the Super PAC Illinois Families First ("IFF")(Committee Ad Audio Fiie#l ID: C00609859) began airing radio advertisements advocating the defeat of Congressman Peter Roskam and the election of candidate Jay Kinzler on at least three Chicagoland radio networks, including WLS-AM, WIND-AM, and WYYL-AM, which together have up to 100,000 listeners per day.^ This independent expenditure was reported in a 24 Hour Report filed with the Commission on February 25,2016.

In the attached transcripts, audio files, and supporting materials, you will see that IFF's first advertisement included numerous false, misleading, and defamatory statements, and further, contained the following disclaimer, which fails to meet the requirements of 11 CFR 110.11:

Email with WLS Upon learning of these deficiencies five days after the ads began to air, Roskam for Email with Congress wrote to the stations on March 8,2016, informing them that the ad contained WIND/WYYL false, misleading, and defamatory statements and failed to comply with the FECA and FEC regulations. On March 9,2016, the stations concurred and removed the ad from circulation.

Ad Transcript #2 On March 10,2016, IFF began airing a revised ad, including numerous new false, Ad Audio File #2 misleading, and defamatory statements and containing a disclaimer again failing to meet the requirements of 11 CFR 110.11:

Ad Transcript Hi Later that day, IFF began airing a yet again revised advertisement, with the same false, Ad Audio File #3 misleading, and defamatory script, while containing a modified but still non-compliant disclaimer stating:

"Paidfor by Illinois Families First, a federal political committee, and not authorized by or coordinated with any candidate or candidate's committee. 414 N. Orleans Plaza, Chicago, IL 60654. " [fails to meet the responsibility requirement. See 11 CFR 110.11(c)(4)(i)]

For yet a third time, IFF sponsored ads contain a disclaimer that fails to satisfy the plain language requirements of 11 CFR 110.11.

Emails to On March 12,2016, Roskam for Congress again wrote to the stations inforrning them of Stations rc; Ad the ad's false and misleading statements and failure to comply with the FECA and FEC #3 regulations. After receiving no response to repeat communications, Roskam for Congress reiterated its takedown demand through counsel. On March 13,2016, WLS responded indicating that they had in fact accepted Roskam for Congress' complaints as valid and the station had taken down the ad. Despite repeated communications to WIND and WYYL on March 12th and 13*'', however, IFF's ads continue to broadcast on those stations as of the writing of this submission.

(Note: Separately, the National Association of Stock Car Auto Racing ("NASCAR") demanded that the candidate and stations cease and desist the infringement of their

Page 2 of7 trademark "NASCAR" by using it in a defamatory and inaccurate manner without permission.)

IFF Statement of These repeated egregious violations demonstrate an ongoing pattern of deception, Organization; defamation, and unlawful behavior by sponsor IFF, depriving the public the right to know Pre-Primary key information about the ads' sponsor and widely publicly disseminating demonstrably Report; 24 Hour Report false and misleading statements about Congressman Roskam's voting record and policy positions. Furthermore, with the ads having already reached hundreds of thousands of listeners, and with only two days remaining until the March IS, 2016 federal primary election, these advertisements appear designed to unlawfully influence the outcome of the election at the last minute and without the chance for timely intervention or enforcement action. Additional evidence of this calculated attempt to evade enforcement can be seen in the fact that IFF filed a Statement of Organization on February 23,2016, a Pre-Primary Report with a close of books date of February 24,2016 showing $0 in receipts and expenditures, and a 24 Hour Report of Independent Expenditure on February 25,2016 showing $62,500 in independent electioneering communications, effectively masking the source of funding until after the primary election April Quarterly Report by minutely manipulating reporting deadlines.

Filings as of 13,2016 replacements, requiring new drafting, recording, editing, and placement of the ads, IFF has filed no new 24 Hour Reports to disclose outlays related to Independent Expenditures ("IE") near an impending election, apparently in violation of 11 CFR 104.3(b)(l)(vii). As of March 13,2016, IFF appears to have filed no 24 Hour Reports to reflect these new lE's.

See IFF Pre- Lastly, the Pre-Primary report filed by IFF shows no expenditures for proportional use of Primaiy Report shared office space, equipment, and staff, despite filings documenting an arrangement of Previously Referenced; colocation, sh^ed resources, and identical personnel managing Family-PAC Federal Screenshot of (Committee ID: C00362178) and Paul Caprio Family-PAC, a political entity registered Family-PAC Federal FEC with the Illinois State Board of Elections (Conunittee ID: 8185). Paul Caprio, listed as Summary; Chairman in IFF filings, has a long history of failing to be transparent or comply with Screenshot of Paul Caprio Family- FECA and FEC regulations, as evidenced by the issuance of at least twenty Requests for PAC Illinois Slate Additional Information ("RFAI") by the Commission to date relating to his control of a Board of Eleciions Summary related group, Family-PAC Federal. Among these RFAI are several citing the total failure of Mr. Caprio's committee to file required reports.

Alarmingly, no remedy is available to the voters who have heard over, and over, and over again these false, misleading, defamatory, and unlawful electioneering communications. Neither is any remedy available to Roskam for Congress, who suffers a clear harm in the loss of support from voters mdiciously deceived by these conununications. It is self evident that after airing numerous ads to a large public audience, one or more voters have been persuaded to vote for Jay Kinzler.^

Such communications will unquestionably have an impact on votes cast for the primaiy election on March 1S, 2016, and even if not determinative in deciding the outcome of ^e election, will likely factor into Mr. Kinder or another potential candidate's consideration of whether to run against Congressman Roskam in the following election cycle, at a clear cost to Roskam for Congress of substantial financial and other campaign resources. It therefore falls on the Commission to fully investigate and, as appropriate, take enforcement action to penalize these repeated, manipulative violations by IFF.

The apparent act of carefully orchestrating violations to occur just before the election date with the knowledge certain that no timely enforcement or remedial action can occur in time to stop the unlawful influence should not be allowed to stand as a model for other committees to follow. We would suggest that swifl and decisive enforcement action is critical to restoring the integrity of the electoral process, penalizing the repeated, intentional disenfranchisement of potentially thousands of voters, and making clear to other candidates and political committees that such bad acts have no place in the free and fair elections so foundational to our democratic system of government.

Part 2 - Illegal Electioneering Communications and Improper Coordination bv Kinzler for Congress inshot of Kinzler for Congress has not Just benefitted from the unlawful electioneering fnzler for Congress communications of IFF, but has also made direct use of such communications in a Facebook Posting manner inconsistent with the separation required by the Commission to keep activities of IFF Ad; Video paid for using funds raised in imlimited amounts, including through corporate FileoflFF Ad Under KInzIer contributions, which would not be permitted under the rules governing the candidate and Image and Logo candidate's committees. For example, Kinzler for Congress has republished IFF electioneering conununications under campaign logo (See attached screenshot and enclosed digital copy of IFF radio ad rebranded with on-screen candidate image and Kinzler for Congress logo). See also, Kinzler for Congress Facebook caption to such rebranded IFF advertisement stating, "So Proud to Learn I Have Just Received Another Endorsement From Illinois Families First. Click the Button Below to Hear the New Ad They are Running For Me, Then, Like and Share With your Friends to Spread the Word!!" (emphasis added).

Kinzler for Kinzler for Congress has also undertaken a number of unlawful communications itself. Additionally, the candidate's conunittee has engaged in a number of questionable activities suggesting improper coordination with Super PAC IFF and Independent Expenditor Illinois Family Action ("IFA")(Committee ID: C90015850).

Page 4 of7 In the first instance, the above referenced use of IFF advertisements rebranded and redistributed verbatim under the Kinzler for Congress logo and the candidate's statement that these ads are being "run[] for me" at the Very least imply the coordination and collaboration of advertising strategy between the candidate, candidate' s committee, and aforementioned Super PAG. Under the Commission's coordination test, the following facts appear present in this situation: 1. Payment Prong - IFI paid for the production and distribution of the radio advertisement (See IFI 24 Hour Report, February 25,2016). 2. Content Prong - The advertisement is specifically an example of standards 1,2, and 4(a). The ad constitutes a public communication expressly advocating the election of Jay Kinzler and the defeat of Congressman Roskam, is an "electioneering communication" within the meaning of 11 CFR 100.29, and refers to a clearly identified House candidate, within 90 days before an election, and distributed within the candidate's jurisdiction. 3. Conduct Prong - By appearance of available information and inference, the overlapping content of the IFF IE with materials prepared and distributed by Kinzler for Congress, the subsequent use and representation of ownership by the candidate and candidate's committee, and Mr. Kinzler's statement appearing to indicate that he "requested," "suggested," or "assent[ed] to" the production of such communications sponsored by IFF for the benefit of his candidacy seems to satisfy the three essential elements of the Commissioni's prohibited coordination test.'

In the second instance of problematic coordination between Kinzler for Congress and a political committee, IFA is "disseminat[ing], distribut[ing], or republi[shing]...candidate campaign materials", potentially resulting, in an impermissible corporate in-kind, contribution to Kinzler for Congress;'' It appears IFA is coordinating with Kinzler for Congress to distribute these electioneering communications, which fiulher qualifies IFA assistance as a prohibited corporate in-kind contribution.'

Based on source code for the Screenshot of Tweet Post Time @ILfamilyaction Twitter feed, IFA tweeted the link to the non-public Kinzler for Congress communication at 4:51:05 p.m. CT on March 7,2016, exactly 5 minutes and 28 seconds after the campaign uploaded the video. As the YouTube notice makes clear, the only way IFA could have obtained the link to the not-yet-public candidate communication was from the creator of the content, the Kinzler for Congress campaign.

Publication This scenario is potentially problematic for a number of reasons. As FEC regulations stipulate, "An expenditure that is coordinated between a candidate or the candidate's campaign and a third party is considered an in-kind contribution to the candidate, which the candidate must report as a contribution received and an expenditure made."® Whether or not the Commission views the electronic distribution of campaign materials itself as an expenditure, we believe it must take into account the cost of staff time, office space, equipment usage, etc. required for IFA to undertake such activities.

Disobey ing such "lawful regulations" is punishable under the Uniform Code of Military Justice ("UCMJ") under Article 92, "Failure to Obey Order or Regulation."* Not only does the candidate and candidate's committee make regular and prominent use of such prohibited imagery in print, online, and broadcast media, but they do so in apparent blatant disregard of the regulations, since they sometimes include the required disclaimer, demonstrating clear knowledge of the existence of DOD limitations on political activity, but continuing to engage in a pattern of repeatedly failing to abide by such limitations anyway.

As the information in this complaint documents, Kinzler for Congress and IFF have committed numerous violations of FECA and FEC regulations to the harm of Roskam for Congress and the voting public. We appreciate the Conunission's thoughtful consideration of our complaint, and are prepared to cooperate in any manner necessary for the Commission's investigation and resolution thereon.
