Tarana Burke, Me Too Founder1 We started the New Zealand Women’s Law Journal — Te Aho Kawe Kaupapa Ture a ngā Wāhine to provoke conversations about how the law affects our wāhine in Aotearoa. In 2016 when we began work on the Journal, we did not quite anticipate just how relevant this platform would become for those within the profession. With the reporting of sexual assault and harassment at Russell McVeagh in February of this year, public conversations began about the behaviour and experiences our lawyers face in their workplaces. These conversations were not new. In fact, they have been had many times before. But they seemed to be taking place with a new fervour. And everyone seemed to be listening. Now that we are coming towards the end of 2018, we are extremely aware of the number of experiences shared, reports written, surveys conducted, policies changed and public discussions had. Some might say they are ‘tired’ of these relentless discussions and they ‘just want to get on with their work’. But we are not done talking and the time for real change to occur has only just begun. We want policies to turn into everyday standards that are upheld, we want changes to regulation to lead to accountability and we want surveys to turn into ideas that are actioned. We want you to keep listening. This Journal can provide one platform by which these conversations are continued and ideas put forward. We are honoured to present this edition of the Journal, which we believe does just that. We want to thank everyone who has contributed to this edition and to this dialogue. We are proud to be sharing their experiences and their whakaaro (ideas) with you. Ana Lenard and Allanah Colley Editors-in-Chief 29 October 2018 2 FOREWORD — KUPU WHAKATAKI This year New Zealand has celebrated a gender equality milestone: it is 125 years since New Zealand women won the right to vote. From this vantage point it is clear that some significant gains have been made towards gender equality. We have our third woman prime minister; the number of women practising law outnumbers men; and we have a majority of women sitting on the Supreme Court. We are proud of these achievements. Despite these outward signs of progress, it has also been a year in which misogyny in the legal profession has been in the spotlight; a year in which sexual misconduct, bullying and harassment has been exposed as commonplace. Culture is the hardest thing to change. The feminist revolution has achieved much, but “revolution is not a one-time event”.1 Sexism is like an iceberg. Overt sexual or sexist misconduct is the visible, exposed tip: easy to recognise but harder to challenge — maybe impossible if you are the one who suffers it. Lurking beneath are problems that are harder to identify: unconscious bias, double-standards, cultural ideas about what it means to be feminine or masculine; you can no doubt think of more. The system we have inherited gives the greatest rewards to the lawyers who sacrifice their home and family life to long hours at the office; who may even behave badly towards colleagues but so long as they deliver the results, this is overlooked. Wouldn’t it be transformational to rebuild the system so that it respects all individuals equally and values collective effort and collaboration, while allowing space for lawyers to have equally rewarding professional and home lives? To achieve this we need to examine how we educate, train and promote lawyers, and how we measure success in our profession. We need to revisit how we define “fit and proper person”, and the regulatory systems that promote and protect the high standards of professionalism we expect. 1 Audre Lorde Sister Outsider: Essays and Speeches (Crossing Press, New York, 1984). 3 [2018] NZWLJ Meaningful change will require buy-in from all parts of the profession: educators, regulators, judges, partners in firms, chief executives in agencies, practising lawyers. Leadership must come from the top but leaders also need to be open to advice from a diverse range of viewpoints, not least from the new generation of lawyers. The insights and the challenges offered in this second volume of Te Aho Kawe Kaupapa Ture a ngā Wāhine will help guide us towards change. Whether through embracing concepts of tuakana/teina (Bernadette Arapere and Kate Tarawhiti, at 22), promoting gender-neutral language to advance gender equality (Ruby King and Jasper Fawcett, at 107) or understanding the history of women lawyers in order to transform women’s experiences in the future (Dr Anna Hood, at 249). I look forward to the challenges ahead, to standing strong alongside the women and men of the profession who are committed to this mahi, and making our profession a safer place where everyone can thrive and reach their full potential.

    2018 – A Year of Anniversaries The 2018 Pankhurst Lecture, University of Manchester Lady Hale, President of The Supreme Court 8 February 2018 2018 marks the anniversary of some very important dates in the history of women’s participation in public life. We all know that 2018 is the 100th anniversary of women getting the vote, although not on same terms as men. Most of us probably know that it is also the 100th anniversary of women getting the right to stand as candidates and be elected to Parliament, this time on the same terms as men. Why the difference? I believe that there were two reasons why only some women got the vote. One was that the same Act of Parliament gave the vote to all men, irrespective of whether they had any property. Giving the vote effectively only to middle class women – those who either had property of their own or were married to men who did or who had University degrees – softened the effect of enfranchising the working-class men. Another was that in 1918, because of the slaughter of the First World War, there were more many more adult women than there were adult men – allowing them to vote on equal terms would have meant that they were in a majority. But there was no risk that more women than men would be elected to Parliament – the whole idea was laughable – so equality there would do no harm. Voting equality was achieved ten years later, in 1928. So we should celebrate 2018 as the 90th anniversary of women getting the 1 right to vote on equal terms with men and have an even bigger celebration in ten years’ time.

    5 October 2017 Women Lawyers: Equals at the Bar? PROFESSOR JO DELAHUNTY QC Question: The times they are a-changing - or are they? Do female lawyers need to be Superwomen to survive? Is motherhood welcomed, tolerated or rejected at the Bar? What makes for a successful advocate? Is gender relevant? What about career progression? Are women fairly represented on the Bench and in its most senior courts? Is there practice or appointment discrimination and if so what is being done about it? The reaction on social media to this lecture has been illuminating: within seconds of the tweet out of this lecture I received these comments: Twitter: ‘inequality is far more about class, uni, school than gender’ LinkedIn: ‘what about black and ethnic minorities’ lawyers: don’t see many at the top’ Gender, race, class and education all play a part in career opportunities and career progression. I can only speak from my perspective, it would be arrogant and insensitive to speak of the barriers to advancement on the grounds of race or disability when I am an outsider on those issues. This lecture shines the spotlight on gender issues at the Bar and draws on my experience in Family Law. I deliver this lecture coming from a background as a child of a single parent from a white working class home. I was the first person in my family to stay in education after the age of 16. I went to a comprehensive state school. My careers advisor suggested I was bright enough to apply to work in a bank but not front of house as I had an ‘attitude’.

    Media Analysis NEW ZEALAND CANNABIS REFERENDUM 2020 Introduction This analysis looks at 281 New Zealand-based media articles and opinion pieces as they appeared online during the cannabis referendum campaign period between May and October 2020. The objective was to assess the extent to which the set of articles and op-eds, as a whole, provided balanced coverage of both sides of debate – consistent with the New Zealand Media Council’s first principle of “accuracy, fairness and balance.”1 All the articles obtained were based on the list provided by NZ Politics Daily, a comprehensive, non- partisan list of articles, columns, and analysis relating to New Zealand politics and government, produced by the Democracy Project at Victoria University Wellington. This list was used to maintain the neutrality of the analysis and to avoid any accusation of searching for articles that leaned to one side or the other of the debate. There were 203 news items and 78 opinion pieces. Accuracy, fairness and balance was assessed across a variety of measures: the headline used, the number of people quoted within each piece arguing one or other side of the referendum question, and the proportion of content arguing each side of the campaign issues. Experts who quoted research or data were considered to be neutral. Any observed imbalance in the content or coverage across the set of news items and opinion pieces is interpreted as evidence of overall bias in reporting on the referendum question. The report was commissioned by Family First New Zealand. The analysis has been audited by an Emeritus Professor who specialises in research methods and statistics.

    A Poststructural Analysis of the Health and Wellbeing of Young Lesbian Identified Women in New Zealand. Katie Palmer du Preez A thesis submitted to Auckland University of Technology in fulfilment of the requirements for the degree of Doctor of Philosophy (PhD). 2016 Faculty of Health and Environmental Sciences. School of Clinical Sciences. ABSTRACT New Zealand is regarded internationally as a forerunner in the recognition of gay rights. Despite the wide circulation of discourses of gay rights and equality, research shows that young women who identify as lesbian continue to be marginalised by society, which constrains their health and wellbeing. This study was an inquiry into the health and wellbeing of young lesbians in New Zealand, from a poststructural feminist perspective. It posed the research question: what are the discourses in play in relation to the health and wellbeing of young lesbian identified women in New Zealand? The methodology employed was a poststructural feminist discourse analysis, drawing on the philosopher Michel Foucault’s concepts of genealogy and the history of the present. Interviews with young lesbians were conducted in 2012 amid public debate around same- sex marriage. Historical data sources were the extant texts Broadsheet, a feminist periodical with strong health and wellbeing emphasis, and Hansard, a record of New Zealand parliamentary debate. Issues of these publications were selected from the early 1970s, during which the second wave feminist movement emerged, and the mid-1980s when the campaign for Homosexual Law Reform took place in New Zealand. The discourse analysis made visible the production of multiple ‘truths’ of young lesbian health and wellbeing.
