OFFICIAL PROCEEDINGS OF THE COUNTY BOARD WASHINGTON COUNTY, JUNE 21, 2016

The Washington County Board of Commissioners met in regular session at 9:00 a.m. in the Washington County Government Center, County Board Room. Present were Commissioners Bigham, Kriesel, Miron and Weik. Board Chair Miron presided. Also present were Molly O’Rourke, County Administrator; George Kuprian, First Assistant County Attorney Division Chief; Becky Sells, Board Secretary; county residents; outside agencies; and county staff.

The Board recited the Pledge of Allegiance.

COMMENTS FROM THE PUBLIC

The Board Chair asked for comments from the public. Mayor Stan Karwoski for the City of Oakdale invited Washington County residents to the City of Oakdale’s Summerfest which starts on Thursday, June 23rd, with the Ted Bearth Summerfest Parade.

CONSENT CALENDAR

Commissioner Weik moved, seconded by Commissioner Bigham, to adopt the following Consent Calendar.

1. Approval of June 14, 2016, County Board Meeting Minutes.

2. Approval to appoint/reappoint for committees and commissions with memberships that expire June 30, 2016.

3. Approval to reappoint Thomas Polasik, Stillwater Township; Kristen Tuenge, Scandia; and David Devalut, May Township, to a term expiring June 21, 2019, to the Carnelian-Marine-St. Croix Watershed District.

4. Approval of Joint Powers Agreement between the State of Minnesota, Department of Corrections, Office of Policy and Legal Services and Washington County by and through the Washington County Attorney’s Office for the period of July 1, 2016, through June 30, 2017.

5. Approval of Amendment No. 3 to contract 8501 with Interstate Removal for Zone 2 snow removal services to extend the term of the contract to May 31, 2017.

6. Approval of Amendment No. 3 to contract 8502 with Twin City Outdoor Services for Zone 3 snow removal services to extend the term of the contract to June 1, 2017.

8. Approval of Resolution No. 2016-078 as follows:

RESOLUTION TO AUTHORIZE FINAL PAYMENT FOR THE COUNTY ROAD 55 PAVING

WHEREAS, on April 14, 2015, the Washington County Board of Commissioners approved a bid award to Hardrives, Inc. for complete paving on County Road 55; and,

WHEREAS, Minnesota Statutes 160.17 subd. 3 requires that final payment on any road construction or improvement contract for which sealed bids have been required may not be made until the county engineer has certified to the county board that all work has been performed according to the contract; and,

WHEREAS, Hardrives, Inc. has satisfactorily completed all work in accordance with the terms and conditions of the contract.

NOW, THEREFORE, BE IT RESOLVED, that Hardrives, Inc. be given final payment in the amount of $148,386.56 as claimed by the final payment voucher which is attached hereto. This final payment results in total satisfaction for the contract work more fully described in the above recitals.

9. Approval of Resolution No. 2016-081 as follows:

APPROVAL OF JOINT POWERS AGREEMENT BETWEEN WASHINGTON COUNTY SHERIFF’S OFFICE AND THE STATE OF MINNESOTA

BE IT RESOLVED, that the Washington County Sheriff’s Office is authorized to enter into a Joint Powers Agreement with the State of Minnesota, acting through its Commissioner of Corrections, to provide housing for State offenders.

BE IT FURTHER RESOLVED, that the Washington County Sheriff, William M. Hutton, is hereby authorized to execute and sign this Joint Powers Agreement and any amendments thereto, as are necessary to implement this agreement on behalf of the Washington County Sheriff’s Office.

The motion was adopted 4-0 with a Roll Call vote as follows: Ayes, Commissioners Bigham, Kriesel, Weik, and Miron; Nays, none.

The Commissioners recognized Peggy Babcock, Forest Lake, and Peggy Elsasser, Woodbury, as Family Child Care Providers of the Year for 2016.

Recognition of Senator Katie Sieben

Commissioner Bigham moved to adopt Resolution No. 2016-079 as follows:

RESOLUTION IN APPRECIATION OF THE LEGISLATIVE CAREER OF SENATOR KATIE SIEBEN

WHEREAS, Katie Sieben was first elected in November 2002 to the House of Representatives serving the residents of Washington County in what was then House District 57A and served in the House for two terms through 2007; and

WHEREAS, Representative Sieben was then elected to the in 2006 to the first of three terms, winning re-election in 2010 and 2012; and

WHEREAS, Senator Sieben began her public service interning for United States Representative Bill Luther and then working for United States Senator Mark Dayton prior to running for elected office; and

WHEREAS, Senator Sieben graduated from Woodbury High School, earned degrees in History and Government at Colorado College, earned her Masters in Public Administration from Harvard University’s Kennedy School of Government, and was selected as a University of Minnesota Humphrey Institute Policy Fellow; and

WHEREAS, Senator Sieben lives in the City of Cottage Grove with her husband, Josh Straka, and their three children, John, Henry, and Greta; and Senator Sieben is part of a family that has and continues to serve the residents of Washington County in public office, including her father Michael Sieben and her uncle, Harry A. Sieben, Jr. who both previously served in the Minnesota Legislature; and

WHEREAS, Senator Sieben has faithfully and tirelessly served the communities of Washington County in the Minnesota House of Representatives and Senate for the past 14 years and advocated for the residents and concerns of those in the sourthern portion of Washington County, as well as working for the good of all Washington County residents during her years of service; and

WHEREAS, Senator Sieben rose through the leadership ranks of the Minnesota Senate, serving as vice chair of the Subcommittee on Elections and the chair of the Rules and Administration Committee and was elected Assistant Majority Leader of the Senate in November of 2012; and

WHEREAS, Senator Sieben especially worked toward bettering the lives of Washington County residents while working toward positive legislation in the areas of elections, especially in absentee voting; the environment; transportation, especially in the areas of supporting the progress of the Red Rock and Gateway corridors; education, especially in the area of early education; and health care, especially in support of the Hastings Veterans Home; and

WHEREAS, Senator Sieben championed projects that will improve the lives of Washington County residents for generations to come, such as the 180

Grey Cloud Island Crossing, the Newport Transit Station, the new Hastings Bridge, the new Wakota Bridge, the Point Douglas Trail connections, and improvements to Point Douglas Park, to just name a few; and

WHEREAS, Senator Sieben has been an attentive, supportive, and effective legislator, representing the needs of the county and its residents on the state level, at the same time attending to the overall needs of state residents,

NOW, THEREFORE BE IT RESOLVED, that the Washington County Board of Commissioners does hereby express its utmost appreciation for Senator Sieben’s work on behalf of Washington County, and wish her the best in her next endeavors.

Recognition of Representative Denny McNamara

Commissioner Bigham moved to adopt Resolution No. 2016-080 as follows:

RESOLUTION IN APPRECIATION OF THE LEGISLATIVE CAREER OF REPRESENTATIVE DENNY MCNAMARA

WHEREAS, Representative Denny McNamara has faithfully and tirelessly served the communities of Hastings, Cottage Grove, Afton and Denmark Township in Washington County, and Hastings and Nininger Township in Dakota County in the Minnesota House of Representatives for the past 14 years; and

WHEREAS, Representative McNamara was first elected to the House in 2002 serving then district 57B, and won re-election in 2004, 2006, 2008, and 2010, and following redistricting was elected to serve District 54B in 2012 and again in 2014; and

WHEREAS, Representative McNamara attended the University of Minnesota Duluth and earned a Business Administration degree from the University of Minnesota, Carlson School of Business; and lives in Hastings with his wife, Lynne, and has two children, Mike and Brian; and

WHEREAS, Representative McNamara held numerous leadership positions in the House, including Minority Whip in 2007-2008, and chair of the Environment and Natural Resources Finance Committee for two terms (2011-2012 and 2015-2016); and rendered his service to all Washington County residents during his years in the Legislature through both his service to the Carpenter Nature Center board of directors, the Hastings Chamber of Commerce, and the Hastings City Natural Resources and Recreation Commission; and

WHEREAS, Representative McNamara has been diligent in his work, especially in the protection of natural habitat through the creation of the Vermillion Highlands and Empire Wildlife Management Area, supporting state funding to match county land and water legacy investments, and crafting responsible budgets for the Department of Natural Resources, Minnesota Pollution Control Agency, and the Minnesota Board of Soil and

Water Resources as chair of the House Environment and Natural Resources Finance Committee; and

WHEREAS, Representative McNamara has advocated for the creation of the Red Rock transitway through financial support from the state, comprehensive nursing home funding reform, responsible road and bridge funding, a number of education initiatives, and support for veterans through relief from state income tax on their pensions; and

WHEREAS, Representative McNamara has been an attentive, supportive, and effective legislator for Washington County, representing its needs, and being attentive to the overall needs of state residents.

NOW, THEREFORE BE IT RESOLVED, that the Washington County Board of Commissioners does hereby express its utmost appreciation for Representative McNamara’s work on behalf of Washington County, and wish him the best in his next endeavors.

PROPERTY RECORDS AND TAXPAYER SERVICES

Commissioner Kriesel moved to approve appointment of members, including Commissioner Miron and Commissioner Bigham, to the 2016 County Canvass Board for the State Primary Election. Commissioner Weik seconded the motion and it was adopted unanimously.

PUBLIC WORKS

Contract with Arnt Construction Company, Inc. for Construction of the County State Aid Highway (CSAH) 26 Project

Commissioner Kriesel moved to approve contract with Arnt Construction Company, Inc. in the amount of $1,112,454.65 for construction of the County State Aid Highway 26 Project. Commissioner Bigham seconded the motion and it was adopted unanimously.

Amendment No. 1 to Contract with Alliant Engineering for Additional Project Design Engineering Services

Commissioner Kriesel moved to approve Amendment No. 1 to contract 9910 with Alliant Engineering in the amount of $74,140 for additional project design engineering services. Commissioner Weik seconded the motion and it was adopted unanimously.

Cooperative Cost Share Agreement with Holiday Stationstores, Inc. for CSAH 26

Commissioner Kriesel moved to approve Cooperative Cost Share Agreement with Holiday Stationstores, Inc. for County State Aid Highway 26. Commissioner Weik seconded the motion and it was adopted unanimously.

Cooperative Cost Share Agreement, Cooperative Maintenance Agreement, and Utilities Cost Share Agreement with the City of Oak Park Heights for CSAH 26

Commissioner Kriesel moved to approve Cooperative Cost Share Agreement, Cooperative Maintenance Agreement, and Utilities Cost Share Agreement with the City of Oak Park Heights for County State Aid Highway 26. Commissioner Bigham seconded the motion and it was adopted unanimously.

Pedestrian Trail in the County State Aid Highway 26 Project

Commissioner Kriesel moved to adopt Resolution No. 2016-082 as follows:

LIMITED USE PERMIT WITH THE STATE OF MINNESOTA, DEPARTMENT OF TRANSPORTATION FOR A PEDESTRIAN TRAIL IN THE RIGHT-OF-WAY OF TRUNK HIGHWAY 36 AT COUNTY STATE AID HIGHWAY 26

WHEREAS, Washington County is a political subdivision, organized and existing under the laws of the State of Minnesota; and,

WHEREAS, The Washington County Board has approved a plan to construct a pedestrian trail in the right-of way of Trunk Highway 36; and,

WHEREAS, the State of Minnesota, Department of Transportation requires a Limited Use Permit for the construction and utilization of said pedestrian trail.

NOW, THEREFORE, BE IT RESOLVED that the Washington County Board of Commissioners hereby delegates authority to the Washington County Public Works Director to enter into on behalf of Washington County conditions upon approval as to form by the County Attorney’s Office a Limited Use Permit and all amendments thereto with the State of Minnesota, Department of Transportation for the following purposes:

To construct, operate and maintain a pedestrian trail within the right- of­way of Trunk Highway 36 of the State of Minnesota in the vicinity of CSAH 26. Washington County shall construct, operate and maintain said trail in accordance with the Limited Use Permit 8214-0046 granted by the Minnesota Department of Transportation.

Commissioner Weik seconded the motion and was adopted 4-0 with a Roll Call vote as follows: Ayes, Commissioners Bigham, Kriesel, Weik, and Miron; Nays, none.

GENERAL ADMINISTRATION

2015 Annual Performance Measures and Indicators Report

Amanda Hollis, Senior Planner, reviewed the 2015 Performance Measures and Indicators Report and provided an update on the countywide performance measurement and improvement efforts. Chad Lubbers, Library Division Manager, presented on early literacy performance measures. Kevin Corbid, Deputy County Administrator, presented on the outstanding debt per capita performance measures. Rita Colin, Public Works Management Analyst II, presented on the building energy efficiency performance measures.

COMMISSIONER REPORTS - COMMENTS – QUESTIONS

Commissioner Bigham reported that she attended the Association of Minnesota Counties Board of Directors Meeting regarding a 3% dues increase next year, and Bob Fox, Renville County, was elected the 100% State Delegate, and Chris Shoff, Freeborn County, was elected the Large State Representative. They will represent Minnesota on the National Association of Counties (NACo) Committees. She attended the Counties Transit Improvement Board Meeting. She attended the Transportation Advisory Board Meeting, and highlighted items such as the Statewide Transportation Improvement Program (STIP), and yearly projects. She attended the Newport City Council Meeting, regarding the passing of the conditional use permit for the Red Rock Crossing project. She attended the Denmark Township meeting. She attended Cottage Grove’s Strawberry Fest where her pet dog won the Doggy Dash.

Commissioner Weik reported that she attended the Counties Transit Improvement Board (CTIB) meeting and highlighted items such as the 2016 Capital Grant Agreements, and that Dakota County is rethinking its membership with CTIB. She attended the Woodbury City Council Workshop meeting in regards to the Central Park Phase One Facility Report, and Bailey Road in Woodbury.

Commissioner Kriesel reported that he co-hosted and attended the Boomsite to Bayport Meeting on June 17th, which is a group of agencies looking to make improvements from the Boomsite area to Bayport. He attended the Metropolitan Library Services Agency (MELSA) meeting on June 16th. He attended an East Suburban Resources (ESR) open house in Stillwater.

Commissioner Miron reported that he will be attending an upcoming ESR Meeting in Forest Lake. He attended the Workforce Development Board Meeting on June 15th. He attended a Library Presentation last night, June 20th, at the Hugo City Council, where both Washington County Library Director Keith Ryskoski and Washington County Library Group Manager Amy Worwa provided presentations on the summer reading programs, and features at the Hardwood Creek Branch Library.

BOARD WORKSHOP – PUBLIC WORKS

The Board met in workshop session to discuss the Central Greenway Regional Trail (Interstate 94 to Cottage Grove section) Master Plan and the Cottage Grove Ravine Regional Park Master Plan Amendment. Present for the workshop session were Commissioners Bigham, Kriesel, Miron and Weik. Also present were Molly O’Rourke, county staff, media, outside agencies and residents.

BOARD WORKSHOP – COMMUNITY SERVICES

The Board met in workshop session to provide updates on the 2016 Section 5310 Elderly and Disabled Assistance Grant to improve access to transportation services and public transportation alternatives for persons with disabilities, seniors, and others with special transportation needs. Present for the workshop session were Commissioners Bigham, Kriesel, Miron and Weik. Also present were Molly O’Rourke, county staff, and residents.

BOARD WORKSHOP – LIBRARY

The Board met in workshop session to review the Law Library court fees and recommendations from the Law Library Board to increase fees. Present for the workshop session were Commissioners Bigham, Kriesel, Miron and Weik. Also present were Molly O’Rourke, county staff, and residents.

RECONVENE THE COUNTY BOARD OF APPEAL AND EQUALIZATION FOR THE SECOND MEETING

The County Board recessed and reconvened as the County Board of Appeal and Equalization for its second meeting; the time being 12:40 p.m.
