CONCERNING ESTIMATED ALLOCATION OF REVENUE SHARING FUNDS FOR GEOTHERMAL MINING NATURAL RESOURCES FOR THE FISCAL YEAR 2013 BY THE GRACE OF GOD ALMIGHTY THE MINISTER OF FINANCE OF THE REPUBLIC OF INDONESIA, Considering : whereas in order to implement the provisions of Article 27 paragraph (5) of Government Regulation No. 55 Year 2005 concerning Balance Fund, it is necessary to stipulate Regulation of the Minister of Finance concerning Estimated Allocation of Geothermal Mining Natural Resources Revenue Sharing for the Fiscal Year 2013; In View of : 1. Law Number 33 Year 2004 concerning Fiscal Balance between the Central Government and the Regional Government (State Gazette of the Republic of Indonesia Year 2004 Number 126, Supplement to the State Gazette of the Republic of Indonesia Number 4438); 2. Law No. 19 Year 2012 concerning State Budget for the Fiscal Year 2013 (State Gazette of the Republic of Indonesia Year 2012 Number 228 , Supplement to State Gazette of the Republic of Indonesia Number 5361); 3. Government Regulation No. 55 Year 2005 concerning Balance Fund (State Gazette of the Republic of Indonesia Year 2004 Number 137, Supplement to the State Gazette of the Republic of Indonesia Number 4575); 4. Regulation of the Minister of Finance Number 06/PMK.07/2012 concerning Implementation and Accountability of Block Grants Budget; 5. Regulation of the Minister of Finance Number 165/PMK.07/2012 concerning Allocation of Block Grants Budget; BE IT HEREBY RESOLVED To enact : REGULATION OF THE MINISTER OF FINANCE CONCERNING ESTIMATED ALLOCATION OF GEOTHERMAL MINING NATURAL RESOURCES

REVENUE SHARING FUND FOR THE FISCAL YEAR 2013.
Article 1 The estimated Geothermal Mining Natural Resources Revenue Sharing Fund (Geothermal Mining Natural Resources Revenue Sharing Fund) for the Fiscal Year 2013 shall be based on the estimated revenues of Geothermal Mining as stipulated in Law No. 19 Year 2012 concerning the State Budget for Fiscal Year 2013. Article 2 (1) The estimated allocation Geothermal Mining Natural Resources Revenue Sharing Fund for the Fiscal Year 2013 as referred to in Article 1 shall be in the amount of Rp322,797,174,974.00 (three hundred and twenty- two billion seven hundred and ninety- seven million one hundred and seventy- four thousand nine hundred and seventy- four rupiah) with the details as follows: a. Fixed Contribution in the amount of Rp10,285,174,974.00 (ten billion two hundred and eighty- five million one hundred and seventy- four thousand nine hundred and seventy- four rupiah) and b. Government Share in the amount of Rp312,512,000,000.00 (three hundred and twelve billion, five hundred and twelve million rupiah). (2) Details of estimated allocation Geothermal Mining Natural Resources Revenue Sharing Fund for the Fiscal Year 2013 for provinces and regency/ municipality shall be as listed in the Attachment of which constitutes an integral part of this Ministerial Regulation. Article 3 (1) The distribution of Geothermal Mining Natural Resources Revenue Sharing Fund for the Fiscal Year 2013 shall be held on a quarterly basis. (2) The distribution of Geothermal Mining Natural Resources Revenue Sharing Fund for the Fiscal Year 2013 for the First Quarter and Second Quarter shall be implemented respectively by 20 % (twenty percent) of the estimated allocation of Geothermal Mining Natural Resources Revenue Sharing Fund for the Fiscal Year 2013. (3) The distribution of Geothermal Mining Natural Resources Revenue Sharing Fund for the Fiscal Year 2013 as intended in paragraph (2) shall be calculated against the revenue of Geothermal Mining Natural Resources Revenue Sharing Fund for the Fiscal Year 2013 for the Third Quarter and Fourth Quarter. (4) The distribution of Geothermal Mining Natural Resources Revenue Sharing Fund for the Fiscal Year 2013, as set forth in paragraph (1),

shall be implemented through the calculation of data reconciliation method between the National Government and the producing regions. (5) The distribution of Geothermal Mining Natural Resources Revenue Sharing Fund for the Fiscal Year 2013 shall be implemented according to the laws and legislations. Article 4 In the event that the estimated Geothermal Mining Natural Resources Revenue Sharing Fund for the Fiscal Year 2013 does not provide for the distribution or the realization exceeds the ceiling in the Fiscal Year 2013, the Government shall distribute the Geothermal Mining Natural Resources Revenue Sharing Fund for the Fiscal Year 2013 based on the realization of revenues of Geothermal Mining for the Fiscal Year 2013 in accordance with the provisions of laws and legislations. Article 5 This Ministerial Regulation shall come into force from its date of promulgation. For public cognizance, it is ordered to promulgate this Ministerial Regulation by announcing it in the Official Gazette of the Republic of Indonesia.
