LOCAL COUNCILS ORDINANCE, 1941.

ORDER, No. 7 OF 1942, BY THE HIGH COMMISSIONER UNDER SECTION 2.

IN EXERCISE of the powers conferred upon him by section 2 of the Local Councils Ordinance, 1941, the High Commissioner, on the No• 30 oi 1041 • recommendation of the District Commissioner of the Lydda Dis• trict, has been pleased to order and it is hereby ordered as follows :—

1. This Order may be cited as the Local Councils (Rishon-le- Citation. Zion) Order, 1942.

2. In this Order, unless the context otherwise requires, Definitions. "Building" means any dwelling-house, flat or part of a build• ing which forms a residence in itself, hotel, boarding-house, warehouse, office, shop, factory, school and any other struc• ture in which persons reside or are employed, and includes any land used or occupied together therewith as a garden, yard or otherwise. "District Commissioner" means the District Commissioner or . a Deputy or Assistant District Commissioner of the Lydda District. "Occupied land" means land wThich is used and occupied other• wise than together with any building. "Occupier" means any person occupying any land or building, either as owner or by virtue of any lease or agreement where• by he is entitled as of right to occupy it, and also includes a person who resides in a room or rooms or part thereof in any building and pays rent therefor to the owner or the lessee of the building, but does not include a person who resides in a room or rooms or part thereof in an hotel or boarding-house. "Owner" includes the reputed owner. "Rate" means any rate imposed by the Council under the pro• visions of this Order or any other Ordinance or law. "Reputed owner" means the person who is in receipt of rents or profits of any building or land in such circumstances that he is the reputed owner thereof whether or not he is in pos• session or is the registered owner : Provided that where a building or land is let on lease or sub-lease for a term of more than three years, the lessee or sub-lessee of the building or land or, if there are two or more sub-lessees, the lessee under the last created sub-lease, shall be deemed to be the reputed owner instead of the per• son entitled to the rents and profits as aforesaid. 8S THE PALESTINE GAZETTE NO. 1163—SUPPLEMENT No. 2. loth January, 1912

"Unoccupied land" means land which.is not used for any pur• pose other than land used or occupied together with any

building as a garden, yard or otherwise :; Provided that where a new building is being constructed upon any land which immediately prior to the commencement of the construction of such building was unoccupied land, such land and the land which will be occupied together with such building as a garden, yard or otherwise shall be deemed to be unoccupied land until such new building is completed and,such new building shall be deemed to be completed when the building or any part thereof is occupied.. . ' •

Establishment 3. A Local Council (hereinafter referred to as "the Council") and jurisdiction shall be-constituted in the village of Rishon-le-Zion, situated in the of Council. L.ydda District, and its jurisdiction shall extend to all lands as set forth in the first schedule hereto.

Composition 4. The Council shall consist of a President and so many mem• of Council. bers, not less than six or more than twelve, including the President, as the District Commissioner shall from time to time determine. Electoral Com• 5. —(!)•The Council> with the approval of the District Commis• mittee and sioner, shall from time to time appoint a committee to be known as register of voters. the Electoral Committee, one member of which shall be nominated by the Council with the approval of the District Commissioner as chairman thereof, to prepare a register of voters' containing a list of all persons entitled •to vote in accordance with the qualifications set out in the second schedule hereto, and to indicate on the list which voters are eligible'in accordance with the qualifications set out in •paragraph 7.(1) hereof and in the third schedule hereto to be elected as councillors, and to supervise the holding of elections, and shall prescribe the date on which the committee shall commence to prepare or revise the register of voters. • (2) So soon as it shall have been prepared or revised, the register of voters shall be posted by the• Electoral Committee outside the Council offices and by the door of places of worship and such other public buildings within the area of jurisdiction of the Council as shall be determined by the Electoral Committee. :(3) Within fourteen days of the posting of the register of Voters :— (a) every person whose name is not. in such register and who claims that it should be inserted therein, and '(b)• every person whose name is in such register who objects to the insertion of the name of any other person therein, may give notice in writing to the Electoral Committee of such claim or objection, stating the grounds therefor iri the'form in the fourth schedule hereto. (4) The Electoral Committee shall within a period of a further three days prepare and publish a list' of the claims and objections received by it within the above prescribed period, and any person whose name is, or who claims to have a right to be on the register of voters may, within seven days after the publication of such list, give notice of objection in writing to the Electoral Committee against the insertion in the register of voters of the name of any claimant included in such list, stating the grounds therefor in the ׳ , .form in the fourth schedule hereto (5) On the expiration of the above period of seven days, the Electoral Committee shall consider each claim or objection in the presence of the person making it, and in the case of an objection in the presence of the person objected to, and shall within three days give its decision thereon, and shall, if necessary, amend the register of voters : Provided that if the person making the claim or objection or. the person objected to shall fail to appear before the Electoral Com­ mittee at the time appointed by the Electoral Committee for the consideration of the claim or objection, the Electoral Committee may proceed to consider the claim or objection notwithstanding such absence, and,,if its decision thereon is given in such absence, the Electoral Committee shall notify such absent person of the result of its adjudication. (6) The decision of the Electoral Committee shall be obtained by vote, each member thereof having one vote : Provided that if there is an equality of votes the chairman shall have a second.or casting vote. (7) The.person making any. claim or objection or the :person objected to may, within.seven days from the date of the decision of the Electoral Committee, if given in his presence, and from the date of the receipt of the notification from the Electoral Com­ mittee of its decision, if given in his absence, appeal to a Magis­ trate's Court on any question,of law involved in the adjudication but• not on any other ground.• • •; (8), The appellant shall serve'ever}' respondent with a copy of appeal through the Magistrate's Court, and the Court after־his hearing the parties or their advocates and after taking any evidence and considering any matter that it may deem fit, shall make such order as it .thinks just, and the parties and the Electoral C6mmittee shall forthwith comply with such order. (9) The decision of the Electoral Committee if there is no ap­ peal therefrom to the Magistrate's Court and the decision of the Magistrate's Court if there is an appeal thereto shall respectively be final. for a period of fourteen days, the chairman of the Electoral Com­ mittee shall sign the register : Provided that if there is any appeal to the Magistrate's Court the chairman of the Electoral Committee shall not sign the register of voters until the Magistrate's Court has given its decision, when the register of voters shall be amended (if necessary) in accordance with the decision of the Court : Provided also that if for any reason the chairman of the Elec­ toral Committee shall refuse or neglect to sign the register the District Commissioner may sign the register. (11) When the chairman of the Electoral Committee or the District Commissioner has signed the register of voters it shall thereupon become the register of voters for the Council.

Election and 6. The Council shall be elected in accordance with the rules set term of office out in the fifth schedule hereto. The Council so elected shall of Council. hold office for a period of three years from the date of election. At the end of that period and at the end of every succeeding period of three years, a new Council shall be elected in accordance with the rules set out in the fifth schedule hereto : Provided that if at the end of any period of three years elections have not been held the Council then in office shall remain in office till elections are completed. Disqualifications 7. —(1) A person shall not be qualified to be elected or to be a for membership, member of the Council if he :— vacation of seat and filling of (a) is an undischarged bankrupt, or vacancies. (b) has directly or indirectly by himself, his wife or her hus­ band, his agent or his partner any share or interest in any contract with, by or on behalf of the Council: Provided that a person should not be disqualified here­ under by reason only, — (i) that he is interested in the sale or lease of any pre­ mises to or the loan of any money to the Council, or (ii) that he is interested in any newspaper in which any advertisement relating to the affairs of the Council is ־• inserted, or (hi) that he is interested in any contract between the Council and any company with limited liability as a shareholder, and not being a director, manager, officer or agent of such company : Provided that such member of the Council shall hot take part in any discussion upon or vote upon an}r question directly affecting the affairs of such company, or ,91

(c) lias before the day of election or since his election been sentenced by a Court-of-Law in Palestine to a term of im• prisonment of one year or upwards and has not received a free pardon for the offence for which he was sentenced, un• less he has completed such term of imprisonment at least- five years before the day of election, or (d) is a paid officer or servant of the Government of Palestine, other than a Mukhtar, or of the Council other than the Pre• sident, a Vice-President or any other member of the Council who receives remuneration m respect of his office, or (e) is a member or paid officer or employee of a Municipal Council or of another Local Council, or (/) is not possessed of the qualifications set out in the second and third schedules to this Order. (2) If any member of the Council, including the President and a Vice-President, shall fail throughout a period of three consecutive months to attend any meeting of the Council, he shall, unless the failure was due to illness or to some reason approved by the Council, cease to be a member of the Council: Provided that attendance at a meeting of any committee of the Council to which any of the functions of the Council have been delegated or transferred, shall be deemed for the purposes of this sub-paragraph to be attendance at a meeting of the Council. (3) If any member of the Council dies or vacates his seat the vacancy shall be filled by the candidate on the party list of such member at the preceding elections who obtained the largest number of votes after the last candidate on that list who was elected : Provided that,if for any reason such vacancy cannot be filled from among the candidates on such party list, or if there are no candidates on such party list, the District Commissioner may,— (a) in the case of the first Council, appoint any fit person to fill the vacancy, and in the case of any subsequent Council, either direct that the vacancy be not filled or appoint any fit person qualified under the provisions of this Order to be elected as a member of the Council to fill the vacancy, or (b) order that the number of councillors be reduced by the number of vacancies which cannot be filled.

(a) to see' that every decision of the Council is duly executed; and in connection therewith to sign documents and'to do all other things incidental thereto; (b) where such decision necessitates the expenditure of funds of the Council to see that such decision is in accordance with the approved estimates or is otherwise in accordance with the provisions of this Order or any other Ordinance or law.

(3) In the absence of the President the Vice­President or if there is more than one Vice­President such Vice­President as shall be nominated for the purpose by the Council shall perform the duties and exercise the functions assigned to the President. . (4) The President and any Vice­President respectively may receive from the Council fund such salary as may from time to time be fixed by the Council, with the approval of the District Commissioner.

(5) A person appointed or elected to any office under this Order at any time resign his office by writing signed by him and ־may delivered, — (a) in the case of the President and a Vice­President, to the Council and the District Commissioner; and (b) in the case of a member, to the President, and the resignation shall take effect upon the receipt of the notice of resignation b}' the body and/or person to whom ih is required to be delivered. (6) The District Commissioner may, if in his opinion it is in the interests of the Council, — (a) suspend the President or a Vice­President from his func­ tion as President or Vice­President, and may direct that any other councillor shall act as President or Vice­President in his place. Such suspension may be either for a period to be prescribed in the order of suspension or until the District Commissioner shall otherwise direct; the order of suspension shall state what salary, if any, shall be paid to the person suspended during the period of suspension; (b) dismiss the President or a Vice­President from his office of President or Vice­President and appoint another councillor as President or Vice­President in his place.

(2) Subject to the provisions of the sixth schedule hereto the Council, with the approval of the District Commissioner, may make standing orders for regulating its conduct of business and the con• duct of business of any committee thereof, and, with the like approval, it may vary and revoke such orders. (3) If for any reason and at any time the number of members of the Council falls belowr the number provided for a quorum by the sixth schedule hereto, and the vacancies are not or cannot be filled from among the candidates on the party lists in accordance with paragraph 7(3) hereof, the District Commissioner — (a) may direct tiiat (i) the number of the members of the Council constitut• ing a quorum shall be reduced, or (ii) the Council shall be deemed to have expired, or (iii) elections shall be held to fill the vacancies, or (b) may nominate persons qualified to be elected as members of the Council to fill the vacancies or any of them. . (4) Subject to the provisions of this Order and the sixth schedule hereto in respect of a quorum of the Council and of a committee thereof, the proceedings of the Council or of a committee shall not be invalidated by any vacancy among their number, or by any defect in the election or qualification of any member thereof.

10.—(1) Unless the District Commissioner shall otherwise order Powers and in respect of all or any of the following matters, and subject to the duties of provisions of any Ordinance or law, the Council shall have power Council. within its area of jurisdiction :— (a) to construct, maintain or repair any street, road or public way, bridge, culvert or footpath, (b) to take steps to abate any nuisance, (c) to provide for the removal and disposal of night soil and hous'e refuse, the voiding of cesspits and the emptying of all sewers, drains, privies, water closets, earth closets, culverts, gutters, water courses, ashpits and sanitary appliances, and for the prevention of the breeding of mosquitoes, (d) to provide measures for the destruction of rats, mice and other vermin, (e) to provide for the licensing of dogs, and for the destruction of ownerless dogs, cats or other animals, ; (/) to establish and regulate slaughter houses and provide for the detention of animals intended for slaughter, the inspec• tion for sanitary purposes of animals before being slaugh• tered and of their carcasses, the marking of the carcasses of 1HE PALESTINE GAZETTE NO. animals slaughtered i'or human consumption and the disposal of the carcasses of diseased or dead animals, (g) to construct and maintain water works for the supply of water for agricultural, domestic and other purposes, and re• gulate the supply of water and the terms and conditions sub• ject to which water will be supplied for such purposes and the price to be paid for any water so supplied and the charges in respect of the installation thereof,

(h) to control the laying out, construction, erection, demolition, alteration and repair of buildings, streets, roads, public ways, footpaths, yards, cisterns, wells, drains, sewers, and all sanitar}' appliances, (i) to control the line of frontage of buildings, the size of build• ing plots and the proportion of the area of plots upon which buildings may be erected, (j) to prescribe the precautions to be taken against accidents during the construction, erection, demolition, alteration or repair of any building, cistern, well, drain, sewer or other work or undertaking, (/i) to control, provide, maintain, administer and contribute towards educational, cultural and social welfare services and institutions, and to provide, maintain, administer and con• tribute towards public health services and institutions,

(I) to establish and regulate public markets and places of public auction and to prescribe fees to be paid for the use of such markets or places of public auction, (m) to regulate and inspect cinemas, theatres and other places of public entertainment and provide for the protection of the public from the danger by fire therein, and to make a charge on tickets sold in respect of public entertainments, provided that no such charges shall be made except under by-laws made in accordance with the provisions of this Order, (n) to regulate common lodging houses, (o) to regulate any trade or business which may be injurious to public health or a source of public danger, or which other• wise it is in the public interest expedient to regulate, (p) to regulate and control the establishment of businesses, trades and industries, and the opening and closing hours thereof, and, without prejudice to the generality of this power, to prescribe the opening and closing hours on any specified day of any particular class of businesses, trades and industries, loth January, 1942 THE PALESTINE GAZETTE NO. 1163—SUPPLEMENT NO. 2.

(q) to name and re­name when necessary all roads, streets, lanes and squares and quarters and to affix such names in conspicuous places therein, and to cause all buildings in such roads, streets, lanes and squares and quarters to be numbered. (r) to provide for the licensing, registration and control of hawkers, pedlars, street sellers, photographers and bill­ posters , (s) to establish, maintain and regulate public baths and wash houses, (t) to construct, maintain and control swimming pools and regulate bathing therein, (u) to regulate cemeteries and prescribe the depth and length of graves, (v) to enter any house or building reasonably suspected to be insanitary for the purpose of ascertaining its state of cleanli­ ness or otherwise and to issue an order to the occupier there­ of requiring him to take such measures as may be specified in such order, (w) to provide, establish, lay out, plant, improve, maintain, regulate and control parks, gardens and other places of resort or recreation for the use of the public and to contribute to the cost of maintenance of parks and gardens and other places of resort or recreation provided by any person for the use of the public, (%) to plant trees in any streets or public places and erect tree guards, provided that such streets or places are not unduly obstructed thereby, (y) to organise campaigns for combating insect pests and fruit diseases and to levy the cost of the campaign on the persons receiving the benefit of such services, (z) to regulate and control the harvesting of crops,

(aa) to order the demolition of any buildings which are in­ sanitary or otherwise injurious to public health or are dan­ gerous,

(bb) to require the owner of land or premises to construct and when constructed to maintain and keep clean sewers, drains, privies, cesspools, latrines or urinals, (cc) to regulate, control and provide for the watching of pre­ ׳•׳:••: ,mises, lands, streets and roads (dd) to do such acts as are necessary for the conservancy of the area or any part thereof, '% THE PALESTINE GAZETTE NO. 1163—SUITLKMKXT No. 2. 15th January, 1942

(ce) to do any act which the Council is required by this Order or any Ordinance or law to do, (//) to execute and carry out any undertaking certified by the District Commissioner to be an undertaking of public utility. (2) Subject to the provisions of any Ordinance or law the Coun• cil may within its area of jurisdiction and with the approval of the District Commissioner — (a) build public buildings and do other public works, (b) grant any concession or monopoly to any person, (c) act as trustees of any trust for public purposes. (3) The Council shall with regard to any of the - matters and powers enumerated in the preceding sub-paragraphs comply with any requirements and directions made by the District Commis• sioner : Provided that in such requirements, directions and approvals under sub-paragraph (2) hereof the District Commissioner shall have regard to the approved by-laws and the current estimates of the Council.

Committees of ' 11.—(1) The Council shall, with the approval of the District the Council. Commissioner, have power to appoint a committee or committees for any such general or special purposes as in the opinion of the Council would be better regulated and managed by means of a com• mittee, and may with the like approval delegate to a committee ' so .appointed, with or without restrictions or conditions, as it thinks fit, any functions exercisable by the Council either with respect to the whole or a part.of its area of jurisdiction, except the power of imposing and levying rates or fees, or of borrowing money or of issuing by-laws. . (2) The number of members of a committee appointed under this paragraph, the chairman thereof, and their term of office, and the area, if any, within which the committee is to exercise its authority, shall be fixed by the Council, with the approval of .the District Com• missioner.

; (3) A committee* appointed under this paragraph other than the Executive Committee or the Finance Committee of the Council may,' with the approval of• the District Commissioner, include per• sons who are not members of the Council: Provided that such persons are qualified under paragraph 7(1) hereof : Provided also that at least two-thirds of the members of every committee shall be members of the Council: 15th January, 1912 THE PALESTINE GAZETTE NO. 1163—SUPPLEMENT No. 2. 97

And provided further that the District •Commissioner may from time to time appoint any person being an officer of the Gov­ ernment of Palestine to be an advisory member of any committee appointed under the provisions of this paragraph. ,The Council, with the approval of the District Commissioner (־ (4 may from time to time discharge, alter, discontinue or reconstitute any such committee and fill vacancies therein. : (5) Every member of a committee appointed under this para­ graph who at the time of his appointment was a member of the Council shall, by ceasing to be a member of the Council, also cease to be a member of the committee.

12.—(1) The Council shall have power, with the approval of the Officials and District Commissioner, to appoint any fit person to any office or labourers of the Council. offices, who shall receive such salary as shall be fixed by the Council, with the approval of the District Commissioner. (2) The Council shall require every official appointed by them to .an, office involving financial responsibility to give such security as the Council thinks proper for the due execution of his office, and the President shall satisfy himself from time to time as to the existence and sufficiency of such security. (3) The President of the Council may employ and dismiss any daily or weekly labourers required in the service of the Council to carry out any work for which provision is made in the current estimates of the Council approved in accordance with the provisions of this Order. .(4) Every.officer of the Council shall hold office during the pleasure of the Council, so, however, that he shall not be dismissed from his office without the approval of the District Commissioner. (5) No official of the Council shall be concerned or interested directly or indirectly by himself, his wife or her husband, or his partner or his agent, in any contract or work made with or executed for the Council. If any official be so concerned he shall be in­ capable of holding any office under the Council, and shall, on con­ viction, be liable to a fine not exceeding ten pounds : Provided that no person shall be so incapacitated or so liable to any fine by• reason only that he is a shareholder, not being a director, manager, officer or agent, of any company which is a party to any .contract with, or executes any work for, the Council. (6) Subject to the provisions of this paragraph, the Council shall have power, with the approval of the District Commissioner, to make regulations providing :— (a) for the term of office of the officials and labourers of the Council, for their conditions of service and for inquiring into their conduct; and 15th January, 1942

(b) for the grant of leave of absence to the officials and labour• ers of the Council, and for the grant of pensions or gratu• ities to them or to their dependants or legal personal repre• sentative, payable from the fund of the Council: Provided that no pension or gratuity, granted in accord• ance with the provisions of this sub-paragraph, or any part thereof, shall be assignable or liable to be attached in respect of any debt or claim other than a debt due to or a claim by the Council.

If at any time it appears to the District Commissioner that District Com- the Council has failed to carry out any duty or work it is required or nussioner. empowered to do under this Order he may make an order requiring the Council within a time specified therein to carry out such duty or work, and if the Council fails within such time to comply with such order the District Commissioner may appoint any person whom he considers suitable to carry out such duty or work, and may fix the remuneration to be paid to such person and may direct that such remuneration and the cost of carrying out such duty or work shall be a charge against the funds of the Council.

By-laws. 14. The Council shall have power, with the approval of the District Commissioner, to issue by-laws for the securing of health, order and internal administration, including road development, within the area of its jurisdiction and without prejudice to the generality of the foregoing power such by-laws may include pro• vision for the imposition and collection of the rates and fees set out in paragraph 16 of this Order.

Financial 15.—(1) The financial year of the Council shall run from the provisions. first day of April to the thirty-first day of March of the following year. The Council shall draw up annually a budget of its revenue and expenditure and shall submit it to the District Commissioner for his approval prior to the first day of January in each year. (2) Subject to the approval of the District Commissioner the Council may vary its current annual budget or transfer any sum or sums from one item of revenue or expenditure to another. (3) The Council shall submit to the District Commissioner prior to the first day of June in each year a copy of its accounts for the preceding financial year audited by an auditor approved by the Dis• trict Commissioner. (4) The District Commissioner may disallow every item of ex• penditure contrary to the approved estimates and may surcharge the sum on the person or persons making or authorising the making of the unauthorised payment. Where the amount surcharged is not made good to the Council within two months after such sur• charge is reported by the District Commissioner to the Council, the Council shall sue for the sum, and shall, if it appears to the ' Court that the expenditure of the amount surcharged was not 15th January, 1942 THE PALESTINE GAZETTE No. 1163—SUPPLEMENT No. 2. 99 authorised in the approved estimates of the year in which the ex­ penditure was incurred, be entitled to judgment for the amount surcharged against any person or persons who appears or appear to have concurred in such expenditure. (5) If the Council neglects or refuses to sue for the recovery of any amount surcharged as provided in the preceding sub­paragraph, the District Commissioner may appoint a suitable person to sue in the name and on behalf of the Council for the recovery of such amount, and the costs of such proceedings shall be payable by the Council.

16.—(1) Subject to the approval of the District Commissioner Kates, ־the Council shall have the power to levy annually all or any of the and fecs following rates and fees on property or persons situated or residing within the area of the jurisdiction of the Council:— (a) a property rate on all occupied and unoccupied buildings and lands, payable by the owners thereof, provided that such rate shall not exceed ten per centum of the rateable value of the property on which it is assessed; (b) a general rate on all occupied buildings and lands, payable by the occupiers thereof, provided that such rate shall not exceed ten per centum of the rateable value of the property on which it is assessed; (c) an education rate on all occupied buildings and lands, pay­ able by the occupiers thereof, provided that such rate shall not exceed seven and a half per centum of the rateable value of the property on which it is assessed; (d) any other rates which may be lawfully levied by a Local Council under the Local Councils Ordinance, 1941, or any other Ordinance or law in force from time to time, to be fixed by the Council and approved by the'District Commis­ sioner; (c) fees for the licensing of trades and industries leviable under any Ordinance in force from time to time; (/) fees for services provided by the Council, payable by persons enjoying the benefit of such services; (g) fees for licences or otherwise as a Municipal Corporation is authorised for the time being to impose or as may be im­ posed by the Council under the provisions of any Ordinance or law. (2) Subject to the approval of the District Commissioner the Council shall have power :— (a) to levy all or any of the rates leviable by it under the pro­ visions of this paragraph at different rates or percentages on property of different categories and all or any of the fees for services at different rates or sums on different persons, 10.0 15th January, 1942

(6) to exempt from payment of property rate, general rate, educational rate and any other rate levied under sub-para• graph 1(d) of this paragraph any area of cultivated land in excess of 5 dunuins, which is owned by a single owner or group of co-owners, or occupied by a single occupier or group of co-occupiers, (c) to reduce or remit the payment of any of the above-men• tioned rates, fees or other sums on account of the poverty of any person liable to pay such rates, fees or other sums, but no person shall be exempted from the payment of any such rates, fees or other sums by reason only that he is not resident within the area of jurisdiction of the Council. (3) The assessment of property within the area of jurisdiction of the Council for the purpose of payment of rates shall be made and determined in accordance with the provisions set out in the seventh schedule hereto. (4) Every assessment shall be made to begin from the first of April and shall be for a period of three years or for any other period that may be prescribed by the Council with the approval of the District Commissioner. (5) In every third year or in any such other period to be pre• scribed under sub-paragraph (4) hereof a new assessment shall be made of all the lands and buildings within the area of jurisdiction of the Council in accordance with the provisions of the seventh schedule hereto : Provided that if at the end of such three years or of such other period a new assessment list has not been made the previous assess• ment list and supplementary assessment lists then in force shall remain valid and in full force until the new assessment list be completed. (6) The rates due to the Council shall be recoverable according to the law in force from time to time for the recovery of rates due to a Municipal Corporation, and the fees and other sums due to the Council shall be recoverable according to the law.in force from time to time for the recovery of fees due to a Municipal Cor• poration. (7) The annual rates due from any person to the Council shall be paid by such person by twelve equal instalments upon the first day of every month : Provided that the Council may by by-laws made in accordance with the provisions of this Order provide for the payment of rates by other instalments and upon other dates.

(a) borrow money from any person for any purposes approved by the District Commissioner, and to secure the payment of principal and interest of any such loan may mortgage or charge any property or revenues of the Council : Provided that the aggregate amount of moneys due from the Council on loans shall not at the time when'any loan is contracted exceed the total rateable value of all the buildings and occupied and unoccupied lands within the area of juris• diction of the Council included in any assessment list for the time being in force, made in accordance with the provisions of this Order; (b) borrow temporarily from the bank at which the account of the Council is kept, any sum or sums.

18. Subject to the approval of the District Commissioner, the Power of Council Council shall have power — to deal with immovable (a) to purchase, take on lease or otherwise acquire immovable property. property or rights and interests therein; and (b) to sell, mortgage, lease, exchange or otherwise dispose of or deal with any immovable property registered in its name : Provided that it shall not be necessary to obtain the approval of the District Commissioner for a contract of taking on lease im• movable property for a period not exceeding three years if the total rent payable thereunder does not exceed the amount prescribed by the District Commissioner under proviso (a) to paragraph 19(3) of this Order.

19. —(1) Subject to the provisions of this Order or any Ordinance' Power of Council or law relating to the capacity of the Council to make any contract to contract. or to the form thereof, the Council shall have power to make any contract in accordance with the provisions of this paragraph for any purpose necessary for or connected with or incidental to the per• formance of the duties or the exercise of the powers of the Council. (2) The President may on behalf of the Council enter into any contract which the Council has power to make without the neces• sity of a special resolution of the Council authorising the making of such contract, provided that :— (a) the subject matter of such contract does not exceed an amount to be prescribed from time to time by the Council, and (b) the contract is to be completed within the financial year . in which it is made, and (c) financial provision exists for the amount of the expenditure, if any, in the approved estimates for the financial year in which such contract is made, and the particulars of such contracts shall be recorded in a book kept for that purpose. 102

(3) Where the subject matter of any contract which the Council has power to make exceeds the amount prescribed by the Council under sub-paragraph (2) hereof, the President may, on a resolu• tion of the Council authorising the making thereof and after ob• taining the approval of the District Commissioner thereto, enter into such contract on behalf of the Council: Provided that, — (a) where the subject matter of any such contract does not exceed an amount to be prescribed from time to time by the District Commissioner, or (b) where such contract involves an expenditure and financial provision exists for the amount of such expenditure in the approved estimates for the financial year in which such con• tract is made, and it can be completed within such year, it shall not be necessary to submit such contract to the District Commissioner and to obtain his approval thereto. (4) Where the Council proposes to enter into any contract which it has power to make and the expenditure involved exceeds an amount to be prescribed from time to time by the District Com• missioner, the Council shall call for tenders in accordance with the rules set out in the eighth schedule hereto, and, after considering the recommendations of the Tender Committee, shall by resolution authorise the making of such contract. (5) Any contract purporting to have been made in accordance with the provisions of this paragraph shall, until the contrary is proved, be deemed to have been so made.

Council fund. 20.—(1) All moneys received by or on behalf of the Council by virtue of the provisions of this Order or of the principal Ordinance or any other Ordinance or law or otherwise, shall constitute a fund which shall be called "the Council fund" (hereinafter referred to as "the fund").

(2) The fund shall be applied to and charged with all expenses lawfully incurred by the Council under the provisions of this Order or of the principal Ordinance or any other Ordinance or law, and any other sums legally due and owing to the Council:

Provided that no payment shall be made out of the fund unless it has been authorised by the current estimates or has been espec• ially authorised by the Council with the approval of the District Commissioner.

(3) The treasurer of the Council, or if there is no treasurer, some officer specially appointed by the Council shall be responsible for the security of the fund. 15th January, 1942 THE PALESTINE GAZETTE NO. 1163—SUPPLEMENT NO. 2. 103

(4) All moneys belonging to or received for and on account of the fund, shall forthwith be paid into the account of the Council at such bank as the Council shall, with the approval of the District Commissioner, appoint : Provided that the Council may from time to time authorise the treasurer to retain in his hands a sum sufficient for the daily ex• penses of the Council : Provided also that where there is no bank within the Council area all such moneys shall be securely kept in a manner to be ap• proved by the District Commissioner. (5) All orders, payment vouchers or cheques against the fund shall be signed by the President and countersigned by the treasurer or any officer specially appointed in accordance with the provisions of sub-paragraph (3) hereof to be responsible for the security of the fund, and the bank may pay all such orders, payment vouchers or cheques against the fund which are so signed and counter• signed. (6) Any moneys comprised in the fund may be invested from• time to time in such manner as the Council may decide with the approval of the District Commissioner. (7) Subject to the foregoing provisions of this paragraph the District Commissioner may issue instructions with regard to the administration of the fund, and the Council shall administer the fund in accordance with such instructions.

21. —(1) The President shall as soon as possible after the first Eeport of day of April in each year prepare a detailed report of the adminis• administration tration of the Council area for the previous twelve months. of Council. (2) Such report shall be submitted to the Council and, together with any amendments made therein by the Council or any resolu• tions thereon, shall be forwarded to the District Commissioner not later than the first day of June in each year.

22. The Local Councils (Rishon-le-Tsiyon) Order is hereby re• Eevocation voked : provided that :— and saving. Laws of Pal., (a) The Local Council of Rishon-le-Zion existing immediately p. 1863. before the commencement of this Order shall remain and continue in office for a period of three years from the date of its election when it shall be replaced by a Council elected under the provisions of this Order, and the provisions of this Order shall apply to such existing Council as though the members thereof had been elected and such Council had been constituted under the provisions of this Order, and the Pre• sident and Vice-President thereof shall be deemed to be President and Vice-President as though they had been ap• pointed under the provisions of this Order. 104 THE PALESTINE GAZETTE NO. 1163—SUPPLEMENT NO. 2. loth January, 1942

(b) All by-laws lawfully made by the Local Council of Rishon- le-Zion and in force at the date of this Order shall remain in full force and effect until repealed by by-laws made under the provisions of this Order. (c) All valid licences and permits issued by the Local Council of Rishon-le-Zion and existing at the date of this Order shall be deemed to have been issued under this Order, and it shall not be necessary to obtain under the provisions of this Order any further licence or permit in respect of the matters, acts or things for which such existing licences or permits were issued until the expiration thereof. (d) Estimates which have been prepared by the Local Council of Rishon-le-Zion and approved by the District Commis• sioner before the date of this Order shall be deemed to be estimates under the provisions of this Order and the provi• sions of this Order shall apply to such estimates. (e) Any rate, tax or fee lawfully imposed by the Local Council - of Rishon-le-Zion in respect of any period current upon the commencement of this Order shall be recoverable by the Council established by this Order, as though it had been imposed under the provisions of this Order. (/) All property and assets of any kind whatsoever and all in• terest therein validly vested in the Local Council of Rishon- le-Zion at the date of the coming into effect of this Order shall at such date be vested in and held by the Council established under the provisions of this Order. (g) All debts, liabilities and obligations and all interest therein due to the Local Council of Rishon-le-Zion shall be trans• ferred and be deemed to be due to the Council established under the provisions of this Order. (h) All debts, liabilities and obligations lawfully incurred and due from the Local Council of Rishon-le-Zion shall be trans• ferred to and be deemed to be the debts, liabilities and obliga• tions of the Council established under the provisions of this Order.

FIRST SCHEDULE.

SECOND SCHEDULE. QUALIFICATIONS FOR ENROLMENT IN REGISTER OF VOTERS. 1. Every person residing or owning property within the area of jurisdiction of the Council shall be entitled to be enrolled in the register of voters, who — (a) is not less than twenty-one years of age, and (b) has not, within a period of five years prior to the date prescribed for the pre• paration or revision of the register of voters, completed a sentence passed on him by a Court-of-Law in Palestine of a term of imprisonment of one year or upward, or has received a free pardon for the offence for which he was so sentenced, and (c) has resided in or has been the owner of property situated within the area of jurisdiction of the Council for a period of not less than twelve months im• mediately preceding the date prescribed for the preparation or revision of the register of voters, and (d) has, within the period of twelve months immediately preceding the date prescribed for the preparation of the register of voters under paragraph 5'of this Order or immediately preceding the date prescribed for any revision of such register, as the case may be, paid rates due from him to the Council, to an amount of at least five hundred mils in respect of any period of twelve months : Provided that if the head of the family has paid, in accordance with the requirements of this sub-paragraph, a rate of more than five hundred mils, then by virtue of each additional five hundred mils so paid, over and above the first five hundred mils, a son or daughter in the order of their ages, (not being already recorded in the tax registers of the Council) shall be deemed to have satisfied the requirements of this sub-paragraph as to the payment of rates. 2. A wife or a husband who is not less than twenty-one years of age shall be entitled to be enrolled in the register of voters if she or he is the wife or the husband of a person entitled to be enrolled in the register of voters in respect of premises in which they reside together.

THIRD SCHEDULE.

QUALIFICATIONS FOR MEMBERSHIP OF COUNCIL. 1. FIFTH SCHEDULE.

RULES GOVERNING CONDUCT OF ELECTIONS.

1. The District Commissioner shall appoint a Returning Officer for the conduct of the elections. 2. —(1) The nomination of candidates shall be made in accordance with the prin• ciple of proportional representation. (2) Each candidate shall be nominated in writing on a party list in the form prescribed, subscribed by the candidate, and by not less than five per centum of the total number of voters (male and/or female) on the register of voters. The party list shall be delivered to the Returning Officer at the time and place previously noti• fied by notice published locally. The Returning Officer, in consultation with.the Electoral Committee, shall scrutinize each list to see that it is in order and shall forthwith publish notice of the party lists of candidates validly nominated by placard• ing the lists outside the Council's offices and on or by the doors of places of worship and other public buildings. (3) A party list may contain a number of names not exceeding the number of councillors, but no party list shall contain less than the names of three candidates/ 107

(4) No person is authorised to stand as a candidate for more than one party list. (5) No voter shall sign more than one party list, and if he does, his signature shall not be counted on any of the lists which he signed. (6) Any person who is entitled to vote may by notice in writing within seventy- two hours of the time at which the party lists are placarded, object in writing to the Returning Officer to the nomination of any candidate as not being duly qualified or as not having been duly nominated. The Returning Officer, after consulting with the Electoral Committee, shall decide finally on any objection. (7) If the number of candidates nominated does not exceed the number of vacan• cies, the Electoral Committee shall thereupon declare the persons nominated to be elected members, and shall forthwith publish a notice by placarding the names of the candidates so elected outside the Council's offices and on or by\the doors of places of worship. (8) If the election is to be contested, the Returning Officer shall by public notice appoint a day not less than seven or more than twenty days .after the day appointed for nomination, on which a poll will be held.

3. —(1) Every candidate for the office of councillor who shall be nominated there• for shall deposit with the Returning Officer the sum of five pounds, and no candidate who has not complied with this provision shall be elected by poll or otherwise to the office of councillor. (2) The deposit made by a candidate in respect of any election under sub-para• graph (1) hereof shall be returned to such candidate by the Returning Officer :— (a) if he is elected a member of the Council, or (b) if one or more persons whose names appear in the party list in which the name of the candidate appears is or are elected. If he shall not be elected or if no other candidate whose name appears in the party list in which the name of the candidate appears is elected, his deposit shall be for• feited and shall be paid into the Council's fund. (3) If any candidate who has made a deposit shall die before the election his de• posit shall be returned to his personal representative or heirs. 4. —(1) The Returning Officer shall cause notice of the day, the time and place for taking the poll and the name, residence and calling of each candidate to be posted at several conspicuous places, not less than five'days before the taking of the poll. (2) Not less than three days before the date of the poll all electoral agreements that have been made in accordance with paragraph 16 of this schedule for the pooling of votes by electoral parties in the event of a poll shall be delivered to the Returning Officer. The Returning Officer shall scrutinize each agreement to see if it is in order and shall forthwith publish those validly made by posting copies thereof out• side the Council's offices. 5. —(1) The poll shall be taken by secret ballot. !!08 THE PALESTINE GAZETTE NO. 1163—SUPPLEMENT NO. 2. 15th January, 1942

(2) The Returning Officer shall be responsible for the conduct of the poll and may appoint such persons and clerks as he thinks fit to assist him therein. 6. The Returning Officer shall provide for use at each polling station :— (a) a copy of the register of voters or registers of voters for the quarter or quar­ ters concerned; b).a box, for the receipt of the votes (hereinafter called the ballot box) which)• , .׳ .• • shall be provided with a lock and key; (c) an adequate supply, for the use of voters, of the validly nominated lists, copies of which shall be placarded in conspicuous places within the polling station; .: . . • (d) an adequate supply of envelopes to contain party lists. ' s 7. The Returning Officer may appoint any fit person (hereinafter included in the term Returning Officer) to be in charge of a polling station, and a clerk or clerks to assist him, provided that every person so appointed shall before entering upon his duties take an oath or make an affirmation to observe the secrecy of the ballot. 8. The Returning Officer shall, before the commencement of the polling, ex­ hibit the ballot box open and empty to the members of the Electoral Committee if .any are present or to any other person who may be present, and shall thereafter in their presence lock it up and place a seal upon it in such a manner as to prevent it being opened without breaking the seal; he shall then explain to such persons as may be present the manner of voting and the number of persons for whom votes may be given. 9. —(1) Every voter shall bring with him or obtain at the polling station a copy of the party list of candidates for which he desires to vote. All party lists shall be on white paper and of dimensions and form prescribed by the Returning Officer. (2) On admission, the voter shall produce his voters' identity card and the clerk • shall thereupon place a mark against the name of such voter in the copy of the register of voters. (3) The Returning Officer shall then stamp the identity card with the word "Voted" and shall retain it and shall mark an envelope with his initials and deliver it to the voter. (4) The voter shall enclose his copy of the party list in the envelope delivered to him by the Returning Officer and shall place the envelope with its enclosure in the ballot box in the presence of the Returning Officer. (5) Each voter is authorised to vote for one list only.

10. —(1) The voter shall delete from his party list not less than half the number of names, provided that if the number of names be an odd number he shall delete not less than one more name than he retains, but he shall not add any name thereto*. (2) If the voter has not deleted a sufficient number of names from his party list, the Returning Officer or his assistant shall, on the counting of the votes, make the necessary number of deletions, beginning from the bottom of the list. lath January, 1942

11. The Returning Officer shall make arrangements regarding the counting of the votes in the presence of the candidates or their agents and the Electoral Com• mittee as soon as practicable after the closing of the poll and shall give to the can• didates or their agents and to the Electoral Committee notice of the time and place at which he will begin the counting. 12. The Returning Officer and his assistants together with the candidates or their agents and the members of the Electoral Committee may be present at the counting of the votes. If any candidate or his agent shall fail to be present at the counting of the votes, the Returning Officer shall proceed as if the candidate were present in person or represented by his agent. No other person may be present at the counting of the votes unless authorised by the District Commissioner. 13. If the counting cannot be completed in one sitting, the Returning Officer shall take adequate precautions for the safety of the ballot papers during the interval. 14. —(1) Any party list not enclosed in an envelope initialled by the Returning Officer shall be void and not counted. (2) If more than one party list be enclosed in an envelope, all of them shall be void and the vote not counted. (3) If any names have been added to a party list, the whole list shall be void and the vote shall not be counted. 15. The total number of party lists cast by the voters shall be divided by the number of seats of the Council to be filled and the quotient to the nearest integer shall be the quota of votes required to qualify for a seat. 16. —(1) It shall be lawful for two or more electoral parties to enter into an agree• ment (hereinafter called "electoral agreement") to pool their votes : Provided that no electoral party shall become a party to more than one electoral agreement in respect of any particular election. (2) An electoral agreement shall be in writing and shall only record the consent of the electoral parties which have entered into the agreement to pool their votes in the event of a poll, and shall be signed on behalf of each such electoral party by at least a majority of the duly nominated candidates thereof : Provided that no such agreement shall be of any effect unless it has been duly de• livered to and posted by the Returning Officer in accordance with paragraph 4(2) hereof. 17. —(1) For the purposes of this paragraph the expression "electoral block" means every combination of electoral parties which have entered into a valid elec• toral agreement under paragraph 16 hereof and also every electoral party which is not a party to an electoral agreement. (2) Each electoral block shall be entitled to one seat on the Council for each quota of votes.it receives. (3) The remaining seats shall be allotted to the electoral blocks having the largest remainder of votes after substraction of the complete quotas : 110 THE PALESTINE GAZETTE NO. 1163—SUPPLEMENT NO. 2. 15th January, 1942

Provided that when an electoral block has received a number of votes which is less than a full quota, all votes so obtained shall be deemed to be a remainder of votes. (4) The seats allotted to an electoral block shall, if such electoral block comprises more than one electoral party, be distributed as amongst such parties in the fol• lowing manner : (a) Each electoral party being comprised in such electoral block shall be entitled to one seat on the Council for each quota of votes it receives; (b) the remaining seat or seats allotted to such electoral block shall be allotted to the electoral party or parties comprised in such electoral block having the largest remainder or remainders of votes after substraction of the complete quotas : Provided that when an electoral party has received a number of votes which is less than a full quta, all votes so obtained shall be deemed to be a remainder of votes.

18. The order of priority of candidates within any party list shall be governed by the number of votes cast for each of the candidates.

19. When an equality of votes is found to exist between any parties or candidates at an election, the priority shall be decided by the drawing of lots in public by the Returning Officer.

20. Immediately after the counting is over, the Returning Officer shall prepare a list showing the results of the poll and shall post it on the door of the Council's offices and on or by the doors of places of worship.

21. Any person who voted or had a right to vote or alleged himself to have been a candidate or claims to have had a right to be returned or elected at such elections or the Attorney General or his representative, may within fifteen days of the pub• lication of the result of the elections as aforesaid present an election petition to the Magistrate's Court against the election of any member of the Council on any of the• following grounds :— (a) that the election was avoided by personation, treating, undue influence,, bribery or illegal practice, as defined in the Municipal Corporations Ordinance, or (b) that illegal practice or illegal payment or employment, as defined in the• Municipal Corporations Ordinance, may be reasonably supposed to have af• fected the results of the elections, or (c) that the person elected was at the time of the election disqualified from being- elected under this Order, or (d) that the person elected was not duly elected by a majority of lawful votes..

22. —(1) At the conclusion of the trial of an election petition the Court shall determine whether the member of the Council of whose election complaint has been 15th January, 1942 111 made has been duly elected or whether any other person, and if so what person was duly elected, or whether the election was void, and shall certify such determination to the District Commissioner whereupon it shall be final and the District Commis• sioner shall give effect to such determination and declare whether the candidate whose return or election is questioned by such petition or any other and what person is duly elected or whether the election is void. (2) If the District Commissioner declares the elections void he shall appoint a day for the holding of new elections to the Council.

SIXTH SCHEDULE.

REGULATIONS FOR MEETINGS AND CONDUCT OF BUSINESS OF THE COUNCIL AND OF COMMITTEES THEREOF.

1. There shall be at least one ordinary meeting of the Council in each month for the transaction of general business, which shall be held on the day or days to be fixed by the Council. 2. Meetings of the Council shall be open, and every question coming before the Council shall be decided by open voting :

Provided that the Council may, if the majority of members present so determiner exclude the public from any meeting thereof. 3. The President may at any time call a meeting of the Council, and the chair• man of a committee may at any time call a meeting of the committee of which he is chairman. 4. Thirty-six hours at least before any meeting of the Council or of a committee thereof *a summons to attend the meeting, specifying the business to be transacted thereat, and signed by the President or the chairman, as the case may be, shall be left at the usual place of abode of every member of the Council or of the committee r Provided that such summons may be sent by post not less than thirty-six hours before any meeting. 5. If no meeting of the Council is held for one month any number of members of the Council being not less than one-third may request the President to call a meeting, and if the President — (a) shall refuse to do so, or (b) shall neglect to do so for a period of fourteen days, from the date of such request, such members may call a meeting of the Council.

6. Thirty-six hours at least before any meeting of the Council or of a committee notice of the time and place of the intended meeting, signed by the President, or 112 15th January, 1942 chairman, as the case may be, or if the meeting is called by members, by those members, shall be posted on or near the outer door of the Council's office during office hours. When the meeting is called by any members of the Council, the notice shall specify the business proposed to be transacted thereat.

7. Want of service of the summons on any member of the Council or of a com• mittee shall not affect the validity of the meeting.

8. No business shall be transacted at a meeting of the Council or of a committee other than that specified in the summons relating thereto, unless there are present and consenting at least two-thirds of the entire number of the Council or of the com• mittee.

9. At every meeting of the Council the President, if present, shall be chairman. If the President is absent, then the Vice-President shall be chairman. If both the President and the Vice-President are absent, then such councillor as the members of the Council then present choose shall be the chairman.

10. All acts of the Council or of a committee and all questions cominff or arising before the Councilor a committee may be done and decided by a maioritv of such members of the Council or committee as are present and vote, the whole number present at the meeting, whether voting or not, not: being less than a quorum, that is to say, half of the number of the whole Council or the committee plus one, except in.any case where this Order or any other Ordinance or law provides for a special quorum : .

Provided that if the number of the Council or of a committee shall be an odd number a quorum shall consist of half the number which exceeds the number of the Council or of the committee by one, e.g. if the number is nine, the quorum would be five :

Provided also that if at two successive ordinary meetings of the Council there be not a quorum of councillors present, any resolution passed by the second meeting, relating to any business, notice of which has been given by the summonses issued in respect of both such meetings, may be submitted to the District Commissioner, and if he approves hereof, such resolution shall be deemed to have been as lawfully made as though there had been a quorum of the Council present at such meeting.

11. In the case of equality of votes, the chairman of any meeting of the Council or of a committee shall have a second or casting vote.

12. Minutes of proceedings of and the resolutions taken at every meeting of the Council or of a committee shall be drawn up correctly and entered in a book kept for that purpose, and shall be signed at the same or at an ensuing meeting of the Council or committee, as the case may be, by the person who presided at the meeting of which the minutes form a record, and any minute purporting to be so signed shall be received in evidence without further proof. 113 loth January, 1942 THE PALESTINE GAZETTE NO. 1163—SUPPLEMENT NO. 2.

SEVENTH SCHEDULE.

RULES FOR THE ASSESSMENT OF PROPERTY.

1. —(1) The rateable value of unoccupied land when assessed on the basis of rate• able value shall be six per centum of the capital value thereof. (2) The rateable value of occupied land when assessed on the basis of rateable value shall be the rent for which it may be expected to let from year to year for the purpose for which it is used. (3) The rateable value of any building shall be the rent for which such building might be expected to let from year to year after deducting therefrom the following- amounts, that is to say :— (a) If the rent for which the building might be expected to let from year to year does not exceed forty pounds, one-fourth part of such rent; 1 (b) If the cent for which the building might be expected to let from year to year exceeds forty pounds, one-fifth part of such rent, or the sum of ten pounds, whichever is the greater : Provided that if the building is used for an industrial undertaking in which mechanically driven machinery is employed, one-third part of such rent be deducted. (4) If any room or rooms in a building is or are sub-let, the rateable value of such room or rooms shall be that proportion of the rateable value of the building which the number of room or rooms sub-let bears to the number of rooms in the building.

2. The Council shall have two committees to be respectively known as the As• sessment Committee and the Appeal Committee, and the provisions of paragraph 11 of this Order shall apply to such committees.

3. The Assessment Committee shall assess the property within the area of juris• diction of the Council in accordance with the provisions of this schedule and of any by-laws made under the provisions of this Order, and shall prepare a list called the assessment list which shall show the following particulars, that is say :— (a) The number of assessments; (6) As regards lands and buildings,— (i) the address or other designation of the property; (ii) the name of the owner of the property; (iii) the name of the occupier, if any, of the property; (iv) the description and category or grade of the property; (v) if the property be a building, the rent for which it might be expected to let from year to year and the rateable value thereof : Provided that the Assessment Committee shall not include in the as• sessment list any new building the construction of which is not completed, and a new building shall not be deemed to be completed until the build• ing or any part thereof is occupied; 114

(vi) if the property be occupied land and is assessed on the basis of rateable value, the rent for which it might be expected to let from year to year and the rateable value thereof; (vii) if the property be unoccupied land and is assessed on the basis of rate• able value, the capital value and the rateable value thereof.

4. —(1) The Assessment Committee and Appeal Committee respectively may re• quire the owner or occupier of any lands or buildings liable to assessment to furnish returns of the rent thereof, to produce such documents and give all such information as is necessary for the preparation of the assessment list or otherwise for the purpose of assessment, and for the like purpose each such committee or any person appointed by them for the purpose may, at any time between sunrise and sunset, enter and inspect any property and if necessary survey the same. (2) No entry shall be made under this paragraph into any dwelling-house in actual occupation without the consent of the occupier unless twenty-four hours previous notice in writing shall have been given where possible to such occupier, specifying as near as may be the hour of such intended entry. (3) Any person who — (a) refuses or fails to furnish such return or to produce such document or to give such information as aforesaid for the space of one week from the day on which he has been required to do so, or (6) knowingly makes such return falsely or incorrectly or gives such information knowing it to be false or incorrect, or (c) hinders, obstructs or prevents the Assessment Committee or the Appeal Committee or any person appointed by it as aforesaid from entering, in• specting or surveying any such lands or building as aforesaid, shall be guilty of an offence and shall on conviction be liable to a fine not exceed• ing fifty pounds, or to a term of imprisonment not exceeding 6 months or to both •such penalties.

5. —(1) The assessment list shall be deposited at the office of the Council and shall be open to the inspection of all persons assessed or liable to be assessed. (2) The President shall cause a notice to be published at the office of the Council and at such other public places as he may prescribe of the deposit of the list and shall state therein that any person may, within fourteen days from the publication of the notice, examine the list and take copies or extracts therefrom.

6. —(1) Within fourteen days of the publication of the notice aforesaid the Coun• cil or any person who is aggrieved by such list on any of the following grounds, that is to say — (a) that he is wrongly included as the owner or occupier of any land or building or as residing within the area of jurisdiction of the Council; (b) that he is not included as the owner or occupier of any land or building or as residing within the area of jurisdiction of the Council: 15th January, 1942 THE PALESTINE GAZETTE NO. 116§—SUPPLEMENT NO. 2. 115

(c) that the assessment of any land or building of which he is the owner or oc­ cupier is incorrect or unfair; (d) that some other person has been wrongly excluded from the list; (e) that the assessment of any land or building is incorrect or unfair; .that any property has been classed in the wrong category or grade (/)׳ may give notice in writing of his objection, specifying therein the grounds of his ob­ jection.

(2) The Assessment Committee shall notify the person making the objection, and if the objection affects directly any person other than the person making the objection also such other person, of the date on which it will be considered : such person may appear himself or by an authorised agent and the Council shall likewise be entitled to appear.

(3) The Assessment Committee shall make such correction in the assessment list as shall accord with their decision on the objection received, and when the assessment list has been finally corrected, shall approve the list by attaching their signature thereto. The list so appproved shall be deposited in the offices of the Council and, subject to the corrections made therein in accordance with paragraph 7(5) hereof, shall be the assessment list in force until a new assessment list is made under para­ graph 16 of this Order.

(4) The President shall cause a notice to be published at the offices of the Council and at such other public places as he may prescribe of the deposit of the amended assessment list and shall state therein that any person may within fourteen days from the publication of the notice examine the list and take copies or extracts there­ from.

7.—(1) Any person (including the Council) — (a) who has applied to the Assessment Committee for rectification of the as­ sessment list, or (b) who has been affected by such application, may within fourteen days from the publication of the notice of the deposit of the amended assessment list as aforesaid appeal to the Appeal Committee.

(2) The Appeal Committee may require that a deposit on account of costs not ex­ ceeding two pounds shall be paid in the case of each appeal by any person other than the Council prior to the hearing of his appeal and, if the deposit so fixed is not paid, shall reject the appeal.

(3) The Apppeal Committee shall hear the appellant and the respondent, or, at the discretion of the Appeal Committee, any other person on their behalf, and may hear such witnesses and call for such documents as it may consider necessary.

(4) A decision of the Appeal Committee shall be final and no appeal shall lie there­ from to any Court, except on a point of law, to a Magistrate's Court. 116

(5) The Appeal Committee shall cause the assessment list to be varied in con• formity with its decision and shall communicate the decision to the Assessment Committee. (6) The deposit provided in. sub-paragraph (2) of this paragraph shall be refunded to the appellant on determination of the appeal, unless the Appeal Committee shall certify in writing that the appeal was frivolously made or made for purposes of obstruction. If-the Committee so certifies, it may'direct that all or any part of the deposit shall be forfeited and paid into the Council fund. (7) A person liable to pay the rates imposed in accordance with the provisions of this Order shall, notwithstanding that he shall have appealed against the assess• ment list and such appeal shall not have been determined on the date when the rates become due, pay the amount thereof on such date : Provided that, where an alteration is made in the assessment list in consequence' of the decision in the appeal, the difference, if too much has been paid by the person liable, shall be repaid or allowed, or if too little has been paid by such person, shall be paid and may be recovered as if it were arrears of the rates. 8.—(1) The President may correct any clerical error in an assessment list. (2) Any property liable to pay rates which is omitted from an assessment list shall not, by reason of such omission, be relieved of its liability. Such property may be added by the Assessment Committee to the list at any time during which the assess• ment list is in operation and the owner and occupier thereof shall thereupon become liable to payment of the rates for the year in wdiich such addition is made, and for the payment of any rates for the preceding year or years during which the list has been in operation : notice in writing shall be given to the owner and/or the occupier of such property of the rates assessed thereon, and the rates so assessed shall become payable, subject to the provisions for objection and appeal in this schedule, on the expiration of fourteen days from the date of the notice. (3) If any building is completed after the preparation of an assessment list, such building may at any time after the completion thereof and during which the assess• ment list is in operation be added by the Assessment Committee to the assessment list, and thereupon the owner and occupier of such building shall become liable to the payment of rates as from the date of the completion of the building : notice in writing shall be given to the owner and occupier of such building of the rate assessed thereon, and the rates assessed thereon shall become so payable, subject to the pro• visions for objection and appeal in this schedule, on the expiration of fourteen days from the date of the notice. (4) If at any time any person ceases to reside within the area of jurisdiction of the Council or ceases to be the owner or occupier of any land or building in respect of which he is liable to pay any rate under the provisions of this Order, such person or his representative shall give notice in writing to the Council, and after the giving of such notice shall not be liable for any further instalment in respect of such rates : Provided that nothing herein shall be deemed to affect the liabilty of any such person for any instalments of rates which become due before the giving of such notice. 15th January, 1942 THE PALESTINE GAZETTE NO. 1163—SUPPLEMENT NO. 2. 117

(5) If any person shall become the owner or occupier of any land or building in respect of which any rate is payable under the provisions of this Order, such person shall be deemed to have been assessed on the date on which he becomes owner of occupier, and shall without any right of objection or appeal become liable to pay. any instalment of any rate which shall be payable between the date when he becomes owner or occupier and the expiration of the period for which the rate is assessed.

9.—(1) If an assessment shall, in accordance with the provisions of paragraph 16 of this Order, be made for more than one year, the Assessment Committee shall each year revise the assessment list and it shall make, or cause to be made, a fresh assessment — (d) when any building not included in the assessment list for the time being in force has been completed since the assessment list was made; (b) when an owner or occupier of any land or building has submitted a claim for revision on the ground' that the property owned or occupied by him has been destroyed or has sustained damage or that the rateable value of such property has decreased by twenty per cent, or more since the last assessment or that such property ought to be classified in another category; (c) when the Council has submitted a claim that the rateable value of any pro• perty in the list has increased by twenty per cent, or more since the last as• sessment or that such property ought to be classified in another category; (d) when any property which is included in the assessment list has been divided or partitioned since the last assessment; (e) when any struclural alteration or addition to a building has been made where• by in the opinion! of the Assessment Committee the rateable value of the house property of which the building forms part is increased by twenty pounds, or more. I (2) A supplementary assessment list shall be issued by the Assessment Com• mittee before the first day of March in each year showing the assessment made or changed by the committee and the rates shall be payable on such assessment from the beginning of the financial year following the revision. (3) All the provisions of this schedule relating to the preparation of, objection to and appeal from, an assessment list, shall be applicable to every supplementary list made by the Assessment Committee.

EIGHTH SCHEDULE.

RULES REGULATING TENDERS FOR CONTRACTS BY THE COUNCIL. ,.'.,,<

1. In accordance with the provisions of paragraph 19(4) of this Order, a Tender Committee shall be appointed by the Council and shall advertise the requirements of the Council in at least two of the local papers. 118 15th January, 1942

2. The advertisement shall state the general conditions of the contract together with a brief description of the requirements and shall indicate where the necessary forms of application and details of the requirements can be obtained. 3. As soon as tenders are received they shall be deposited in a locked box at the office of the Council. The box shall be provided with two different locks, the keys of which shall be retained by such different persons as the Council shall appoint. 4. All tenders shall be opened in the presence of a majority of the Tender Com• mittee and shall be registered by a clerk or other official appointed by the Council. 5. Defective or late tenders shall not be considered. 6. The lowest tender shall, as a rule, be recommended for acceptance, provided that the prices quoted are reasonable and that the committee is satisfied as to the suitabiliy of the tenderer. When the lowest tender is not recommended the com• mittee shall record their reasons for not recommending it.

ORDER BY THE HIGH COMMISSIONER, WITH THE APPROVAL OF THE SECRETARY OF STATE, UNDER SECTION 4(2).

IN EXERCISE of the powers vested in him by subsection (2) of section 4 of the Trading with the Enemy Ordinance, 1939, and of , No.'36 of 1939. all other powers enabling him in that behalf, the High Commis­ sioner, with the approval of the Secretary of State, has ordered and it is hereby ordered as follows :—

.1. This Order may be cited as the Trading with the Enemy (Specified Persons) (Amendment) Order, 1942, and shall be read as one with the Trading with the Enemy (Specified Persons) (Amendment) Order (No. 5), 1941, hereinafter referred to as the Gaz•.1•8•41, principal Order. 1

2. The Schedule to the principal Order shall be varied — (a) by inserting the names and addresses specified in Part I , \ of the Schedule to this Order; (b) by deleting the names and addresses specified in Part II of the Schedule to this Order; and (c) by making the amendments specified in Part III of the ׳. .Schedule to this Order

3. This Order shall come into operation on the eighteenth day of January, 1942. 15th January, 1942

RULES MADE BY THE CONTROLLER OF SUPPLIES UNDER SECTION 12.

IN EXERCISE of the powers vested in me under section 12 of the Food and Essential Commodities (Control) Ordinance, 1939, I, COLONEL GEORGE WYKEHAM HERON, Controller of Supplies, do hereby make the following rules :— 1. These rules mav be cited as the Food and Essential Commodities (Rationing) Rules, 1942. 2. In these Rules, unless the context otherwise requires — —׳: Rationed Commodity" means any of the following commodities" (a) Sugar (b) Rice (c) Wheat, maize, barley or millet (d) Flour of wheat, maize, barley or millet 4 (e) Bread. "Retailer" and "Wholesaler" means a person holding a valid licence under the Wholesale and Retail Dealing in Controlled Articles (Licences) Rules, 1941; "Coupon" means a coupon issued under the authority of the Controller of Sup­ plies, being attached to and forming part of a ration card, and authorising the sale of such quantity of such rationed commodity as may be specified in the coupon and specifying the period of the validity thereof; "Ration card" means a card issued for the purposes of these rules under the authority of the Controller of Supplies to an individual consumer or group of consumers. 3. —(1) These rules shall apply only in areas to which they have been applied by the Controller of Supplies by notice published in the Gazette. 15th January, 1912 THE PALESTINE GAZETTE NO. 1163—SUPPLEMENT NO. 2. 157

(2) In any such notice as aforesaid applying these rales to any area, the Con• troller of Supplies may direct that for the purpose of such application there shall be excluded from the definition of "rationed commodity" appearing in rale 2 of these rules such of the commodities set out in that definition as may be specified in the notice,•and where any such direction is given these rules shall apply to such area subject to such exclusion as aforesaid.

4. Save as provided in these rules, no retailer shall sell to any person any rationed commodity except under the authority of a ration card issued to such person and upon the surrender to the retailer of a valid coupon therefrom, in the manner set forth hereunder :— (a) The purchaser shall present his ration card to the retailer with whom the purchase is to be made containing the valid coupon intact and undetached. (b) The retailer shall detach and retain the valid coupon and return the ration card to the purchaser as the purchase is completed. Coupons not used during the period of the validity thereof shall lapse : they cannot be brought forward. Every coupon not used by a consumer during the period of its validity shall be detached and cancelled and destroyed by the retailer whenever any ration card is presented to him. - (c) The quantity of any rationed commodity that may be sold by any retailer" and purchased by a consumer against the surrender of a valid coupon in the manner provided herein, shall be limited to the quantity printed on such coupon, or such other quantity as the Controller of Supplies may from time to time fix by notice published in the Gazette. (d) No person other than a retailer may detach any coupon. (e) No ration card issued to any person may be transferred to any other person. (/) No retailer may accept coupons that have been detached from any ration card. (g) No consumer or retailer or any other person shall offer or give or accept any ration card or coupon as a pledge or security or deposit for any purpose what• soever.

5. No retailer shall — (a) detach a valid coupon from any ration card without supplying the commodity and the quantity specified therein, or supply any other commodity in place of the commodity specified in the coupon; (6) dispose of any stocks of any rationed commodity otherwise than — (i) against the surrender to him by a consumer of a valid coupon as pro• vided in these rules, or (ii) under the authority of a written permit in that behalf granted by the Deputy Controller of Supplies of the District in which the retailer carries on his business; (c) refuse to sell any rationed commodity upon the offer of a valid coupon in the manner prescribed hereinbefore; 158

(d) acquire any rationed commodity except in the manner prescribed in the licence issued to him under the Wholesale and Eefcail Dealing in Controlled Articles (Licences) Rules, 1941, or except from a wholesaler who is the holder of a licence issued under those rules; (c) use or apply or transfer any coupon detached by him which was not used by a consumer during the period of its validity, or include any such coupon in support of his application to a Deputy Controller of Supplies for further sup• plies of any commodity.

6. —(1) All coupons detached by any retailer and retained by him in accordance with the provisions of rule 4(b) of these rules, must be submitted in proper condition to the appropriate Deputy Controller of Supplies for checking and retention when further supplies of any particular rationed commodity are required b}^ such retailer. (2) No application for further supplies of any rationed commodity will be con• sidered by the Deputy Controller of Supplies unless the coupons referred to in para• graph (1) of this rule have been submitted to him in manner provided in this rule and accepted by him as representing the sales of such commodity by the respective retailer during the period covered by, and under the authority of, the coupons sub• mitted by him. The manner and frequency in which such applications and supporting coupons should be submitted to the Deputy Controller of Supplies shall be in accordance with such instructions as may be issued by him from time to time.

7. —(1) No person who is entitled to purchase any rationed commodity from the Navy, Army and Air Force Institutions or who receives rations from the Govern• ment of Palestine or as a member of His Majesty's Forces or the Forces of any of His Majesty's Allies shall apply for or use any ration card. (2) No person who is a patient in any hospital for a period exceeding one month shall apply for or use any ration card.

(3) No person shall apply for or use any ration card during any period in which he is on the rationed staff of any hospital or is an inmate or on the rationed staff of an orphanage, or school, or any other institution, which is receiving an allocation of any rationed commodity under these rules.

8. Any person who joins His Majesty's Forces or any Forces of any of His Majesty's Allies after the issue to him of a ration card and to whom rations are provided by such Forces shall surrender his ration card to the office of its issue for cancellation or alteration, as the case may be.

9. Every ration card and valid coupon shall be available for use in accordance with the provisions of these rules in the town or place of its issue only : Provided that any ration card containing a valid coupon stamped with the word "EMERGENCY" shall be accepted by any retailer in any town or place in which ration cards are issued, in the same manner in all respects as if such ration card had been issued in such town or place. 15th January, 1942 THE PALESTINE GAZETTE NO. 1163—SUPPLEMENT NO. 2. 159

10. The Controller of Supplies may for the purpose of these rules from time to time issue or cause to be issued to any person or class of persons ration cards or coupons which shall be available for use in accordance with the provisions of these rules and any conditions which may be endorsed on such ration cards or coupons:

11. —(a) Any retailer who, either by himself or by his servant, employee or agent, shall act in contravention of these rules, and (b) Any consumer or other person who aids, abets or agrees with any retailer in any contravention of these rules, and (c) Any person who uses, or permits the use of, any ration card or coupon issued to him, for the purpose of obtaining a quantity of any rationed commodity in excess of the quantity which he may obtain under such ration card or coupon or under these rules, shall be guilty of an offence and on conviction shall be liable to a fine not. exceeding fifty pounds or to imprisonment for a period not exceeding six months or both such fine and imprisonment.

RULES MADE BY THE CONTROLLER OF SUPPLIES UNDER SECTION 12.

IN EXERCISE of the powers vested in me under section 12 of the Food and Essential Commodities (Control) Ordinance, 1939, I, No. 34 of 1939. COLONEL GEORGE WYKEHAM HERON, Controller of Supplies, do hereby make the following rules :—

1. These rules may be cited as the Food and Essential Com- Citation, modifies (Registration) Rules, 1942. 2. In these rules — "permanently" when used in relation to residence shall mean residence for a period of not less than 15 days.

3. A Registration of the Public for the purpose of carrying out! a system of rationing will be effected in such areas and on such dates as may be specified by the Controller of Supplies in a notice published in the Gazette. 4. required under the Schedule to these rules, and shall notify the Deputy Controller of Supplies of their District, in writing, on the last day of each month of all changes that have occurred during such month in the particulars furnished by them previously in pur• suance of such a demand as aforesaid :— (a) The Head of a family. (b) The Head, or the Person in charge, of any of the following- Institutions and Establishments :— I. Pensions, Hostels, Boarding Houses, Monasteries,. Convents, Besidential Clubs, and Charitable Institutions- in which persons are permanently boarded. II. Hotels, Universities, Colleges, Boarding Schools, Hospitals including private hospitals, Medical and Sur• gical Institutions, Canteens and Institutions other than charitable institutions, Cafes, Bestaurants and non-re• sidential clubs. (c) Persons who do not permanently reside with a family or any of the institutions or establishments mentioned in paragraph (b) hereof. (2) This rule shall not apply with respect to Hospitals and other Institutions maintained wholly by, or on behalf of, the Government of Palestine or any Department of His Majesty's Forces. 6. Any person who— (a) fails to furnish any authorised enumerator, on demand, with any information lawfully required under these rules, or (b) fails to notify the appropriate Deputy Controller of Supplies of any changes in any such information furnished to an authorised enumerator as required by these rules, or (c) furnishes an authorised enumerator or a Deputy Controller of Supplies with any information required to be furnished under these rules which such person knows to be false in a material particular, or recklessly so furnishes any such in• formation which is false in a material particular, shall be guilty of an offence and on conviction shall be liable to a fine not exceeding fifty pounds or to imprisonment for a period not exceeding six months or both such fine and imprisonment. 15th January, 1942 THE PALESTINE GAZETTE NO. 1163—SUPPLEMENT NO. 2. 161
