SQUAMISH- REGIONAL DISTRICT BYLAW NO. 1641-2019

A bylaw to amend Squamish-Lillooet Regional District / Fire Protection Financial Contribution Service Establishing Bylaw No. 480, 1992

WHEREAS Squamish-Lillooet Regional District Seton Portage/Shalalth Fire Protection Local Service Area Establishment Bylaw No. 480, 1992 established a local service for the purpose of providing fire protection to the community of Seton Portage/Shalalth;

AND WHEREAS the Regional Board of the Squamish-Lillooet Regional District now wishes to align Squamish-Lillooet Regional District Seton Portage/Shalalth Fire Protection Local Service Area Establishment Bylaw No. 480, 1992 with the service delivery method that is currently in place in the community of Seton Portage/Shalalth, which is a service being operated via financial contribution to a third-party organization;

AND WHEREAS the consent of the Regional Board of the Squamish-Lillooet Regional District has been obtained in accordance with a resolution dispensing with the consent of the Electoral Area B Director and giving participating area approval in accordance with section 347(3) of the Local Government Act;

AND WHEREAS the approval of the Inspector of Municipalities has been received under section 349 of the Local Government Act;

NOW THEREFORE the Regional Board of the Squamish-Lillooet Regional District, in open meeting assembled, enacts as follows:

1. The following recital is added as the fifth and final recital of Squamish-Lillooet Regional District Seton Portage/Shalalth Fire Protection Local Service Area Establishment Bylaw No. 480, 1992:

AND WHEREAS the Regional Board of the Squamish-Lillooet Regional District wishes to align the wording of this bylaw with the service delivery model actually in place, which is a service being operated via financial contribution to a third- party organization.

2. Section 1 (including Schedule “A”), section 2, section 3 and section 4 of the Squamish- Lillooet Regional District Seton Portage/Shalalth Fire Protection Local Service Area Establishment Bylaw No. 480, 1992 are deleted and replaced with the following sections (and corresponding headings):

Citation 1. This bylaw may be cited as “Squamish-Lillooet Regional District Seton

Portage/Shalalth Fire Protection Financial Contribution Service Establishing Bylaw No. 480, 1992”.

Definition 2. In this bylaw, "fire protection" includes the operation and administration of fire safety services, including fire prevention and suppression.

Service being Established 3. The Regional District hereby establishes a service for the purpose of providing a financial contribution for fire protection within the service area, being part of Electoral Area B. 4. The Regional Board of the Squamish-Lillooet Regional District may enter into contracts with third parties in respect of the payment of the financial contribution, or any part thereof.

Service Area 5. The service area established in this bylaw is shown on Schedule “A” attached to and forming part of this bylaw.

Participating Area 6. The participating area in the service is Electoral Area B of the Squamish-Lillooet Regional District.

Cost Recovery 7. As provided in section 378 of the Local Government Act, the annual cost of providing the service shall be recovered by one or more of the following: a) Property value taxes imposed in accordance with Division 3 of Part 11 of the Local Government Act;

b) Parcel taxes imposed in accordance with Division 3 of Part 11 of the Local Government Act;

c) Fees and charges imposed under section 397 of the Local Government Act;

d) Revenues raised by other means authorized under the Local Government Act or another act; or

e) Revenues received by way of an agreement, enterprise, gift, grant or otherwise.

Maximum Requisition 8. The maximum amount that may be requisitioned annually for this service shall be the greater of $20,000 or $0.97319/$1,000 of the net taxable value of land and improvements in the service area.

3. This bylaw may be cited as “Squamish-Lillooet Regional District Seton Portage/Shalalth Fire Protection Financial Contribution Service Establishing Bylaw No. 480, 1992, Amendment Bylaw No. 1641-2019”.
