Progress Report on Implementation of Resettlement Plan

Resettlement Plan implementation progress for the months October and December 2018 is given in detail in this report

1. The revised number of 2010 affected households comprise of 1517 affected households who had opted for house and 493 affected households who had opted for cash in lieu of house and those who are entitled for cash, such as those losing their shop and cattle shed. The river wise summary of affected households categorised by their resettlement preference based on May-June 2018 field assessment is given in Table 1.

Affected Households Categorised for Proposed Phased Resettlement 2. Subsequently, an assessment of the affected households with the help of contractors to ascertain the number of households located within the Corridor of Impact (CoI) and beyond CoI and within the Right of Way (RoW). The NGO with the contractor and SDS conducted this assessment between May and June 2018. The number of households within the CoI were 1319 (65.6%) and those beyond CoI and within RoWwere 691(34.4%).The contractors were requested to incorporate this data in the embankment construction drawings. The summary of affected households categorised as within and outside CoI based on the data collected and finalized during joint verification is given in Table 2.

Results of consultation with PAFs opted for house for phased approach in implementation of

RP

3. Interview schedule was prepared to collect data from PAFs regarding various options and choices for the phased approach by consulting only the PAFs opted for houses to expedite the implementation of RP. The schedule was prepared by the Social Development Specialist and HEAVEN NGO. The same was wetted with Er. Mohammed Salim Babu, EE. PMU and Mr.Chandrasekar, Social Safeguard Specialist, ADB and was used to collect data and information from the PAFs.

4. Using Interview schedule the decisions among PAFs opted for house for capturing their resettlement options in all rivers was carried out between July and November 2018. All the NGO staff were involved in collecting data among PAFs opted for house. Of 1517 PAFs, data were collected from 1448 affected families who were presented. Since many PAFs were absent during data collection, multiple visits were made.

5. Data were collected entered, compiled and analysed. Out of 1517 PAFs, majority of 1072 PAF have reaffirmed the option towards houses and 376 PAFs have changed their options to cash. Attempts are being made to contact and collect data from remaining, 69 PAFs. For the deceased households, their legal heirs are being contacted to collect data and if the heir were able to produce legal document, proof of residence or in the baseline survey family data and residing in the same asset, they could be treated as the PAFs subject to that the family does not have any house own by them.

6. Of 1072 affected families opted for house, 700 were located within CoI and 372 were residing beyond CoI. Among total 376 APs opted for cash, 230 were located within CoI and 146 were beyond CoI and within RoW. Hence, the overall preference for opting house has reduced to 1072 from 1517 opted for house before Table 3&4. Table 3. 7. PAFs located within and beyond CoI was also worked out in the sites allotted for giving priority to resettle the PAFs residing within CoI. The same data have been shared to the Engineering Specialist, CAVSCDP and Contractors and aligned construction activities have been prepared.

8. Further, the number of PAFs have been reduced in the beyond CoI, as the assets are situated just abutting and beyond RoW stone, which were included earlier assuming that those would be affected if the bunds of canal raised. Currently, 20 DPs were identified and confirmed that they would not be affected by the project activities and were excluded from the list of PAFs. The numbers from each river is given in the following Table 5. Hence, the number of PAFs opted for houses has been reduced to 1121 from 1141. 9. Hence, keeping the view of filling the houses and delay in identification of land for 56 PAFs of Taluk, in District, consultations were made to accommodate those PAFs in the surplus units available in Kadanthethi, VadakkuPanaiyur or Thirukuvalai resettlement sites where 58 houses unfilled units are available. Of 56 PAFs, 26 have opted for houses and 30 opted for cash. Further, consultations were conducted among the PAF opted for cash previously to accommodate in the unfilled units at Kadanthethi, Thirukuvalai and VadakkuPanaiyur in , for which 19 PAFs have chosen for houses instead of cash. In total, 48 PAFs will be accommodated in 58 unfilled houses in Nagapattinam District and remaining 7 units will be filled in the following consultationsTable 5. Table 5. 10. Two separate meetings were conducted by the Additional Secretary, PWD and Principal Secretary, PWD in the month of October, 2018. In the meeting, similar to the Project Steering Committee meeting, conducted by the Principal Secretary to Government, PWD on 11.10.2018,Officers from all line departments from both an Nagapattinam and PIC of CAVSCDP have participated. Resettlement component was given much importance especially identification of lands for the construction of houses. District Collector of Thiruvarur and Officer Concerned of Nagapattinam have agreed to find and provide enter upon permission for the construction of houses for the affected families. Based on the meeting and requirement of land, District Collector of Thiruvarur have given enter upon permission for 7.105 ha of land from 23 different locations in Thiruvarur District, which were sufficient for the construction of resettlement houses. A total of 18.25 ha of land comprising 11.90 Ha of land in Thiruvarur and 6.342 Ha in Nagapattinam District have been allotted for the construction of houses for resettling PAFs from all affected villages.

11. A total of 1135 houses are planned to be constructed in all enter upon sites provided in both Thiruvarur and Nagapattinam Districts. Of 1135 houses planned, 759 in Thiruvarur and 376 houses in Nagapattinam District. Of 58 unfilled houses in Nagapattinam District, 51 were opted to be fied remaining 7 units of houses and 18 houses in Thiruvarur District planned will be filled by consulting PAFs opted for cash previously. PAFs change their options to choose houses as they had harsh experience with disastrous cyclone 'Khaja' Table6 and 7 (Appendix I).

12. Since all PAFs could be accommodated in the resettlement houses, there is no need for further land for the construction of resettlement houses.

13. In addition, resettling of PAFs opted for houses residing within CoI in the presently ongoing construction is very less and houses located in CoI in other hamlets are far and not feasible to resettle them in the already progressing houses e.g. 56 units in Pinnavasal site, there are 12 PAFs reside within CoI and the distance of other PAFs within CoI are far from the resettlement site. Besides, construction activities will be launched in the near future in all enter upon sites and all the PAFs in the vicinity could be resettled irrespective of PAFs within and beyond CoI without disturbing the socio-cultural intact.

14. The officials of WRD and Buildings Wing of PWD have inspected all the enter upon sites for the preparation of layouts and estimates for construction of required number of houses. The visits have enabled them to prepare layout ideally by keeping vacant land for other purposes by the Revenue Department and avoid situation where enter upon is received and the site is reported unsuitable or not required for the project. The support from respective Tahsildar along with taluk surveyor could be sought for demarcating the NoC sites.

Issue of Identity Cards

15. Out of 2010 PAFs, identity cards have been distributed to 2002affected households and of the remaining 8 cards have to be corrected and issued. Identity cards were distributed to the affected households in the presence of jurisdictional Assistant Engineers and NGO personnel obtaining due acknowledgement from the affected household. The status of identity card distribution is given in Table8.

Common Property Resources

16. As part of the Implementation of resettlement plan the Common Property Resources which are located in the project corridor were enumerated for considering them for compensation to the respective users appropriately. A total of 331 CPRs were enumerated in all four rivers by referring baseline survey register. The enumeration has been completed by the NGO staff and given in the Table 9. Joint verification with WRD- CAVSCDP staff will have to be undertaken to ascertain the CPR in their respective reach. Of 291 CPRs, 69 located beyond CoI and 222 are located within CoI. The common property resources are to be valued for replacement cost.

Grievance Redress Mechanism

17. Total valid petitions including general petitions received at PIU were 449, of which 174 grievances were accepted for compensation and Identity cards were issued and 169 were rejected as those were baseless. Further, 72 petitions were received and it was reported by PIU that 24 petitions have not been received from respective PIUs to PIU Thiruvarur for redressal, hence a total of 96 grievances will have to be resolved.

18. Separate registers for each river are kept on updated jointly by the NGO and PIU Thiruvarur. Data on grievance and other particulars are also kept on updated by the PIU, Thiruvarur.

Valuation of affected Structures and Micro Plan 19. List of affected households who opted for cash in lieu of house and those losing their shop were submitted to PMU and the same was forwarded to PWD (Buildings Wing) through PIUs for valuation of the structures by adopting current schedule of rates without depreciation as per the entitlement matrix. Social Development Specialist had meetings with PWD (Buildings) and requested them to complete the valuation of assets to enable payment of replacement cost to the structure and/or assistances to the affected households. The NGO supported the PWD buildings wing in identification of such structures. Out of 493 structures that required valuation, the PWD (buildings wing) had completed valuation for all 493 structures. On receipt of the valuation report of the PWD, the NGO prepares the micro-plan for disbursement and submits the same to PMU for disbursement. As on 31December 2018, the NGO had received valuation report for 390 structures and prepared micro plan. For the remaining 103structures that have been valued, the valuation report from PWD – Buildings is awaited. Status of valuation of structures is given in Table 11.

20. Currently, 1110 PAFs have opted for houses and remaining 387 PAFs have opted for cash based on the subsequent consultations. Micro plan for 387 opted for cash after consultations were done need to be worked out and out of 1110 chosen for houses, for 1000 PAFs micro plans were completed and soft copy except cost involved for compensation is in the database available with HEAVEN - NGO. Compensation matrix for each PAF will be done after consultations will be completed. The folders for each PAF were printed in different colours (four colours) for each river (please see the pictures attached).

Key Activities to be carried out ➢ Enter upon sites need to be demarcated by the PWD Buildings facilitated by CAVSCDP PIUs with help of Revenue Department ➢ Carry out needs assessment among PAFs for initiating livelihoods activities for the deserved individuals for training and assistance ➢ Conduct consultation among PAFs of affected hamlets by informing resettlement sites ➢ Preparation of site (NoC) specific plan for all enter upon sites for resettlement of PAFs without hurdles ➢ Consultations with PAFs to resettle in the unfilled houses in Thiruvarur and Nagapattinam Districts ➢ Completion of micro plan for each PAF (each folder for every PAF with all details ) after consultation process is over ➢ Conduct Valuation, prepare compensation matrix of all assets opted by PAFs after reassessment survey and through grievance petitions ➢ Workout entitlement matrix for the remaining assets already valued by PWD- buildings in all rivers ➢ Reconfirm all assets located near RoW included as affected assets in all rivers ➢ Carry out valuation of Common property resources (CPRs) with the help of PWD- WRD and Buildings or communication to be sent to respective owners of the buildings / structures ➢ Preparation of list of PAFs with names and asset IDs, which are to be resettled to the particular resettlement sites after the ongoing consultation (filling the surplus houses) is completed ➢ Identification of Organizations provide livelihoods training programs and get the willingness from the eligible PAPs for training and bank linkages for initiating micro enterprises ➢ Assist in allocation of houses in the resettlement sites following certain criteria such as 10

lottery method, women headed families, aged persons, people with disability etc ➢ Attend grievance redressal with PIU, CAVSCDP ➢ Counseling the PAFs before, during and post resettlement of PAFs ➢ Conducting HIV/AIDS awareness programmes among labourers in the construction sites and among PAFs
