124. *Ms. Munaza Hassan: (Deferred during 23rd Session)

Will the Minister for Law, Justice and Human Rights be pleased to state:

(a) the total number of murder, kidnapping and other crimes against women which are pending in Federal Courts at present; and

(b) the steps taken by the Government for and expeditious disposal of the such cases by easy access to justice?

Minister for Law, Justice and Human Rights: (a) The Government is committed to eliminate all forms of violence against women. Ministry of Law, Justice and Human Rights is making all out efforts to control such violations and to expeditiously dispose of cases related to women. The question no 124 was circulated among relevant Federal Court seeking total number of cases pending in their respective courts.

Supreme Court is of the view that as per Article 2 (A) of the Constitution, independence of the judiciary shall be secured and Constitution does not envisage, oversight in any form/manner by any other institution/organs of the State on the functioning of the Courts.

According to Federal Shariat Court, 196 criminal cases regarding murder, kidnapping and other crime against women are pending at their Court. A total number of 103 cases are also pending in the Special Courts. 2 (b) Federal Government has taken following steps for expeditious disposal of such cases:

• The Access to Justice programme is one of the key reform initiatives which aim at implementing reforms in the judicial, police, legal and administrative justice sectors. The programme was launched in 2001. Judicial reforms like improvement in process serving systems and procedures, alternate dispute resolutions, monitoring system through Members Inspection Team, Amendments in code of Criminal Procedure to devolve Habeas Corpus powers from High Courts to District and Session Judges, establishment of Courts for small claims and minor offences, have been undertaken.

• Shaheed Benazir Bhutto Human Rights Centers for Women at Federal and Provincial level are also providing legal support to the women victims of violence for expeditious disposal of their cases in Courts.

• Women Police Stations have also been established in different cities all over the country where the female police officers/officials are deputed to deal/facilitate women in persuasion of their cases.

• A Helpline at Federal level for Legal Advice on Human/women Rights Violations has also been installed to give legal advice to victims of violence and to refer the cases to respective authorities.

133. *Mr. Asad Umar: (Deferred during 23rd Session)

Will the Minister for Law, Justice and Human Rights be pleased to state the present status of the Universal Periodic Review 2012 regarding the recommendations given for banning the domestic child labour in Pakistan?

Will the Minister for Science and Technology be pleased to state:

(a) the number of Scientists readied according to the requirement so far; and 3 (b) the number of persons received modern education of science from Pakistan and rendering their services in the country and abroad at present?

Minister for Science and Technology: (a) According to the survey conducted by Pakistan Council for Science & Technology (PCST) an organization of this Ministry, there were 60,699 Researchers (Scientists) in the country during 2013; among them 17.05% were females. The field wise number of researchers was as under:

There is a steady increase in number of scientists from 2005 onwards.

(b) According to the survey a vast majority of researchers in Pakistan i.e 43,636 (71.89 %) are educated upto the level of Master’s or equivalent whereas 10,670 (17.57%) researchers hold the degree of Ph.D. Most of them have acquired their education in Pakistan. It is therefore, submitted that this Ministry has no information about qualified Pakistani researchers rendering their services abroad.

268. *Syed Waseem Hussain: (Deferred during 23rd Session)

Will the Minister for Petroleum and Natural Resources be pleased to state:

(a) the quantity of the Liquefied Natural Gas (LNG) being imported from other countries especially from Qatar at present alongwith the utilization and rates thereof; and

(b) the quantity of electricity will be produced from the said LNG in the near future? 4

Minister for Petroleum and Natural Resources (Mr. Shahid Khaqan Abbasi): (a) Total of 25.7 Btu of LNG has been imported by M/s PSO as per details below:

(b) Currently, 180 MMCFD RLNG is being provided to Saif, Sapphire, Orient and KAPCO. These plants are generating 840 MW. Furthermore, additional 600 MMCFD RLNG is planned for three (3) RLNG based plants at Bhikki Baloki and Havali Bahadur Shah. These plants will have a total installed capacity of 3600 MW.

279. *Mr. Imran Zafar Leghari: (Deferred during 23rd Session)

Will the Minister for Defence be pleased to state:

(a) the present status of the Operation Zarb-e-Azb;

(b) the successes achieved by the said Operation since its commencement; and

(c) the target date of completion of the said Operation?

Minister for Defence: (a), (b) & (c) Operation Zarb-e-Azb commenced on 15 June 2014 and continued successfully. Operation Zarb-e-Azb had various facets in its manifestation. First one was the physical clearance of areas under terrorists sway and establishment of writ of the state. 89% area of North Waziristan 5 Agency and 87 % of Khyber Agency have been physically cleared. 13,000 weapons (all types) and 1,80,000 tons of explosive have also been recovered. Since it was known that terrorists will flee towards cities as a result of operation in FATA, a comprehensive “integrated Security Plan” was put into effect. Over 10,000 Intelligence Based Operations were conducted in cities / towns throughout the length and breadth of Pakistan. 216 x terrorist were killed. Afghan authorities and “Resolute Support Mission Headquarters” are continuously being pursued to target the terrorists who have fled to Afghanistan. Sequel to all above, now is the time for major politico-adm initiative reforms and development works in FATA for ensuring durable peace, while military carries out intelligence based operations for sustained peace, takes steps for better control of border and facilitates for rehabilitation of Temporary Displaced Persons (TDPs). Operation Zarb-e-Azb is configured to deal with menance of terrorism as a whole and therefore, will continue to nab sleeper cells of terrorists and financiers elsewhere in the country including FATA.

31. *Dr. Nafisa Shah:

Will the Minister for Petroleum and Natural Resources be pleased to state:

(a) the total number of ships carrying Liquefied Natural Gas (LNG) have berthed at the Elengy Terminal alongwith the amount and utilization thereof; and

(b) the cost of the LNG imported so far alongwith the names of the countries thereof?

32. *Ms. Sajida Begum:

Will the Minister for Petroleum and Natural Resources be pleased to state:

(a) the time fixed for the approval and procedure adopted for the urgent gas connection; and

(b) the fee fixed for the said connection at present? 7

Minister for Petroleum and Natural Resources (Mr. Shahid Khaqan Abbasi): (a) In this connection, SNGPL has reported that the procedure adopted for urgent gas connection is as under:

• This scheme is meant for applicants of domestic category whose premises are situated on SNGPL’s existing distribution network.

• Application for domestic gas connection should at least be 6 months old.

• Connections should be installed within 03 months from the date of payment of urgent fee bill i.e. Rs. 25,000/-

• Urgent fee is in addition to the security and. service line charges to be recovered from the applicant on subsequent stage.

(b) An amount of Rs. 25,000/- has been fixed as processing fee to avail urgent gas connection. This amount is in addition to security/ service line charges which are recovered from the applicant on subsequent stage.

33. *Dr. Nafisa Shah

Will the Minister for Petroleum and Natural Resources be pleased to state the upfront tariff set for the Liquefied Natural Gas Power Plants alongwith the terms and conditions thereof?

34. *Ms. Parveen Masood Bhatti:

Will the Minister for Communications be pleased to state:

(a) the percentage of work completed so far on the project of reconstruction of Islamabad-Lahore Motorway; and

(b) whether it is a fact that the pace of work is very slow thereupon; if so, the reasons thereof?

Minister for Communications: (a) The activity of Overlay work started on 19- 01-2015 after the signing of Concession Agreement with M/s MORE 8 (FWO) for Overlay & Modernization of Motorway M-2 (Lahore-Islamabad) on BOT basis. Presently, 19.77 % of Motorway M-2 has been rehabilitated which is 17.22 % of overall progress of the project. Detail of progress so far achieved by the Concessionaire (M/s MORE) is as under:

Actual planned progress: 14.67%

Progress (overall): 17.22%

Length Rehabilitated: 19.77%

(Total 357 KM x 2 = 714 KM)

(Length rehabilitated: 141 KM)

(b) The pace of work is per schedule agreed between NHA and M/s MORE, as evident from the above details.

35. *Ms. Parveen Masood Bhatti:

Will the Minister for Communications be pleased to state:

(a) whether it is a fact that hundred percent land has been acquired for Gojra to Multan Motorway; and

(b) the time by which the said Motorway will be completed?

Minister for Communications: (a) Status of land acquisition for M-4 is as under:—

I Gojra-Shorkot (Length) 100%

II Shorkot Khanewal (Length) 90%

(b) I. Faisalabad-Gojra Section has been completed.

II. Construction work for Gojra-Shorkot section has been tendered and work will start after ADB approval which will be completed by 2017. 9 III Shorkot-Khanewal section will be tendered by the end of 2015 after approval of ADB. The project will be completed in two (02) years.

36. *Ms. Belum Hasnain:

Will the Minister for Parliamentary Affairs be pleased to state:

(a) the details of electoral reforms adopted by the Election Commission of Pakistan (ECP); and

(b) the steps taken by the ECP to train the election staff for the local Government elections?

Minister for Parliamentary Affairs: (a) The ECP has constituted a Legal Framework Committee to review the existing Electoral Laws and the same proposed Draft Unified Law that was submitted before the Sub-Committee of the Parliamentary Committee on Electoral Reforms for deliberation and necessary amendments thereof.

2. Further, the ECP launched its Second Five Year Strategic Plan 2014-2018 in June, 2014 to continue the reform process in an effective manner and ultimately to strengthen the electoral processes in Pakistan. The Second Five Year Strategic Plan 2014-2018 comprises 162 objectives grouped under the following 13 broader goals:

1. Reforming Electoral Legal Framework. 2. Election Operations. 3. Election Disputes Resolution. 4. Autonomy of the ECP, Finance and Budget System. 5. Electoral Finance. 6. Voter Registration and Electoral Rolls. 7. Civic and Voter Education. 8. Gender in Electoral Process and the ECP. 9. Minorities and persons with disabilities. 10. Training and Capacity Building. 11. ECP’s Stakeholder Outreach. 12. ECP’s Organizational structure and Human Resources. 13. ECP offices and infrastructure 10

(b) The Training Wing of ECP has been making elaborate arrangement to train polling staff for conducting Local Government Elections (Annex-I).

37. *Ms. Musarat Rafique Mahesar:

Will the Minister for Law, Justice and Human Rights be pleased to state the steps taken by the Government for the empowerment of women?

Minister for Law, Justice and Human Rights: National Commission on the Status of Women Act, 2012 that replaced the earlier NCSW Ordinance 2000 provided for a financially and administratively autonomous body with the objective of promoting social, economic, political and legal rights of women as guaranteed in the Constitution of Pakistan and in accordance with Pakistan’s international obligations as embodied in various conventions, covenants and declarations.

NCSW’s mandate as prescribed in the Act is very comprehensive - from review and assessment of laws, government policies, programmes and measures and their implementation to making recommendations to achieve gender equality and women’s empowerment and eliminate discrimination. It is also mandated to recommend signing and ratification of international instruments for protection of human rights, undertake and encourage research and data generation for policies and action, interact with non governmental organisations; experts and individuals develop active associations with other similar institutions in other countries.

The Commission also has powers to seek and receive information, data or documents from any official source and powers of a civil court to enforce attendance of any person and production of documents. It can also visit any jail or sub-jail and intervene for redress of women’s rights.

In line with its objectives and mandate, NCSW strives to safeguard and promote interests of women and makes, all efforts for the protection of rights and empowerment of women inside and outside the family It sees ensuring women’s security and rights as an integral part of protecting the family. 11 The major activities have been carried out todate for protection and empowerment of women, during tenure of this commission i.e. since Jan. 2013, attached at Annex A.

38. *Ms. Musarat Rafique Mahesar:

Will the Minister for Law, Justice and Human Rights be pleased to state whether there is any legislation and special arrangements to deal with child abuse; if so, the details thereof?

Minister for Law, Justice and Human Rights: The issue of Child Abuse is covered under various provisions of Pakistan Penal Code (PPC) 1860 under following sections.

„ 292. (Sale, etc., of obscene books, etc.: imprisonment of either description for a term which may extend to three months, or with fine or with both)

„ 293. Sale, etc., of obscene objects to young person, may extend to six months).

„ 365B (Kidnapping, abducting or inducing woman to compel for marriage etc , imprisonment for life);

„ 366 A (Prostration of minor girl, may extend to ten years);

„ 369. (Kidnapping or abducting child under ten years with intent to steal from its person, imprisonment of either description for a term which may extend to seven years)

„ 371A. (Selling person for purposes of prostitution, etc., imprisonment which may extend to twenty-five years)

„ 371B. Buying person for purposes of prostitution, etc , imprisonment which may extend to twenty-five years)

„ 375. Rape, 376. (Punishment for rape, death or imprisonment for life)

„ 377. Unnatural offences, imprisonment for life)

Besides above, provinces have the following legislations on issues related to child abuse. 12 Punjab

• The Punjab Destitute and Neglected Children Act, 2004, Section 40 criminalizes exposure to seduction which makes it punishable with imprisonment of three years or with fine which may extend to fifty thousand rupees or with both.

Sindh:

• The Sindh Children Act, 1955, Section 55 criminalizes allowing or permitting child to be in Brothel and make it punishable with imprisonment of two years or with fine which may extend to Rs. 1,000 or with both. Similarly, section 56 criminalizes causing or encouraging seduction and makes it punishable with imprisonment two years or with fine which may extend to Rs. 1,000 or with both.

Khyber Pakhtunkhwa:

• The government of Khyber Pakhtunkhwa has (KP) promulgated the Child Protection and Welfare Act, 2010. Section 48 of the Act, criminalizes child pornography which is punishable with rigorous imprisonment of three years and may extend to seven years and also liable to fine which may not be less than two hundred thousand rupees and may extend to five hundred thousand rupees. Similarly, section 50 criminalizes exposure to seduction which is punishable with rigorous imprisonment of seven years or liable to fine which may extend to ten hundred thousand rupees, or with both. Moreover, section 53 criminalizes sexual abuse which is punishable with imprisonment for fourteen years and not less than seven years and shall also be liable to fine which shall not be less than ten hundred thousand rupees.

Furthermore, the Ministry of Law, Justice and Human Rights has drafted Criminal Law Amendment Bill, 2015 which covers all aspects of child abuse. It provides for insertion of new section in the PPC i.e. 292A (Exposure to Seduction), 292 B (Child Pornography), 292 C (Punishment for Child Pornography), 328A (Cruelty to a Child) 369A (Trafficking to Human Being in Particular Internal Trafficking), 377A (Child Abuse) and 377B (Punishment for Child Abuse). The said Bill has been approved by the Standing Committee on Law, Justice and Human Rights and referred to National Assembly. 13 Special Arrangements:

ICT level:

At ICT level, National Child Protection Center has been established to provide protection and rehabilitation services to the victims of child abuse.

Punjab:

The Government of Punjab under the Child Protection and Welfare Bureau has established 9 Child Protection Unites which provide protection and welfare services to the victims of child abuse. The services are also being extended in other districts.

Sindh:

The Government of Sindh under the Child Protection Authority Act, 2011, twelve (12) child protection centers/units have been established which provide protection and welfare services to the victims of child abuse.

Khyber Pakhtunkhwa:

The Government of Khyber Pakhtunkhwa under the Child Protection and Welfare Commission has established 13 Child Protection Units which provide protection and welfare services to the victims of child abuse.

39. *Mrs. Shahida Rehmani:

Will the Minister for Petroleum and Natural Resources be pleased to state:

(a) the total funds allocated for the Central Inspectorate of Mines in the budget 2015-16; and

(b) the performance made by the said department during the last three years? 14

Minister for Petroleum and Natural Resources (Mr. Shahid Khaqan Abbasi): (a) Central Inspectorate of Mines is allocated Rs.7,847,000/- in the budget grant 2015-2016 (Current Expenditure).

(b) Central Inspectorate of Mines (CIM) is entrusted with enforcement of Mines Act, 1923 and rules/regulations framed thereunder regulating working conditions of mines labour in the federal sphere comprising oil-fields and gas- fields in the country.

For achievement of organizational objectives, the officers of CIM carry out regular field inspections of oil & gas exploration & production sites; seismic survey, drilling and production works to monitor the status of implementation of legal safety requirements viz competent supervision of operations, appropriate working procedures, provision of protective equipment and safety devices, first- aid and health care, working hours and rest intervals etc. Inspection observations are pursued with the operator company/work management for remedial measures. The worksite accidents are also followed up for adoption of preventive measures to avert reoccurrence and payment of compensation to the affectees.

Besides the regulatory functions, the Inspectorate conducts training/ awareness-raising programmes for workers, supervisors and managers on occupational safety & health concerns to promote safe-work culture. During last three years (2012-15), 55 field inspections and 24 training/awareness-raising, sessions were conducted.

40. *Mrs. Shahida Rehmani:

Will the Minister for Law, Justice and Human Rights be pleased to state:

(a) the total funds allocated for the Commercial Courts in budget 2015-16; and

(b) the year-wise performance of the said Courts during the last three years?

Minister for Law, Justice and Human Rights: (a) There are only two Special Courts (Commercial) working under the purview of Federal Government, one each at Lahore and Karachi. Due to less work load both Courts are working as part time Courts. 15

The total funds allocated to Special Court (Commercial) Lahore for the year, 2015-2016 are Rs.2,907,000/-.

The total funds allocated to Special Court (Commercial) Karachi for the year, 2015-2016 are Rs.4,348,000/-.

Will the Minister for Petroleum and Natural Resources be pleased to state the reasons of failure/delay in exploring the new reservoirs of oil and gas in the country?

Minister for Petroleum and Natural Resources (Mr. Shahid Khaqan Abbasi): Since taking over by the current Government, Exploration activities have intensified. During the period June, 2013 to August, 2015, 108 exploratory wells and 101 development/appraisal wells have been drilled resulting in sixty (60) oil and gas discoveries.

However land acquisition, security clearance, Law and order situation, far flung location and non-availability of seismic crew some time delay exploration activities.

42. *Ms. Aisha Syed:

Will the Minister for Petroleum and Natural Resources be pleased to state the steps taken by the present Government to increase the production of gas in the country?

Minister for Petroleum and Natural Resources (Mr. Shahid Khaqan Abbasi): The present Government has taken the following steps to increase gas production in the country.

• Model Petroleum Concession Agreement has been formulated with the consent of all provinces.

• New exploration Licences are being granted. During the tenure of this government, 46 new exploration licences covering an area of 94,608.85 Sq. Kms have been granted to different E&P companies sofar.

• 21 Leases have been granted to develop various fields to produce hydrocarbon.

• 211 wells have been spud in since 05-06-2013.

• Monitoring of E&P activities have been enhanced. 17 • 12,964 L.Km of 2D and 9,746 Sq. Km of 3D seismic survey have been acquired since 05-06-2013 to identify new prospects.

• Apart from conventional resources, the Government is also making all out efforts to pave way for exploration of unconventional resources like Tight gas, Shale Gas and Low BTU gas etc.

43. *Ms. Shakila Luqman:

Will the Minister for Petroleum and Natural Resources be pleased to state:

(a) the price at which LPG is being purchased by the Government; and

(b) the price at which the same is being sold to the general public/ consumers?

Minister for Petroleum and Natural Resources (Mr. Shahid Khaqan Abbasi): (a) The price of LPG including the producer’s price has been deregulated since year 2000. However, there are 12 LPG producers and price of LPG producers and price of LPG Base stock is being fixed by LPG producers themselves. In pursuance of LPG (Production & Distribution) Policy Guidelines, 2013, LPG producer and consumer prices are being determined by market forces, being a deregulated activity and OGRA / Government has no role in fixing / notifying the same.

(b) It may be noted that average LPG consumer price /11.8 kg cylinder of is being set by LPG marketing companies and for August 2015 stands at Rs. 938/11.8 Kg cylinder (Rs.79/Kg).

44. *Ms. Munaza Hassan:

Will the Minister for Communications be pleased to state:

(a) whether there is any proposal under consideration of the Government to bound the National Highway Authority and its attached departments to issue monthly performance report including oil expenditure; if so, the details thereof;

(b) if not, the time by which it will be issued? 18

Minister for Communications: (a) There is no proposal under consideration to issue monthly performance report of NHA. However, NHA prepares / issues Yearly Performance Report. The report for year 2013-14 is attached at Annex-A.

(a) the total amount collected since the year 2013 under the head of petroleum development cess alongwith the head-wise utilization thereof; and

(b) whether the provinces also got share out of the said amount; if so, the percentage thereof?

Minister for Petroleum and Natural Resources (Mr. Shahid Khaqan Abbasi): (a) There is no Petroleum Development Cess.

Will the Minister for Communications be pleased to state:

(a) the sections of Motorways on which the maintenance works have been carried out during the last five years in the country; and

(b) the total expenditure incurred thereupon, separately?

Minister for Communications: (a) National Highway Authority (NHA) is mandated to maintain all National Highways and Motorways. Will the Minister for Petroleum and Natural Resources be pleased to state:

(a) the Tehsil-wise funds provided/allocated for gas plant in Balochistan by the Ministry during the period from 1-6-2013 till date; and

(b) whether the approval has been given by the Ministry to supply gas in various Tehsils in the said province; if so, the details thereof?

Minister for Petroleum and Natural Resources (Mr. Shahid Khaqan Abbasi): (a) SSGCL has prepared estimates for Nine (9) LPG AIR-MIX Plants in Balochistan amounting to Rs.4.060 billion and submitted to the Federal Government for approval.

(b) The Cabinet Division has allocated funds of Rs. 537.505 million for provision of natural gas to Village Enayat Ullah Karex, Tehsil Gulistan, District Qila Abdullah.

48. *Ms. Zahra Wadood Fatemi:

Will the Minister for Communications be pleased to state:

(a) the prescribed criteria to report/evaluate substandard road design causing traffic jams and accidents thereupon;

(b) the steps being taken by the Ministry to improve the said road infrastructure, the flow of traffic and to avoid traffic jams on the said road; and

(c) whether any traffic campaign has been conducted so far by the Ministry to educate the road-users?

Minister for Communications: (a) As per National Highway Safety Ordinance 2000 (NHSO 2000), National Highways and Motorway Police (NH&MP) is mandated to enforce road safety related matters on National Highways. As part of the road safety matters, NH&MP collect the road accident 21 data. NHA share the data and identifies the “Black Spots”. NHA regional offices across the country plan and implement remedial actions to correct Black spots on National Highways.

(b) All new Highways, Motorways and Expressways constructed by NHA are based on international standards. Special consideration is given to road safety in design for new highways. However, there is a large highway network, inherited by NHA, constructed by Provincial Highway Agencies in the past. There are some inherent Black spots in those sections. Same are corrected through corrective measures in NHA Annual maintenance plans and up-gradation program.

(c) NH&MP is the first organization to introduce the concept of Public Friendly Policing in the country.

It is the premier agency to educate the public in safe driving and ensure meticulous enforcement of traffic regulations on the motorways and highways.

The objective of endorsement by NH&MP is not to penalize the commuters. Rather ticketing is only one aspect to ensure safe driving and reduction in accidents.

Hallmark of NH&MP is to help and provide assistance to commuters while in distress. The Public Friendly image of the department has always been recognized and appreciated at all levels inside the country and abroad.

In order to maintain the hard earned standards of professionalism and efficiency and to augment the spirit of soft policing. Road Safety Education and Awareness Campaigns are regularly being launched on Motorway and National HighWays specially on Over-speeding. Dozing at wheel, Worn out Tyres, Lane violation, Slow moving vehicle in fast lane, Installation of Stickers on rear side of long vehicles, Removal of Zero /Extra Seat from PSVs, Over loading of goods land passengers, Overcharging by the PSVs, Pedestrian Crossing, Safe Driving Campaigns, Safety Helmet, Seat Belt, installaltion of illegal CNG cylinders in vehicles, Mobile Phone, Mechanically unfit vehicle, Violaltion committed by motorcyclist and precautions during bad weather conditions, etc. The Zone-wise number of campaigns launched during the year 2015 (January to September) are as under: 22 —————————————————————————————— Sr # Zone Number of Campaigns —————————————————————————————— (1) Motorway Zone 93 (2) N-5 North Zone 103 (3) N-5 Central Zone 18 (4) N-5 South Zone 31 (5) West Zone 28 —————————————————————————————— Total : 273 ——————————————————————————————

In addition to above, it is stated that Road Safety Education and Awareness Campaigns has become an integral part of NH&MP operational activities. Hence, in order to educate and create awareness amongst the masses about safety while traveling on motorway/national highways, Mobile Education Units have also been established and Road Safety Officers have been deputed. Besides Road Safety Education Campaigns, MEUs impart briefings at academic institutions, bus terminals, factories, Workshops offices etc.

Apart from verbal briefings through officers at toll plazas and road users are also educated through printed material.

49. *Ms. Zahra Wadood Fatemi:

Will the Minister for Defence be pleased to state:

(a) whether it is a fact that the areas of the Defence Housing Authority (DHA) have been declared as no-go areas for the traffic police; if so, the reasons thereof; and

(b) the authority who is controlling the functions to ensure the traffic discipline in the DHA in Rawalpindi and Islamabad at present?

Minister for Defence: (a) Defence Housing Authority Islamabad/ Rawalpindi (DHAI) has never been declared as No Go Area for Traffic Police. DHAI security staff regulates the traffic due to absence of Traffic Police. The said security staff do not impose financial penalties on traffic violators. 23

Chief Traffic Police Officer, Rawalpindi and Senior Superintendent Police (Traffic) Islamabad were approached by DHA for the provision of Traffic Staff for DHA1 Phase-I and Phase-II. However, provision of requisite staff is still awaited. In addition, Inspector General of Police, Islamabad was also requested to establish a Police Check Post ex-Police Station Sihala in DHA1 Phase-II for which DHAI offered to bear all expenses. However, reply on this request is still awaited.

50. *Engineer Dawar Khan Kundi:

Will the Minister for Defence Production be pleased to state whether it is a fact that present Government has failed to install new passenger aircrafts manufacturing factory in the country; if so, the reasons; if not, the location-wise details of such factories installed alongwith the capacity of production thereof?

Minister for Defence Production (Rana Tanveer Hussain): “As per allocation of business, manufacturing of passenger aircraft is neither mandate of MoDP nor there is any manufacturing factory for passenger aircraft under MoDP.”

51. *Engineer Dawar Khan Kundi:

Will the Minister for Law, Justice and Human Rights be pleased to state:

(a) whether there is any proposal under consideration of the Government to establish evening courts for providing speedy and inexpensive justice to the people in the country;

Minister for Law, Justice and Human Rights: (a&b) Presently there is no such proposal, under consideration of Government to establish of evening Courts.

24 52. *Rai Hasan Nawaz Khan:

Will the Minister for Law, Justice and Haman Rights be pleased to state:

(a) the steps being taken by the Government to bound the employees of the National Accountability Bureau (NAB) to investigate the cases referred to them on merit and as their jurisdiction; and

(b) the percentage of amount received by employees of the NAB from recovered amount alongwith the justifications thereof?

Minister for Law, Justice and Human Rights: (a) 1. NAB derives its legal mandate from National Accountability Ordinance 1999 which authorizes the Bureau:—

i. To take cognizance of acts constituting the offences of corruption and corrupt practices.

ii. To eradicate corruption and corrupt practices and hold accountable) all those persons accused of such practices and matters ancillary thereto.

iii. To provide effective measures for the detection, investigation, prosecution and speedy disposal of cases involving corruption, corrupt practices, misuse of authority, misappropriation of property, taking of kickbacks, commission and for matters connected and ancillary or incidental thereto.

2. The relevant law on the subject is section 18 of the NAO 1999 which generally covers following:

a. A reference under this ordinance shall be initiated by the National Accountability Bureau on — a reference received from the appropriate government; or receipt of a complaint; or own accord.

b. Where the Chairman NAB, or an officer of the NAB duly authorized by him, is of the opinion that it is, or may be, necessary and appropriate to initiate proceedings against any person, he shall refer the matter for inquiry or investigation. 25 c. The responsibility for inquiry into and investigation of an offence alleged to have been committed under this Ordinance shall rest on the NAB to the exclusion of any other agency or authority, unless any such agency or authority is required to do so by the Chairman NAB or by an officer of the NAB duly authorized by him.

3. It is submitted that as per section of NAO, quoted above, NAB employees are bound to perform their duties within the prescribed limit.

4. NAB exercises strong internal control / Accountability mechanism. As per operational methodology of NAB, cognizance of corruption cases against NAB officials are taken on top priority. Further, NAB has its own Intelligence & Vigilance cell to monitor the activities of its officers at NAB HQ and at Regional Bureaus as well. Complaints are handled separately by Complaint Verification Cell (CVC) and disposed off by Complaint Scrutiny Committee. Procedure is defined to conduct inquiries / investigation wherein Combined Investigation Team (CIT) is authorized to conduct inquiry / investigation. Hence, no single officer is allowed to contact / interact with any person relevant with the case or to meet outside NAB premises. CIT or at least two officers are allowed to interview accused and witnesses at specific room reserved for the purpose where Audio / Video recording of all proceedings are made. Similarly, ground verification are made by CIT or at least two officers together. On completion of inquiry fate of the case is decided by Executive / Regional Board. Hence, any officer of NAB cannot handle or decide case at his own at any stage. Further, no officer is allowed to contact any department for personal/private matters.

(b) NAB’s employees are not directly paid any amount out of recoveries as percentage thereof. However, Finance Division vide their letter No. 2(2)DFA(Cab)/2000 dated 6th July 2000 (Annex-A) has allowed a percentage of NAB share for operational activities of NAB as well as Welfare measures of NAB employees to be utilized under Recovery and Reward Rules 2002 approved by the President of Pakistan in consultation with Chief Justice of Pakistan as per detail below:

The Funds authorized to NAB out of Recoveries are utilized in term of R&R rules 2002, as under:-

• 20% funds are utilized on Welfare Measures of NAB Employees such as Medical / Health Care, Death and Disability Compensation, Scholarships to Children, Burial/Funeral Expenses etc. 26

• 80% funds are utilized on other purposes such as Bonus Ex-gratia, purchase of equipments and vehicles, purchase of land/Buildings for official purpose and repair of official buildings owned by NAB etc.

• A sum of Rs. 104.516 Million was expended on NAB’s employees during 2014-15 which was only 04% of the amount recovered by NAB (viz Rs. 2782.560 Million) in the said period.

53. *Rai Hasan Nawaz Khan:

Will the Minister for Communications be pleased to state whether it is a fact that maintenance work on GT Road from Lahore to Multan via Sahiwal Checha Watni has not been completed so far; if so, the time by which the said work will be completed thereupon?

Lahore-Sahiwal

Routine maintenance, cleaning and Cut Vegetation contracts from Lahore to Sahiwal have been awarded and work is in progress. (List of contracts is enclosed) . The completion period of the contracts is one year.

Furthermore, periodic maintenance contracts are also in progress which will be completed in 2015. Completion dates are shown against each contract.

Multan-Chichawatni

The road section from Multan (KM-929) via Chichawatni to Sahiwal (KM-1100) falls in the jurisdiction of Punjab-South Region. The road is being maintained through Routine maintenance contracts. These contracts are concluded in 12 months. The road section from Minachanu to Multan has recently been improved through periodic maintenance contract costing of Rs. 569 Million and work at site is near completion. A periodic maintenance contract costing Rs. 230 Million is in procurement stage whereof section of 11 KMs Chichawatni-Sahiwal is being taken for repair. 27 Annex 28 54. *Sahibzada Tariq Ullah:

Will the Minister for Communications be pleased to state:

(a) the total length in kilometers of N-45 from Nowshera to Chitral;

(b) the year-wise total amount incurred on construction/repair of the said road during the last five years; and

(c) whether it is a fact that the condition of the said road is dilapidated inspite of spending huge amount thereupon; if so, the reasons thereof?

Minister for Communications: (a) Total Road length from Nowshera to Chitral (N-45) is 313 Kilometers.

(b) Expenditure Incurred during last five years:

2. F.Y. 2011-12 - Rs. 183.298 Million

3. F.Y. 2012-13 - Rs. 331.804 Million

(c) The road section from Nowshera to Chitral (N-45) has been maintained in accordance with NHA standards and is mostly in good condition. National Highway Authority launched and duly completed Periodic Maintenance Works, hence the respective road is now in better condition. Periodic Maintenance works in progress are nearing completion. Map of N-45 is at Annex-A. 29 30 55. *Sahibzada Tariq Ullah:

Will the Minister for Communications be pleased to state

(a) whether it is a fact that the Prime Minister during his recent visit to Chitral has announced a grant of 45 billion rupees for construction of Chakdara-Dir-Chitral Section of N-45; if so, the time by which the construction work will be started thereupon;

(b) the name of the firm/construction company to whom the said amount has been provided; and

(c) whether the said highway will be further widened and dualised or it will be upgraded in its present form?

Minister for Communications: (a) The Prime Minister of Pakistan during recent visit to Chitral has announced that National Highway Authority (NHA) has planned to construct the projects of more than Rs. 50 billion. Additional grant of Rs.45 billion has not been announced by the Prime Minister. However, the present government has planned to upgrade this important highway as per detail given below:

“Three Packages of 141 Kms of N-45 Chakdara-Dir-Chitral costing Rs. 20 billion through Korean Government financing”

(b) The projects are likely to be commenced in 2016 & the time for implementation of road section Chakdara-Dir-Chitral of N-45 is about 3 years. After signing of loan agreement. between GoP/NHA and Korean Eximbank, construction work will commence.

(c) The feasibility study for road sections from Chakdara-Dir-Chitral has been completed and procurement will be done in 2016.

The road section Chakdara-Dir-Chitral of N-45 will be upgraded and widened to a international/NHA standard of a 2-lane highway.

56. *Mr. Siraj Muhammad Khan:

Will the Minister for Science and Technology be pleased to state: 31 (a) whether it is a fact that Pakistan is a signatory of the Antarctic Treaty;

(b) whether it is also a fact that Pakistan has developed/is developing a permanent base in Antarctic;

(c) if the answers to parts (a) and (b) above are in the affirmative, the details alongwith the scientific benefits thereof?

Minister for Science and Technology : (a) The Instrument of Pakistan’s accession to the Antarctic Treaty-1959 was signed by the President of Pakistan in November 2011.

Pakistan is included among the Non-Consultative Parties to the Treaty since 01 March 2012, the date when the Instrument of Accession was deposited.

(b) Pakistan has neither a permanent base in Antarctica nor it is planned to develop such a base in the near future, as this requires lot of investment. However, efforts are being made to re-activate Pakistan’s Antarctic Research Programme in collaboration with State Oceanic Administration of China. Under this collaboration, Pakistani scientists will be participating in the expeditions to Antarctica along with Chinese scientists. This will provide necessary experience to our scientists before making their own expedition to Antarctica.

(c) Large deposits of strategic and costly minerals like iron ore, chromium, copper, gold, nickel, platinum and other minerals, and coal and hydrocarbons are known to be present in Antarctica. The presence of fin fish, and crustaceans has been estimated in commercial quantities. Massive quantity of fresh water resources is also available in the form of ice sheets and iceberg. Antarctic resources will be of utmost value when the land resources in other regions would be depleted or exhausted. Realizing the importance of the Antarctic Resources, it is in our strategic interest to establish our presence by regularly sending expeditions to Antarctica.

The scientific objectives and anticipated benefits of Pakistan’s presence in Antarctica by reactivating Antarctic Research Programme will be as follows;

• Environmental and Oceanographic Studies in Antarctica and Southern Ocean would be undertaken through collaborations; 32 • Pakistani Scientists by working jointly with Chinese scientists will get an opportunity to learn state of the art techniques of Oceanography;

• Professional and Institutional capacity building.

• Joint publications of the Antarctic expedition.

• The findings will be disseminated through seminars/symposia/research papers, reports for awareness of scientific communities as well as general public.

• Research activities, jointly undertaken, will enable Pakistan in obtaining full membership of the Convention for the Conservation of Antarctic Seals (CCAS).

57. *Mr. Siraj Muhammad Khan:

Will the Minister for Petroleum and Natural Resources be pleased to state whether there is any proposal under consideration of the Government to supply gas to the deprived areas of the country after the import of Liquefied Natural Gas and likely resumption of the Pak-Iran Gas Pipeline?

Minister for Petroleum and Natural Resources (Mr. Shahid Khaqan Abbasi): Modalities of import of Liquefied Natural Gas (LNG) and supply of re-gasified LNG (RLNG) have been approved by ECC of the Cabinet vide case No. ECC-122/13/2015 dated 3rd October, 2012 stating that RLNG will be transported to bulk consumers meeting the energy efficiency criteria only through the transmission and high-pressure distribution network and shall not be transported through the dense network of small dia pipeline across the distribution network.

However, supply of gas to the deprived areas of the country may be considered after construction of the Pak-Iran Gas pipeline.

58. *Mr. Asad Umar:

Will the Minister for Petroleum and Natural Resources be pleased to state the magnitude of Un-Identified Gas/Un-accounted For Gas Losses occurred during the financial years 2013-14, 2014-15 and 2015-16? 33

Minister for Petroleum and Natural Resources (Mr. Shahid Khaqan Abbasi): Magnitude of un-identified / un-accounted for gas (UFG) losses is finalized/ determined by OGRA every year keeping in view the various factors / parameters on this issue.

Due to various constraints OGRA could not announce decision on FRR (Final Revenue Requirement) for the years 2012-13, 2013-14, and 2014-15. However, based on the policy guidelines of the ECC of the Cabinet, UFG figures for both the gas utility companies during the financial years 213-14 and 2014-15 are as under:

• The government with the concerned of all provinces has formulated Model Petroleum Concession Agreement.

• New exploration Licences are being granted. During the tenure of this Government, 46 new exploration licences covering an area of 94,608.85 Sq. Kms have already been granted to different E&P companies.

• 21 Leases have been granted to develop various fields to produce hydrocarbon.

• 211 wells have been spud in since 05-06-2013.

• Monitoring of E&P activities have been enhanced.

• 12,964 L.Km of 2D and 9,746 Sq. Km of 3D seismic survey have been acquired since 05-06- 2013 to identify new prospects.

• Apart from conventional resources, the Government is also making all out efforts to pave way for exploration of unconventional resources like Tight gas, Shale Gas and Low BTU gas etc.

(d) The Government contemplates to rationalize gas sale prices in view of the prices in view of the prices of alternate fuels as well as socio economic consideration.

Construction work of Trauma Center at Pir Khara Sharif near Salt range area has been fully completed by NHA. However, after signing of Concession Agreement with M/s MORE (FWO). Trauma Centre at Pir Khara has been handed over to MORE & Trauma Centre at Bhera is being handed over to M/s MORE in consultation with Govt. of Punjab (owner).

AMBULANCE SERVICE:

NHA has provided 17 fully equipped ambulances to NH&MP for Motorways to curb the emergent situation. 29 Fully ambulances are also deployed by M/s FWO at each Toll Plaza on Motorways which are used during emergencies. The average distance to be covered by an Ambulance is about 20 KM to reach the incident area. Doctors and Para Medical staff is also available in Ambulances. Since Jan 2013, following ceasefire violations (CFVs) have been committed by Indian Army along Line of Control (LoC) and Working Boundary. (WB):—

(a) Ceasefire Violations:

(1) 2013. 464 x CFV (414 along LoC & 50 along WB). Due to Indian firing, 10 x soldiers and 6 x civilian embraced Shahadat, whereas, 24 x soldiers and 89 x civilian were injured.

(2) 2014. 315 x CFV (232 along LoC & 83 along WB). Due to Indian firing, 2 x soldiers and 18 x civilian embraced Shahadat, whereas, 24 x soldiers and 74 x civilian were injured.

(3) 2015. 192 x CFV (123 along LoC & 69 along WB) till 27 Aug. 2015. Due to Indian firing, 1 x soldier and 25 x civilian embraced Shahadat, whereas, 16 x soldiers and 62 x civilian were injured.

(b) Raid Attempt by Indian Troops. On 6th Jan. 2013, Indian troops carried out a raid attempt on a Pakistani Post in Bagh sector. The Indian attempt failed due to timely response by troops. During the encounter, one Pakistani soldier embraced Shahadat and one soldier got injured. 7

2. To address such ceasefire violations, Pak Army maintains high level of vigilance and responds selectively though effectively.

Minister for Science and Technology: (a) It is not a fact that M/s Asad & Co. Contractors have undertaken the mentioned assignment under mutual agreement with Regional Director, Pakistan Council of Research in Water Resources (PCRWR), Lahore or PCRWR Head Office, Islamabad. The factual position is that Mr.Sarfraz Ahmed, Research Officer, Water Quality Lab, Sargodha unauthorizedly took the assignment from UN-HABITAT without permission of Regional Office, Lahore or Head Office PCRWR Islamabad. When, Mr.Sarfraz Ahmad came to know about UN-HABITAT correspondence with PCRWR Head Office, Islamabad on this matter, he submitted a fake joint venture agreement between PCRWR Sargodha Lab and M/s Asad & Co. to Regional Director, PCRWR, Lahore. The Report submitted to UN-HABITAT was with the names of Mr. Sarfraz Ahmad and Mr. Asad Mehmood indicating that it is a private effort of Mr.Sarfraz Ahmad and he had taken the matter on his personal level without the involvement of the PCRWR and submission of bid and invoices were issued to UN-HABITAT on fake file and dispatch numbers.

Ministry of Science and Technology has initiated disciplinary proceedings against Mr.Sarfraz Ahmed, Research Officer, Water Quality Lab, Sargodha under E&D Rules, 1973 for undertaking this assignment unauthorized and for sending a fake joint venture agreement signed with M/s Asad & Co. to Regional Director, PCRWR, Lahore.

(b) Yes, the firm has submitted invoice to Regional Director PCRWR, Regional Office, Lahore for payment amounting to Rs.19,22,550/-. However, payment to the said firm has been withheld in view of the position explained above.

Yes, in order to encourage local investment in E&P sector, the Government has incorporated the following provisions in the Pakistan Petroleum Exploration and Production Policy, 2012:—

Operators of all blocks are required to maintain the participation of local companies for the entire licence period as below:

Zone I 15 % Zone-II 20 % Zone-III 25 %

Smaller local Pakistani companies are allowed to Join consortia with other E&P companies as non operator in order to gain the necessary industry experience to allow them to expand their capacity to take on operating roles in future.

In the event, local Pakistani company does not have requisite past operating experience, such company is required to either produce an agreement with an internationally renowned E&P and/or services company acceptable to DGPC or a high caliber technical and management team with proven track record of overseeing and managing operations in the international petroleum industry.

Minister for Petroleum and Natural Resources (Mr. Shahid Khaqan Abbasi): (a) Yes. A project of supply of gas to UC Dosehra and Dargai was approved vide PM Directive dated 20/01/2010 along with allocation of fund amounting to Rs. 180.60 million against total project cost of Rs. 205.458 million.

(b) An amount of Rs.178.70 million out of the allocated Rs.180 Million for supply of gas to Union Council Dargai and UC Doshera in NA-7 District Charsadda has since been sanctioned/completed.

(c) Supply main of 6" Dia x 13 km for UC Dosehra and Dargai has been laid and commissioned. Laying of 96% of distribution network in UC Doshera has been completed. It may please be noted that laying of remaining portion of 4" dia for Doshera is pending due to railway crossing for which NOC from railway authorities is awaited. Work to the tune of above allocated amount has been sanctioned/ completed, whereas additional work shall be undertaken after approval of additional funds

(d) Approval for allocation of an amount of Rs.93.546 million (Revised as per prevailing rates) will be required from Prime Minister’s Office for supply of gas to said areas.

Since all new gas connections are being provided strictly on turn/merit basis through computer generated lists, which is determined on the basis of allocation of the Region and number of pending applications, therefore, gas connections to the remaining residents of subject locality will be provided on their turn/merit, barring unforeseen circumstances.

The above categories may fall in plain, rolling and hilly terrain and entails cost accordingly. The bridges on major rivers if encountered contribute huge share of the total cost. The comparison of the cost in plain areas is given below:

Further the cost in higher water (logged) table area will be more as compared to plain area. The reconstruction may be vary due to above reasons between Rs. 55 million per kilometer to Rs. 80 million per kilometer or more.

(b) The company further apprised that no inflated gas bill has been issued as per billing records. However, 02 numbers high consumption bills were issued during last two years on the basis of actual meter reading. 06 numbers claims were debited against defective meters and 01 number claim was debited against meter tampering case. Above actions have been taken in accordance with the Company/ OGRA policy.

After signing of the Concession Agreement with M/s MORE for Overlay & Modernization of Motorway M-2 (Lahore-Islamabad) on BoT basis for a period of twenty (20) years, the Concessionaire has taken over the charge of Service Areas from M/s DPMSL.

Now, the MSAs are being operated by M/s MORE, however, NHA simply monitors the overall performance of the Concessionaires. As far as the procedure to check the price/rates of goods is concerned, it is the responsibility of District Administration to check the rates and quality of items sold at MSAs under the laws of Pakistan and Magisterial powers for checking of food prices and quality assurance are vested with Provincial District Administration.

Islamabad-Peshawar Motorway (M-1)

All rates have been approved by the concerned DCO for implementation on tuck shops in the service areas of Motorways and all approved rates have been displayed for information of the road users. In order to ensure the implementation of rates, the field officers randomly visit and check the rates charged by these shopkeepers.

21. Mr. Sajid Nawaz:

Will the Minister for Petroleum and Natural Resources be pleased to state whether recruitments against various posts in Sui Northern Gas Pipelines Limited have been made on merit during the period from 1-1-2013 till date; if so, the details thereof?

Minister for Petroleum and Natural Resources (Mr. Shahid Khaqan Abbasi): Recruitments in SNGPL is made purely on merit through a transparent recruitment process. The recruitment criteria of SNGPL is very well defined and all Pakistan Nationals/Applicants get a fair opportunity to compete, subject to meeting the Company’s laid down criteria. SNGPL is an equal opportunity employer.

The Company advertises its staffing requirements (career terms) in the National Press and follows a merit based recruitment process whereby Qualification, Age and Minimum Experience requirements as defined by its Board of Directors are observed.

As per approved criteria of recruitment, the Company has to fulfill following requirements:

(i) Determination of position requirements / criteria / job description.

(ii) Publication of advertisement in the Press.

(iii) Short listing of applicants as per advertised criteria.

(iv) Written Test through third party/interview of short listed applicants by the Management.

Will the Minister for Law, Justice and Human Rights be pleased to state:

(a) the total number of cases are pending in the National Accountability Bureau for the last four years; and

(b) the prescribed procedure to dispose of those cases?

Minister for Law, Justice and Human Rights: (a) It is informed that 516 cases are pending in NAB for the last four years, as per following details:

(b) Operational procedures

The operational procedures of NAB have been evolved with a view to lay down unambiguous criteria for an objective and transparent assessment of cases. The operational procedures comprised following stages:

(a) Receipt of complaints: Section 18 (b) of the NAO stipulates that NAB can initiate a reference on receipt of a reference/complaint from the appropriate government department or agency, receipt of a complaint from member of the public or its own accord (suo moto) 27 (b) Preliminary examination/probe: The complaint is examined by relevant experts in order to determine the nature of the offence and the possibility of taking cognizance under the NAO.

(c) Inquiry: During this stage, formal evidence is collected according to law to determine whether there is sufficient evidence to incriminate the accused. If accused is govt servant, concerned department is informed. Accused is afforded the option of Voluntary Return (VR) at this stage.

(d) Investigation: Investigation is advanced stage, which is authorized after scrutiny of evidence and discussion with experts (financial as well as legal). The investigator collects evidence and prepares report according to the law. The investigation process entails interviewing of accused, recording of witness statements, collection and examination of evidentiary material. The option of Plea Bargain (PB) is available to the accused at this stage.

(e) Arrest of accused: Section 24 of NAO empowers Chairman NAB to issue Warrant of Arrest of accused. In order to execute arrest following tools are adopted:

“ Placement on Exit Control List (ECL) “ Issuing Red Notice “ Extradition through INTERPOL

(f) Priority of cognizance of cases: Cases are prioritized by adopting a priority matrix. Priority is assigned on the basis of gravity of offence, the profile of accused and amount of corruption money involved.

(g) Decision making process: In the course of enforcement operations and legal proceedings, the prime decisions of authorization/ closure of inquiry/ investigation, accepting / rejection of PB/VR application and reference filing are being taken in the Executive Board, chaired by Chairman NAB.

(h) Exit Control List: At any stage of the case, name of an accused is placed on ECL through Ministry of Interior. 28 (i) Freezing of assets: U/s 12, NAO empowers NAB and Court to freeze property, assets and bank accounts of the accused person.

(j) Filing of Reference: The final investigation report is examined and scrutinized by legal experts of NAB. Chairman, having satisfied, sings the reference against accused which is filed in the court of law.

(k) Prosecution: NAB Prosecutors present the case in the Court to prosecute the accused. At this stage accused can avail Plea bargain (PB) opportunity, whereby he returns back the plundered money, but yet Plea Bargain amounts to conviction of accused. The Prosecution may culminate into:

(i) Conviction of accused

(ii) Acquittal of accused

(iii) Plea Bargain

(l) Time Lines: To ensure timely completion of cases and to dispose them on merit, the concept of time lines have been assigned to all pending cases by the competent authority.
