1 (26Th Session) NATIONAL ASSEMBLY SECRETARIAT 1 (26th Session) NATIONAL ASSEMBLY SECRETARIAT ———— “QUESTIONS FOR ORAL ANSWERS AND THEIR REPLIES” to be asked at a sitting of the National Assembly to be held on Monday, the 23rd November, 2015 124. *Ms. Munaza Hassan: (Deferred during 23rd Session) Will the Minister for Law, Justice and Human Rights be pleased to state: (a) the total number of murder, kidnapping and other crimes against women which are pending in Federal Courts at present; and (b) the steps taken by the Government for and expeditious disposal of the such cases by easy access to justice? Minister for Law, Justice and Human Rights: (a) The Government is committed to eliminate all forms of violence against women. Ministry of Law, Justice and Human Rights is making all out efforts to control such violations and to expeditiously dispose of cases related to women. The question no 124 was circulated among relevant Federal Court seeking total number of cases pending in their respective courts. Supreme Court is of the view that as per Article 2 (A) of the Constitution, independence of the judiciary shall be secured and Constitution does not envisage, oversight in any form/manner by any other institution/organs of the State on the functioning of the Courts. According to Federal Shariat Court, 196 criminal cases regarding murder, kidnapping and other crime against women are pending at their Court. A total number of 103 cases are also pending in the Special Courts. 2 (b) Federal Government has taken following steps for expeditious disposal of such cases: • The Access to Justice programme is one of the key reform initiatives which aim at implementing reforms in the judicial, police, legal and administrative justice sectors. The programme was launched in 2001. Judicial reforms like improvement in process serving systems and procedures, alternate dispute resolutions, monitoring system through Members Inspection Team, Amendments in code of Criminal Procedure to devolve Habeas Corpus powers from High Courts to District and Session Judges, establishment of Courts for small claims and minor offences, have been undertaken. • Shaheed Benazir Bhutto Human Rights Centers for Women at Federal and Provincial level are also providing legal support to the women victims of violence for expeditious disposal of their cases in Courts. • Women Police Stations have also been established in different cities all over the country where the female police officers/officials are deputed to deal/facilitate women in persuasion of their cases. • A Helpline at Federal level for Legal Advice on Human/women Rights Violations has also been installed to give legal advice to victims of violence and to refer the cases to respective authorities. 133. *Mr. Asad Umar: (Deferred during 23rd Session) Will the Minister for Law, Justice and Human Rights be pleased to state the present status of the Universal Periodic Review 2012 regarding the recommendations given for banning the domestic child labour in Pakistan? Transferred to Overseas Pakistanis and Human Resource Development Division for answer on next Rota Day. 260. *Ms. Aisha Syed: (Deferred during 23rd Session) Will the Minister for Science and Technology be pleased to state: (a) the number of Scientists readied according to the requirement so far; and 3 (b) the number of persons received modern education of science from Pakistan and rendering their services in the country and abroad at present? Minister for Science and Technology: (a) According to the survey conducted by Pakistan Council for Science & Technology (PCST) an organization of this Ministry, there were 60,699 Researchers (Scientists) in the country during 2013; among them 17.05% were females. (b) According to the survey a vast majority of researchers in Pakistan i.e 43,636 (71.89 %) are educated upto the level of Master’s or equivalent whereas 10,670 (17.57%) researchers hold the degree of Ph.D. Most of them have acquired their education in Pakistan. It is therefore, submitted that this Ministry has no information about qualified Pakistani researchers rendering their services abroad. 268. *Syed Waseem Hussain: (Deferred during 23rd Session) Will the Minister for Petroleum and Natural Resources be pleased to state: (a) the quantity of the Liquefied Natural Gas (LNG) being imported from other countries especially from Qatar at present alongwith the utilization and rates thereof; and (b) the quantity of electricity will be produced from the said LNG in the near future? 4 Minister for Petroleum and Natural Resources (Mr. Shahid Khaqan Abbasi): (a) Total of 25.7 Btu of LNG has been imported by M/s PSO as per details below: Source MMBTU Supplied Price Range of in to (US$) per Supply Million MMBTU ——————————————————————————— Qatar 19.7 Power, 7.5 to (FOB CNG and 8.05 basis) Fertilizer sectors ——————————————————————————— Tenders 6.0 Power 8.2321 (DES Sector to 8.58 basis) (b) Currently, 180 MMCFD RLNG is being provided to Saif, Sapphire, Orient and KAPCO. These plants are generating 840 MW. Furthermore, additional 600 MMCFD RLNG is planned for three (3) RLNG based plants at Bhikki Baloki and Havali Bahadur Shah. These plants will have a total installed capacity of 3600 MW. 279. *Mr. Imran Zafar Leghari: (Deferred during 23rd Session) Will the Minister for Defence be pleased to state: (a) the present status of the Operation Zarb-e-Azb; (b) the successes achieved by the said Operation since its commencement; and (c) the target date of completion of the said Operation? Minister for Defence: (a), (b) & (c) Operation Zarb-e-Azb commenced on 15 June 2014 and continued successfully. Operation Zarb-e-Azb had various facets in its manifestation. First one was the physical clearance of areas under terrorists sway and establishment of writ of the state. 89% area of North Waziristan 5 Agency and 87 % of Khyber Agency have been physically cleared. 13,000 weapons (all types) and 1,80,000 tons of explosive have also been recovered. Since it was known that terrorists will flee towards cities as a result of operation in FATA, a comprehensive “integrated Security Plan” was put into effect. Over 10,000 Intelligence Based Operations were conducted in cities / towns throughout the length and breadth of Pakistan. 216 x terrorist were killed. Afghan authorities and “Resolute Support Mission Headquarters” are continuously being pursued to target the terrorists who have fled to Afghanistan. Sequel to all above, now is the time for major politico-adm initiative reforms and development works in FATA for ensuring durable peace, while military carries out intelligence based operations for sustained peace, takes steps for better control of border and facilitates for rehabilitation of Temporary Displaced Persons (TDPs). Operation Zarb-e-Azb is configured to deal with menance of terrorism as a whole and therefore, will continue to nab sleeper cells of terrorists and financiers elsewhere in the country including FATA. 31. *Dr. Nafisa Shah: Will the Minister for Petroleum and Natural Resources be pleased to state: (a) the total number of ships carrying Liquefied Natural Gas (LNG) have berthed at the Elengy Terminal alongwith the amount and utilization thereof; and (b) the cost of the LNG imported so far alongwith the names of the countries thereof? (b) An amount of Rs. 25,000/- has been fixed as processing fee to avail urgent gas connection. This amount is in addition to security/ service line charges which are recovered from the applicant on subsequent stage. 33. *Dr. Nafisa Shah Will the Minister for Petroleum and Natural Resources be pleased to state the upfront tariff set for the Liquefied Natural Gas Power Plants alongwith the terms and conditions thereof? The Law and Justice Commission of Pakistan is mandated to suggest law reforms to make our legal system more responsive to such concerns and formulate efficient and workable policies for strengthening the system of administration of justice.     Pakistan Legal Practitioners & Bar Councils Rules, 1976______________________________1 PREFACE I am delighted to write the preface of this latest edition of the Legal Practitioners & Bar Councils Act, 1973 and the Rules made thereunder, which is an official publication of the Pakistan Bar Council. The last edition was published in 1989 when, for the first time, the details of original tests of all those provisions, which were either omitted or amended, from time to time, were placed at the footnotes, to facilitate making comparison between the original texts of such provisions with amended ones. For compiling and publishing the last edition strenuous efforts were made by Mr. Muhammad Arshed, Secretary, Pakistan Bar Council which are acknowledged with appreciation. In view of number of amendments made in different Rules and enactment of some new Rules by the Pakistan Bar Council since 1989, it was thought appropriate to publish the new edition. V- CONCLUSION. INTRODUCTION Continuous professional development (CPD), is the ongoing training of a professional throughout his or her career. It is separate and distinct from the original degree course and professional or vocational training which is often mandated at the start of the career. The purpose of CPD is “.. the maintenance and enhancement of a lawyer's or paralegal's professional knowledge, skills, attitudes and professionalism throughout the individual's career. It is a positive tool that benefits lawyers and paralegals and is an essential component of the commitment they make to the public to practice law or provide legal services competently and ethically”. The professionals are required to maintain and improve their skill and competence through such periodic systematized trainings. This is a well established practice in various professions all over the world. In Pakistan, to become a lawyer, a person has to do bachelors and get a law degree. The LL.B course is designed to impart the minimum necessary knowledge of the law of the land to would be lawyers so as to help them practice the profession. In addition the six months training course is meant to provide some bare minimum skills necessary for practicing the vocation. However, this education and training alone, is inadequate to provide all the skills and necessary knowledge required by lawyers to practice this noble profession. It is because of this that in many countries of the world, professional development is an ongoing process.

    Legal Practitioners & Bar Councils Act, 1973 1 LEGAL PRACTITIONERS AND BAR COUNCILS ACT, 1973 [ACT XXXV OF 1973] An Act to repeal and, with certain modifications, re-enact the law relating to legal practitioners and bar councils The following Act of the National Assembly received the assent of the President on the 22nd February, 1973, and is hereby published for general information:- Whereas it is expedient to repeal and, with certain modifications, re-enact the law relating to Legal Practitioners and Bar Councils and to provide for certain incidental and ancillary matters; It is hereby enacted as follows:- CHAPTER I PRELIMINARY 1. Short title and commencement.--(1) This Act may be called the Legal Practitioners and Bar Councils Act, 1973. (2) It shall come into force at once. 1[1A. Overriding effect.--The provisions of this Act shall have effect notwithstanding anything inconsistent therewith contained in any other law for the time being in force.] 2. Definitions.--ln this Act, unless there is anything repugnant in the subject or context,-- 2[(a) "Advocate" means an advocate entered in any roll under the provisions of this Act;] (b) "Bar Council" means a Bar Council constituted under this Act; (c) "Common roll" means the common roll of advocates of the High Court or, as the case may be, the common roll of other advocates prepared and maintained by the Pakistan Bar Council under this Act; 3[(cc) Omitted]; 1.
