STATEMENT OF INTEGRITY As Members of Waikato Secondary Schools Sport Association, Principals recognise and accept collective responsibility to act with integrity in protecting the values of school sport so that each secondary school student attending a Member’s School can experience sport in a positive and safe environment. In recognition of this responsibility, all schools taking part in Waikato Secondary Schools Sport sanctioned events agree to display honesty, respect, and fair play in their own school and towards other schools and competition organisers. CODE OF CONDUCT Every student, coach, manager, and supporter has a responsibility to uphold the spirit of fair play and sportsmanship in any Waikato Secondary Schools Sport events. Schools are responsible for providing a safe environment for Waikato Secondary School Sport events in which all individuals are treated with respect. The Waikato Secondary Schools Sports Association Incorporated, [WSSSA] is governed by an elected executive committee of Secondary School Principals representing the Principals from the Central North Island Secondary School Principals Association [CNISSPA]. A member of this organisation is a representative of the School Sport New Zealand [NZSSSC*] board. The cur- rent representative is WSSSA Chairman Kelvin Whiting of Hillcrest High School. Key aspects of the organisation are supporting the capability of school sports staff, creation and the sanctioning process of an effective calendar of sporting events for the schools, and actively working with sports bodies to deliver accessible opportunities and pathways for all secondary school student-athletes in over 35 sports codes. The Waikato region has a proud heritage of developing youth talent to the international arena from provincial New Zealand and endorses its young people being “out there and active”.

8 WSSSA INC CONSTITUTION

1.1 NAME The name of the association shall be Waikato Secondary Schools Sports Association (Incorporated).

1.2 REGISTERED OFFICE The registered office of the Association shall be at such a place as the Executive may from time to time determine.

1.3 INTERPRETATION In this Constitution, unless a contrary intention appears: 1.3.1 “The Association” means The Waikato Secondary Schools Sports Association (Incorporated). 1.3.2 “The Executive” means the Members of the Executive, appointed under Rule 1.10.2 of these rules. 1.3.3 “Director” means the Executive Sports Director appointed pursuant to rule 1.12 of this Constitution. 1.3.4 “Sports Council”, or “Council” means the School Sport New Zealand [SSNZ]. 1.3.5 “Year” means the financial year of the Association, which shall extend from 1 July in any year until 30 June of the following year. 1.3.6 “Waikato Secondary Schools” means a secondary school in the Waikato area that is registered with the New Zealand Ministry of Education as an accredited secondary school. It shall include state owned, integrated and private secondary schools, such schools being approved by a general meeting of the Association on the recommendation of the Executive. 1.3.7 “WSSSA” means Waikato Secondary Schools Sports Association (Inc). 1.3.8 The following shall be deemed to be approved secondary schools for the purposes of this Constitution: Berkley Normal Middle School; Cambridge High School; Coromandel Area School; Fairfield College; Forest View High School; Hamilton Fraser High School; Hamilton Boys’ High School; Hamilton Girls’ High School; Hamilton Christian School; Hamilton Junior High School; Hauraki Plains College; Hillcrest High School; ; Mangakino Area School; ; ; Mercury Bay Area School; College; Ngaruawahia High School; Nga Taiatea Wharekura; ; College; Pio Pio College; Putaruru College; Raglan Area School; Junior High School; Rototuna Senior High School (2017); Sacred Heart Girls’ College; St John’s College; St Paul’s Collegiate School; St Peter’s School; Tai Wananga; Taumarunui High School; Te Aroha College; Te Awamutu College; Te Kauwhata College; Te Kuiti High School; Te Wharekura O Te Kaokaoroa O Pātetere; ; High School; ; for Girls’; Whangamata Area School

1.4 PURPOSE, MISSION, GOALS AND OBJECTIVES 1.4.1 Purpose To operate as a sporting agency for the secondary schools of the Waikato region as defined in 1.3.8.

9 1.4.2 Mission To administer, foster and coordinate sport in the secondary schools of the wider Waikato region. 1.4.3 Goals (a) To provide access and opportunities for all secondary school students in the wider Waikato region to participate in sport. (b) To provide opportunities for elite performers to fulfil their potential. (c) To facilitate participation in Island, National and where appropriate, International secondary school sporting events. 1.4.4 Objectives (a) To administer and control an inter-secondary school sports structure within the Central North Island region with regular and stable competition for school based sports. (b) To facilitate the maximum participation of students in inter-school sport at secondary level. (c) To provide the very best of conditions and standards for students to enjoy and realise their potential in sports competition. (d) To promote public awareness of the benefits of students’ involvement in sport at secondary school. (e) To properly serve the secondary schools of the wider Waikato region; including their Principals, Administrators, Teachers and Coaches involved in sport. (f) To promote a sound and philosophical base for sport as part of the school educational process. (g) To maintain strong relationships between Sport Waikato and secondary schools in general. (h) Advocacy for the Principals in the coordination of sport, in liaison with sporting bodies.

1.5 MEMBERSHIP AND PARTICIPATION 1.5.1 There shall be two types of membership: (a) School Membership All schools making up the wider Waikato secondary schools (i.e. CNISPA region) shall be entitled to membership of the Association and may be represented at any meeting by the Principal or any other person accepted by the Chairperson as a representative of the school. (b) Honorary Membership Any person whom the Association or the Executive deems appropriate to further the objectives of the Association may be invited to Honorary Membership status. Such members may constitute an advisory body to the Association and be assembled at the direction of the Chairperson of the Association. An Honorary Member shall not be eligible to vote at any General or Executive Meeting. 1.5.2 Member schools of the Association will have the right to participate in approved sports of the Association, subject to the provisions of this Constitution and the Association’s Bylaws. 1.5.3 The right to participate may be withdrawn at any time by the Association Executive for failure to comply with this Constitution or any Bylaws of the Association. 1.5.4 Each Member School must have a staff member designated as Sports Coordinator, Sports Representative or a person entrusted to represent the school in the organisation. 1.5.5 Each Member School must demonstrate an active willingness to provide, encourage and develop sport within their school. 1.5.6 Each Member School must abide by the Bylaws of the Association and adhere to the rules or code of conduct of individual approved sports.

10 1.6 SUBSCRIPTION 1.6.1 Each Member School shall pay such subscription as decided at the Annual General Meeting. 1.6.2 The subscription for the following year shall be set no later than 30 April in the preceding financial year. 1.6.3 Any Member School whose subscription has not been paid by 1 October shall be deemed to be un-financial and shall forfeit all rights of membership until the subscription is paid. This will include access to all inter-school competitions administered by the Association. 1.6.4 Additional to this, schools choosing to participate in approved/affiliated sports must pay the individual code fees levied by WSSSA or other affiliated bodies. 1.6.5 Fees, levies and costs associated with Island and National secondary school events shall be the responsibility of individual Member Schools.

1.7 TERMINATION OF MEMBERSHIP 1.7.1 Membership of the Association may cease in accordance with any of the following: (i) Written resignation received by the Director or Executive. (ii) Any Member School which has refused or failed to pay the prescribed subscription. 1.7.2 Schools who resign their membership shall forfeit their eligibility to participate in all activity of the Association.

1.8 MEETINGS 1.8.1 The Annual General Meeting shall be held at a date and venue to be decided by the Executive, but shall take place before 31 March each year. The business of the meeting shall be to receive the annual report and to approve the audited accounts as required by this Constitution and to transact any other business. 1.8.2 Notice of any Annual General Meeting or Special General Meeting of the Association, including the date, and venue, shall be circulated to all Members Schools at least two weeks before the date of the meeting. 1.8.3 Any Member School shall have the right to attend any General Meeting and to vote. 1.8.4 The Executive may at any time, or upon the written request of ten Member Schools, convene a Special General Meeting, for any specific purpose. Such a meeting shall be held not more than two weeks after the written receipt of the request. 1.8.5 The quorum at any General or Special Meeting shall be one quarter of the Member Schools.

1.9 VOTING 1.9.1 All Member Schools shall be eligible to one vote at all General or Special Meetings. 1.9.2 Voting at any General or Special Meeting shall be by voices or show of hands, except that a ballot shall be held if any member requests it. 1.9.3 At any meeting, the Chairperson, where necessary, shall have a casting vote, in addition to their personal vote.

1.10 EXECUTIVE 1.10.1 The Executive shall consist of the Chairperson, the WSS Executive Sports Director, CEO of Sport Waikato and up to ten Executive Members. 1.10.2 All Members of the Executive (Director) shall be Principals appointed each year by a meeting of the Central North Island Schools Principals Association. Any member of the Executive may be reappointed for any number of terms.

11 1.10.3 The quorum at any Executive Meeting shall be five persons. 1.10.4 A meeting of the Executive may be called at any time by the Chairperson and the RSD and shall be called within fourteen days of receipt by the Director of such a request. 1.10.5 The Executive may appoint a Principal from a Member School to fill any vacancy on the Executive.

1.11 POWER AND DUTIES OF THE EXECUTIVE 1.11.1 The Executive shall carry out the Objectives in accordance with these Rules and shall decide any matters not here included. 1.11.2 The Executive shall ordinarily meet at least four times in a year. 1.11.3 The Executive shall have the power to appoint sub-committees as required and to appoint representatives to any committee, commission or other affiliatedAssociation upon request. 1.11.4 The Executive shall have the power to enter into any sponsorship agreement that assists in meeting the Objectives of the Association. 1.11.5 The Executive shall have the power to employ other specialist services to assist in meeting the objectives of the Association as it deems appropriate. 1.11.6 The Executive shall engage Sport Waikato as their Agent, based on the agreed three Memorandum of Understanding for the delivery of the desired sporting outcomes for the Association.

1.12 WAIKATO SECONDARY SCHOOLS’ EXECUTIVE SPORTS DIRECTOR 1.12.1 The Executive shall have the right to contract a salaried Executive Sports Director. 1.12.2 The remuneration package to be paid to the Director shall be negotiated and approved by the Executive, but shall not have voting rights at meetings. 1.12.3 The Director shall attend Executive, General and Special Meetings as required by the Executive. 1.12.4 The duties and functions of the Director shall be specified by the Executive within any guidelines which may be agreed at a General Meeting. These may include the keeping of all expenditures, accounts and provision of a Statement of Accounts where required.

1.13 FINANCE 1.13.1 The Association shall have a current account at a Bank approved by the Executive, which may be operated by any two of the Chairperson, Secretary-Treasurer and Director. 1.13.2 The financial year of the Association shall be from 1 July in any year to 30 June of the following year. 1.13.3 The Association shall have the power to invest such sums of money as it from time to time deems necessary in any matter and which the Executive in its discretion thinks fit. 1.13.4 The Executive, in its discretion, may make any charge to any person, Member or otherwise, for the use of any Association property or privilege. No member of the Association shall receive any profit from the Association, but in exceptional circumstances, may be paid reasonable expenses when on the Association’s business, subject to the approval of the Executive. 1.13.5 No member or person associated with a member of the organisation, shall derive any income, benefit or advantage from the organisation where they can materially influence the payment of the income, benefit or advantage. Except where that income, benefit or advantage is derived from professional services to the organisation rendered in the course of business charged at no greater rate than current market rates.

1.14 HONORARY AUDITOR 1.14.1 Accounts will be audited annually by an auditor approved by the Executive.

12 1.15 ALTERATIONS 1.15.1 These Rules may be altered, added to or rescinded at a General Meeting of the Association, provided two thirds of those present and eligible to vote are in favour. 1.15.2 Notice of the proposed changes shall be sent in writing to all Members at least fourteen days prior to the date of the meeting. 1.15.3 Such changes that are approved shall come into effect when approved by the Register of Incorporated Societies, except that a later date may be approved at a General Meeting. 1.15.4 No addition to or alteration or recession of the rules shall be approved if it affects the pecuniary profit clause or the winding up clause.

1.16 BYLAWS The Executive may make such bylaws for the conduct of the Association’s business as it sees fit, conditional on such bylaws being subsequently ratified at a General Meeting of the Association.

1.17 COMMON SEAL The Common Seal of the Association shall be kept in the custody of the Director and shall be affixed only in the presence of the two members of the Executive pursuant to a resolution of the Executive.

1.18 WINDING UP The Association may be wound up if the Members, at a General Meeting, pass a resolution by a simple majority requiring the Association to be wound up; and the resolution is confirmed at a subsequent General Meeting, called for that purpose, and held no earlier than thirty days after the date on which the resolution to be confirmed was passed. Such a second Meeting may also direct the method of disposition of the funds and property of the Association after such dissolution, provided that such funds and property shall not be distributed amongst Members, but paid to or distributed between one or more organisations having objects similar to the Association.

1. STATUS 1.1 These By- Laws are made under the Rules of Waikato Secondary Schools Sports Association (Incorporated) Unless otherwise stated they apply to all Waikato Secondary School events. 2. INTERPRETATIONS 2.1 In these By-Laws: (a) “WSSS” refers to – Waikato Secondary Schools Sports Association that being an Executive elected group of Central North Island Principals Association [CNISPA]. In context of the rules “WSSS” may refer to WSSSA or its sanctioned delivery agent[s] for events. (b) “ESD” refers to the Waikato Secondary School’s Executive Sport Director (c) “Events”, is an interchangeable terms dependent upon context for “Sports”, “Tournaments”, “Leagues” and “Competitions”

14 (d) “Sports” also refers to Sports Codes (e) “District” means an area within the Sport Waikato region, such as a cluster of schools or any sub - Association within the region (f) “Region” refers to the defined region of responsibility for secondary school by Sport Waikato (g) “Member” or “Participating” School means any secondary school in the Sport Waikato region included in the WSSSPA executive, of Central North Island Secondary Principals Association [CNISSPA] jurisdiction. The region bounded by and including north to Te Kauwhata, north east from Coromandel to Waihi, west to Raglan south to Taumarunui and south to Tokoroa, that are registered with the MOE as an accredited secondary school and who has paid the annual levy due to WSSS. This interpretation shall include state, integrated and private secondary schools. (h) “MoE’ means Ministry of Education (h) “Domestic student” refers to all students so classified by the MoE. (i) “Non–Domestic” refers to all students so classified by the MoE. Any non-domestic student who enrols in a school in year 9 before the first day of term 3 is in a sporting context exempt from any quota limitations. Apart from this exclusion all other Non-Domestic students remain part of the quota throughout their time at any school. (j) “New to School” [NTS] – refer to Premier eligibility for definition of NTS (k) “Primary Caregiver Relocation Exemption” [PCRE] refers Where the family or primary caregiver of a student has changed address and the student cannot reasonably be expected to remain at their previous school, an application for exemption care be made for exceeding NTS quota (l) ‘Home School’ refers to students who are school / educated at home and who are not registered or enrolled at a recognized MOE school. (m) “Co-Ed Schools: The MoE status of a school will be used to determine its co-educational status (m) “NSO” means the National Sporting Organisation associated with a particular sport; (n) “RSO” means the Regional Sporting Organisation associated with a particular sport; (o) “Premier Sport” means a sport identified as premier in the Sanctioned Sport Schedule (p) “Premier Competition” means the WSSS Competition for a Premier Sport (q) “Premier Team” means the top or first team of the school for that code (r) “Sanctioned Sport Schedule” means the document which identifies the status of each Sanctioned Sport. This may be amended by WSSS from time to time; (s) “Sport Advisory Group” means a group made up of representatives from the relevant RSO and/or NSO and a sufficient number of representatives from Member Schools to give advice to WSSS on the competition structure; (t) “RSD” refers to the Regional Sport Director or “SSSD” Secondary School Sport Director (u) “TIC” means teacher in Charge of sport in the member school (v) “SC” means a Member School Sport Coordinator (w) “DoS” means a Director of Sport or Head of Sport in Member School (x) “CRC” means a Complaints Review Committee called by WSSS (y) “SAG” means Sport Advisory Group (z) “SSNZ” means School Sport New Zealand (formerly NZSSSC)

3. SANCTIONED SPORTS EVENTS 3.1 Sanctioning of Events Rationale is to ensure that an “event” it meets all the requirements set down by the WSSS for the following purposes (a) To undertake due diligence to facilitate safe environments for WSSS sanctioned competitions and events. (b) To ensure that secondary school sporting event administrators provide a fair and equitable opportunity for school’s teams to be selected to compete at a competitive level that is appropriate to their performance in that year. (c) To ensure that all schools can participate in all district or regional events. (d) To ensure that the event is held under the rules of the sport and is organised to a high standard. (e) There will be expectations that national and regional bodies or organising committees have appropriate procedures in place to deal with breaches of regulations, including codes of conduct, and that these will be applied at a sanctioned event. Where necessary all breaches will default to WSSS Rules & Bylaws Guidelines:

15 For all events, a WSSS sanctioning form detailing, inter alia, the following information will need to be provided to WSSS on by 1 October of the preceding calendar year before the event meeting the requirements of Sanctioning in 3.2 (a) – (k). Applications are to be made online at http://www. sportwaikato.org.nz/programmes/secondary-schools/forms/one-off-events.aspx 3.2 Sanctioning an Event requires the following conditions; (a) adhere to the philosophy and objects of WSSS and comply with these Bylaws (b) show positive evidence of the development of the sport within the region for many of the member schools (c) entry to be available to all Member Schools within district or region (d) provide details of proposed competitions dates, days and venues of District or Regional events that are to be held in the school terms as defined by WSSS calendar and supports Bylaw 16 “competition dates” (e) be constituted, or have “event” rules and/or a “Code(s) of Conduct” acceptable to WSSS and updated copies of them shall be lodged with the WSSS (f) provide details of all competition entry fees to be borne by competitors or schools in entering to the event in consultation with WSSS or SAG, the RSO or NSO (g) show they have availability of officials of an acceptable standard (h) demonstrate a system of disciplinary processes acceptable to WSSS; (i) Ensure availability of appropriate safe venues and facilities and submit all required “Health and Safety” plans to WSSS at least 6 weeks prior to the event; (j) have public liability insurance cover for the event; (k) within 10 weeks post event agree to supply an event report, financial report and details of any incidents, and allow opportunity for Member Schools to provide feedback to WSSS or any such determined SAG 3.3 All Sanctioned Sports would be eligible for the participants to be recognised through WSSS Sports Awards System as a Sanctioned event – see Appendix I : “Sanctioned Events Schedule” 3.4 Where WSSS does not have a partnership with an RSO/NSO in the delivery of a sanctioned event, the overall jurisdiction of that sport is the responsibility of WSSS. 3.5 Application to become a Sanctioned Event shall first be made to WSSS.The ESD shall at his/her discretion determine annually whether a sport will be sanctioned on application and by any previous sanctioning reviews in consultation with the WSSS and SAG’s 3.6 Organising committees that want to allow Year 7 & 8 students to compete in their events as secondary school students or to compete in separate grade[s] associated with the secondary school event are encouraged to do so if this is made clear to all schools and to WSSS when sanctioning is requested 3.7 In special cases [e.g. to complete a school team], the organising committee may request dispensation to allow Year 7 and 8 students to represent a school in secondary school competitions provided the majority of the team is Year 9 and above

4. NON-SANCTIONED EVENTS 4.1 Events that fail to meet these criteria will not be sanctioned and will not be placed on the WSSS List of Sanctioned Events and calendar 4.2 Schools are requested not to enter students in any event which is not sanctioned by WSSS. “Breaches” of such by member schools may result in consequential actions to the schools or individuals

GENERAL ELIGIBILITY 5.1 The purpose to defining of clause 5 is to establish ‘Bona Fide’ student status and consistency in age groupings that are recognised by all sporting bodies and member schools. Member Schools must ensure that their representatives in WSSS Events (individual or team) satisfy the eligibility requirements in these Bylaws, and accept they are defined for consistency, equity and fair play for participation in District, Regional, Island and National Secondary School events. 5.2 To be eligible to represent that Member School in any WSSS event, a student must be enrolled at and attending a Member School as a ‘bona fide’ (Year 9 or above) student at the school of representation, have a satisfactory attendance record at the school and studying at least 80% [to be classified as a FTE] of a programme that is part of the timetable provided by the school for at least four weeks immediately prior to the event. A student may not participate in any WSSS Event while he or she is suspended from school. Any variation would be at the discretion of the ESD and will be the final decision.Any school leavers must meet the ‘MOE’ 20-day rule to be eligible.

16 5.3 A student must be under the age of 19 years on January 1 of the year of competition to be eligible to participate in any WSSS events (unless specified otherwise for a competition sanctioned by WSSS). If requested by WSSS, the student or the student’s Member School must provide a certified copy of the student’s passport or birth certificate to WSSS. A student who does not produce such a certified copy within 48 hours of being requested to do so will be ineligible to participate in any WSSS events until the certified copy is provided.

6. ELIGIBILITY – TEAM AND PLAYER REQUIREMENTS 6.1 A student may be registered to play in one team per code 6.2 In any WSSS event, students may play up into a higher grade but not down into a lower grade. A student who plays up for four (4) games will be deemed to have moved teams and must re- register and then stay in the higher grade thereafter 6.3 Members Schools with more than one team in the same grade in any WSSS event cannot transfer players between these teams. Additional students must come from lower graded teams. 6.4 If any student wishes to return to their original team, the school convenor of that code must on the student’s behalf, apply to WSSS and have approved a regrading before the student can return. Any such regrading requests must be received at least 4 competition matches prior to any Semi Final or Final. 6.5 To be eligible to play in any WSSS administered code Semi-Final or Final, unless they are being promoted from a lower team, or returning from injury, a student must have played a minimum of four (4) WSSS sanctioned competition games for that team. 6.6 A school may through unforeseen circumstance, make written application to WSSS seeking a waiver to 6.4 and 6.5 but that determination will be final. 6.7 If required Schools must register all their code squads through the WSSS on-line registration process. Where codes are managed or delivered by a body other than WSSS, then schools should register their first teams only on to the WSSS portal no later than one week after being required by that body. The ESD may grant a dispensation from the restrictions in Bylaws 5 and 6, if he or she considers that exceptional circumstances warrant such a dispensation. 6.8 Subject to the limits described in School Team Eligibility of Bylaw 6 or 8, students who otherwise meet the criteria above and who transfer from one school to another are eligible to compete provided they are on the roll of the participating school and have attended classes for at least four (4) weeks immediately prior to the time of the event. (Dispensation for those who transfer within four weeks of the competition is at the discretion of the organising committee)

7. COMPOSITE TEAMS: 7.1 Composite teams will be permitted and approved by WSSS or its sanctioned event code only if: (a) all other eligibility rules regarding age and attendance are met as all clauses of section 5 (b) the principals of the schools that the students attend agree through the Host School — Attached School Relationship Agreement, and the host school principal accepts responsibility for the composite team and all requirements within the agreement (c) the team including at Premier level will be permitted through the preliminary rounds and may not be eligible for placing or competition trophies or promotion (but may be eligible for awards such as Fair Play and individual trophies.) (d) Composite teams should not be able to enter tournaments when single school teams are on a waiting list. (e) When a qualifying tournament exists, or a promotion opportunity to a higher level, a composite team cannot qualify above a single school team (f) The team will be called by a name that indicates that more than one school has contributed players See Appendix II: Host School-Attached School Relationships Agreement NB. 8. PREMIER ELIGIBILITY 8.1 To be eligible to participate in Premier Events, students must meet the General Eligibility requirements of Bylaw 5 in addition to the requirements in this Bylaw 8. 8.2 Member schools must comply with the maximum squad sizes and the maximum number of NTS students in each squad for Premier Events as set out in the Sanctioned Event Schedule. 8.3 A student will be considered NTS in respect of a WSSS Competition if:

17 a) they have been at their current school for less than two years from the date of Enrolment, unless one of the exceptions in Bylaw 8.4 applies; b) he or she would not be classified as domestic student. 8.4 A student will not be considered NTS under Bylaw 8.3 if he or she has: (a) Enrolled in the Member School which he or she wishes to represent by the first day of the third term in Year 9; b) attended a middle school and has enrolled in the Member School which he or she wishes to represent at the commencement of the year immediately after finishing middle school; or c) withdrawn from the Member School which he or she wishes to represent and then returned to that school within 18 months, so long as he or she was: (i) initially attended that school for a minimum of 12 months before withdrawing; (ii) not considered NTS had he or she attended that school continuously; (iii) has not represented another Member School in a Premier Event. 8.5 To avoid doubt, the exceptions in Bylaws 8.4 does not apply to any student who is considered NTS by Bylaw 8.3 (b). 8.6 If a student withdraws from a Member School and then enrols at another Member School within 12 months, the receiving school is responsible for initiating the Premier Sport transfer process as prescribed by WSSS in order for the student to compete in Premier Event for the receiving school. See Appendix III: PREMIER SCHOOL TRANSFER 8.7 To avoid doubt, the Premier Event transfer process is not required if a student has been Enrolled at their current school for more than 12 months. 8.8 A student who has enrolled in either Year 11 or Year 12 at a Member School where the earliest year offered for enrolment of that student’s gender is Year 11, but where students of another gender are able to enrol in an earlier year (e.g. Year 9 or Year 10), will only be NTS for one year from the date of enrolment. 8.9 A student will not be eligible to play in any Premier Competition finals or playoffs unless he or she has played at least 50% of the regular season for their current school in any grade of that competition. 8.10 A Member School’s second team is not permitted to enter a Premier Event without the prior approval of the ESD. This approval will normally be granted only where a second team is required to make a viable competition and the top teams from the next grade down are not willing to play in the Premier Event. 8.11 The ESD may grant a dispensation from the restrictions in Bylaw 8, if he or she considers that exceptional circumstances warrant such a dispensation.

9. PREMIER REGISTRATIONS 9.1 Any team who wishes to compete in a WSSS Premier Event must be made up of students who are registered in accordance with the requirements of this Bylaw 9. Complete team lists must be submitted by the due date and in such format as required by WSSS. 9.2 A Member School may in such a format as required by WSSS at least 48 hours prior to the student competing in any match in the Premier Event of that event unless approved by WSSS: (a) register additional students for its Premier Event squad for any Sanctioned Event in respect of which registration is required to maximum number prescribed; (b) correct or update details of any student registered in its Premier Event squad for any Sanctioned Event; (c) de-register students who are not considered NTS from its Premier Event squad, 9.3 A student who is NTS may be de-registered only: (a) if he or she is seriously injured (with support of a medical certificate) such that he or she was unavailable for more than three matches in the relevant WSSS event; or (b) if he or she has left that school. 9.4 If a team has reached their NTS quota, a NTS student who is deregistered under Bylaw 9.3 (a) and replaced by another NTS student then reregistered may only replace the student who covered for them. 9.5 The ESD may grant a dispensation from the restrictions in Bylaw 6, if he or she considers that exceptional circumstances warrant such a dispensation.

10. PREMIER NON-DOMESTIC STUDENT ELIGIBILITY 10.1 No Member School may include in any team competing in any Premier Event more than two students who would not be considered domestic student. Non-domestic students shall be included in the Member School’s NTS quota. 10.2 In addition to the 4-week requirement [Bylaw5.2], any Non-Domestic student must have been enrolled

18 in and have commenced their attendance at the school of representation on or before the first day of the term in which the event or any event qualifying is held. See Appendix IV: NEW TO SCHOOL QUOTA

11. HOME SCHOOLED STUDENTS 11.1 Where event organisers wish to do so, home school students, who are not on the roll of any member school may participate under certain conditions in WSSS sanctioned event in those sports, provided an exemption is granted as prescribed in By Law 11.2 11.2 WSSS may consider a written request from the parent/caregiver of a student for an exemption to participate in such sanctioned events for which there is no community opportunity available at the appropriate age level/grade if it receives written affirmation from the Principal of the school for whom the student wishes to play. 11.3 a) Individual Sports (i) Home-schooled students are not eligible for medal placings however organisers may recognise a merit performance with a separate award/s. (ii) The parent of the home-schooled student must sign off a document with the event organiser accepting full responsibility for their student including the event health and safety plans b) Team sports (i) Where agreement of the event organiser is given, Home-schooled students may be included in the Composite Team of a member school. (ii) The member school principal of such teams is responsible for providing to the event organiser current evidence of MoE approval for home schooling for each home schooled student included in the Composite Team. (iii) All other WSSSA regulations relating to Composite Teams will apply to such teams in (i) above, including the principal of the member school taking responsibility for all team members. (iv) Composite teams made up entirely of home-schooled students, i.e. not part of a member school team, will not be permitted in WSSSA sanctioned events. 11.4 Any such exemption shall apply to WSSS sanctioned activity only.

12. CORRESPONDENCE SCHOOL STUDENTS 12.1 The correspondence school is affiliated to NZSSSC and as such this establishes a partnership with WSSS, thus Correspondence school students will accordingly be accepted as individuals in district or regional championship events and may form a Correspondence School team for team events. 12.2 Should Correspondence school students participate as part of another school team, then this will constitute a composite team. By Law 7 will then apply

13. REFUGEE STUDENT ELIGIBILITY 13.1 A student who has refugee status if enrolled in a Member School for their first enrolment in New Zealand will not be classified as NTS. 13.2 If a student consequently enrols at a 2nd Member school within a year of initial enrolment then they will only be NTS for one year from the date of Enrolment.

14. PRIMARY CAREGIVER RELOCATON EXEMPTION [PCRE] 14.1 A PCRE exemption from the quota is available on application to WSSS for consideration through the ESD. Such exemptions need only be sought if the inclusion of a specific student(s) results in a school’s Premier team exceeding the stipulated “NTS” quota for a code. 14.2 The application, is to be initiated by the student’s new school, must be on the official WSSS PCRE - See Appendix V: PRIMARY CAREGIVER RELOCATION EXEMPTION 14.3 No Teams that have a quota limit may have more than two PCRE’s. 14.4 Any student who has applied for a PCRE is ineligible to play for a team at their new school until their school has been notified of the outcome of the application. 14.5 Any appeal of WSSS determination of any application must be lodged in writing with the ESD of WSSS within 7 days of any WSSS decision being received by the student’s new school 14.6 If a student is proven to have been ineligible to participate in any WSSS sanctioned activity which is part of any Island or National qualification or elimination, then WSSS shall have the right to revoke that school’s qualification and advise the appropriate organising body.

19 15. THE QUOTA [NTS] 15.1 The documented number of “NTS” students permitted in any first team participating in a WSSS or NZSSSC sanctioned sport is over a two-year period. 15.2 The squad size listed is based on that which teams can generally register for a NZSSSC sanctioned event. See - Appendix IV: NEW TO SCHOOL QUOTA 15.3 Any breach related to exceeding the quota numbers may result in WSSS imposing sanctions on the player, team, coach or school. This may include loss of all or a portion of competition points, player or coach suspension, exclusion from the competition or any other sanction the judicial committee deems appropriate.

16. COMPETITION DATES 16.1 All WSSS Competitions will have a specified start date and finish date. In the interests of student health and welfare. Member Schools should not actively prepare outside those dates. NB: It is an expectation of WSSS that preparation outside Winter or Summer window should not impact of any student’s ability to represent their school in chosen summer and winter codes 16.2 No WSSS Event can be held on a Sunday or Public Holiday, without the specific approval of WSSS. 16.3 WSSS events should, to the extent possible, not encroach on school time. At district or regional level, no one sport should seek more than two school days for WSSS approved district or regional events. 16.4 Summer and Winter season start and end dates will be confirmed by 1 October of the preceding year competition. In general, the seasons will be (a) Summer Season: Term 1 and Term 4 (From week 1 in term 1 until the end of March and from week 2 in September until the last school week in December) (b) Winter Season: Term 2 and 3 (from week 1 in term 2 until the end of the first week in September) 16.5 When exceptional circumstances arise, WSSS may grant a variation to any of the start or competition dates prescribed. 16.6 Where possible any WSSS events should be scheduled in alignment with Island or NZSSSC events.

17 AGE GROUPS 17.1 Unless otherwise specified in the rules of a specific WSSS events, the following age bands will be used, based on age as at January 1 of the year of competition: (a) Junior – under 14; (b) Intermediate – under 16; and (c) Senior – under 19. 17.2 If other age grouping is to be used by event organisers prior approval is to be sought by WSSS. i.e. Year 9 as opposed to Juniors, or Weights and Age group criteria maybe used in some sports or only one or two age categories maybe used 17.3 Unless otherwise approved no student may compete in both Junior and Senior Championship events even if staged on separate days 17.4 Alternative age groupings maybe used for some events if approved by WSSS

18. COMPETITION STRUCTURE: GRADING, PROMOTION AND RELEGATION 18.1 WSSS considers grading matches as the most appropriate means to determine the composition of Premier (and other) grades each year. Unless prescribed otherwise by any WSSS sanctioned code convention, the protocols will be: (a) Pools for grading matches at the start of a season shall be formulated based on rankings at the end of the previous season; (b) If, through whatever circumstance, the number of teams required to fill any Premier grade quota are not met, WSSS reserves the right to invite teams to fill any vacancies; (c) Any team who for whatever reason in their grading matches defaults a game shall after grading be automatically relegated to the lowest grade of those they are contesting and all grading games involving that team shall become null and void and recorded as a ‘no result’ and no points awarded; (d) If any team, who through their ranking qualifies for any promotion-relegation playoff then does not wish to exercise that option; then there shall be no offer to another team to replace them in those playoffs unless one of the teams originally offered promotion is the 2nd team of a school who are ineligible to play in any Premier grade. In this eventuality, the next ranked team may at WSSS discretion be offered the position; (e) WSSS reserves the right, in consultation with schools, to consider any application for a variation to these protocols. 20 19. DIFFERENTIATION OF TIED TEAMS 19.1 The process for differentiating two teams tied on round robin competition points shall be as follows unless prescribed otherwise by any specific code convention: (a) The team who won the most recent competition match between those two teams shall be afforded the higher rank; (b) If that match was cancelled, drawn or no result is entered within the required period, then the team with the better point’s differential [match points or goals or sets scored for v match points or goals or sets scored against] in all rounds of that grade’s competition shall be afforded the higher ranking; (c) If any tied team has during the round robin competition defaults a game; they will automatically be disqualified from the differentiation process and given the lowest ranking. 19.2 The process for differentiating more than two teams tied on round robin points shall be: (a) The team with the best win/loss ratio in matches between the tied teams shall be afforded the higher ranking; (b) If more than two teams are still tied, then the team with the better point’s differential in all competition matches between those tied teams in the most recent round shall be afforded the higher ranking; (c) If any tied team has during the round robin competition defaulted a game; they will automatically be disqualified from the differentiation process and given the lowest ranking. 19.3 In the case of Semi-Finals and Finals not scheduled at neutral venues [as prescribed by that code], pending the provision of appropriate facilities, the higher seeded team shall be afforded the home venue.

20. DEFAULTS, RESCHEDULING AND DEFERRALS 20.1 WSSS will maintain a defaults & rescheduling policy 20.2 Any competition match may only be deferred if all of 20.2 (a) – (e) inclusive are agreed and in the listed order. (a) The request is made through WSSS at least 2 weeks prior to the originally scheduled fixture; (b) WSSS approves the reasoning for such a request being asked of another school; (c) There is mutual agreement between the two schools; (d) The rescheduled game is to be played within one week of the originally scheduled match or at a date set by WSSS. If for whatever reason the ‘deferred’ match is not played on or by such, then neither team will be awarded any competition points; (e) The school requesting the deferral must advise WSSS no later than 48 hours before the match of all changes including the revised match date, time, venue and the name of any officials involved. 20.3 If approval is not granted by WSSS or there is no mutual agreement on a rescheduled date/time/ venue, then the school seeking to reschedule the fixture can either play as per the original draw or default the fixture. 20.4 If any two or more students from a team are required to play in the same code in a representative event on the day of scheduled fixture (this excludes trials/trainings and the like) that clashes with any WSSS fixture, then a deferral can be sought through WSSS. Any such deferred matches must then be played within one week of the originally scheduled date or if there are other circumstances, at WSSS’s direction. 20.5 Schools’ who have vacations outside of the gazetted school holidays should advise WSSS of such no later than the 1st February in that year. In such cases, WSSS will then endeavour to accommodate but this may not be practical. While we urge schools to be accepting of deferral requests in such circumstances, ultimately 20.2 & 20.3 apply. 20.6 Unless there are mitigating circumstances, Semi-Final and Final matches shall not be deferred. WSSS shall be the sole judge on this matter if there is extenuating circumstances. 20.7 If a team defaults three times during a WSSS Event in one season, they may be removed from the competition in that year. 20.8 Where any team defaults in a WSSS Premier Event they may not be permitted to enter the Premier Event in the following year. 20.9 Procedures for any school wishing to default a match include making every endeavor to contact the opposing school teacher- in -charge TIC and or SC or DoS and WSSS and if necessary the venue controller, by telephone, email or SMS, no later than 1pm on the day of the default. If emailing ask for a confirmation receipt. Do not leave messages on voicemail as they may not be cleared. Failure to complete

21 the procedure may result in consequential action against the team or school. 20.10 Procedures for any school if defaulted against if you receive late notification (later than 1pm) or no notification of default, advise WSSS office by email within 24 hours. 20.11 Consequences for schools or teams if late or no notification is received from a school, WSSS may impose a penalty fee of $20. The defaulting school may be liable for any travel expenses incurred by the opposition school. 20.12 Unless any code prescribes another convention, then any team defaulted to shall receive the maximum number of competition points any other team in that grade/division received in that round.

21. CANCELLATIONS 21.1 Where, through weather or other intervention prior to the commencement, WSSS determines to cancel games; to maintain some grade equity, WSSS will generally cancel all of a grade and endeavour to re-schedule such games within the competition window available. 21.2 In the circumstance where a game(s) within a grade is cancelled and others played, unless stated otherwise the protocols shall be that the competition points for any cancelled games (less any bonus points) are shared between the two teams. 21.3 Every endeavour will be made to have all round-robin games completed before any Semi-Finals or finals, however, if after cancellations, there are insufficient playing days to play Semi-Finals or complete round-robin play, then the top two ranked teams at the end date of the last completed round shall contest the Final. 21.4 In the case of any grading match (formulation of a grade), quarter/semi-final match or other match deemed by WSSS to be of significance and not provided for above, then WSSS shall determine any process and reserves the right in consultation with schools, to vary any of these conditions.

22. ABANDONED MATCHES 22.1 Unless a code has its own convention; if for whatever reason a game once started is abandoned or called off, the following protocols will be applied: (a) If a game is abandoned or called off before the second half of a match starts, the competition points will be shared between the two teams; (b) If a game is abandoned or called off after the second half has started, then the score at the time of the abandonment shall stand and competition points be awarded accordingly. 22.2 The above shall be applied unless there is mutual agreement between the management of each team at the time of the abandonment/calling off, to reschedule the match within seven days, at a date, time and venue determined and agreed by the teams. This shall exclude any semi-final where (a) and (b) above will be applied. 22.3 All of the above may be annulled by any formal Judicial Process and resultant sanctioning or any other WSSS determination

23. SUPERVISION OF STUDENTS 23.1 The Principal of a Member School or a school official or coach authorised by the Principal must be present whenever that school is participating in a WSSS event. Where the event concerned is a match between two teams the Principal, school official or coach must identify him or herself to the referee and to the representative of the other Member School prior to the match. Failure to provide supervision may result in the team forfeiting the match. 23.2 If a male coach is assigned to a girls’ team or female coach to a boys’ team, an adult (non-high school student) of the opposite gender should normally be present at any WSSS Event involving that team. Member Schools should address this issue through their own policy relating to students involved in co- curricular activity. 23.3 Where a student is ejected from any WSSS event that student must immediately be placed under the direct supervision of a school official.

24. COMMITMENT TO WAIKATO SECONDARY SCHOOL SPORT COMPETITIONS 24.1 Member Schools have an obligation to participate fully in WSSS Events which they have entered. The scheduling of any other commitments must be done in a manner which allows that obligation to be met

25. DUTIES 25.1 If a WSSS event requires schools to perform duties or provide volunteer officials and a member

22 school fails to fulfil these requirements, appropriate sanctions may be imposed by WSSS

26. RESULTS 26.1 Participating Member Schools are responsible for entering and/or checking all results. 26.2 To ensure that accurate tables are available and subsequent draws promulgated, all event results should be entered no later than 1.00pm on the day following play, apart from Friday night or weekend sport when all results must be entered no later than 1.00pm on the Monday immediately following play. 26.3 Where an incorrect result has been entered for a match played corrections to results must be submitted in writing to WSSS of the incorrect result being entered within 4 days. WSSS will consult with both schools to confirm the correct 26.4 If results are not entered within a week of any fixture being played, then the score may be recorded as a ’No Result’ and no competition points will be awarded to either team for that fixture 26.5 Where the result of any fixture is in dispute between two members, the ESD will attempt to mediate the dispute to achieve an acceptable resolution. If this is not possible the ESD Office will adopt an arbitration role making a decision that takes into account the views of both parties.

27. GENDER 27.1 Unless by gender exception specified by any WSSS sport or NSO protocol; all WSSS events shall be gender specific. 27.2 Schools may, on behalf of an individual, make a written submission with supporting evidence requesting a variation to Rule 27.1. This may for example be on behalf of an elite level athlete or a transgender student. 27.3 All cases will be considered by WSSS and any other appropriate parties on their individual merit which shall include the health and safety of all participants, unfair advantage - perceived or otherwise, and any policy advice from an NSO, NZSSSC or any other agency.

28. UNIFORM 28.1 All schools must provide an update each year in their annual return to WSSS, a registry of their school’s sport uniform colours. Any variation or change of colours being considered should first be signalled to WSSS to ensure there is no clash with another member school. 28.2 All members of teams participating in a WSSS events must wear matching uniforms of their school appropriate to the sport. Failure to wear appropriate uniforms may result in the team forfeiting the match. 28.3 This includes any safety equipment as prescribed by that code. Officials may remove competitors that fail to wear approved and code required safety equipment 28.4 In the case of any uniform colour clash the ‘home’ team shall retain its own uniform and the visiting team changes to an alternate strip. Where the match is played at a neutral venue, then the first named team in the draw shall retain its own strip and the second named team changes to an alternate strip. 28.5 Tracksuits, school day uniform or any other casual clothing is not acceptable and deemed inappropriate for competitive play. 28.6 Codes that require competition uniform to have player specific numbering to assist with officiating must have competition strip numbers that meet code conventions, and where necessary to player registrations 28.7 Failure to comply with uniform standards may result in the player and or team being defaulted and points forfeited

29. SPONSORSHIP 29.1 Sponsorship arrangements to support and develop sport for Member Schools are the property and responsibility of the school and should be signed off by the Principal. WSSS respects this but requests the following guidelines should be met when branding up such property. 29.2 School sports uniforms may display the official manufacturer’s logo, the official school crest and team name/level or emblem, number(s) and any sponsor’s logo as outlined in Rule 25.4. 29.3 The size of any sponsor’s advertising or logo, while needing to be ‘visual’, should not become excessively dominant on the playing strip and should not interfere or impose on any uniform numbering required by the rules or requirements of any code. 29.4 Schools should discourage sponsorship or association with companies, retailers or outlets associated with products or services, which could be considered objectionable or inappropriate. 29.5 WSSS reserves the right to request a change to any Member School uniform if the sponsorship or

23 proposed sponsorship is unsuited to the secondary school environment or is in any other way deemed inappropriate.

30. OFFICIALS 30.1 WSSS will endeavour to have suitably qualified officials appointed to at least the top divisions of any code. 30.2 Except where any code has a different officiating convention specified in its playing conditions, at any level where there are no officials appointed, unless there is mutual agreement to the contrary between the captains of each team prior to the commencement of any match, then each team is required to provide a match official; the ‘home’ team - that team playing at its own venue - shall provide the necessary official for the first half, the visiting team for the second half of the match. 30.3 In the case of codes that require two match officials (e.g. Basketball, Netball), unless there is mutual agreement to the contrary between the captains of each team prior to the commencement of any match, each team is required to provide a match official for the entire game. 30.4 Where the match is played at a ‘neutral’ venue - that is a venue that is not the ‘home’ of either team - then the first named team on the official WSSS draw shall be considered the ‘home’ team. 30.5 If in any instance where any team cannot or declines to provide the required official(s), then the opposing team may apply to WSSS to claim the match by default

31. RECOGNITION OF ACHIEVEMENT 31.1 WSSS will recognize student participation, achievement and excellence of sporting endeavor by an appropriate, cost effective, equitable and uniform set of awards 31.2 WSSS will seek media coverage of results of all significant secondary school events. It will also publish all regional competitions and championship results on its website. 31.3 WSSS will recognize achievement at four levels (a) Certificate (b) Trophy (c) Champions Lapel badge (d) Regional Award functions 31.4 Certificates will be printed for individuals and individual team members in all WSSS hosted events and if requested by the event organizers, for other WSSS sanctioned events. 31.5 Certificates will be printed for individual members of all teams placed 1st, 2nd or 3rd in all WSSS hosted events if team member names are forwarded to WSSS on the template provided. 31.6 Trophies will be presented to winners of events as they are available. Trophies are held for one year on a returnable basis. The school is responsible for appropriate storage/display of any trophy and its engraving. WSSS will maintain a register of trophies. This will be published in the annual report directory and the WSSS website. 31.7 Elite ‘Champions’ lapel badges may be awarded where appropriate. 31.8 WSSS will cooperate with Sport Waikato to conduct the annual Regional Secondary School Sports Awards. That support be may one or more of financial, administrative, consultative, and facilitate appropriate judging panels. 31.9 WSSS recognizes that North Island and National events generally operate at a higher level than its regional activities and believes that the award of medals is appropriate at this level and not appropriate at regional level

32. INDUCEMENT TO TRANSFER SCHOOLS FOR SPORTING REASONS (POACHING) 32.1 WSSS does not condone any inducement of students to transfer from one school to another 32.2 No employee or other person associated with coaching or managing sport in a partner school shall initiate any communication, written or verbal, or any inducements other than those which are publicly available by application to all students, with a prospective student, parents of a student, guardian or family member, in person or through a third party, while that student is enrolled in another partner school. 32.3 If it is established that an employee or other person associated with coaching or managing sport in a partner school knew or ought to have known that a person associated with their school suggested to, or used undue influence on a student to transfer schools for sporting reasons, it may cause the student or any first team in which they play to be ineligible upon transfer and could further result in the management

24 committee imposing sanctions on that school or an individual associated with the school. 32.4 Any such allegation should be referred in writing with substantiated evidence of the allegation to the WSSS ESD, who shall then, if appropriate, refer to the WSSSA chairperson for determination. Any such determination which is upheld may lead to the transgressing school incurring cost and sanctions as deemed by the WSSSA and notified to NZSSSC who may support and impose such sanctioning deemed appropriate

33. HEALTH AND SAFETY 33.1 This is everybody’s responsibility and is informed by various legislation, regulations and guidelines. It is a requirement of each school to put in place responsible measures to ensure the safety and welfare of their students both at event venues and in transit to and from such venues. 33.2 WSSS may additionally at the commencement of each year require from each member school through a Principal sign off; a declaration that their courts (indoor and outdoor), playing fields and any other space, they provide for WSSS related sporting activity is ‘fit for purpose’ and meets the minimum standards WSSS requires to host events. See - Appendix VI: HOSTING REQUIREMENTS for WSSS EVENTS

34. COMPLAINTS 34.1 Match Official - any report from a match official against a player, team management or spectator involved in a WSSS sanctioned event must within 72 hours of the completion of that event, lodge their written report with their RSO and WSSS who will then deal with it in accordance with any RSO process or at the RSO request, by a WSSS process. 34.2 Other Person - any complaint from any other person relating to a WSSS sanctioned event must within 72 hours of the completion of that event lodge their written report with corroborating evidence initially to their school’s Head of Sport. Then within this period, the Head of Sport should choose what action to take which may include dealing with it themselves or add their endorsement and forward it to WSSS for resolution. 34.3 Any complaint relating to any alleged breach of the WSSS ByLaws or any other matter under the jurisdiction of WSSS, must within 72 hours of the alleged breach be lodged in writing with corroborating evidence initially to their school’s Head of Sport. Then within this period, the Head of Sport should choose what action to take which may include dealing with it themselves or add their endorsement and forward it to WSSS for resolution. 34.4 Any complaint that is not lodged through the Head of Sport nor has the endorsement of the complainant school’s Head of Sport or Principal will be dismissed. 34.5 It is the responsibility of each school’s Head of Sport to ensure their Principal is aware of any formal complaint and the nature of it. 34.6 WSSS will consider all such complaints and depending on the nature of them shall either: (a) deal with the complaint itself in consultation with the principal(s) and parties of the school(s) concerned; (b) refer it to the WSSS Complaints Review Committee; (c) refer it to the RSO; (d) in the absence of any established RSO process or a request by the RSO that WSSS deal with a complaint, then the WSSS ESD may choose to deal with it themselves in consultation with the Principal(s) of the school(s) involved or refer it to a WSSS CRC for their consideration and determination. 34.7 Whichever, the following guidelines will be observed but with licence to go beyond if deemed appropriate/necessary: (a) WSSS will gather any additional evidence deemed appropriate to the complaint; (b) the principal of the school or body against whom the complaint has been made will be notified in writing of the details of the complaint including the school, organisation or person bringing the complaint and the details of evidence provided; (c) the principal receiving notice of the complaint will be asked to provide a written response to the WSSS ESD within 72 hours of the complaint being transmitted; (d) the ESD will then and where necessary in consultation with the WSSS Chair, determine how the complaint is to be processed and advise the involved parties accordingly; (e) The CRC and Hearing process proceeds as outlined in Appendix VII: COMPLAINTS REVIEW & APPEAL PROCESS

25 35. APPEALS 35.1 Any school wishing to appeal any Complaints Review Committee [CRC] decision and/or sanction must do so through its principal, within 5 working days of any decision being formally notified and in doing so must include all the following: (a) written substantiated grounds for the appeal; (b) the principal’s signed endorsement of the appeal; (c) an undertaking that the principal will attend the appeal hearing; (d) a $500.00 bond which the Appeals Committee may refund in whole or part pending the appeal outcome. 35.2 An appeal will have deemed to have been lodged when all of 35.1 (a) – (d) inclusive have been received by the WSSS ESD. 35.3 Ordinarily, appeals will be heard based on the record of the decision of the Disciplinary Panel [CRC] and the evidence received and considered by it. 35.4 The Appeal Committee will however have full discretionary authority to hear and receive such further evidence as it thinks fit although generally such evidence will only be admissible where it can be established that evidence was not available at the time of the original hearing. 35.5 The decisions of the Appeal Committee are absolute and binding on all parties. 33.6 Any further recourse on an appeal decision must be conducted through the NZ Sports Tribunal. See Appendix VII: COMPLAINTS REVIEW & APPEAL PROCESS

36. CIVIL DEFENCE, EMERGENCY AND INDUSTRIAL ACTION 36.1 WSSS recognizes that from time to time Civil Defence, Emergency or Industrial action may be considered by some schools as a legitimate reason for withdrawing/requesting deferrals of teams from competitions and events at affected times. In all such cases, the ESD will make an assessment as to whether the event can viably and safely proceed with an expected reduction in the number of participants and/or the expected absence of school based officials/personnel. Normal WSSS policy procedures will apply to events which conflict with such action. 36.2 For Industrial action which would be considered to be a ‘forseeable’ reason, and WSSS should be advised in advance so that teams will not be included in draws, resulting in defaults to schools which wish to play as scheduled, and facilities not booked nor charged for unnecessarily. 36.3 In normal weekly competitions, teams which do not provide such advice will be considered to be in breach of Rules 36.4 WSSS will, to the best of its ability, ensure that school teams that are withdrawn from competitions for reasons outlined in 36.1, and which wish to subsequently re-enter those competitions, are not disadvantaged

V: PRIMARY CAREGIVER RELOCATION EXEMPTION [PCRE]

KEY INFORMATION The purpose of a PCRE is to support circumstances where the family or primary caregiver of a student has changed address and the student cannot reasonably be expected to remain at their previous school, an application for exemption may be submitted to WSSSA and will be considered by the Executive Director. The application, initiated by the students new school, must be on the official PCRE (Appendix V) form ; providing formal evidence of the address change as outlined on the application form, and be completed and signed by: a. the student b. the principals of the student’s Exit and New School c. the student’s parent or authorised primary caregiver d. have the attached evidence as prescribed in note 6 below on address change

For an exemption from the NTS quota, a Primary Caregiver Relocation Exemption (PCRE) need only be sought if the inclusion of specific student then results in a schools’ first [Premier] team exceeding the stipulated quota for that sport.

The process for determining exemption is outlined below: 1. Exemption for a student should only be sought if a school finds it has exceeded the quota of new to school/non-resident students as specified in the Rule 14 of the WSSSA By Laws and has a student/s eligi- ble for PCRE under all other eligibility rules. One exemption will cover all sports for that student. 2. Applications will only be accepted on the Primary Caregiver Relocation ‘Application for Exemption’ form available from WSSSA, its Member schools or downloaded from the WSSSA website or School Sport NZ website 3. Applications should be received by WSSSA at least 2 weeks prior to the first occasion that student seeks to represent their ‘new’ school. 4. Any student seeking an exemption is ineligible to represent their ‘new’ school until any WSSSA Execu- tive approval is received as per WSSSA Bylaws clause 14.4 5. Applications will be considered by the Executive Director of WSSSA and 2 other representatives of the WSSSA Executive. 6. Applications must include evidence of the relocation as specified below. Documents must be in the primary caregivers name at both the original address and the new address as specified in the application. All documents must be originals or copies verified by a Justice of the Peace. Suitable documents may include; Telephone accounts, Power accounts, Bank Statements or other documentary evidence deemed suitable by the WSSSA Executive. 7. WSSSA will notify the decision to the ‘new’ school by returning the signed exemption and also advise the Executive Director of NZSSSC of decisions by way of a monthly return. 8. The Principal/s of the applicant’s school/s may appeal the WSSSA decision as per By Laws Clause 14.5 and the Appeals process will be invoked. For any such appeal No New Evidence will be considered

32 Importing Student Data from KAMAR (Automatically)

If your schools uses KAMAR you have the option to automatically import student data into EnterNOW.

1. In EnterNOW In EnterNOW go to the Settings tab, then click on [Create API Key]. On the next screen type in Kamar as the Key Description, then click on [ Save Changes]. You will now be back on the Settings tab, and down the bottom will be your new API Key. Select and copy the Kamar API Key.

2. In KAMAR Note: you may need your kamar administrator to do this. Main Menu > Setup > KAMAR > Server > Directory Services > Services Create a ‘ New Service’ and select the ‘Create’ option, then will need the following settings. Address: kamar.enternow.co.nz Use SSL: YES Authentication: Use the API Key you created in EnterNOW above Data Format: XML

Click on the [Check and Enable] button to verify your connection is working. After a few seconds, KAMAR will report the result of your connection. If successful, you can then press the [ Send Full Update] button to complete your first full sync of all students to the EnterNOW service. Note: The update process is run on the server and may take a while to complete before you see anything happening.

33 Student Photos If you need student photos to be transferred, under the selected directory service, select the ‘Student Photos’ option. The first time a full sync runs, all students photo’s will be uploaded to the remote service. The ‘Date Modified’ will then be populated with the current date and time. Subsequent uploads will only send new / updated student photo’s. If you want to send all student photo’s again - clear the date modified field and run a full sync again.

(This is no different to what they receive with a paper entryform) • Have the ability to use the auto-complete functionality to enter students on your behalf (for late entries or special cases). • DO NOT have the ability to download or view your full your student list (the Members tab in EnterNOW) EnterNOW • EnterNOW Ltd and its staff will have access to your data for the sole purpose of providing support and resolving problems with the system.

34 WHAT PRECAUTIONS ARE TAKEN TO KEEP THE DATA SECURE? • SSL Secure certificate is used on the website (encrypts data between end user and server) • SSH public key access is used to authenticate to the server and transfer files. (only 2 people have access to the key) • Our website server has a firewall in place. • Software/Security patches are applied at regular intervals • Regular backups are taken of all data, and stored on a secondary server which is not publicly accessible, also protected by firewall. • All our development machines have encrypted hard drives, with password access (in the case of loss or theft, they will be inaccessible) • Development machines all run current antivirus/malware detection software. • Development machines are backed up on regular intervals and backups are encrypted.

HOW LONG DO YOU KEEP THE DATA • Student records are erased once they turn 19, as the system assumes they have left the school • If a student leaves school before they turn 19 and the student management system offers that data, then we will erase the students record • If a student record is not accessed for a period of 24 months, the record will be erased • Entries that are made into events, and the associated information are retained indefinitely.

35 SPORTS RUNNER

WHAT IS SPORTSRUNNER? SportsRunner is a competition management software system, to facilitate the administration of draws and results for team sports. It consists of two main components: • A richly featured management app, provided as cloud-based “software as a service”, for the use of the competition administrator in managing all aspects of the draws and results, for league and tournament competitions. • A website, for the publication of full draws & results information, for the purpose of informing players and supporters. It is a well established and highly reputed system, operating successfully since 1997, and serving the needs of many New Zealand sports organisations across many sports codes.

WAIKATO SECONDARY SCHOOLS SPORT Waikato Secondary Schools Sport is increasingly using the SportsRunner system. This applies to team sport competitions that are run directly by WSSSA, as well as supporting events run by affiliated sports organisations. We see that this can provide many benefits to secondary school sport in the Waikato.

SCHOOLSYNCH Another service provided within the SportsRunner system is the ability to maintain a database of schools. All RSD offices in New Zealand do this. This serves the needs not only of WSSSA, but also for the purposes of School Sport NZ. Part of this process is a website, where schools can log in and update their school and personnel contact information. The updated data from this website is then imported into the SportsRunner database. Waikato Secondary Schools Sport periodically asks schools to complete this process online.

ONLINE ENTRIES Waikato Secondary Schools Sport also subscribes to the EnterNOW online entries service, to process entries and registrations for events. In the case of team sport competitions and tournaments, the entries are integrated into SportsRunner.
