From Just War to Just Intervention Susan J. Atwood What is Just War? What is Just Intervention? This paper examines the evolution of the criteria for Just War from its origins in the early Christian church to the twenty-first century. The end of the Cold War era has expanded the discussion to include grounds for intervention. Indeed, in the 1990s, a number of multilat- eral interventions took place on humanitarian grounds. But the debate is ongoing about whether the criteria applied in the Just War theory — proper authority, just cause, and right intent — remain valid in an era of Just Intervention. The author examines as case studies some multilateral interven- tions and the lessons learned from them as we seek to develop the framework of international law to address the evolving theory and current practice of Just Intervention. -

Tracey, for his tireless commitment to my success. 1 ABSTRACT The purpose of this analysis was to discover the extent to which dictates of war theory ideals can be considered universal, by comparing the Western (European), Classical Chinese, and Islamic models. It also examined the contextual elements that drove war theory development within each civilization, and the impact of such elements on the differences arising in war theory comparison. These theories were chosen for their differences in major contextual elements, in order to limit the impact of contextual similarities on the war theories. The results revealed a great degree of similarities in the conception of warfare as a social tool of the state, utilized as a sometimes necessary, albeit tragic, means of establishing peace justice and harmony. What differences did arise, were relatively minor, and came primarily from the differing conceptions of morality and justice within each civilization – thus indicating a great degree of universality to the conception of warfare. -

Baltimore, Maryland June 18, 2014 © 2014 James M. Dubik All Rights Reserved Abstract 1. Statement of the Problem. Just war theory’s account of jus in bello is deficient. Michael Walzer, the prime representative of the prevailing view in the United States, restricts jus in bello to combat, war-fighting, then constructs a theory of responsibility and presents a set of principles that guide action when fighting: the principles of combatant/noncombatant distinction, proportionality, double effect and double intent, as well as the principle of due care/due risk—all of which arise amid the tension between winning and fighting well. 2. Procedures and methods. This study establishes and describes the gap in the prevailing view’s treatment of jus in bello, then investigates alternative ways to fill that gap. Throughout, the study combines elements of moral philosophy, political philosophy, and strategic studies with historical and contemporary case illustrations of war. 3. Results. This study finds that the prevailing view is necessary but insufficient; it omits jus in bello’s strategic, war-waging dimension which involves a tri-partite tension: (a) setting war aims and making strategy, policy, and campaign decisions that increase the probability of being right, or at least less wrong than those one is fighting; (b) translating those decisions into action to achieve war aims at the least cost, in lives and resources, and least risk to one’s political community and adapting aims, strategies, policies, and campaigns to the changing realities of war as they unfold; and (c) doing all of the foregoing while observing the war convention, sustaining the war’s legitimacy in the eyes of the political community, and maintaining proper subordination of the military to civilian ii leadership. -

A FEW NOTES ON A SYNOPSIS OF THE MILITARY CLASSICS Felix Siegmund* ABSTRACT The famous Ming general Qi Jiguang (1522-1582) is best known for his military treatises, namely the Jixiao xinshu and the Lianbing shiji, while his other writings are much neglected by researchers. This article is an annotated translation and discussion of Qi Jiguang’s Wujing qishu zhaiti (16th cent.) The Wujing qishu zhaiti is a collage of excerpts from the Seven Military Classics (Wujing qishu), which are then re-arranged to form a new text. This new text, which is constructed like a word- game, can be read as a commentary on the meaning of the military classics and their relative importance to the canon of military texts. In this re-arranged text, new meaning is constructed and new interpretations are suggested. While the history of the reception of the Wujing qishu zhaiti is unknown due to a lack of sources, the text seems to bear traces of discursive confrontations of the time and of a struggle for legitimacy. Qi Jiguang even seems to challenge the established order of the elites by re-enforcing the position of military studies as a serious subject, comparable to civil (Confucian) studies. Sawyer As military forces grew in strength, tactics evolved, and warfare became more lethal in ancient China, the need for communication between the political authorities and leaders in the field, as well as among commanders and their subordinates, was increasingly recognized. Vestiges in Shang dynasty (1650-1045) oracle scripts and Western Zhou dynasty (1045-771) bronze inscriptions show written commands were already being issued to field commanders. Furthermore, according to the earliest historical writings, the Chun Qiu (春 秋), Zuo Zhuan (左 傳), and Guo Yu (國 語), written and verbally transmitted reports were being routinely furnished to the ruler and directives frequently received by the seventh and sixth centuries BCE. A passage in the Art of War (兵 法), the infamous work attributed to Sunzi (孫 子) that probably reflects late Spring and Autumn (722-481) or very early Warring States (481-221) thought, indicates that because of the complexities of the battlefield and the emergence of experienced, if not yet fully professional, generals, instructions issued by a distant ruler ignorant of military strategy and the details of the situation could entangle the operation and even doom the state:1 1 “Planning Offensives.” (For a complete translation of the Art of War and introduction to the text see Sawyer, Sun-tzu Art of War (Boulder: Westview Press, 1994). Sun Tzu is a book with universal value and eternal wisdom, which can be applied by people of all the times to human activities of all the fields. This book incorporates many military terms which are important for the understanding of it. All the Chinese commentators in the history have their own understanding of these terms, and the same is true for Sun Tzu’s English translators. The author of this paper aims to compare two English translations of Sun Tzu: the translation by American comparative philosopher Roger T. Ames and the translation by Chinese scholar Lin Wusun. The author selects twelve military terms from Sun Tzu and compares the translations of these two translators and makes an evaluation and comment on their renderings.
