    United Nations A/58/307 General Assembly Distr.: General 22 August 2003 Original: English Fifty-eighth session Item 119 (a) of the provisional agenda* Human rights questions: implementation of human rights instruments Status of the International Covenant on Economic, Social and Cultural Rights, the International Covenant on Civil and Political Rights and the Optional Protocols to the International Covenant on Civil and Political Rights Report of the Secretary-General** Summary The General Assembly, by its resolution 2200 A (XXI) of 16 December 1966, adopted and opened for signature, ratification or accession the International Covenant on Economic, Social and Cultural Rights, the International Covenant on Civil and Political Rights and the First Optional Protocol to the International Covenant on Civil and Political Rights, and expressed the hope that the Covenants and the Optional Protocol would be signed, ratified or acceded to without delay. The Assembly also requested the Secretary-General to submit to it at its future sessions reports concerning the status of ratification of the Covenants and of the Optional Protocol. In response to that request, reports on the status of the International Covenants and the Optional Protocol have been submitted annually to the Assembly since its twenty-second session in 1967. Both Covenants and the Optional Protocol were opened for signature at New York on 19 December 1966. In accordance with their respective provisions,1 the International Covenant on Economic, Social and Cultural Rights entered into force on 3 January 1976, the International Covenant on Civil and Political Rights entered * A/58/150. ** The footnote requested by the General Assembly in resolution 58/248 was not included in the submission.

At its thirty-third session, the Commission on Human Rights had before it a note by the Secretary-General (E/CN.4/1227) on the status of the International Covenant on Economic,"Social and Cultural Rights, the International Covenant on Civil and Political Rights and the Optional Protocol to the International Covenant on Civil and Political Rights. 2. In its resolution 2 (XXXIIl) of .18 February 1977 the Commission on Human Rights welcomed with deep satisfaction the entry into force of the International Covenant on Economic, - Social an.d Cultural Rights, the International Covenant.on Civil and Political Rights and the Optional Protocol to the latter Covenant. The Commission called upon all States to take legislative or other measures for the realization of the human rights and fundamental freedoms provided for in the Covenants, invited the States parties to the International Covenant on Civil and Political Rights to consider making the declaration provided for in article 4I of that Covenant and requested the Secretary-General to continue to inform the Commission on Human Rights at each session of any new developments with regard to ratification and implemiontation of the International Covenants on Human Rights and the Optional Protocol. The present note was prepared in response to ..that request. 3.     TUNISIA Date of Elections: 4 November 1979 Purpose of Elections Elections were held for all the members of Parliament on the normal expiry of their term of office. Characteristics of Parliament The unicameral Parliament of Tunisia, the National Assembly, is composed of 121 members elected for 5 years. Electoral System All citizens aged 20 years or more who have held Tunisian nationality for at least five years and who are in full possession of their civil and political rights are entitled to vote. Disqualified are persons convicted of crime; those convicted of offences which entail either an unsuspended sentence of imprisonment in excess of three months or a suspended sentence of imprisonment in excess of six months; those under guardianship; undis­ charged bankrupts; the insane; and members of the armed forces and National Guard. The electoral registers are permanent. They are revised at the commune and sector level on January 1. Citizens living abroad may also be registered. All disputes concerning the lists are resolved by a revision committee. Voting is not compulsory. Candidates to Parliament must be qualified electors who are at least 28 years of age and born of a Tunisian father. Governors, magistrates, certain local public officials and members of the police force cannot be elected. The exercise of public functions which are non-elective and remunerated out of funds from the State, public establishments or public collectivities are generally incompatible with the office of Deputy; this is also true for the office of president or director of a national enterprise and public establishment, as well as director or administrator of certain public enterprises.
