MINUTES OF THE 120th MEETING OF SEAC HELD DURING 24-26, MARCH, 2021 AT THE CONFERENCE HALL, STATE ENVIRONMENT IMPACT ASSESSMENT AUTHORITY,

The 120th meeting of the SEAC KERALA was held online during 24th, 25th&26th March, 2021 observing all the lockdown protocols stipulated by the Government.The meeting started at 10.00 AM on 24th March 2021 with Dr. C. Bhaskaran, Chairman, SEAC, Kerala in the Chair. The Chairman welcomed the members to the meeting. Heinformed the Committee about his participation in the online Review Meeting of the MoEF&CC conducted on 3-3- 2021 in which it was indicated that about 400 proposals are pending with the SEIAA/SEAC Kerala for more than 90 days. The Chairman brought to the notice of the MoF&CC that since July, 2020 issuance of EC is considerably delayed in respect of majority of the mining projects for want of final orders on the minimum distance criteria from the Hon’ble NGT.The Committee then moved on to the deliberations on the agenda items.

1) Top soil dump with gabion wall is proposed between buffer zone and garland canal on southern side of the project area. Relocate the top soil dump outside the project area on lower elevation with suitable measures to avoid soil erosion.

2) The proposed CER activities of different institutions are spread over years. It will be better to complete CER activities of a particular institution during the same year. The CER proposals have to be revised accordingly.

a. In the survey map already submitted, the certificate issued by the Village Officer and the one issued by the Grama Panchayat Secretary contradict one another. Hence, a recent survey map certified by the Village Officer showing all the structures within a radius of 200m.from the boundary should be submitted. b. Revised EMP incorporating the specific CER activities in physical terms to be undertaken by the proponent in consultation with the stakeholders as stipulated in the OM No.22- 65/2017-IA.III dated 30/09/2020 and OM No. 22-65/2017-IA.III dated 20/10/2020 of the MoEF&CC, GOI instead of allocation of funds under CER. Field Inspection Reports Received

Item No.120.16 Environmental clearance for the Commercial project “Ozone Mall” in Sy. Nos. 4/2B, 146/1 and 146/7 at Pathaikkara Village, Municipality, , District, Kerala by Sri. A.K. Abdul Aziz, M/s INOA Properties & Developers L.L.P. – Request to remove the Ordinary Earth – reg. (File No. 864/SEIAA/ EC1/3073/2015) Decision: The Proponent requested SEIAA to include the details of the removal of ordinary earth in the EC for starting construction. The SEIAA in its meeting held on 22nd to 23rd October 2020 requested the SEAC to clarify the purpose of removal of earth and why the EC was recommended only for 20000m3. SEAC was also requested to clarify the present position and recommend for exact quantity of earth to be removed for building construction. The SEAC considered the matter and conducted the Field Inspection. The Committee discussed the FIR and it was found that as per the special condition No.1 of the EC issued to Sri.A.K.Abdul Aziz vide order No. 864/SEIAA/EC1/3073/2015 dated 17.8.2017 for the construction of the building that the “stability of the deep cutting is to be ensured in accordance with the revised drawing”, it is noticed from the revised drawing that the earth cutting depth below ground level at the back side of the plot is + 19.30m and at front side + 5.00m.below the general ground level of the area. It is found that there is another EC issued for removal of earth from the above site vide order No. 778/SEIAA/EC1/904/2016 dated 1.6.2016, in which the depth of removal of earth was limited to 2.00 m from the general ground level. Considering the two ECs issued in this regard, the Committee recommends to SEIAA that it is not desirable to revise the EC issued for removal of earth, without revision of the building plan.

Item No.120.17 Environmental Clearance for the proposed granite building stone quarry project in Survey Nos. 110/2, 112/1, 112/3, 110/1, 109/1 in Village, Taluk, , Keralaby Mr.K.J.Thomaskutty, Managing Partner, M/s Mary Matha Granites (File No. 1385/EC2/2019/SEIAA) Decision: The Committee found that on field inspection the total area of existing operational quarry and the proposed quarry is more than 5ha. Therefore, the proponent is directed to apply for Terms of Reference (ToR) for conducting the EIA study.

Item No.120.18 Judgment in W.P (C) No. 27358 of 2020 filed by Sri. Aneesh Kumar against the rejection of Mining and Geology order (File No.1549/EC4/2019/SEIAA

Decision: The FIR was discussed and approved by SEAC. The EC was granted based on the following: 1) The project was given Environmental Clearance earlier based on the fact that the approved mining plan did not indicate any environmental implications as the area and depth proposed for mining was small as well as there was a favorable recommendation of the erstwhile DEAC. The SEAC also found that the proposal was delayed considerably at the DEIAA. 2) Now on Field Inspection it was found that the mining plan approved by the competent authority which was submitted then before the SEAC was contradictory to the actual field conditions. The Committee decided to bring these facts before the concerned.

Legal Opinion

Item No. 120.22 Quarry project in Survey No. 8/9, in Alakkode Village, ThodupuzhaTaluk, Idukki District, Keralaby Mr.U.I.John, Managing Partner, M/s Marthoma Granites (File No. 1413(A)/EC1/2019/SEIAA)

Decision: As per the legal opinion there is no impediment for SEIAA to consider application for EC on merits subject to final decision of the case pending before the Hon’ble Supreme Court. EC will be operated only if the PP Complies with all statutory requirements in the common cause Judgment. Further on the compensation aspect, Mining & Geology Department shall ensure that the mining operation shall not commence till the entire compensation is levied for illegal mining as directed by the Hon’ble Supreme Court in the common cause Judgment. The PP has to be directed to submit a revised remediation plan and natural resource augmentation plan for sustainable mitigation of the environmental damages of the area as the one submitted is inadequate. There is a house at 102m from the project boundary and therefore the appraisal is subject to the distance criteria to be decided by the Hon’ble NGT.

Item No. 120.32 Letter from DC, Palakkad regarding stopping the quarrying operations of M/s. Darkstone Land Developers Pvt.Ltd in Sy. No. 1/1 (pt) of Ottappalam Village, Ottappalam Taluk, Palakkad District, Kerala by Sri.Shamsudheen. M.P (File No. 705/SEIAA/KL/5657/2014)

Decision: The Committee noted the following aspects in this context:

The proponent made presentation for the revalidation of EC before SEAC on 01.02.2021. At that time, he has not declared the facts about the stay order issued by the DC, Palakkad dated 24.12.2020 and other subsequent developments and legal proceedings in this regard. Moreover, he has not submitted the documents sought by SEAC on 18.02.2021. The Committee observed that the proponent has concealed these facts. In the meantime,the Hon’ble High Court of Kerala, in Cri.MC No.1232/2021 vide order dt.25-3-2021, has directed SEIAA to take a fresh look at the matter in the wake of the torrential rains and devastating floods which the State faced, after issuance of the EC dt. 25-10-2017 and suggest measures to be taken and additional conditions if any, to be complied with, for operating the quarry in question. The case is posted on 8-4-2021 for further consideration based on the suggestions of the SEIAA. Since there is a specific direction of the Hon’ble HC with a time limit, it is decided to entrust Dr.R.Ajayakumar Varma and Dr.A.V.Raghu for Field Inspection. These facts may be brought to the notice of SEIAA and the Standing Counsel with a request to seek extension of time limit for three months from the Hon’ble HC in this regard.

General Suggestion for the urgent consideration of the SEIAA KERALA

A huge number of proposals for construction of residential complexes and mineral mining quarries are being processed by the SEIAA/SEAC now for Environmental Clearance.There are reportsthat Kerala State already have lakhs of unoccupied houses/flats/villas etc. Similarly, there are alsofrequent reports on the functioning of myriad unauthorised mineral mining quarries in the State.This pristine State is experiencing frequent natural disasters in the recent times causing unbearable misery to its people. In this backdrop, it is increasingly felt that such unplanned, unsustainable and unbridled exploitation of the natural resources would lead to an environmentally catastrophic situation in this serene state of Kerala. The SEAC is seized of this alarming situation and this grave concern needs to be reckoned by the SEIAA and taken up at appropriate levels to ensure that effective policy decisions and steps are initiated to stop the deterioration of the already fragile natural resource base of the Kerala State in the future.

It is decided to convene the next meeting of SEAC during 22-24,April, 2021.
