Mustafa Kemal Ataturk If Men Were Angels, No Government Would Be CONSTITUTIONAL ROLE AND INDEPENDENCY OF ATTORNEY GENERAL INTRODUCTION “Freedom and independence, form my character” - Mustafa Kemal Ataturk If men were angels, no Government would be necessary. If angels were to govern men, neither external nor internal controls on Government would be necessary. 1 In framing a Government which is to be administered by men over men, the great difficulty lies in this: you must first enable the Government to govern the governed; and in the next place, oblige it to control itself. 2 The constitution is full of old and strange jobs and titles, like that of Attorney General. To most people, even those with knowledge of Government and the criminal justice system, the role of Attorney General is something of a mystery. 3 The office of Attorney General is described as a meeting place of diverse legal, political and constitutional functions; the Attorney General is both the legal adviser to the Government and the guardian of the public interest. 4 The common tendency is to view the Attorney General and his department as nothing 1 Johnson V. E. Vahanvati who is the current Attorney General of India, to put it as politely as possible, misled the Supreme Court itself, if only by his silence?’ 6 The event that happened was this, the Supreme Court asked a simple, a very direct, question. Had the C.B.I. shared its report on the Coal Allotment Scam with anyone in the 'political executive'? Multiple sources confirm that G. E. Vahanvati was present at such a meeting, in the office of the Union Law Minister, and with officials from both the Prime Minister's Office and the Coal Ministry in attendance. 7 (Union Law Minister Ashwani Kumar has reportedly gone so far as to allege that the meeting was called by the Attorney General!) It is also on record that G. E. Vahanvati was present in court when their Lordships posed that query. He chose to remain silent when Additional Solicitor General Haren Rawal said the C.B.I. had not revealed its report to the 'political executive'. 8 Can anyone present a reasonable explanation to excuse this? 5 John Ll. Perhaps their Lordships could also extend this protection to the Attorney General too — simultaneously sending out the message that the Attorney General is much more than a professional doing his duty to the ministry of the day that he owes a higher duty as an officer of the court. 9 The Authors see that Article 76 10 of the constitution gives constitutional status to the office of Attorney General. Article 76 (2) 11 provides that the Attorney General shall be the legal adviser of the government and shall perform all such powers, functions and duties as are prescribed by law. The constitutional status and role of the Attorney General is defined in the constitution, but “the constitutional provisions do not expressly define all the powers and function of the office. In Attorney General (Condition of service) Rules 12 , the President made the following Rules regulating remunerations duties and other terms and conditions of the Attorney General for India. In essence, the powers and functions of the Attorney General as described in clause 5, Attorney General (Condition of service) Rules 1987 shall be 14 : (a) to exercise the final responsibility for the office of the prosecutor general; (b) to be the principal legal adviser to the President and the Government; (c) to represent the government of India in any reference made by the President to the supreme court under article 143.15 Since independence, our community has changed fundamentally. It is contented that those changes have produced a redirection, a new purpose in the role of the Attorney General. We have become, in a striking way, a rights- oriented society. 16 The courts are increasingly perceived by our citizens as the appropriate forum for profound social and economic changes. The basis of the office of the Attorney General is found in history and constitution. The origins and development of the office in England can provide a frame of reference for understanding today’s problem; to understand this development is to understand the conflicts inherent in the structure today are not necessarily of intentional design. This paper takes the position that the Attorney General is not just the government’s lawyer, but plays an important role in protecting the rule of law within government. GENESIS OF THE ATTORNEY GENERAL ’S OFFICE “I think it is vitally important to study History. If we can learn the lessons of the past, we will be able to avoid making mistakes in the future.” - Tony Blair It is not that the early experiences of the development of the office of the Attorney General would necessarily answer today's questions. But, one of the most important contributions that a study of history of this office offers is the point that, from the start of this office, what were the questions and problems present and what were their answers.

    Scotland Act 2012 – commencement of provisions relating to Supreme Court appeals Following the coming into force of the Scotland Act 1998, the UK Supreme Court and its predecessors were given a role in determining “devolution issues” arising in court proceedings. Devolution issues under the 1998 Act include questions whether an Act of the Scottish Parliament is within its legislative competence, and whether the purported or proposed exercise of a function by a member of the Scottish Executive would be incompatible with any of the rights under the European Convention on Human Rights or with the law of the European Union. This included the exercise of functions by the Lord Advocate as prosecutor, with the effect that the Supreme Court was given a role defined in statute in relation to Scottish criminal cases for the first time. The Scotland Act 2012 makes substantial amendments to this aspect of the 1998 Act and creates a new scheme of appeals in relation to “compatibility issues”. “Compatibility issues” are questions arising in criminal proceedings about EU law and ECHR issues, or challenges to Acts of the Scottish Parliament on ECHR or EU law compatibility grounds. These issues would currently be dealt with as devolution issues under the regime created by the 1998 Act. Under the 2012 Act provisions, the remit of the UK Supreme Court is to determine the compatibility issue and then remit to the High Court for such further action as that court should see fit. The 2012 Act also imposes time limits in appeals to the Supreme Court in the new system and introduces the same time limit in appeals to the Supreme Court in relation to devolution issues arising in criminal proceedings.

According to Advocate General Pitruzzella, a national court can order a subsidiary company to pay compensation for the harm caused by the anticompetitive conduct of its parent company in a case where the Commission has imposed a fine solely on that parent company For that to be the case, the two companies must have operated on the market as a single undertaking and the subsidiary must have contributed to the achievement of the objective and the materialisation of the effects of that conduct By a decision issued in 2016, 1 the Commission imposed fines on a number of companies in the automotive sector, including Daimler AG, in respect of collusive arrangements on the pricing of trucks. Following that decision, the Spanish company Sumal S.L. asked the Spanish courts to order Mercedes Benz Trucks España S.L. (‘MBTE’), a subsidiary company of Daimler, to pay it the sum of approximately EUR 22 000 in compensation. According to Sumal, that amount corresponded to the increased price paid by it to MBTE when purchasing certain trucks manufactured by the Daimler Group as compared with the lower market price that it would have paid in the absence of those collusive arrangements. In that context, the Audiencia Provincial de Barcelona (Provincial Court, Barcelona, Spain), before which the case is being appealed, asks the Court of Justice, in essence, whether a subsidiary (MBTE) can be held liable for an infringement of the EU competition rules by its parent company (Daimler) and under what conditions such liability can arise.

Before this time, though friends of litigants could appear as unpaid amateurs, there had, of course, been professional lawyers, lay and ecclesiastical, variously described as "fore- speakers," procurators and prolocutors. The functions of advo- cate and solicitor had not yet been differentiated, though the notary had been for historical reasons. The law teacher was then essentially an ecclesiastic. As early as 1455, a distinctive costume (a green tabard) for pleaders was prescribed by Act of Parliament.' Between 1496 and 1501, at least a dozen pleaders can be identified as in extensive practice before the highest courts, and procurators appeared regularly in the Sheriff Courts.2 The position of notary also flourished in Scotland as on the Continent, though from 1469 the King asserted the exclusive right to appoint candidates for that branch of legal practice.

[2] There are three UK government law officers: the attorney general, the solicitor general and the advocate general. Michael Ellis QC MP is attorney general, Lucy Frazer QC MP is the solicitor general and Lord Stewart of Dirleton QC is the advocate general for Scotland. The attorney general also holds the separate office of advocate general for Northern Ireland. Suella Braverman QC MP was attorney general from February 2020 to March 2021, when she went on maternity leave. She is currently classed as a ‘minister on leave’ and it is expected she will return to her post after her leave concludes. The core function of the law officers is to advise the UK government on legal matters, help ministers to act legally, and in accordance with the rule of law, and to oversee the work of prosecution services. Speaking at the Institute for Government in February 2020, Geoffrey Cox, the then attorney general [3], described the role of the law officers as follows: “It is vital as a law officer that one speaks truth unto power. The law officer has to stand as a clear and uncompromising defender not only of the black letter interpretation of the law but also of the legal values that underpin it.” Are the law officers politicians? [4] The law officers are junior ministers appointed by the prime minister. They must sit in one of the Houses of Parliament. While they are political appointees, the law officers are, by convention, expected to have a deep knowledge of the law and to have worked in the legal profession.

Its pursuit at The Court of Justice of the European Communities demands of the common lawyer a readiness to set sail from the secure anchorage and protected haven of “plain words” and to explore the wider seas of purpose and context. This Essay is an attempt to enunciate the essential elements of the Court’s approach to legal interpretation, by the only Irish Advocate General to be appointed to that Court to date and to draw attention to some of its most notable practical applications. LEGAL INTERPRETATION AT THE EUROPEAN COURT OF JUSTICE Nial Fennelly* INTRODUCTION "Schematic and teleological"' are in the view of Lord Den- ning, former Master of the Rolls, "strange words."2 They de- scribe the method of interpretation of legal texts employed by the Court of Justice of the European Communities ("Court"),' which sits in Luxembourg where the common and civil law tradi- tions meet. The Common Law, of course, prevails in only two of the fifteen Member States, the United Kingdom and Ireland.
