PETERMAN* In this Note I argue that the Federal Election Campaign Act’s $5000 limitation on individual contributions to political committees should be removed. I advance two main arguments. First, in light of recent campaign finance decisions, the limitation appears to be unconstitutional as it imposes a limit on First Amendment rights without being tailored to the government’s interest in preventing quid pro quo cor- ruption. Second, eliminating the contribution limitation will have previously unrec- ognized normative benefits. Smaller PACs representing a variety of viewpoints will be more able to compete with established corporate and union PACs, and the volume of accountable political speech may increase as more money is channeled through PACs to candidates’ hands. INTRODUCTION The modern campaign finance system is praised by few and maligned by many. At the center of the criticism lies the seminal 1976 Supreme Court decision Buckley v. Valeo,1 which requires any regula- tion of political speech to be closely related to preventing corruption. Buckley holds that the risk of corruption justifies regulating contribu- tions given to candidates but not independent expenditures made in support of candidates by unaffiliated individuals and groups.2 The presence of limits on direct contributions to candidates in the absence of restrictions on independent expenditures makes it easier for money to flow to independent expenditure groups.3 This outcome is worri- * Copyright 2011 by Jeremy R. COOKSEY AND JAMES E. “TREY” TRAINOR III INTRODUCTION Before his election to the U.S. Senate in 2018, Rick Scott served as the Chair of New Republican PAC, an independent expenditure-only political committee (“New Republican”). After presiding over that entity’s raising of nearly $1.2 million, then- Governor Scott resigned as New Republican’s Chair, conducted testing-the-waters activities, and formally announced his candidacy for the Senate. New Republican was an active participant during the campaign that followed, making nearly $30 million in independent expenditures. In response to the complaints in this Matter, which allege that Scott, his authorized committee, and New Republican committed various violations of the Federal Election Campaign Act of 1971, as amended (the “Act”), our Office of General Counsel (“OGC”) recommended that the Commission find reason to believe that New Republican violated the Act by raising and spending so-called “soft money”—funds raised in excess of the Act’s contribution limits—and that now-Senator Scott failed to timely file a statement of candidacy and a statement of organization for his attendant authorized committee.1 1 First Gen. December 15, 2020 The Honorable Macro Rubio, US Senate The Honorable Rick Scott, US Senate Dear Senators Rubio and Scott, As you are aware, the year 2020 has posed immense challenges for the U.S. health care system and the medical community. Amid an unprecedented global pandemic, physicians and other health care professionals have worked tirelessly and made extraordinary sacrifices to meet the needs of patients, often risking their physical safety to ensure that the most sick and vulnerable among us are able to receive life-saving treatment. In addition to risking grave illness, many physicians throughout Florida have also suffered considerable economic harm that has endangered the financial sustainability of medical practices across the state. Unfortunately, with the holiday recess looming, Congress is now considering a flawed piece of surprise medical billing legislation that was drafted behind closed doors and released at the 11th hour, with no opportunity for stakeholders to negotiate its substantive details. While this legislation includes some important improvements over prior proposals, such as the ability to enter arbitration without meeting an arbitrary dollar-amount threshold and the ability to batch claims together for efficiency, the cumulative details of this legislation are crucial to its success and unfortunately still amount to a proposal that would further threaten the economic viability of physician practices. For instance, while the legislation excludes physicians from submitting legitimate charge data as evidence for consideration in the arbitration process, the bill nevertheless allows for insurers to submit government-set Medicare and Medicaid rates for the arbiter’s consideration, thereby creating an unlevel playing field tilted to the advantage of insurance companies. -

Independent Expenditures What are they and what are the rules? The 2010 Citizens United decision by the Supreme Court may have reinvented political spending, but it did not invent the independent expenditure. Organizations–largely through their political action committees (PACs) —have engaged in independent expenditures to elevate their issues and influence— election outcomes for decades. 1 What the Court’s ruling did, was to allow—for the first time— corporations (including nonprofit corporations like 501(c)(4)s and labor unions) to make independent expenditures from their own bank accounts without having to rely on a connected PAC. It also triggered a wave of court decisions and Federal Election Commission (FEC) advisory opinions that redefined how and what money can be spent on elections, invalidated entire sections of the Federal Election Campaign Act (FECA), and helped create a new type of political organization. This fact sheet explains what an independent expenditure is, briefly addresses how different types of organizations may effectively make independent expenditures, and reviews the rules and federal law that govern them. 2 It ends with Frequently Asked Questions that apply the rules and concepts to common activities in which you may be engaging. Governor Richard L. Scott Biography Rick Scott is the 45th Governor of the great State of Florida. Rick campaigned on creating jobs and turning Florida's economy around. Born in Bloomington, Illinois and raised in Kansas City, Missouri, Rick Scott is considered one of America’s foremost entrepreneurs. The son of a truck driver and JC Penney clerk, Rick is known as an innovator in business, health care, and politics, and has developed a reputation in the health care industry for providing affordable, high quality services through a patient-centric approach to cost and care. Rick is the founder of two health care providers, Columbia Hospital Corporation and Solantic Corporation, which builds and operates urgent care facilities throughout Florida. Rick also started Conservatives for Patients’ Rights, an organization founded to defend free market principles in health care that focused successfully on defeating President Obama’s government-run public option plan. Rick has been married to his high school sweetheart, Ann, for 38 years. They have two wonderful daughters, Jordan and Allison. An Early Entrepreneur After high school and one year of community college, Rick enlisted in the United States Navy, where he served on active duty aboard the USS Glover as a radar man. Rick then enrolled at the University of Missouri-Kansas City and, while also working full-time at a local grocery store, he made his first significant foray into the business world by buying two Kansas City doughnut shops for his mother to manage. Following graduation from UMKC with a bachelor’s degree in business administration, Rick earned a law degree from Southern Methodist University. -
