    NEW MEXICO SCHOOL BOARDS ASSOCIATION PUBLIC EDUCATION RELATED LEGISLATION PASSED AND SIGNED BY GOVERNOR • HB 2 General Appropriations Act of 2018 (Patricia Lundstrom) The New Mexico Legislature sent a $6.3 billion budget plan to Governor Martinez which includes a 2.3% increase in public school funding to $2.7 billion. Minimum teacher three-tier salaries are increased by two thousand dollars each. Teacher pay will increase by 2.5 percent and other school employees pay would increase by an average of 2% allowing some discretion to school districts. At-risk funding factor will be increased for districts and no new four-day school week districts will be allowed, • HB 48 Prior Year Data for School Distributions (Dennis J. Roch) Requires the Public Education Department to use prior year data for determination of distribution amounts to school districts. (PSCCOTF) • HB 98 Local Election Act (Paul C. Bandy and Daniel A. Ivey-Soto and James E. Smith) Provides for a single election day in November of odd numbered years for nonpartisan elections; provides that certain ballot measure elections that are held at times other than with regular local elections only be conducted by mailed ballot; repeals the school election law, mail ballot election act, the municipal election code. • HB 188 Phase-in Teacher Cost Index (George Dodge, Jr.) Amends the Public School Finance Act to establish a phase-in teacher cost index; requiring a study to evaluate the Index’s sufficiency; making a phase-in adjustment to the At-Risk Index; repealing the section of law creating the Funding Formula Study Task Force; making an appropriation.

    NEW MEXICO SENATE DEMOCRATS For immediate release Contact: Arnold Vigil, (505) 986-4263 www.nmsenate.com SENATE REVIEW: March 5, 2013 Minimum Wage Bill Passes Senate On a straight party-line vote, and after a highly emotional debate, the state Senate passed a bill to raise the statewide minimum wage by a dollar to $8.50 an hour. Senate Bill 416, sponsored by Senator Richard Martinez (Los Alamos, Rio Arriba, Sandoval, Santa Fe, District 5) and Senator William Soules (Dona Ana, District 37), passed the Senate by a 25-17 vote. The minimum wage bill is a centerpiece in Democratic legislation to help working families. The increase would provide nearly $2000 a year for full-time employees earning minimum wage. “This amount of money is not insignificant to workers trying to support their families. There is a real need out there,” said Senator Michael S. Sanchez, Senate Majority Leader. Although opponents of the bill have argued that it will negatively impact small businesses, advocates believe that the increased wages will go directly into local economies to purchase basic necessities, such as food and medication. “Hard working New Mexicans deserve to be paid a fair wage that will allow them to provide for their families,” said Senator Richard Martinez. “Even with the increase in the minimum wage, a family of four will still be below the poverty level.     New Mexico Municipal League LEGISLATIVE BULLETIN VOL. 2021-3 March 1, 2021 TOUGH CHOICES AHEAD This last week, the League hosted its 32nd Annual Municipal Day, where it took the opportunity to apprise members of the progress made during the First Session of the 55th Legislature. In general, the week saw a fair amount of movement on legislation affecting our membership; as always, you can find narrative of bills of import below. Priorities to date: • House Bill 2 – House Appropriations and Finance Committee Substitute for House Bills 2 & 3 appropriates a total of $7.39 billion for FY22, an increase of 4.6 percent over the current budget year with much of the $332 million increase used to restore general fund dollars to costs temporarily covered with federal funds. The Act made its way out of the House this week and now makes its way to the Senate. The League supports using the general fund to cover operational needs and enterprise funds to provide executive agencies or departments with what they want. Currently, the state shifts costs to the local governments through the enterprise model to reduce its general fund exposure. Importantly, these monies also include a special appropriation to the Department of Transportation in the amount of $170M for various needed road improvements. • House Bill 4 – The Senate Health and Public Affairs Committee heard this bill on Friday afternoon/evening and issued a do pass without recommendation, which in its current form remains a punitive measure without effect as to the behavior giving rise to risk, and as a result leaves significant gaps in our state for law enforcement training.

HB 22, which would assure that children of state employees and public school employees are covered for autism services on the same basis as families covered by most other individual and group insurance policies, passed the House by unanimous vote this past Friday. The bill was cleared for a final vote after it was passed in its first committee and then withdrawn from the House Appropriations and Finance Committee earlier in the week without a hearing. The bill now goes to the Senate, where it has been assigned to two Senate committees. The Senate will likely delay the bill's first committee hearing for a while in order to give preference to Senate bills that are waiting to be heard.
