    September 21, 2020 Senator Bill Ferguson President of the Maryland Senate H-107 State House 100 State Circle Annapolis, MD 21401 Dear President Ferguson, We are writing to voice our serious concerns about the “bill hearings” scheduled this week before the Judicial Proceedings Committee. It is shocking that with more than 50 people shot in two weeks in Baltimore, 240 individuals shot and killed in Baltimore this year, including 3-year-old Shaniya Gilmore and her pregnant mother, JPR would hold hearings on a suite of 15 bills that would certainly result in less policing. It is equally troubling that, given the incredible and unacceptable carnage in Baltimore, we would exclude legislation modeled after Governor Hogan’s anti-crime package, which the Senate passed 43-4 last Session, from being heard at the same time. It is imperative that we move similar legislation quickly to keep people safe from rising crime. We ask that the Judicial Proceedings Committee cancel what is really nothing more than an anti-police political rally and instead hold hearings on a potential anti-crime package that will save lives in our state by keeping repeat violent offenders who use guns off the street and in prison. In 2015-2016, after the death of Freddie Gray and the Baltimore Riots, the General Assembly put together a bipartisan police reform workgroup where Republicans and Democrats came together, and passed, almost unanimously, the Police Reform and Accountability Act. It should be noted that this process involved a series of public hearings to determine the problem and propose solutions.

    July 21, 2020 Governor Larry Hogan 100 State Circle Annapolis, MD 21401 Dear Governor Hogan, We write in response to recent demands by numerous Democrat elected officials that you reapply significant statewide restrictions on Maryland’s restaurants and bars. The misplaced assumption behind these demands is that these businesses are the cause of the recent increase in COVID positive test results among the low risk population of young adults under the age of 35. These demands are doubly misplaced. First, now is not the time for irrational, punitive actions. We should maintain the steady course you have set. We are seeing significant and consistently favorable COVID-related data in Maryland – death rates have declined from a daily high of over 160 in May to under 10, hospitalization rates have been cut by two- thirds, and we have relatively low positivity rates across the board. Second, Democrat leaders’ demands completely ignore the reality of their own actions over the past month and seek to scapegoat small business owners. While imposing crippling restrictions on employers and citizens engaged in necessary daily activities, these politicians have supported, encouraged, and attended mass gatherings of those most impacted by the recent increase in positive tests. While we strongly support the 1st Amendment rights of all who demonstrate peacefully, it is clear that the state’s prohibition on mass gatherings has been completely ignored since at least Memorial Day when it involved protests. All the while, the vast majority of restaurant and bar owners have been carefully complying with all COVID related rules and regulations. Civis Analytics estimates that 15 to 26 million young Americans joined protests over the course of the last two months.

    2018 Legislative Wrap-Up To Our Valued Clients, Friends, and Colleagues: On April 9, 2018, the Maryland General Assembly concluded its 438th Legislative Session. At this time each year, we like to take a moment to share the highlights of the last 90 days. A record 3,101 bills were introduced in 2018. Needless to say, this synopsis is not an exhaustive report of the legislative activities this session, but merely an overview on certain topics of interest. If you have specific questions, please feel free to contact us. Labor and Employment Minimum Wage Increase (“Fight for Fifteen”) Continuing a nationwide effort, Fight for Fifteen labor advocates reintroduced legislation to increase the state minimum wage to $15.00 per hour by July 1, 2024. The bill would eliminate a tip credit for employers who employ tipped employees, and was strongly and successfully opposed by Maryland full service restaurants. Maryland is one of 29 states that mandates a minimum wage higher than the federal minimum wage of $7.25 per hour. Only seven states require employers to pay the full state minimum wage before tips. Senate Bill 543/House Bill 664, introduced by Senator Richard Madaleno (D-Montgomery County) and Delegate Shelly Hettleman (D-Baltimore County), received significant opposition from Maryland businesses who already face an increasing wage to $10.10 per hour, beginning July 2019. There were several other pieces of legislation introduced this session to increase the state minimum wage rate or to index it including: Senate Bills 235 and 1019, both sponsored by Senator Barbara Robinson (D-Baltimore City), and Senate Bill 368, sponsored by Senator Nathaniel McFadden (D-Baltimore City), all of which failed due to lack of action by the legislature.
