TERMS AND CONDITIONS

West Coast Eagles – WIN a Grand Final Package Crown Promotion

10 July 2015 – 30 July 2015

1. The Promoter is the Football Club of Domain Stadium, Gate 12, 250 Roberts Road, Subiaco, WA, 6008. (ABN 31 009 178 894) (Promoter).

2. The Sponsor is Virgin Australia of 56 Edmondstone Road, Bowen Hills, Queensland, 4006 (ABN 36 090 670 965) (Sponsor).

3. The promotional period (Promotional Period) for West Coast Eagles entrants commences at 12.01pm WST Friday July 10, 2015 and ends at 11.59pm WST Thursday July 30, 2015.

4. Participation in this promotion constitutes acceptance of these Terms and Conditions.

5. Participation is only open to current employees of Crown Perth (Burswood Nominees Ltd for the Burswood Property Trust (ABN 24-078-250-307) and their immediate family who are WA residents and aged 18 years or over. Employees (and their immediate families) of Virgin Australia and the West Coast Eagles are ineligible to participate. Immediate family means any of the following: spouse, ex-spouse, de- facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

6. To constitute a valid entry into the promotion, entrants must complete all three steps outlined in the promotion, these are: a. Step 1: Join Velocity Frequent Flyer at http://www.velocityfrequentflyer.com/westcoasteagles

b. Step 2: Register the West Coast Eagles as their team at http://www.velocityfrequentflyer.com/content/Specials/Airlines/afl-promotion-westcoasteagles

c. Step 3: Complete the entry form at https://www.westeagles.com.au/virginaustralia/sponsors

7. Instructions on how to enter, prize details and other information contained within the promotional advertisements form part of these terms and conditions. By participating in this promotion entrants agree to be bound by these terms and conditions.

8. Nominated Persons must be available all day from Friday October 2, 2015 to Sunday October 4, 2015 to participate in the prize.

9. The winner of the prize must provide the Sponsor with the name of the two people, 18 years and over, who will be accepting the Prize (Nominated People) (may be the winner and 1 other person of their choosing) by Monday September 7, 2015. After which no changes can be made by the winner in relation to their Nominated People.

The Promoter will provide the winner with the relevant contact information for the Sponsor for the sole purpose of booking the prize.

11. The winner will be drawn at random on Friday, July 31, 2015 at 12.01pm (WST) by the Promoter from all eligible entries received. Prior to confirming the winner the Promoter will verify with the Sponsor that the entrant is a member of Velocity Frequent and registered the West Coast Eagles as their team. Following valid verification the winner will be notified by telephone and email by a representative

of the Promoter. The prize is to be taken as stated and is not redeemable for cash. The total prize package value is $6,000 Inc GST RRP. The Winner will receive the following prize: a. Two (2) x return economy airfares flying Virgin Australia from Perth, WA to Melbourne, VIC with flights departing on 02/10/2015 and returning on 04/10/2015 (with flight times determined by Virgin Australia in its sole discretion);

b. Two (2) x Category 5 tickets to the 2015 AFL Grand Final on 03/10/2015 –AFL Grand Final Permit Code: GFAFL15/31;

c. Two (2) nights, in a minimum three (3) star accommodation in Melbourne (exact hotel determined by Virgin Australia) for each of the two (2) Nominated People; and

d. Transfers between Melbourne Airport to accommodation in Melbourne, and transfers between the accommodation to for the 2015 AFL Grand Final.

12. Spending money, meals, insurance, transport to and from departure point of Perth, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken to coincide with the 2015 AFL Grand Final event with the flight to Melbourne departing Perth on 02/10/2015 and the flight to Perth departing Melbourne on 04/10/2015. The flights are subject to booking and flight availability. The winners and their companions must depart from and return to the same departure point and travel together. The winners’ itinerary will be determined by the Sponsor in its absolute discretion. Velocity Frequent Flyer Points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winners will be required to present their credit card at time of accommodation check in.

13. In the event that for any reason whatsoever the Nominated People do not take an element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited and cash will not be awarded in lieu of that element of the prize.

14. If any prize (or part of any prize) is unavailable, the Sponsor, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

15. The 2015 AFL Grand Final ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Sponsor and event organisers hereby expressly reserve the right to eject any winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize. If West Coast Eagles discovers or has reasonable grounds to believe that grand final tickets issued to a winner have attempted to be sold or have been sold via eBay or through any other method, the tickets will be cancelled by West Coast Eagles.

16. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, place of work, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoters discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

17. Incomplete or indecipherable entries will be deemed invalid.

18. Multiple entries will be deemed invalid.

19. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

20. Entrants consent to the Promoter and Sponsor using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome).

21. Promoter, Sponsor and associated agencies accept no responsibility for any loss, damage, accident, death or injury resulting from the promotion.

22. Entry into this promotion signifies acceptance of all conditions. The Promoters’ decision will be final and cannot be contested. No correspondence will be entered into. The Promoters reserve the right to limit entry or amend rules if considered necessary without notice.

23. The Promoter reserves the right to refuse to allow a winner or Nominated People to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner or Nominated People is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner or Nominated People may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

24. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter and/or Sponsors ability to proceed with the Promotion on the dates and in the manner described in these terms and conditions, including but not limited to fraud, unauthorised intervention, vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the West Coast Eagles may in its absolute discretion (a) disqualify any entrant or (b) modify, suspend, terminate or cancel the Promotion, subject to any written directions given under State Regulation.

25. Except for any liability that cannot be excluded by law, the Promoter (and its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the AFL Grand Final event is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f)any tax liability incurred by a winner or entrant; or (g) taking of a prize and participation in a prize.

26. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of this promotion. Any entrant disqualified under this clause is prohibited from any further participation in the competition. The Promoters legal rights to recover damages or other compensation from such an offender are reserved.

27. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, internet failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

28. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any causes beyond the control of West Coast Eagles , which corrupt or affect the administration, security, fairness or integrity or proper conduct of this competition, the West Coast Eagles reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to any written direction given under State Regulation.

29. The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

30. Prizes are non-refundable and non-transferrable once the Nominated Person has been nominated and cannot be redeemed for cash or used for travel on another airline. If for any reason the Nominated Person does not take the flight or ground transfers at the times stipulated, then the flights and ground transfers will be forfeited and will not be redeemed for cash.

31. Travel on Virgin Australia flights is subject to Virgin Australia’s Conditions of Carriage, which are available at http://www.virginaustralia.com/au/en/about-us/legal-policies/conditions-of-carriage/ and are subject to change. 32. Prizes may not be sold or offered for resale at a premium (including via on-line auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services, either by the original recipient or any subsequent bearer. If a Prize is sold or used in breach of this condition, the Prize may be withdrawn.

General 33. The Promoter and Sponsor is bound by the following Privacy Law elements: a. the Privacy Act 1988 (Cth)

b. any legislation in any Australian jurisdiction affecting privacy, Personal Information or the collection, handling, storage, processing, use or disclosure of data.

c. any mandatory rules, guidelines, orders, directions, directives, codes of conduct or other instruments made or issued under them, as amended from time to time.

d. all personal information provided will be used by the Promoter and Sponsor in accordance with their Privacy Policies and may be disclosed by the Promoter and Sponsor in accordance with their Privacy Policies (including for promotional and marketing purposes). By providing personal information you agree to such use by the Promoter and Sponsor.
