New Business

Massachusetts’ Municipal Vulnerability Preparedness (MVP) Program

• Carrieanne Petrik asked to present an outline of the MVP program to make NMPB aware of the program; no action necessarily required. • MVP is a grant focused on vulnerabilities associated with climate change. • The initial grant ($20,000) allows a municipality to hire a contractor to develop a resiliency plan and to apply for an action grant ($25,000 - $2MM). • New Marlborough has already received an action grant in partnership with Sheffield and Sandisfield to evaluate the effect of climate change on dirt roads.

• Other vulnerabilities that could affect New Marlborough include food production, roads elderly populations (power, food, weather, housing). • Mark Carson asked if the MVP could be used to restore riverbanks. Carrieanne indicated it could be used to restore riverbanks on private land. • “Champions” of the MVP program in New Marlborough could be DPW and police chief. • Additional information regarding the MVP program is attached to these minutes.

Old Business

Annual Town Meeting

The annual town meeting was postponed (no new date set) by the Select Board on 5/26/20. The presentation regarding the marijuana bylaw is postponed until the annual town meeting is rescheduled.

Dan circulated all the relevant information required for the marijuana bylaw discussion including the notification of the proposed amendments (4) sent to the town administrator, the four amendments that need to be voted on and the full marijuana bylaw.

NMPB needs to put together a brief historical timeline for background relative to the marijuana bylaw. Dan volunteered to assist with the annual town meeting presentation whenever that is rescheduled.

NMBP Composition

Eric Schaefer’s resignation is effective after the next NMPB meeting on 6/10.

Dan Doern’s term expires on 6/29.

Mark Carson indicated that he has determined that he will be able to continue to serve on the NMPB even if he is elected to the Select Board.

Per state law, the composition of the NMPB can be five to nine members.

The current composition is five members. Three members are required for a quorum. Without a quorum, no decisions can be made by the NMPB. The NMPB would effectively be advisory only.

Dan noted that he heard Peter Tiso may be coming back east at the end of summer. Dan will reach out to Peter by email to explain where we are with the composition of the NMPB to see if he would have any interest in an appointment when he returns.

Town elections will be held on 6/29/20.

Hartsville Mill River Road Riverbank Restoration

Riverbank near the bridge is eroding and encroaching on private land and the public road. Mark has been working on this problem with the private landowner and Trout Unlimited for several years. Trout Unlimted had done the engineering work necessary to apply for a grant to restore the riverbank. The value of the work done by Trout Unlimited is approximately $25,000. Additional information regarding this issue is attached to these minutes.

The bridge is located approximately 320’ northeast of the intersection with Underwood Road. The Konkapot is a tributary to the Mill River in the Watershed. The site is located Berkshire County in the Town of New Marlborough, . Buel, is a 196 acre enlarged Great located approximately 1400’ northwest of the site. The stream draining enters the Konkapot River on River Right approximately 200’ upstream of the bridge. The hydraulics of the outlet of the Lake may be contributing to the instability of the Konkapot site.

Project Overview: Recurring instability on the highly sinuous section of the Konkapot River above the bridge on Hartsville Mill River Road is contributing to high erosion, property damage and habitat degradation. Lateral migration is estimated at 15 feet in 2 years. A review of aerial photography reveals that lateral migration since 1995 may be as high sas 60 feet on river left. The proposed restoration work would reduce erosion and restore long term stability and improve habitat for the cold water fishery.

Project Goals: Collaborate with the Town of New Marlborough and the landowners to restore stability to the erosive banks of the Konkapot River.

BEHI Analysis: A Bank Erosion Hazard Index was completed at station 3+12 to estimate the tons/year of soil loss on the erosive bank. The BEHI Analysis is based on the sandy loam soils reported on the bank as well as the steep bank angle and the lack of deeply rooted vegetation. Combined with the Near Bank Stress Analysis (Method 5), the estimated annual soil loss is 0.9 tons per year. Please see the attached BEHI summary page for the site. Maintenance Plan: Trout Unlimited and the Town of New Marlborough will monitor the project following storm events and seasonal changes to check on stability and vegetation.
