To All Sportsmen: This pamphlet contains an abstract of the laws regulating- fishing in open waters, as contained in Chapter 38 of the Revised Statutes, Biennial Revision of 1943, also all rules and regulations of the Commissioner of Inland Fisheries and Game adopted up to the time of going to press. Your special attention is called to the many changes in the rules and regulations of all the counties effected by the 91st Legis­ lature’s passage of “An Act to Simplify the Inland Fishing Laws.” Before fishing, be­ cause of these many changes, one should always consult the Special Fishing Laws, pertaining to his respective county, to be found at the back of this booklet. Fishing laws were first framed to answer the demands of sportsmen. The laws and regulations will protect your rights and those of others, and insure perpetual fishing. Obey them, and see that others do and report any violators to the proper authorities. It is unlawful to fish without a license and it must be issued in your own name. It is unlawful to buy or sell fish protected by law. It is unlawful to fish with a seine for min­ nows to be used for bait. It is unlawful to take fish (except cusk) by use of set lines. Quit when you have your daily bag limit. When you catch short fish, wet your hands, remove the fish gently and carefully and return it to the water. Respect the property rights of others; clean up your papers, bury your rubbish, close gates after you have used them. Avoid forest fires. Please be careful of your fires. Be sure any fire is out before leaving. Always break matches before throwing them away, never throw, or allow another to throw down a lighted cigarette or cigar. Carelessness can destroy in a few minutes that which has taken a century to grow.

( 4 ) ABSTRACT OF GENERAL LAWS REGULATING FISHING IN OPEN WATERS

(This booklet does not contain a complete tran­ script of the fishing laws. It is intended merely as a concise statement of the provisions most likely to be of general interest.) (Any reference to It. 8., 1930, C. 38, refers to the 7th Biennial Revision located at end of 1943 Raws.)

DEFINITIONS “ Closed Season” means the period during which it is unlawful to fish for, take, catch, kill or destroy any fish. (See R. S., 1930, Chap. 38, Sec. 18). “ Open Season” means the period during which fish may be taken as specified and limited by law and includes the first and last day thereof. (See R. S. 1930, Chap. 38, Sec. 18). (For opening dates in the respective counties please refer to the special rules and regulations to be found in the back of this book.) “Fly Fishing.” What is the ordinary way of casting with artificial flies known as fly fishing? This is a question which is frequently asked the de­ partment, and the answer is that the “ Ordinary way of casting with artificial flies” is by means of un­ baited flies. In waters which are restricted to fly fishing by special regulations, the use of only un­ baited artificial flies is permitted. “Fly,” a single hook dressed with feathers, hair thread, tinsel, or any similar material to which no additional hook, spinner, spoon or simila^fdeyis^)" added. “Transport” includes to offer or to receive for transportation. ( 5 ) “ Aliens.” An Alien is an unnaturalized, foreign born person who, for the purposes of the fishing laws of this State, shall be classified as non-residents and shall be licensed as such, except that any alien who has lived in the state continuously for 2 years and in addition thereto, pays a tax on real estate in the city or town in which he resides may purchase a resident fishing license. This privilege applies only to the taxpaying alien himself and not to any member of his immediate family. (See R. S. 1930, Chap. 38, Sec. 40). “ Resident.” A resident is a citizen of the United States who has been a bona fide resident of this state and actually domiciled here for a period of 3 months next prior to his application for a license and who has not during that period claimed a residence in any other state for any purpose. (See R. S. 1930, Chap. 38, Sec. 40). All employees and soldiers regularly employed at the Veterans Administration Facility and members of the United States’ Armed Forces stationed in Maine are classified as residents. (See R. S. 1930, Chap. 38, Sec. 19, par. 2). “Non-resident.” Non-residents are persons not coming within the definition of “ resident” and in­ cludes “ aliens” as defined above. “Tributary or Tributaries” mean brooks or streams flowing directly or indirectly into another body of water. One great pond or lake (over ten acres) shall not be considered as a tributary to another great pond or lake. Ponds over 10 acres are not tributaries. (See R. S. 1930, Chap. 38, Sec. 18). “ Game Fish’” are: Trout, salmon, togue, bass, white perch and pickerel.

( 6 ) “ Bag Limit” means the maximum limit, in num­ ber or amount of fish which may lawfully be taken by any one person during a specific period of time.

“ Inland Waters,” shall include all waters within the state above the rise and fall of the tide.

“Commissioner” wherever the word “commis­ sioner” appears hereafter, it refers to the Commis­ sioner of Inland Fisheries and Game.

MISCELLANEOUS GENERAL PROVISIONS

No person shall fish with more than 2 lines at any one time. (See R. S. 1930, Chap. 38, Sec. 21A). All pools connected with state fish hatcheries and feeding stations shall be closed to all fishing at all times. (See R. S. 1930, Chap. 38, Sec. 21).

Closed Season for Fishing: All waters are closed to all fishing for such period as same waters are closed to fishing for salmon, trout or togue. (See R. S. 1930, Chap. 38, Sec. 21). During the period of the respective closed season it is unlawful for any person to fish for, take, catch, kill or have in possession any fish of any kind from such closed waters. (See R. S. 1930, Chap. 38, Sec. 21).

Possession of Fishing Tackle. The possession of any fishing tackle in the fields or forests or on the waters or ice of the state by any person not having the required fishing license shall be prima facie evi­ dence of fishing in violation of the laws of this state. (See R. S. 1930, Chap. 38, Sec. 108).

( 7 ) Fishways. Fishing in or within 150 feet of any fishway is prohibited. (See R. S. 1930, Chap. 38, Sec. 20). Ponds Formed by Brooks, Streams and Rivers. Ponds 10 acres or less, formed on brooks, streams or rivers shall be governed by the same law regulating fishing that applies to the brook, stream or river on which they are situated, whether said pond be natural or artificial. (See R. S. 1930, Chap. 38, Sec. 24).

Thoroughfares and Bogs. The general laws gov­ erning lakes and ponds also apply to thoroughfares and bogs. (See R. S. 1930, Chap. 38, Sec. 18).

Bait Dealers. All dealers in live bait must pro­ cure a license from the Commissioner (Fee $2.00), which entitles the holder to use ordinary commercial types of minnow traps or minnow seine not to ex­ ceed 4 ft. x 25 ft. or a net made from not more than 2 bolts of mosquito netting used as a seine, without sinkers or floats, in taking unprotected fish for bait purposes. (See R. S., 1930, Chap. 38, Sec. 38A) Provided, further, that it shall be lawful to take minnows and other fish usually used for bait for fishing, in all the inland waters of the state for bait for fishing only in this state. (See R. S., 1930, Chap. 38, Sec. 29)

Advance Baiting. Tolling or luring fish by means of advance baiting such as depositing meat, bones, dead fish, or other food for fish or any other sub­ stances in any of the inland waters for the purpose of attracting fish, is prohibited. Penalty $10.00 to $30.00. (See R. S., 1930, Chap. 38, Sec. 35)

( 8 ) Stocking of Inland Waters. No person shall intro­ duce any game fish or other fish, fish fry, or spawn in any of the inland bodies of waters in the state without the written consent of the commission. Penalty $50 to $500. (See R. S., 1930, Chap. 38, Sec. 34)

Planting of fish in inland waters. No person, firm, corporation, department head or employee of the state of Maine shall deposit or plant any fish or fish spawn obtained from or raised by the state of Maine or the federal government in any brook, stream or river of this state within a distance of 5 miles down stream of any saw mill, wood working plant or fac­ tory, which deposits in said inland waters, or on the banks thereof, in such manner that the same jnay fall or be washed into said waters, any slabs, edg­ ings, sawdust, chips, bark, mill waste, shavings or fibrous materials created in the manufacture of lum­ ber or other wood products, or so deposit any oil regardless of its source. (See R. S., 1930, Chap. 38, Sec. 36A) Transportation of Fish. Any person, licensed to fish may transport to his home in any one day the bag limit of fish for that day when open to view and in the possession of the person who caught said fish. Any person legally in possession of any fish may once in 10 days offer one day’s bag limit to a common carrier for transportation to his home under a $1.00 transportation tag. (See R. S., 1930, Chap. 38, Sec. 31). Exceptions. Shipments of fish legally in posses­ sion as above may be made only once a year from , Mooseluemeguntic Lake, Cupsuptic Lake, Richardson Lake Upper and Richardson Lake

( 9 ) Lower and at any time from Moosehead Lake and waters in Piscataquis County. (See R. S., 1930, Chap. 38, Sec. 31)

Transportation by Aeroplane. Fish transported by aeroplane must bear transportation tag issued by the commissioner and aeroplanes other than regular transport planes must procure special permit before transporting any fish taken from inland waters. (See R. S., 1930, Chap. 38, Sec. 81) Private Ponds. In all inland waters wherein fish are artificially cultivated by permission of the com­ missioner, fishing is prohibited except with the per­ mission of the owner. Penalty. $10.00 to $100.00 and $2.00 for each fish illegally taken. (See R. S., 1930, Chap. 38, Sec. 38)

Fishing for Gain Prohibited. Fishing for salmon, trout, togue, black bass, pickerel, white perch or white fish for gain or hire in the inland waters is prohibited. Penalty. $50 and costs. Exceptions. Pickerel legally taken in the county of Washington, may be sold by the person taking the same. (See R. S. 1930, Chap. 38, Sec. 27).

Sale of Certain Fish Prohibited. The buying or selling, either directly or indirectly, of any salmon, trout, togue, black bass or white perch is prohibited. (See R. S. 1930, Chap. 38, Sec. 26).

Game Fish at Camps. Salmon, trout, or togue taken from the inland waters of the state shall not be served, consumed or possessed at or in any camp or building used in construction, lumbering or log driv­ ing operations. (See R. S. 1930, Chap. 38, Sec. 27A). ( 1 0 ) Devices Prohibited. The use of dynamite or any other explosive or poisonous or stupefying substance in destroying or killing any kind of fish is prohibited. Penalty $100.00. The use of fish spawn, grapnel, spear, trawl, weir, gaff, seine, gill net, trap, or set lines is prohibited (except when fishing through the ice and then with not more than 5 lines to a person in the daytime). The taking of any kind of fish, except suckers, eels, hornpout, yellow perch, white fish and cusk, as here­ inafter provided, is prohibited, with any device or in any other way than the oi’dinary mode of angling with single baited hook and line, artificial flies, arti­ ficial minnows, artificial insects, spoon hooks and spinners. Penalty. $10.00 to $30.00 and costs and $1.00 for each fish caught, killed or possessed in vio­ lation of this section. The above prohibited imple­ ments, devices or substances are forfeit and contra­ band when found in use or possession and any person finding them in use may destroy them. (See R. S. 1930, Chap. 38, Sec. 28).

Penalties. Whoever violates any provision relat­ ing to Open Seasons, Daily Bag Limits and the Buy­ ing and Selling of Fish shall pay a fine of not less than $10, nor more than $30, and costs of prosecu­ tion, for each offense; and in addition thereto $1 for each fish taken, caught, killed or had in possession in violation of any provision of said sections. (See R. S., 1930, Chap. 38, Sec. 23) Whoever violates any of the provisions of chapter 38 or any rules and regulations promulgated there­ under, excepting only those for the violation of which specific penalties have been hereinbefore provided, ( 1 1 ) may be punished by a fine of not less than $10 nor more than $300 and costs, or by imprisonment for not more than 90 days, or by both such fine and im­ prisonment. (See R. S., 1930, Chap. 38, Sec. 107)

SPECIAL PROVISIONS Pickerel. No person shall take or have in posses­ sion more than 10 pickerel in any one day. (The provisions of this section do not apply in Washington County). (See R. S. 1930, Chap. 38, Sec. 25). Smelts. Except as hereinafter provided, it is law­ ful to take smelts with a dip net in any inland waters of the state during the period such waters are open to fishing; but no person shall take or have in posses­ sion more than four quarts of smelts in any one day. Smelts may be taken during April and May, with the hands in any of the brooks of the state flowing directly into tide water but only for table use in the family of the person taking them. Provided, however, it is unlawful to take smelts at any time within an area beginning at tide water, and extending one-half mile above tide along any of the brooks, streams or rivers and branches thereof, which flow directly into tide water; except smelts may be taken in this area with single hook and line in the daytime. Minnows and other Bait Fish. It is lawful to take, for use in Maine only, minnows and other fish usually used for bait in any of the inland waters of the state during the period such waters are open to fishing. (See R. S., 1930, Chap. 38, Sec. 29)

White Fish. In the daytime it is lawful to take white fish with single hook and line during sue period as such water is open for taking salmon, trout and togue. (See R. S. 1930, Chap. 38, Sec. 29). Hellgrammites. Hellgrammites cannot be trans­ ported beyond limits of this state. (See R. S. 1930, Chap. 38, Sec. 29A). Common Fish. Suckers, eels, hornpouts, alewives and yellow perch may be taken for market by means of eel pots, traps, spears, or nets, under such terms, rules and regulations as the commissioner may es­ tablish. Exclusive territory permits not granted. The commissioner may issue permit to any licensed trapper to take not more than 20 pounds of eels an­ nually for use as bait in trapping. (R. S. 1930, Chap. 38, Sec. 30). 'Black Bass. 3 per day may be taken by fly fishing from June 1st to June 20th.

Cusk. It is lawful to fish for and take cusk in the \ night time during such period as the waters fished \ in are open to fishing for salmon, trout and togue. \ (See R. S., 1930, Chap. 38, Sec. 29)

LICENSES (See P . S., Chap. 38, Secs. 19, 19A, 295A) All residents over 18 years of age and all non-resi­ dents over 10 years of age, unless otherwise ex­ empted as provided below, are required to hold a fishing license for fishing in inland waters and for transporting fish taken therefrom. The license must be carried in possession and must be shown on de­ mand to any warden, employee of the fish and game department, or guide. All persons holding any type of license are subject to the laws of the State. (13) RESIDENT Resident Citizen: (Resident of Maine for three consecutive months next prior to application.) All residents over 18 years of age must have a license to fish except as provided below. Veterans: All employees and soldiers regularly employed at the Veterans Administration Facility are classified as residents. Members of Armed Forces of the U. S.: All mem­ bers of the armed forces of the U. S. who, at the time of applying for a fishing license, are stationed in this state are classified as residents for the pur­ pose of obtaining a fishing license. Fee $1.15. Mem­ bers of the armed forces who were residents of the state of Maine at the time of enlistment or induction may procure from any city or town clerk in the state, a resident fishing license good for the year in which applied for, free of charge, upon payment of the clerk’s fee of 15 cents. The provisions of this shall be in effect only for the duration of the present war. (See R. S., 1930, Chap. 38, Sec. 19) Exemptions and Exceptions: Minors less than 18 years of age may fish without a license. Any legal resident of the state or any member of his immediate family residing on land owned by him, ay fish in any inland waters bordered by such land On-without a license if he is or they are actually domi­ ciled thereon and the land is used exclusively for agricultural purposes. No charge for resident soldiers except as specified above. Indians: Full blooded Indians over 18 years of age of both the Passamaquoddy and Penobscot tribes may, through their Indian Agent, procure a free li-

(14) cense to fish, hunt and trap. (See R. S., 1930, Chap. 38, Sec. 295-A) Fees: License shall be issued to a resident by the clerk of the town in which he resides or if he is domi­ ciled in an unorganized place, by the clerk of the nearest town upon payment of a fee of $1.15 or $2.15 for a combination fishing and hunting license, of which $.15 shall be retained by the town clerk.^A 3-

The Game Wai'den is your friend and counselor and will be glad to assist you to get the most enjoy­ ment from your sport. Companions should notify nearest game warden if fisherman is lost.

( 1 6 ) GUIDES

Registration. All persons who engage in guiding for hire, either directly or indirectly, for either hunting or fishing must be licensed by the Commis­ sioner of Inland Fisheries and Game. Persons so licensed may hunt and fish by virtue of their guide’s license. (See R. S. 1930, Chap. 38, Sec. 15).

Class “A ” Guide: Must be a person who is physi­ cally, mentally and morally capable of guiding and caring for a party anywhere in the forests or on the waters of the State. Fee $5.00 annually. (See R. S. 1930, Chap. 38, Sec. 16). Class “B” Guide: Any person who qualifies ac­ cording to standards set up by the Commissioner. Fee $4.00 annually. (See R. S. 1930, Chap. 38, Sec. 16). A “Non-Resident” may also secure a guide’s li­ cense. Fee $40.00 annually. (See R. S. 1930, Chap. 38, Sec. 16). Promotion, demotion, suspension. Whenever a reg­ istered guide is charged with having violated any of the Inland Fish and Game Laws, the Commissioner may suspend or revoke his certificate of registration and for any cause whatsoever the Commissioner may, at his discretion, promote or demote a registered guide from one class to another. (See R. S. 1930, Chap. 38, Sec. 16).

Practice Conservation! Simply because a bag limit is set by law is no reason for taking that limit if you have no personal use for it.

*The Daily Bag Limit is 25 fish, providing total weight is not more than 10 pounds of fish taken from lakes and ponds and 7% pounds for fish taken from rivers, brooks and streams unless the last fish caught increases the combined weight thereof to more than the weight limit in which case the last fish may be kept. A person shall not have in his possession at any time more fish than he may lawfully take in one day. (Refer to county rules and regulations for special provisions). Provided however, that a person who has fished in two or more counties, may have in his possession, at any one time, the maximum number or weight of fish permitted in the county where the larger number or amount is allowed under the rules and regulations of the respective counties. (See R. S. 1930, Chap. 38, Sec. 22). RULES AND REGULATIONS BY COUNTIES

Special Fishing Laws Fishing waters are subject to annual changes. Familiarize yourself with the current regulations. The waters listed herein are those on which there are special regulations, all waters not listed herein are open to fishing under the general law. In all cases wherein the daily bag limit differs from the general law the limit of fish which may be legally taken by any one person in any one day is stated herein either in numbers of fish or pounds. Where any variance occurs between the General Laws and the following regulations this summary supersedes by reason- of the special powers of the Commissioner. “ Closed” means closed to all fishing. All dates are inclusive. All of the following rules and regulations have the force and effect of law.

ANDROSCOGGIN COUNTY The season opens in Androscoggin County on April 1st. Trout less than 8 inches cannot be taken from any lake or pond. Smelts, the taking of is prohibited. \ j Auburn T ake. Beginning at the post set in the ground on the shore of Uake Auburn about 2500 feet westerly from the Auburn Water District intake; thence northerly about 300 feet to a point (buoy) ; thence northeasterly about 2400 feet to a point (buoy) about 3300 feet northerly from the intake of the Auburn Water D istrict; thence easterly about 2500 feet to a point (buoy) ; thence southerly about 3000 feet to a post on the shore of and on the line between the Lake Grove lot and the Morrell farm, so-called; thence westerly by the shore of Lake Auburn to the point of beginning; containing 340 acres more or less, is closed to all Ashing.

(20) Moose Hill Pond, Bast Livermore. Is open to white perch fish­ ing only. Pleasant Pond, Turner. South of row of stakes situated ap­ proximately 5 rods north o f the outlet is open to white perch fish­ ing only. Thompson Pond, Poland, (also situated in Cumberland and Oxford Counties). A daily bag limit of 4 fish in the aggregate of trout, togue and salmon per person. ^/Townsend Brook, (tributary to Lake Auburn). From the bridge on the discontinued road running from the Waterman road to Dillingham Hill, downstream, to two red posts set at the mouth of the brook is closed to all fishing.

AROOSTOOK COUNTY

The season opens in Aroostook County on May 1st. Trout less than 8 inches cannot be taken from any lake or pond. t/Allagrash River Tributaries. Only fly fishing for salmon and trout is permitted from August 15th to September 30th. (General law governs from time season is open until August l5 th ). ' / Chiputneticook Chain of Lakes. Open under the general law. Thoroughfares connecting the different lakes are open to fly fishing only from May 19th to September 15th. It is unlawful to fish within 25 yards of the lower end of any fishway. The daily bag limit is 20 fish or 10 pounds providing the 20 fish do not weigh over 10 pounds or the 10 pounds do not exceed 20 fish. Gill nets for the taking of white fish in Grand Lake may be used during the month of November. The length of each net shall not exceed 90 feet and the mesh thereof shall not exceed 2% inches extension. Nets must be marked by a tag or float attached thereto with the full name and address of the owner and position of each net shall be marked by a surface buoy. Nets shall be placed not less than 100 yards apart. Nets shall not be set or fished within y2 mile above the dam at Forest City. v Cross Lake Thoroughfares, are closed from September 30th un­ til May 1st. Between Cross and Mud Lakes from Highway Bridge down to dam at Cross Lake the season closes July 1st. ( / Dickey Brook, Fort Kent, St. Agatha and T. 17, R. 5, and tributaries. Closed. " \/ Eastern Grand Lake. Gill nets of not larger than 1>4 inch mesh may be used in the taking of white fish during November.

( 2 1 ) F ish R iver, T. 14, R. 8. From red posts set on either bank at the head of Falls to similar red posts set on either bank at a point 500 feet below the foot of said falls is closed after June 15 th. Gilmore Brook, (tributary to Eagle Lake and Fish River Thor­ oughfare). Closed. Hot Brook Lake. Gill nets of not larger than 114 inch mesh may be used in the taking of white fish during November. Closed to the taking of fish except by rod and line. V Chiputneticook Chain of Lakes. Fishing under the general law from the—tigie the ice goes out until September 30th. Pro­ vided, however that © the Thoroughfares connecting the differ­ ent lakes are open to fly fishing only- from May 19th to September 15th. It is unlawful to fish within 25 yards of the lower end of any fishway. The daily bag limit is 20 fish or 10 pounds provid­ ing the 20 fish do not weigh over 10 pounds or the 10 pounds do not exceed 20 fish. Gill nets for the taking of white fish in Grand Lake may be used during the month of November. The length of each net shall not exceed 90 feet and the mesh thereof shall not exceed 2% inches extension. Nets must be marked by a tag or float attached thereto with the full name and address of the owner and position of each net shall be marked by a surface buoy. Nets shall be placed not less than 100 yards apart. Nets shall not be set or fished within % mile above the dam at Forest City.
