HERTFORDSHIRE COUNTY COUNCIL ( RURAL FOOTPATHS 14, 15 & 16) DIVERSION ORDER 2019

On 30th June 2020, Hertfordshire County Council confirmed the above Order made under section 119 of the Highways Act 1980.

The effect of the Order as confirmed is to divert: • The full width of that part of Tring Rural Footpath 14 commencing at SP 8929 1787 (Point M on Part 1 of the Order Plan) running in a generally SE direction for approx 625m to SP 8962 1735 (Point N on Part 1 of the Order Plan) to a line running from a distance of 2m away from the top of the bank commencing from its junction with Tring Rural Footpath 11 at SP 8930 1773 (Point O on Part 1 of the Order Plan) and running in a generally SE direction along the NE side of the field boundary for 505m to join Tring Rural Footpath 14 at SP 8962 1735 (Point N on Part 1 of the Order Plan)

• The full width of that part of Tring Rural Footpath 14 commencing at SP 8959 1675 (Point S on Part 2 of the Order Plan) running in a S direction for 110m to SP 8959 1664 (Point Q on Part 2 of the Order Plan) and the full width of that part of Tring Rural Footpath 15 commencing at SP 8930 1702 (Point P on Part 2 of the Order Plan) running in a generally SE direction for 485m to SP 8959 1664 (Point Q on Part 2 of the Order Plan) to a line commencing from SP 8930 1702 (Point P on Part 2 of the Order Plan) and running in an ENE direction for 30m to SP 8933 1704 (Point U on Part 2 of the Order Plan) then running SE along the NE side of the boundary at a distance of 2m away from the top of the bank for approx 185m to SP 8945 1691 (Point T on Part 2 of the Order Plan), continuing over the farm track where it crosses to the S side of the boundary and continues in a SE direction 2m away from the root of the hedge for 210m to a junction with Tring Rural Footpath 14 at SP 8959 1675 (Point S on Part 2 of the Order Plan). Continuing in a SE direction 2.5m from the root of the hedge for approx 75m to a woodland plantation at SP 8964 1669 (Point R on Part 2 of the Order Plan) then running SW 2m out from the NW side of the boundary for approx 75m to SP 8959 1664 (Point Q on Part 2 of the Order Plan).

• The full width of that part of Tring Rural Footpath 16 commencing at SP 8978 1626 (Point V on Part 3 of the Order Plan) and running in a generally SW direction for approx 220m to SP 8961 1611 (Point W on Part 3 of the Order Plan) to a line commencing at SP 8965 1646 (Point Y on Part 3 of the Order Plan) and running in a WSW direction at a distance of 2m away from the top of the bank along the SE side of the boundary for approx 235m to SP 8945 1635 (Point X on Part 3 of the Order Plan) then running SE at a distance of 3m away from the root of the hedge on the NE side of the boundary for 290m to join Tring Rural Footpath 16 at SP 8961 1611 (Point W on Part 3 of the Order Plan) as shown on the Order Plan.

The Order comes into force as from 9th September 2020, but if any person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the grounds that it is not within the powers of the Highways Act 1980, as amended, or on the grounds that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 9th September 2020, make an application to the High Court.

Hertfordshire County Council (Tring Rural Footpaths 14, 15 & 16) Diversion Order 2019

This Order is made by Hertfordshire County Council ("the authority") under section 119 of the Highways Act 1980 ("the 1980 Act") because it appears to the authority that in the interests of the owner of the land crossed by the footpaths described in paragraph 1 of this Order it is expedient that the line of the path should be diverted. Michael & Julie Gaymer of Mentmore Park Farm have agreed to defray any compensation which becomes payable in consequence of the coming into force of this Order and any expenses which are incurred in bringing the new site of the paths into a fit condition for use by the public. Dacorum Borough Council has been consulted as required by section 120(2) of the 1980 Act

BY THIS ORDER: 1. The public rights of way over land situated at Long Marston and shown by a bold continuous line on the plan contained in this Order ("the Order Plan") and described in Part 1 of the Schedule to this Order shall be stopped up on the date on which the authority certifies that the public footpaths described in paragraph 2 below are in a fit condition for use by the public such date not being earlier that 90 days from the date of confirmation of this Order.

2. There shall at the end of 90 days from the date of confirmation of this Order be public footpaths over the land situate at Long Marston as described in Part 2 of the Schedule and shown by a bold broken line on the Order Plan.

4. The rights conferred on the public under this Order shall be subject to the limitations and conditions set out in Part3 of the Schedule.

A public footpath running at a distance of 2 metres away from the top of the bank commencing from its junction with Tring Rural Footpath 11 at SP 8930 1773 (Point O on Part 1 of the Order Plan) and running in a generally south easterly direction along the north eastern side of the field boundary for 505 metres to join Tring Rural Footpath 14 at SP 8962 1735 (Point Non Part1 of the Order Plan)

Width: 2 metres A public footpath commencing from SP 8930 1702 (Point P on Part 2 of the Order Plan) and running in an east north easterly direction for 30 metres to SP 8933 1704 (Point U on Part 2 of the Order Plan) then running south easterly along the north east side of the boundary at a distance of 2 metres away from the top of the bank for approximately 185 metres to SP 8945 1691 (Point T on Part 2 of the Order Plan), continuing over the farm track where it crosses to the southern side of the boundary and continues in a south easterly direction 2 metres away from the root of the hedge for 21 O metres to a junction with Tring Rural Footpath 14 at SP 8959 1675 (Point S on Part 2 of the Order Plan). A public footpath commencing at SP 8965 1646 (Point Yon Part 3 of the Order Plan) and running in a west south westerly direction at a distance of 2 metres away from the top of the bank along the south east side of the boundary for approximately 235 metres to SP 8945 1635 (Point X on Part 3 of the Order Plan) then running south easterly at a distance of 3 metres away from the root of the hedge on the north east side of the boundary for 290 metres to join Tring Rural Footpath 16 at SP 8961 1611 (Point Won Part 3 of the Order Plan) Width: 2 metres
