October 27, 2020 Page 1 of 25 B 3 - CW Action Committee of the Whole Meeting Date: October 27, 2020 Submitted by: Chris Traini, County Engineer SUBJECT: SPEED LIMIT BYLAW UPDATE BACKGROUND: County staff review speed limits on County roads from time to time based on changes to the roadside environment due to development, changes in the alignment of the road resulting from reconstruction, or by citizen or municipal request. ANALYSIS: It is important to remember that changing the posted speed limit in areas where it is not warranted can create lower compliance with drivers and actually decrease the safety of travellers in the area due to a larger discrepancy of vehicle speeds. Village of Denfield, County Road 20 (Denfield Road) A number of homes have been constructed on both sides of Denfield Road south of the Village of Denfield between 15 Mile and 16 Mile Roads. It is appropriate to reduce the speed limit from 70 km/hr to 60 km/hr at this time due to the development in the area. Village of Bryanston, County Road 23 (Highbury Avenue North) A request was received to reduce the speed limit on Highbury Avenue North to 60 km/hr from Ilderton Road to the Village of Bryanston. Due to the lack of any roadside development along this stretch of road a reduction in the speed limit is likely to have little effect on driver behaviour. The 60 km/hr zone at the south limit of Bryanston is at an appropriate location and gives ample time for drivers to slow when entering the built- up area. October 27, 2020 Page 2 of 25 B 3 - CW Action Village of Newbury, County Road 1 (Hagerty Road) Concern was raised by a resident north of the Village of Newbury that traffic had been speeding and passing dangerously while they were turning into their driveway. While this may be occurring a reduction in the speed limit is not recommended as it is expected to have no effect on this type of driver behaviour. Boundary Adjustments: A number of settlement areas have grown over time and it is appropriate for an adjustment to the 50 km/hr speed limit zones in the following areas: County Road 22 (Egremont Drive) – east and west limit of Lobo County Road 29 (Hamilton Road) – west limit of Dorchester County Road 30 (Putnam Road) – south limit of Crampton County Road 73 (Elgin Road) – south limit of Mossley RECOMMENDATION: That the revised by-law designating prescribed rates of speed on County Roads No. 1 to 81 inclusive be approved. Attachment October 27, 2020 Page 3 of 25 B 3 - CW Action THE CORPORATION OF THE COUNTY OF MIDDLESEX BY-LAW # A By-law Designating Prescribed Rates of Speed on County Roads No. 1 to 81 Inclusive. WHEREAS Subsection (2) and (3) of Section 128 of the Highway Traffic Act (S.O., Chapter H.8), as amended provides that the Council of a municipality and the trustees of a police village may by by-law, for vehicles driven on a highway or portion of a highway under its jurisdiction, prescribe a rate of speed of 40, 50, 60, 70, 80, 90 or 100 kilometres per hour. AND WHEREAS it is deemed expedient that the speed limit of motor vehicles on certain highways in the Municipality of the County of Middlesex be decreased or increased; WHEREAS section 5(3) of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides that a municipal power shall be exercised by by-law; AND WHERAS section 9 of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHERAS section 10 of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides that a municipality may pass by-laws respecting any service or thing that the municipality considers necessary or desirable for the public; NOW THEREFORE the Council of the Corporation of the County of Middlesex enacts as follows: 1. When any highway or portion of highway set out in Schedule ‘A’ appended hereto is marked in compliance with the Regulations in the Highway Traffic Act, the maximum rate of speed thereon shall be the rate of speed prescribed in the Schedule. 2. The penalties provided in Subsections (14) and (15) of Section 128 of the Highway Traffic Act as amended, shall apply to offences against this By-Law. 3. That By-Law #7018 is hereby repealed. 4. This By-Law shall become effective on the day it is finally passed.
