(b) Recreation & Parks Commission June 18, 2009 Recommendations: THAT the Town consider a bylaw for new construction involving gravel driveways to have a hard surface buffer where it meets the road to minimize loose gravel on the shoulders for the safety of bicyclists. CORRESPONDENCE

(1) Correspondence Log - June 15, 2009. Council confirmed staff will provide a recommendation on the Cease-Fire Community Education Program at the next Council meeting.

(2) Trisha Grecht, BMX Society (15 Apr 09) requesting Town approval and assistance for improvements to the BMX facility. Councillor Brouilette MOVED and Councillor Avis SECONDED, THAT Council instructs staff to work cooperatively with the BMX Society to discuss options for improvements; AND FURTHER THAT the matter be referred to budget deliberations in the Fall of 2009. (3) Terry Dyer, Bike for Your Life Island Society (1 Mar 09) Councillor Avis MOVED and Councillor Becker SECONDED, THAT Council grants permission for the Bike For Your Life Event on Sunday, August 9, 2009 subject to the applicant working with Town staff to finalize street use; AND FURTHER authorizes Town placement of signage. CARRIED

(4) St. Mark's Anglican Church, requesting permission to have temporary road closures of Veteran's Way and Berwick from 6:00 a.m. - 4:00 p.m. on Saturday, July 25, 2009. Councillor Avis MOVED and Councillor Becker SECONDED, THAT Council instructs staff to proceed with the temporary road closures of Veteran's Way and Berwick from 6:00 a. m. until 4:00 p.m on Saturday, July 25, 2009 for the annual St Mark's Fair; AND FURTHER authorizes Town placement of barricades and subject to the applicant working with Town staff to ensure Town requirements are met, including emergency notifications. CARRIED

(5) Gary Hopkins, Gary's Bistro & Seaside Cruizers, (14 May 09) requesting permission to hold a Street Dance Saturday, June 20, 2009 as part of the Fathers' Day Show weekend. Councilor Avis MOVED and Councillor Brouilette SECONDED, THAT Council instructs staff to proceed with the temporary road closures of Second Avenue West from Beach Road down to Memorial Avenue from 6:00 p.m. to 11:00 p.m. on Saturday, June 20, 2009; AND FURTHER THAT Council authorizes staff to place barricades and subject to the applicant working with Town staff to ensure Town requirements are met, including emergency services notification, traffic control, insurance, security, washrooms, and litter, and confirmation of other conflicting special events and consideration of ways to minimize noise for neighbours and subject to no alcohol being served outdoors. Arrowsmith Biosphere Reserve advising that Councillor Kent Becker will act as the Town's liaison to the Mt. Arrowsmith Biosphere Reserve during his current term on Council. CARRIED

(7) Dee Aguilar, Artisans in Qualicum Beach Market, (4 June 09) requesting that the Artisans Market operate from 3:30 p.m. - 9:00 p.m. beginning on June 30, 2009 and expiring September 4, 2009. Councillor Brouilette MOVED and Councillor Becker SECONDED, THAT Council instructs staff to amend the Artisans in Qualicum Beach Market hours of occupancy as stated in the Licence of Occupation between the Town of Qualicum Beach and the Artisans of Qualicum Beach dated May 27, 2009, to 3:30 p.m. to 9:00 p.m. for the period June 30 to September 4, 2009. (5) Parks & Recreation (Councillor Jack Wilson) Councillor Wilson reported on the following: (a) Recreation and Parks Commission May 7, 2009 Recommendations Councillor Wilson MOVED and Councillor Avis SECONDED, THAT Council instructs staff to install a temporary concrete/wood bench in the Civic Centre off-leash dog park located at the Community Park; AND FURTHER THAT the public be offered the option to purchase a memorial bench to be located in the Park in the future. (i) Community Adjustment Fund Councilor Wilson MOVED and Councillor Brouilette SECONDED, THAT Council directs staff to apply for funding from the Community Adjustment Fund for the Berwick Rail Crossing Connector; AND FURTHER THAT Council directs staff to apply for funding from the Community Adjustment Fund for the Qualicum Beach Roundabout. (j) Development Variance Permit - Museum - Final Consideration The Mayor called for comments from the public; no one indicated they wished to address Council. Councillor Avis MOVED and Councillor Wilson SECONDED, THAT Council directs staff to issue a development variance permit for 587 Beach Road as attached to the report to the June 15, 2009 Council meeting. CARRIED

(k) Alphabet Walk Councillor Wilson MOVED and Mayor Westbroek SECONDED, THAT Council waives the requirement for a development permit in connection with those 'Alphabet Walk' benches proposed to be located on private property within the Town's Official Community Plan Development Permit Areas, as shown on the list attached to the Planning Department's report to the Council meeting of June 15, 2009, provided that the benches are located on a temporary basis for up to 8 months; AND FURTHER THAT Council waives the Town's Bench Policy and approves the location of the 'Alphabet Walk' benches on Town-owned property as shown on the list attached to the Planning Department's report to the Council meeting of June 15, 2009, provided that the benches are located on a temporary basis for up to 8 months; AND FURTHER THAT the Town agrees to install benches only on land under the ownership or auspices of the Town; AND FURTHER THAT a licence of occupation be required for benches located on land under the ownership or auspices of the Town. Councillor Wilson MOVED and Councillor Avis SECONDED, THAT the motion on the floor be amended by striking "provided that the benches are located on a temporary basis for up to 8 months" and inserting "provided that the Project shall be reviewed by Council 8 months after the first installation of benches". Council reminded the community to apply to the "Colour Us Green" Communities in Bloom contest. Council requested staff provide information at the next Council meeting on options to install an outdoor shower at the Beach public washrooms. The Corporate Administrator introduced Melanie Zerrer, an intern from Kehl University in Germany who is completing a two- month work experience at the Town of Qualicum Beach.

SUBJECT: Cease Fire Prevention Program - "Safe Senior" Program

RECOMMENDATION THAT the Town of Qualicum Beach supports the value of fire education and awareness; AND FURTHER THAT the Town supports the concept of Community Education Programs being proposed by Cease-Fire; AND FURTHER THAT written approval is required from the Town's CAO prior to any member of Cease-Fire using the Town logo and/or indicating the Town's support for the program on news releases, announcements or any other forms of communication.

BACKGROUND Correspondence was received from Nancy Marshall, President of Cease-Fire: Community Education Programs, requesting a letter of support for the "Safer Seniors" Program aimed at senior citizens in the Oceanside area. The correspondence was circulated to Council and staff and placed on the Town's correspondence log with a referral to staff for comment. The correspondence received from Nancy Marshall states in part: "We would be honoured Mayor Westbroek if you would provide us with a letter of support indicating the value of fire education and awareness, while expressing your support of this valuable communit initiative."

REPORT ANALYSIS On June 18, 2009 a presentation was made to the executive of the Qualicum Beach Fire Department by Nancy Marshall, President of Cease-Fire Community Education Programs ("Cease-Fire"). The fire department officers found the presentation informative and support the concept Cease-Fire has put forth for their "Safe Senior" program. Fire prevention programs that increase the safety of the community are very important and the fire department recognized the significant effort in the development of the program.

As a fire service, the Town supports fire prevention programs that adhere to the recognized and regulated fire service standards throughout and North America, and strive to meet these standards within our own prevention programs within the Qualicum Beach Fire Department. These regulations could be from the Fire Commissioner's office or the Justice Institute of B.C. TQB 2009 Paint July 13, 2009 Regular Council Meeting Page 2 of 2

The officers and department were in favour of the concept of Cease-Fire; however, it is the practice of the Qualicum Beach Fire Department to not support programs or endorse organizations outside the fire service.

Correspondence from Cease-Fire included the following paragraph:

"Your organization will be recognized as a sponsor of this Program. Your organization's logo will be used wherever possible on printed supporting materials. Your organization's support will also be noted in news releases and announcements about the success stories that occur as a result of this program."

Staff has concerns with the use of the Town's logo and the potential use of the Town's support on news releases and announcements about the program. This concern is as a result of the Town not having any control over Cease-Fire and the fact that Cease-Fire is not regulated, for example by the Fire Commissioner's office or the Justice Institute of B.C. In addition, Cease-Fire: Community Education Programs is listed as a dealer/agent for a product called Stove Guard, through Stove Guard International Ltd. This arrangement with Stove Guard was not conveyed to the Town; however, it could indicate a business/profit component related to Cease-Fire. The issue is not whether the Stove Guard product is appropriate; but rather, should the Town be providing support to private sector products. As best Town staff can recall, the Town has not given unconditional support to any private business and/or product in the past.

PURPOSE To present to Council a report on amending the sprinkling regulation bylaw to use alternate days (odd and even) from 6 a.m. to 10 a.m. and 6 p.m. to 10 p.m.

BACKGROUND At the April 20, 2009 Regular Meeting Council adopted Town of Qualicum Beach Waterworks Rate and Regulation Bylaw 532.01, 1994, Amendment (Water Conservation/Watering Restrictions) Bylaw No. 532.08, 2009. This bylaw permits sprinkling for the period May 15th through September 15th between the hours of 7PM and 7AM daily.

At the June 24, 2009 Special Meeting of Council, the following motion was ratified: THAT staff consider Council amending the sprinkling regulation bylaw to use alternate days (odd and even) from 6 a.m. to 10 a.m. and 6 p.m. to 10 p.m.; AND FURTHER provide a report on why that would not work.

OVERVIEW The objectives of the newly adopted Bylaw regulations were to promote water conservation by minimizing the water lost to evaporation, and to eliminate the concentrated stress on the water system of having peak indoor and outdoor water use occurring at the same time.

The first objective of minimizing evaporative loss was addressed by prohibiting sprinkling during strong sunlight hours. The changes requested for consideration would reintroduce 4 hours of sprinkling during strong sunlight hours. The motivation of the Council request is understood to be for the added convenience of the residents. It has the consequence of compromising the intent of trying to minimize evaporative loss. Water Works Regulation Review July 13, 2009 Council Meeting Page 2 of 2 The Town's water supply is sufficient to meet the current maximum daily demands, which is to say the wells are capable of producing in a day all the water that the residents want to use. However the peak hour demand is very much a function of the timing of the sprinkling regulations and the degree to which they superimpose sprinkling demand on the regular domestic demand. Peak hour demand exceeds the well production capacity and must rely on the balancing storage of the reservoirs to supply the extra water. The motivation to amend the sprinkling regulation arose from the difficulty being experienced in maintaining sufficient water in the balancing reservoirs to provide emergency or fire fighting storage in reserve while trying to supply the instantaneous domestic and sprinkling demand.

The peak domestic demand occurs between about 6:00 a.m. and 8:00 a.m. with a secondary peak around the dinner hour. The changes requested for consideration reinstate the overlap of domestic and sprinkling demands that it was the original intention of the Bylaw revision to eliminate. Once the new Berwick reservoir is constructed there will be additional storage capacity that could allow for some overlap of sprinkling demand within the periods of peak domestic demand.

Watering of lawns and gardens is restricted by the bylaw for the period of May 15th to September 15th from 7PM to 7AM and it is recommended that this period be maintained and evaluated after the program has been in place for a season. The proposed amendment to use alternate days is at the discretion of Council, but it is seen as being an inconvenience to residents and may not actually achieve substantial water use reductions.

SUMMARY/CONCLUSIONS The Town of Qualicum Beach has reduced the average and peak per capita consumption of water by half in the last three decades through the implementation of a variety of demand management strategies. The continuation of this strategy by Council is encouraged and maintaining the current sprinkling times of Town of Qualicum Beach Waterworks Rate and Regulation Bylaw 532.01, 1994, Amendment (Water Conservation/Watering Restrictions) Bylaw No. 532.08, 2009 is recommended in the interest of conserving water by reducing water loss from evaporation and to achieve the additional benefit of reducing the overlap of domestic and lawn and garden water demands.

The Council of the Town of Qualicum Beach, in open meeting lawfully assembled hereby enacts the following: 1. "Town of Qualicum Beach Waterworks Rate and Regulation Bylaw No. 532.01, 1994" is hereby amended by deleting paragraph number 25 and substituting it with the following:

"25. Watering of lawns and gardens shall be restricted to the hours during which evaporation rates are lower, and therefore watering of lawns and gardens within the Town of Qualicum Beach during the period May 15 through September 15, of each year, is only permitted between the hours of 7:00 p.m. and 7:00 a.m. daily. Notwithstanding section 22 of this bylaw, all other residential uses (e.g. car washing, etc.) no restrictions apply.

2. This Bylaw may be cited for all purposes as the "Town of Qualicum Beach Waterworks Rate and Regulation Bylaw No. 532.01, 1994, Amendment (Water Conservation/Watering Restrictions) Bylaw No. 532.08, 2009".

A BYLAW TO AMEND THE APPORTIONMENT DATE OF THE NORTHERN COMMUNITY SEWER LOCAL SERVICE AREA

WHEREAS the Regional District of Nanaimo Board established the Northern Community Sewer Service pursuant to "Regional District of Nanaimo Northern Community Sewer Local Service Conversion Bylaw No. 888, 1993", as amended;

AND WHEREAS the Board wishes to amend the method of apportioning costs by changing the calculation period so that, rather than following the calendar year, it runs from October 1 to September 30 th to better harmonize with the budget preparation process;

AND WHEREAS at least two thirds of the service participants have consented to the adoption of this bylaw in accordance with section 802 (2) of the Local Government Act;

NOW THEREFORE the Regional District of Nanaimo Board, in open meeting assembled, enacts as follows:

1. Bylaw No. 889 is hereby amended by deleting Section 5 (c) (iii) and replacing it with the following:

(iii) Annual service costs shall be apportioned amongst the benefitting areas based on percent use, which shall be measured as a function of sewage flow to be calculated as follows:

• the annual sewage flow for each benefiting area shall be the average of the preceding three years, where each year starts October i g and ends September 30th.

• the annual sewage flow for each benefiting area shall be used to calculate the overall sewage flow for the service and the percent use for each benefiting area.

2. This Bylaw may be cited as "Northern Community Sewer Local Service Apportionment Amendment Bylaw No. 889,51.2009".

"Safish Sea" proposal

We request your comments to help us gauge public support for a proposal to adopt the name "Salish Sea." A map and information about the proposal Is included to assist you in making comments.

The proponent describes this entity as an estuarine inland sea that is distinct from the Pacific Ocean to the west of Juan de Fuca Strait (Canada)/Strait of Juan de Fuca (USA) and the marine waters north of Strait of Georgia: salinity, tidal patterns and climate create habitat conditions that support plant, animal & marine species unique or limited to the inland sea area —an integral ecological unit that should have its own distinct name. Further, the proponent maintains that the name "Salish Sea" is becoming established in the region, and cites the Tribes and who meet in the annual Gathering, the participants at the Georgia Basin Puget Sound Research Conferences (co-hosted by Environment Canada and Puget Sound Action Committee) and assorted community groups throughout the region, as important populations that routinely use the name "Salish Sea".

The proponent also identifies improved ecosystem management as a compelling reason to adopt the name "Salish Sea," however, it is important to note that adoption of this or any name does not imply protection, or obligate agencies to manage the entity being named. The single outward evidence of adoption of this name might be the addition of a label on maps, charts & atlases produced by provincial, state and federal governments.

018 01 09/04 INTENT OF THE OLYMPIC TORCH RELAY COMMUNITY GRANT PROGRAM The Vancouver 2010 Olympic Torch Relay will start in Victoria, British Columbia on October 30, 2009 and is a 105 day celebration of peace and friendship. This 45,000 kilometre journey across Canada will be the longest single-country relay in Olympic history and will include nearly 200 community celebrations. The Olympic Flame will visit over 1,000 communities and places of interest representing over 90 per cent of the population.

The Vancouver 2010 Olympic Torch Relay is a journey that celebrates and shines a light on the people, places and achievements that make us truly Canadian. It is an opportunity to direct the spotlight on B.C.'s cultural and historical heritage. Communities are urged to show their pride and showcase the best that they have to offer.

Communities in B.C. may receive funding to create a truly celebratory event on the day of the arrival of the official 2010 Olympic Torch. This funding is available for designated Olympic Torch Relay communities only and is available for celebrations associated with community torch stops during the Torch Relay period from October 30, 2009 through February 12, 2010.

The funding can not be used for staffing costs or salaries or infrastructure. For information on appropriate use of funding please see the attached Guidelines and Conditions.

EVENT PROPOSAL Communities may receive a Grant to create an event before, during and after the arrival of the 2010 Olympic Torch based on the following priorities: 1. Create meaningful community celebrations during the official Torch Relay arrival, with a focus on showcasing the best the community has to offer. Examples include: local entertainment, performance fees and travel, costuming, audio/visual requirements. For Celebration Communities, 2/3 or more of the provincial contribution should be used for this purpose. If anticipated costs total less than 2/3, the balance may be applied to priority #2. 2. Create meaningful ancillary community celebrations before and/or after the official arrival of the Torch Relay. Examples include: promotional items, give-aways, food, entertainment. For Route Communities, 2/3 or more of the provincial contribution should be used for this purpose. 3. Ensure that appropriate logistical elements are in place to stage a community event. No more than 1/3 of the provincial contribution should be used for this purpose. Examples include: fencing costs; traffic planning; parking; non-promotional signage; permits or licensing relating to the arrival and departure of the Torch Relay; road work or snow removal; medical support; facility booking costs; waste management costs: tents.
