    WEST BANK AND GAZA 2020 HUMAN RIGHTS REPORT EXECUTIVE SUMMARY The Palestinian Authority basic law provides for an elected president and legislative council. There have been no national elections in the West Bank and Gaza since 2006. President Mahmoud Abbas has remained in office despite the expiration of his four-year term in 2009. The Palestinian Legislative Council has not functioned since 2007, and in 2018 the Palestinian Authority dissolved the Constitutional Court. In September 2019 and again in September, President Abbas called for the Palestinian Authority to organize elections for the Palestinian Legislative Council within six months, but elections had not taken place as of the end of the year. The Palestinian Authority head of government is Prime Minister Mohammad Shtayyeh. President Abbas is also chairman of the Palestine Liberation Organization and general commander of the Fatah movement. Six Palestinian Authority security forces agencies operate in parts of the West Bank. Several are under Palestinian Authority Ministry of Interior operational control and follow the prime minister’s guidance. The Palestinian Civil Police have primary responsibility for civil and community policing. The National Security Force conducts gendarmerie-style security operations in circumstances that exceed the capabilities of the civil police. The Military Intelligence Agency handles intelligence and criminal matters involving Palestinian Authority security forces personnel, including accusations of abuse and corruption. The General Intelligence Service is responsible for external intelligence gathering and operations. The Preventive Security Organization is responsible for internal intelligence gathering and investigations related to internal security cases, including political dissent. The Presidential Guard protects facilities and provides dignitary protection.

    Update on Settler Violence in the West Bank, including East Jerusalem October 2013 This update is issued by the Office of the United Nations High Commissioner for Human Rights (OHCHR) as coordinator of the Protection Cluster in the occupied Palestinian territory. It has been jointly prepared by members of the Protection Cluster Working Group in the West Bank, including JLAC, MDM-France, NRC, OCHA, PU-AMI, UNICEF, UNRWA and Yesh Din, and also draws upon information from FAO and the Food Security Sector. Violence by Israeli settlers against Palestinians and the property in the West Bank, including East Jerusalem, remains a key issue of protection concern for the humanitarian community. This ad hoc update provides an overview of ongoing protection concerns related to settler violence, highlighting in particular the lack of law enforcement and accountability by Israeli authorities. 1. Introduction and legal framework Violence by Israeli settlers against Palestinians and their property is directly linked to the existence and expansion of illegal Israeli settlements in the West Bank, including East Jerusalem. Since 1967, Israel has established an estimated 150 settlements in the West Bank, including East Jerusalem, in addition to some 100 “outposts” erected by settlers in contravention of Israeli law.1 The expansion of settlements continues: during the first three months of 2013, the construction of 865 settlement housing units commenced in the West Bank, excluding East Jerusalem, marking a 355% increase compared to the last quarter of 2012.2 The estimated settler population in the West Bank, including East Jerusalem ranges between 500,000 and 650,000, and has almost tripled in the 20 years since the Oslo accords were signed in 1993.3 The establishment and expansion of Israeli settlements in the West Bank, including East Jerusalem, violate Article 49 of the Fourth Geneva Convention, which prohibits the transfer of parts of the Occupying Power’s own civilian population into territory it occupies.

    HaMoked Annual Activity Report for 2019 During 2019, Israel continued to systematically violate the human rights of Palestinians in the occupied territories (oPt), further entrenching its hold of the West Bank (including East Jerusalem), and maintaining the devastating closure of the Gaza Strip. Within Israel, the political stalemate created an atmosphere of uncertainty, and exacerbated anti-democratic, racist rhetoric from the highest-ranking government officials. Israel’s civic space continued to shrink, as human rights organizations and activists faced an onslaught of rhetorical and physical attacks from ultra- nationalists, often with the facilitation and support of government officials. Attacks against HaMoked primarily targeted our work against collective punishments of Palestinians, and manifested through provocations at our court hearings and efforts to cut-off our funding. Despite this difficult climate, in 2019 HaMoked assisted 5,098 Palestinians to realize their basic rights, with a high overall success rate. We conducted strategic litigation to challenge discriminatory laws and policies, generating precedents with a positive impact for many thousands of rights-holders. Below is an overview of our activities and achievements during the year. Overview of Activities Freedom of Movement Challenging increased restrictions on Palestinian access to the lands trapped behind the Separation Wall This year we witnessed a severe deterioration in Palestinian access to the so-called “Seam Zone” – the West Bank lands trapped between the Green Line and the Separation Wall, and a big increase in demand for HaMoked’s assistance. We assisted 243 Palestinians to contest denials of Seam Zone permits, and challenged new access restrictions as they emerged. We challenged the military’s outrageous assertion that privately-owned plots of land under 330 square meters are “too small to require cultivation”, and therefore do not justify issuing a Seam Zone permit.

    The Arab Bedouin indigenous people of the Negev/Nagab – A Short Background In 1948, on the eve of the establishment of the State of Israel, about 65,000 to 100,000 Arab Bedouin lived in the Negev/Naqab region, currently the southern part of Israel. Following the 1948 war, the state began an ongoing process of eviction of the Arab Bedouin from their dwellings. At the end of the '48 war, only 11,000 Arab Bedouin people remained in the Negev/Naqab, most of the community fled or was expelled to Jordan and Egypt, the Gaza Strip and the Sinai Peninsula. During the early 1950s and until 1966, the State of Israel concentrated the Arab Bedouin people in a under military administration. In this (سياج) ’closed zone known by the name ‘al-Siyāj period, entire villages were displaced from their locations in the western and northern Negev/Naqab and were transferred to the Siyāj area. Under the Planning and Construction Law, legislated in 1965, most of the lands in the Siyāj area were zoned as agricultural land whereby ensuring that any construction of housing would be deemed illegal, including all those houses already built which were subsequently labeled “illegal”. Thus, with a single sweeping political decision, the State of Israel transformed almost the entire Arab Bedouin collective into a population of whereas the Arab Bedouins’ only crime was exercising their basic ,״lawbreakers״ human right for adequate housing. In addition, the state of Israel denies any Arab Bedouin ownership over lands in the Negev/Naqab. It does not recognize the indigenous Arab Bedouin law or any other proof of Bedouin ownership over lands.

    ISRAEL 2019 INTERNATIONAL RELIGIOUS FREEDOM REPORT Executive Summary This section covers Israel, including Jerusalem. In December 2017, the United States recognized Jerusalem as the capital of Israel. It is the position of the United States that the specific boundaries of Israeli sovereignty in Jerusalem are subject to final status negotiations between the parties. The Palestinian Authority (PA) exercises no authority over Jerusalem. In March 2019, the United States recognized Israeli sovereignty over the Golan Heights. A report on the West Bank and Gaza, including areas subject to the jurisdiction of the PA, is appended at the end of this report. The country’s laws and Supreme Court rulings protect the freedoms of conscience, faith, religion, and worship, regardless of an individual’s religious affiliation, and the 1992 “Basic Law: Human Dignity and Liberty” protects additional individual rights. In 2018, the Knesset passed the “Basic Law: Israel – The Nation State of the Jewish People.” According to the government, that “law determines, among other things, that the Land of Israel is the historical homeland of the Jewish people; the State of Israel is the nation state of the Jewish People, in which it realizes its natural, cultural, religious and historical right to self-determination; and exercising the right to national self-determination in the State of Israel is unique to the Jewish People.” The government continued to allow controlled access to religious sites, including the Temple Mount/Haram al-Sharif (the site containing the foundation of the first and second Jewish temple and the Dome of the Rock and al-Aqsa Mosque).
