bsk.com Gold Medal Award Presented by the New York State Bar Association To recognize distinguished service in the law. The Gold Medal is the New York State Bar Association’s highest honor. The Gold Medal is awarded each year to a lawyer “whose qualifications include outstanding legal accomplishments, an active interest in and positive influence upon the profession, and constructive contributions in civic and community matters.” Recipient: Evan A. Davis, Esq. Evan A. Davis is senior counsel at Cleary Gottlieb Steen & Hamilton LLP, based in the New York office. His practice focuses on litigation and other forms of international and domestic dispute resolution. He also provides services as a mediator, arbitrator, expert witness on New York law and moot court judge though Evan A. Davis LLC. He graduated from Columbia Law School in 1969 where he was a Kent Scholar and Editor-in-Chief of the Columbia Law Review. Mr. Davis is a recognized authority on New York law and has argued frequently in the New York Court of Appeals, the State’s highest court. He has also provided expert opinions on matters of professional ethics. He served as President of the Association of the Bar of the City of New York from May 2000 through May 2002, and as Vice Chair of the Trustees of , where he also chaired the Finance Committee. He has been recognized by Benchmark Litigation: the Definitive Guide to America’s Leading Litigation Firms and Attorneys, Who’s Who in the World, Euromoney’s Guide to the World’s Leading Experts in Commercial Arbitration, Law Business Research’s the International Who’s Who of Business Lawyers and Who’s Who of Commercial Litigators, Mondaq’s Guide to the World’s Leading Commercial Arbitration Advisors, the Legal 500 U.S. and the Best Lawyers in America. He was the honoree at the Bar Twelfth Night musical roast in 2010 and at the Episcopal Charities Award Gala in 2014. He was a candidate for the Democratic nomination for Attorney General in 1998. Mr. Davis is a member of the American Law Institute, and the board of Governors of the Franklin and Eleanor Roosevelt Institute in Hyde Park, New York. He served as a Director of the Center for Family Representation and as a Trustee of the Spence School where he headed the Admissions Committee. He is a member of the Advisory Council of New York Common Cause and the Advisory Board of Disability Rights Advocates and a Director of Episcopal Charities. He is a former Warden of Trinity Church Wall Street and is currently a member of the Vestry and its Chancellor. He is also a member of the Vestry at his home church, the Church of the Heavenly Rest. He formerly chaired the American Bar Association’s Standing Committee on Public Education and its Commission on Youth Education for Citizenship. He was a member of the New York State Bar’s Committee on Standards of Attorney Conduct when it proposed a Code of Professional Responsibility for New York. Caplan, former Section member, Executive Committee member and Committee Chair, to recognize exemplary and long- term service to the Business Law Section and its constituent members. Recipient: Frederick G. Attea, Esq. Frederick G. Attea is a corporate lawyer at Phillips Lytle LLP. He concentrates his practice on mergers and acquisitions, securities laws, corporate governance and legal compliance programs. He has been a member of the New York State Bar since 1965 and has served as a member of the House of Delegates, Chair of the Business Law Section, Chair of the Corporation Law Committee, and is currently Chair of the recently organized Not-For-Profit Corporation Committee. Stanley H. Fuld Award Presented by the Commercial and Federal Litigation Section Presented to a member of the legal profession who has significantly contributed to the practice of commercial law and litigation in New York. The award was created by the Commercial and Federal Litigation Section in honor of the late Chief Judge of the New York Court of Appeals, Stanley H. Fuld, to recognize outstanding contributions to the development of commercial law and jurisprudence in New York State. Recipient: Honorable Sheila Abdus-Salaam Sheila Abdus-Salaam, Associate Judge of the Court of Appeals, was born in Washington, D.C. in 1952 and educated in its public schools. She graduated from Barnard College in 1974 and received her J.D. from Columbia Law School in 1977. She began her legal career as a staff attorney at East Brooklyn Legal Services Corporation A, served as an Assistant Attorney General in the New York State Department of Law, Civil Rights and Real Estate Financing Bureaus, and served as General Counsel for the New York City Office of Labor Services. She began her judicial career in 1992, having been elected in 1991 to the Civil Court of the City of New York. In 1993, she was elected to the Supreme Court, New York County, and re-elected in 2007. She was appointed an Associate Justice of the Appellate Division, First Department in March 2009 by Governor David A. Patterson. Her appointment to the Court of Appeals by Governor Andrew M. Cuomo was confirmed by the State Senate on May 6, 2013.

New York State Bar Association Award for Attorney Professionalism Presented by the Committee on Attorney Professionalism Honors an attorney for outstanding professionalism, which is defined as dedication to service to clients and a commitment to promoting respect for the legal system in pursuit of justice and the public good, characterized by exemplary ethical conduct, competence, good judgment, integrity and civility. Recipient: Norman J. Resnicow, Esq. Raised in the New York City metropolitan area, Norman J. Resnicow did his undergraduate and law studies at Yale, then entered private practice in the City in 1972, where he is currently a partner with Fox Horan & Camerini. From the beginning Norm focused on cross-border business transactions, at that time considered a relatively new and esoteric practice area. He enjoyed ongoing active participation in bar committees, professional and university panels, and charitable organizations, in particular the international refugee rescue and resettlement agency HIAS (Hebrew Immigrant Aid Society). Norm derived special satisfaction from mentoring young lawyers.

8 | The New York Bar Foundation Haywood Burns Memorial Award Presented by the Committee on Civil Rights Given to honor the late civil rights lawyer and academic, Dean Haywood Burns, who, from the age of 15 until his untimely death at age 55 while visiting South Africa, was active in seeking to expand the civil rights of all people. He was a builder of bridges rather than walls, actively involved in trying to extend connections to diverse groups within the community as a whole. Recipient: Vincent Warren, Esq. Diversity Trailblazer Award Presented by the Committee on Diversity and Inclusion Created to honor individuals who demonstrate a strong commitment to help enhance diversity in the legal profession. Recipient: Christopher S. Auguste, Esq. Christopher S. Auguste counsels and represents clients in the private placement and public offering of debt and equity securities. He counsels private investment funds and funds of funds in connection with their structure and formation, and represents institutions and issuers in structured financings. Mr. Auguste is chair of Kramer Levin’s Diversity Committee and currently serves on the board of Goddard Riverside Community Center and YouthBridge-NY. Recipient: Dolores Gebhardt, Esq. Dolores Gebhardt, Esq. is a partner at McCarthy Fingar LLP in White Plains. Her practice is concentrated in matrimonial and family law, collaborative divorce, and civil appeals. She is a member of the New York State Bar Association’s Committee on Courts of Appellate Jurisdiction, where she has served as Westchester Chair of its biennial Appellate Practice CLE since 2011. Dolores serves the Women’s Bar Association of the State of New York as co-chair of its Matrimonial Law Committee. Dolores is a past president of the Westchester Women’s Bar Association (WWBA). She currently serves on its Executive Board and is a co-chair of its Matrimonial Law and Holiday Party Committees. Previously, she served as WWBA Vice President, Treasurer, co-chair of the Annual Dinner, and was a member of the Judicial Screening Committee. She was WWBA Programs co-chair from 2003-2010 and 2011-2013, and remains “Programs Chair Emeritus.” Dolores is a member of the Board of Directors of the Westchester County Bar Association. Recipient: Dean Patricia E. Salkin Patricia E. Salkin is the Dean of Touro College Jacob D. Fuchsberg Law Center and Interim Provost of the Touro College Graduate and Professional Divisions. Active in the leadership of the New York State Bar Association, the American Bar Association and the American Association of Law Schools, she lends an important voice to legal education reform as well as to cutting edge and complex issues facing the legal profession. Dean Salkin has consistently worked to advance the status of women in the legal profession through her scholarship (e.g., an edited book on Women Trailblazers in the Law published by the ABA), her service (e.g., as a liaison to the ABA Commission on Women in the Law) and in her community (e.g., most recently through the establishment of the country’s first “Justice Patch Program” with the Girl Scouts of Suffolk County). A nationally recognized authority on land use and zoning law, Salkin is a graduate of the University at Albany and Albany Law School where she served for more than two decades including as Associate Dean, Director of the Government Law Center and the Raymond & Ella Smith Distinguished Professor of Law. Crimi Memorial Award Presented by the Criminal Justice Section Recognizes the professional career of a defense attorney in private practice that embodies the highest ideals of the Criminal Justice Section. Recipient: Benjamin Ostrer, Esq. Benjamin Ostrer has tried numerous cases to favorable verdict and has successfully litigated appeals before the New York State Court of Appeals and Appellate Divisions. He regularly accepts pro bono matters on behalf of individuals accused of serious crimes, including People v. Maragh, 94 N.Y.2d 569, (Orange) which resulted in the adoption of a new jury charge with respect to juror expertise and the reversal of a homicide conviction; People v. Pitkin, (Ulster) in which he obtained not guilty verdict of all charges, including Murder 2nd, in a shaken baby diagnosis case and, in Saratoga County, on behalf of Katherine Seeber, in which he and now U.S. District Court Judge Vernon Broderick and Corey Chivers successfully vacated a guilty plea, ending 12 years of incarceration for a young woman based upon falsified evidence at the New York State Police Lab. He is currently engaged in the pro bono defense of a man accused of homicide in the death of an escaped rapist in Orange County. Ben is a Past President of the New York State Association of Criminal Defense Lawyers, and a currently serves on the Board of the Criminal Justice Section of the NYSBA and the Legal Aid Society of Orange County.

The Vincent E. Doyle, Jr. Award for Outstanding Judicial Contribution in the Criminal Justice System Presented by the Criminal Justice Section Recognizes outstanding judicial efforts to improve the administration of the criminal justice system. Recipient: Honorable Eugene F. Pigott, Jr. Eugene F. Pigott, Jr., Senior Associate Judge of the Court of Appeals, was born in Rochester, New York. He graduated from LeMoyne College (B.A.1968). Judge Pigott served on active duty in the United States Army from 1968 to 1970. While in the service, he was stationed in the Republic of Vietnam, serving as a Vietnamese interpreter. He graduated from SUNY at Buffalo School of Law (J.D. 1973) and was admitted to the Bar of the State of New York in 1974. Judge Pigott practiced law in Buffalo, New York, with the firm of Offermann, Fallon, Mahoney & Adner from 1974 to 1982. In 1982 he was appointed Erie County Attorney and served in that position until 1986. In 1986 he became chief trial counsel for the firm of Offermann, Cassano, Pigott & Greco. On February 4, 1997, he was appointed to the New York State Supreme Court by 14 | The New York Bar Foundation Governor George E. Pataki and thereafter was elected to a full 14-year term. In 1998 he was designated to the Appellate Division, Fourth Department and was appointed Presiding Justice on February 16, 2000. On August 18, 2006, he was nominated by Governor Pataki to the Court of Appeals. His nomination was confirmed by the New York State Senate on September 15, 2006. He and his wife Peggy live on Grand Island, New York. They have two children.

The Michele S. Maxian Award for Outstanding Public Defense Practitioner Presented by the Criminal Justice Section Recognizes an outstanding public defense practitioner. Recipient: Cynthia Conti-Cook, Esq. * Cynthia Conti-Cook is a staff attorney at New York City’s Legal Aid Society, Special Litigation Unit of the Criminal Defense Practice, where she oversees the Cop Accountability Project and Database. She has presented the database at national defender conferences and consulted with defenders across the country to help them set up similar databases. Also in pursuit of greater police accountability and transparency, she filed a petition, which was granted, demanding that the Civilian Complaint Review Board disclose the number of substantiated community complaints, along with any resulting discipline, for Officer Daniel Pantaleo (the officer whose chokehold killed Eric Garner). She is also involved in several large impact litigation projects, including the injunction to stop the Department of Correction from filming inside of attorney-client arraignment interview booths. Cynthia also works closely with Legal Aid Society’s incredibly talented staff attorneys doing research, writing and brainstorming at all stages of their criminal cases. Prior to joining Legal Aid, Cynthia was a civil rights litigator for seven years at a small Brooklyn law firm, Stoll, Glickman & Bellina, LLP, where she brought over 100 civil rights lawsuits against police and correction officers in New York City and State. A Guide to NYSBA Awards at the Annual Meeting | 15 Outstanding Appellate Practitioner Presented by the Criminal Justice Section To recognize outstanding advocacy, protection of due process and the public welfare, and the integrity of the judicial system by defense attorneys and prosecutors. Recipient: Barbara J. Davies, Esq.* Barbara J. Davies, a Buffalo native, is a summa cum laude graduate of the State University of New York at Buffalo and a graduate of SUNY Buffalo Law School, where she was a member of the Buffalo Law Review. Her first job was at Lipsitz, Green, Fahringer, Roll, Schuller and James in Buffalo where her career as a criminal appellate attorney began. Ms. Davies switched sides briefly in the early 1980’s when she was an assistant district attorney in the Erie County District Attorney’s Office, handling many appeals before the Appellate Division, Fourth Department and the Court of Appeals. During this same time period she was also Executive Assistant to Erie County District Attorney (now US District Judge) Richard Arcara. When Ms. Davies was hired by the Legal Aid Bureau of Buffalo, Inc. in 1987, she never imagined that she would spend the next 28 years (and counting) happily working for this not-for-profit legal services organization. When Ms. Davies became supervisor of the Legal Aid’s Appeals Unit in January, 1988, she was faced with an enormous backlog of pending criminal appeals. Her first task was to deal with this problem, which she solved, by working with Appeals Unit staff and pro bono attorneys. The result was that the average time to perfect an indigent criminal appeal was significantly reduced. Throughout her career at the Legal Aid Bureau, her primary responsibility was to oversee the work of a dozen or so staff attorneys who represent on appeal all indigent defendants convicted in Erie County superior courts. While she did have her own cases, one of the more gratifying duties as supervisor was offering advice and guidance to colleagues and mentoring new attorneys in the important work of representing indigent criminal appellants. In June, 2014 Ms. Davies stepped down from the supervisor role to assume a four-day a week position where her only focus is her own caseload, which recently included making new law for youthful offenders (People v Middlebrooks, decided by the Court of Appeals in June, 2015). * To be presented in the Spring

Catherine Richardson Ad a.indd 1 12/2/2015 4:19:27 PM Outstanding Police Contribution in the Criminal Justice System Presented by the Criminal Justice Section Recognizes outstanding efforts to improve the police function within the criminal justice system. Recipient: William Bratton, New York City Police Commissioner William J. Bratton was sworn in as the 42nd police commissioner of the City of New York on January 1, 2014, the second time he has held the post. Since then he has overseen two years of declining crime, including historic lows for murders and robberies. At the same time, he implemented an unprecedented Neighborhood Policing program and has worked to close the gap between the NYPD and some of the communities it serves. A U.S. Army veteran of the Vietnam War, Commissioner Bratton began his career in 1970 as a beat cop in the Boston Police Department. By 1980 he had risen to Superintendent of Police, the department’s highest sworn position. In the 1990s, he established an international reputation for re-engineering police departments and fighting crime, first as Chief of the New York City Transit Police, and then as Boston Police Commissioner. In his first term as New York City Police Commissioner, from 1994 to 1996, he revitalized morale and achieved the largest crime declines in New York City’s history. As Los Angeles Police Chief from 2002 to 2009 he brought crime to historically low levels and greatly improved race relations. Commissioner Bratton is a graduate of Boston State College and the FBI National Executive Institute. At Harvard University’s Kennedy School of Government, he was a Senior Executive Fellow in Criminal Justice and a member of the school’s National Executive Session on Policing.

Outstanding Contribution in the Field of Criminal Law Education Presented by the Criminal Justice Section Recognizes outstanding work in criminal law education, the promotion of interest in the practice of criminal law, and the provision to students the opoprtunity to gain practicing insight into the operation of the criminal justice system. Recipient: Peter Gerstenzang* Peter Gerstenzang is the senior partner in the Albany firm of Gerstenzang, O’Hern, Sills & Gerstenzang where he focuses on Criminal Defense with an emphasis on DWI cases and Vehicular Crimes. He commenced his legal career as a prosecutor for the United States Army in the Republic of Vietnam. From 1972 to 1975, he was an Assistant District Attorney for the County of Albany. Certified as a breath test operator, he taught at the New York State Police Academy in its Breath Test Training Program for 12 years. Mr. Gerstenzang is 18 | The New York Bar Foundation Board Certified by the National College for DUI Defense (ANCDD@), and is a former Dean of that college. The NCDD is the only organization accredited by the American Bar Association to certify attorneys as specialists in DUI law.* His book, Handling the DWI Case in New York, published by West Group, is considered a standard reference in the field of Driving While Intoxicated cases. Peter Gerstenzang is a regular lecturer for the New York State Bar Association, the New York State Association of Criminal Defense Lawyers, the National Association of Criminal Defense Lawyers, the New York State Magistrates Association, and the New York State Defenders Association. A Guide to NYSBA Awards at the Annual Meeting | 19 Outstanding Prosecutor Presented by the Criminal Justice Section Recognizes a prosecutor who has made a special contribution not only to the prosecution community, but to the bar at large, and whose professional conduct evidences a true understanding of a public prosecutor’s duty to advance the fair and ethical administration of criminal justice. Recipient: Kathleen B. Hogan, Esq. Kate Hogan is the Warren County District Attorney. After graduating from Washington and Lee University Law School, she began her legal career as an Assistant District Attorney in Brooklyn, where she specialized in trial work, prosecuting murders, rapes and serious felony cases. Kate entered private practice but soon returned to prosecution, accepting a position with the New York Prosecutors Training Institute. In 2000, she accepted a position as an Assistant District Attorney in Warren County. In 2001, Kate was elected Warren County District Attorney. She currently is serving her fourth term. She currently serves on the Executive Committee of the District Attorney’s Association and Sub-committee on Sexual Assault and Family Violence. Kate served on Chief Judge Lippman’s Justice Task Force and currently serves on the Sentencing Commission and the Children’s Justice Task Force. In 2011, she was appointed to the New York State Law Enforcement Council and serves as the Council’s chairperson. She has served on Chief Judge Kaye’s Commission on the Jury and the New York State Arson Board. In April 2007, the United States Attorney’s Office for the Northern District of New York awarded her their Spirit of Justice Award for her work on behalf of victims of crime. In 2010, the Kings County District Attorney awarded her the Distinguished Alumni Award. In July 2012, the New York Prosecutors Training Institute awarded her the Prosecutor of the Year, Executive Leadership Award. In July 2013, Governor Cuomo appointed Kate to the Moreland Commission which was charged with the task to probe systemic corruption in state government.

Catherine Richardson, Esq. Catherine’s passion for the legal profession and commitment to community service is remarkable. A brief synopsis of her services includes: being the President of New York State Bar Association (1996-1997); the first woman President of the Onondaga County Bar Association (1987); President of the New York Bar Foundation (2009-2012); Chair of the Foundation Fellows (2005-2008), and a member of the Board of Governors of the American Bar Association (2003-2006). Catherine practiced her entire legal career as a lawyer at Bond, Schoeneck & King, PLLC in Syracuse. She continues to serve the legal community as board member and past President of ABA Retirement Fund. And if you think she is truly retired, she is currently Chair of SRC, Inc. a company that keeps America safe and strong, a board member of the New York Chiropractic College and the Gifford Foundation, and is one of the co- chairs of Consensus, a commission on the modernization of local government in Onondaga County. Intellectual Property Law Section Law Student Writing Competition Presented by the Intellectual Property Law Section Recipients: TBA Distinction in International Law and Affairs Presented by the International Section Honors outstanding efforts in the area of international law and affairs. The award recognizes those who have made a major contribution to international peace, understanding and democracy. Recipient: Judge Fausto Martin De Sanctis Judge De Sanctis is a Brazilian Federal Appellate Judge with the Federal Court of Appeals, 3rd Region (Sao Paulo). Judge De Sanctis is renowned for his courageous fight against organized crime, corruption, tax evasion and money laundering. He first became famous for his performance in several controversial cases, especially for the Operation Satiagraha and the subsequent public dispute with the Supreme Court Judge Gilmar Mendes. He also made the headlines with the overseas arrest warrant for a high profile advisor and the freezing of bank accounts over money laundering allegations. In the growing and important fight against corruption in Brazil and elsewhere, Judge De Sanctis has led by example, and the International Section is proud to award him the annual Award for Distinction in International Law.

A Guide to NYSBA Awards at the Annual Meeting | 27 Pergam Writing Competition Presented by the International Section To foster legal scholarship among law students in the field of international law. The competition is intended to encourage students of law to write on areas of public or private international law. The Section believes that by providing a forum for students to disseminate their ideas and articles, the professional and academic communities are enriched. Furthermore, the competition presents an opportunity for students to submit law review quality articles to the Section for possible publication in one of its publications. Recipient: TBA Award for Advancement of Judicial Diversity Presented by the Judicial Section The NYSBA Judicial Diversity Award serves to recognize individuals for their efforts to promote diversity on the bench throughout New York State. Recipients will embody the New York State Bar Association’s commitment to diversity and inclusion at all levels of the judiciary. Recipient: Honorable Edwina Mendelson Judge Mendelson was appointed to the New York City Family Court bench by Mayor Michael R. Bloomberg on January 24, 2003, and was reappointed by Mayor Bill de Blasio in October 2014. She served as a trial judge in Queens County Family Court until February 14, 2008, when she was appointed Supervising Judge of that Court. One year later, on May 6, 2009, Judge Mendelson was elevated to Administrative Judge in charge of all New York City Family Courts. In October 2015, Judge Mendelson resumed the trial bench. Before becoming a judge, Judge Mendelson served as a Court Attorney-Referee in Queens County Family Court presiding over child protective proceedings from July 2001 until her appointment to the Family Court bench. Prior thereto, she practiced law for ten years as a member of the Assigned Counsel Panel, representing parents and children in New York County Family Court and in Supreme Court matrimonial matters.

Mr. McCarthy is a regional leader at Nationwide Mutual Insurance Company, with oversight of litigation in over fifteen law offices in six Northeastern states. He is a Certified Litigation Management Professional, whose primary specialization is in complex, high exposure cases in Commercial, Excess, Surplus and Specialty lines of insurance. Bob is a member of the New York State Bar Association House of Delegates and Trial Lawyers Section. He is the former Chairman of the NYSBA Torts, Insurance and Compensation Law Section and currently serves on the Section’s Executive Committee. Glenn A. Monk began his career as an ADA in the Trial Division of the New York County District Attorney’s Office. Mr. Monk has been in the insurance defense field since 1984 and has been a proud and active member of the NYSBA where he serves on the Executive Committee of the Torts, Insurance and Compensation Law Section and Chairs the Premises Liability/Labor Committee, of which he was the recipient of the “Chair of the Year” Award in January 2008. District Representative of the Year Presented by the Torts, Insurance and Compensation Law Section (TICL) This award recognizes an outstanding TICL Section Executive Committee District Representative. Recipient: Terrence Lee Tarver, Esq. Terrence L. Tarver is an attorney at Sullivan Papain Block McGrath & Cannavo, P.C., where he practices all types of personal injury litigation. Mr. Tarver handles all facets of these cases from inception through trial and has obtained millions of dollars in results for clients, including a $500,000 settlement in December and a $4 Million verdict in June. Torts, Insurance, And Compensation Law Section & Trial Lawyers Section Honoree Presented by the Torts, Insurance, and Compensation Law and Trial Lawyers Sections Presented in honor of Judge Jenny Rivera for her devoted and accomplished efforts for the benefit of the bench and bar, and for her inspiring administration of justice for the people of the State of New York. Recipient: Honorable Jenny Rivera Jenny Rivera, Associate Judge of the Court of Appeals, was born in New York City in December 1960. On January 15, 2013, Governor Andrew M. Cuomo nominated her to the Court of Appeals, and the New York State Senate confirmed her appointment on February 11, 2013. Judge Rivera has spent her entire professional career in public service. She clerked for the Honorable Sonia Sotomayor, on the Southern District of New York, and also clerked in the Second Circuit Court of Appeals Pro Se Law Clerk’s Office. She worked for the Legal Aid Society’s Homeless Family Rights Project, the Puerto Rican Legal Defense and Education Fund (renamed Latino Justice PRLDEF), and was appointed by the New York State Attorney General as Special Deputy Attorney General for Civil Rights. Judge Rivera has been an Administrative Law Judge for the New York State Division for Human Rights, and served on the New York City Commission on Human Rights. Prior to her appointment, she was a tenured faculty member of the City University of New York School of Law, where she founded and served as Director of the Law School’s Center on Latino and Latina Rights and Equality. She graduated from Princeton University, and received her J.D. from New York University School of Law and her LL.M. from Columbia University School of Law.

Jason is as an active member of the Entertainment, Arts and Sports Law Section of the New York State Bar Association (including as Chair of the Law Student Liaison Committee), and volunteers his services for numerous not-for-profit organizations (including New York Foundation for the Arts and Brooklyn Arts Council), providing legal guidance to artists in the community regarding copyright, contracts and negotiation.
