Abruzzese Brooklyn Daily Eagle NEW TRIAL ORDERED FOLLOWING PROSECUTOR’S INAPPROPRIATE COMMENTS Appellate Division, Second Department A new trial for defendant Loren Dawson was ordered in Kings County Supreme Court, Criminal Term, due to inappropriate remarks made by the prosecution. Dawson was convicted of attempted assault in the first degree, assault in the second degree and criminal possession of a weapon in the fourth degree in connection with an incident that occurred inside a restaurant in Brooklyn on May 6, 2016. During Dawson’s trial, the evidence presented established that during the incident, Dawson swung a knife at someone and caused a number of lacerations, including a 12-centimeter laceration on a bystander’s neck. Upon Dawson’s appeal, the justices of the Appellate Division. Second Department, found that, contrary to Dawson’s contention, the prosecution did present legally sufficient evidence that he intend- ed to cause serious physical injury and was not justified in using deadly force. Therefore, they concluded that the jury’s rejection of Dawson’s justification defense and the verdict of guilt were not against the weight of the evidence. On the other hand, the jus- tices agreed with Dawson’s argument that the cumulative effect of the prosecutor’s improper comments during summation deprived him of a fair trial. Noting that the contention was unpre- served for appellate review, the justices nevertheless reached it in the exercise of their interest of justice jurisdiction. In their review of the record, the justices determined that, during summation, the prosecutor repeatedly engaged in improper conduct. Noting that the prosecutor referred to Dawson’s self-defense claim as “ridiculous,” “insulting” and “ludicrous” and informed the jury that the defendant would “tell [them] anything” in an effort to “sell” them a story, the justices also mentioned that the prosecu- tor described Dawson as a “hothead” and a “punk” who could not “take a beating like a man.” Additionally, the justices found that the prosecutor improperly invoked the jury’s sympathy for the victim, vouched for the victim’s credibility and interjected the prosecutor’s own sense of moral retribution with respect to the victim’s entitlement to use physical force against Dawson, while misleading the jury as to the law on justification. The justices con- cluded that the cumulative effect of the prosecutorial miscon- duct was to deprive Dawson of a fair trial and ordered a new one. Finally, the justices highlighted that since there must be a new trial, it should be indicated that the Supreme Court’s jury charge failed to convey adequately that if the jury found Dawson not guilty of the greater charge of attempted murder in the second degree on the basis of justification, it was not to consider any of the assault charges for which justification was also a defense. —People v Dawson, 2017-06314, Dec. 4, 2019 ••• CASE DISMISSED AGAINST DEFENDANT FOR PEDESTRIAN INJURIES Appellate Division, Second Department In the Appellate Division, Second Department, plaintiff Margaret Levi appealed an order by Hon. Debra Silber of Kings County Supreme Court, Civil Term, which granted the motion of defendant Maria Biesty for summary judgment, dismissing the complaint asserted against her. Levi filed the com- plaint on behalf of Margherita Nanfro, who was struck by a car driven by Elisa Agostinelli and owned by Enrico Nardone, as she was walking across Rutherford Place at its intersection with Hon. According to a report prepared by a detective who responded to the accident, shortly after Biesty stopped at the stop sign at the intersection, she allegedly made a gesture to Nanfro, who was already halfway across Rutherford Place, to continue crossing the street. Allegedly, one second later, Nanfro was struck by Agostinelli‘s vehicle. Agostinelli claimed that she did not see Nanfro prior to the impact and did not take any evasive actions. In the Supreme Court, Biesty moved for summary judgment, contending that she did not negligently wave Nanfro across the street and that, in any event, Agostinelli’s negligent conduct constituted an intervening and superseding act that broke any connection between her alleged negligence and Nanfro’s injuries. That motion was grant- ed, and Levi subsequently appealed. In response, the justices of the Appellate Division, Second Department, affirmed the deter- mination of the Supreme Court. They explained that Agostinelli’s unforeseeable failure to see what was there to be seen and fail- ure to yield the right of way to Nanfro, who was crossing the street within an unmarked crosswalk, constituted an intervening and superseding cause that established Biesty’s entitlement to judgment as a matter of law. —Levi v.
