R.) 2"d NOVEMBER, 1999 Fundamental rights - Failure to promote the petitioner as a Major General - Article 12(1) of the Constitution. The petitioner was suspended from duties until the hearing and determination of the "Embilipitiya disapperances case” and he was not considered for promotion pending the court case. Consequently, he was superceded by two other officers. After trial, he was acquitted. Thereafter, the Commander of the Army made a written recommendation to the Secretary, Ministry of Defence (the Is1 respondent) that the petitioner be, inter alia, promoted to the rank of Major General with'effect from 4lh December. 1997 on a supernumerary vacancy on which date the two officers who had superseded the petitioner were promoted to the rank of Major General and thereafter be absorbed into the permanent cadre with effect from 10lh February. 1999 on which date the High Court judgement was delivered. However, the petitioner was not promoted to the post of Major General on the ground that the promotion was not in the best interest of the Army since the petitioner failed to exercise due control over persons who were convicted by court. The petitioner did occupy a place of authority in the chain of command. But so were others above and below him who were nevertheless pro­ moted. There was also no explanation why a captain Chamarasinghe who had been indicted in the court was promoted with effect from 2"d June 1995 to the rank of temporary major.

Provincial Councils - Dissolution - Writs of Certiorari and Prohibition - Whether the Governor has a discretion, when he exercises the power of dissolution of a Provincial Council, vested in him under Article 154 B (8) (c) of the Constitution or whether he is bound by the advice of the Chief Minis­ ter in terms of Article 154B(8) (d). The two Provincial Councils of North Central Province (N.C.P.) and Sabaragamuwa Province (S.P.) were dissolved by the respective Gover­ nors of the said Provinces by Orders published in the Gazette dated 3.1.1996. In consequence, the Commissioner of Elections published No­ tices dated 4.1.1996 indicating his intention to hold elections to the said Provincial Councils, and called for nominations. On representations made by the general public and on information gathered by them about the al­ leged maladministration of the said Councils, the said Governors have CA Mahindasoma v. Senanayake and Another 181 sought the advice of their respective Chief Ministers whether the said Coun­ cils should be dissolved. The said Chief Ministers who command the support of the majority of members of the said Provincial Councils, ad­ vised the said Governors against dissolution. Thereafter the said Gover­ nors sought the advice of Her Excellency the President, in the alleged exercise of their discretion.

    Brigadier General Lewis M. Boone Director, U.S. Army Physical Disability Agency Brigadier General Lewis Boone was commissioned a second lieutenant of Infantry in 1980 following graduation from the Reserve Officers’ Training Corps program at Western Maryland College with a bachelor’s degree in sociology. Following commissioning, he attended the Infantry Officer Basic Course at Fort Benning, Georgia, before heading to his first assignment, at 2nd Brigade, 1st Armored Division, in Erlangen, Germany. There he served as a platoon leader and company executive officer with the 1st Battalion, 46th Infantry. For his next assignment he returned to Fort Benning to attend the Infantry Officer Advanced Course and Ranger school. He remained at Fort Benning to serve with the 29th Infantry Regiment as armored carrier operations chief, battalion motor officer and company commander in both 1st and 2nd Battalions, 29th Infantry, and later as operations officer for the 29th’s Bradley Training Detachment. Brigadier General Boone next attended the Defense Information School at Fort Benjamin Harrison, Ind., and then moved to Fort Bragg, N.C., where he began his tenure in Army public affairs as commander of the 49th Public Affairs Detachment and later as the XVIII Airborne Corps command information officer. During Operations Desert Shield and Desert Storm, he served as the XVIII Airborne Corps public information officer with the primary duty of escorting media during both operations. Following redeployment from Southwest Asia, he served as the 82nd Airborne Division public affairs officer until departure for Fort Leavenworth, Kan., to attend the Command and General Staff Officer School.
