Justice Khare favoured en- larging the jurisdiction of these courts, to enable them try offences punishable with imprisonment of up to seven years. Amidst thunderous applause from the prisoners, he assured them that a final decision on the matter would be taken soon. The court, which started functioning in May 2000, sits twice a month at present and tries petty offences punish- able with imprisonment for up to three years. Director general, prisons, Ajay Agrawal, Supreme Court Bar Association presi- dent R K Jain and secretary Ashok Arora, also present on the occasion, supported the idea. They said it would save considerable time and re- sources besides the ‘‘harass- ment’’ to inmates and police personnel. PTI

DDA to chop 500 trees in Nehru Place

TIMES NEWS NETWORK New Delhi: Over 500 trees in a park in Nehru Place are on the verge of being lost to a concrete jungle. For the Del- hi Development Authority (DDA) plans to axe the trees and develop the park as a night bazaar-cum-parking lot in the commercial centre. A consultant architect has already been hired for the project. But the proposal to axe trees has not gone down well with the Delhi Munici- pal Corporation (MCD) and the corporate company which has been developing the park over the last nine years. It had a pact with the MCD. Spokesperson of the said: ‘‘We have facts to prove that the park has brought down pollution in the area.’’ Sunita Narain of Centre for Science and Environment (CSE) has even requested the lt-governor to intervene. ‘‘Protecting greens in the city is important, especially, in a congested area like Nehru Place. It would be best if the DDA finds an alternative site for its plan,’’ she reacted. DDA vice-chairman Sub- hash Sharma said there was nothing wrong in cutting trees for development. ‘‘Aren’t trees cut when fly- overs are built,’’ he asked. Sharma said the DDA was prepared to plant 10 trees for every tree axed in the project. ‘‘We are willing to follow the prescribed norms for restor- ing greenery,’’ he said. 6 SUNDAY TIMES OF INDIA New Delhi, January 26, 2003 DELHI Katara murder accused want charges to be dropped

TIMES NEWS NETWORK New Delhi: Nitish Katara murder case accused Vikas Yadav and his cousin Vishal Yadav have moved the Delhi high court, saying the charges against them should be dropped. The matter had come up for hearing before the court of Justice R C Chopra, who listed it for Tuesday for the response of advocate S K Sax- ena, who is a special public prosecutor in the case. The defence lawyers K N Balgopal and G K Bharti have taken the plea that there was no evidence to suggest that Nitish has been forceful- ly taken from the wedding ceremony. Secondly the hammer with which Nitish was killed was not sent along with blood smears for the DNA test to es- tablish the deceased was the son of Neelam Katara. Ni- tish’s body was found in a charred condition after he was abducted. Vikas and Vishal are ac- cused of kidnapping Nitish from a wedding and then murdering him on February 16-17 night last year in Ghazi- abad. The alleged provoca- tion was that they did not like his friendship with their sister Bharti Yadav. The Supreme Court on Au- gust 23 had transferred the trial proceedings from Ghazi- abad to Delhi on a petition filed by the victim’s mother Neelam Katara alleging that a fair trial was not possible there. The U.P. police had filed the chargesheet in Ghaziabad court against the accused in April, but the apex court had stayed the tri- al proceedings at Ghaziabad court following the transfer petition. Vikas is also an accused in the murder case of ramp model Jessica Lall. Before this, the high court had already rejected the plea of the accused to stay the tri- al in the court of additional sessions judge S N Dhingra. The accused had then tak- en the ground that since Vikas Yadav was also an ac- cused in Jessica Lall murder case, both can not go on si- multaneously because of practical difficulties.

He said he obtained a pass- port by faking his age, only to get a job in the US and help his family. The period in prison ‘‘was mental and physical tor- ture’’, he said, recalling his days in custody. ‘‘I was told if I owned up to the attacks on the WTC I would be given a new life. The FBI said it would bring my wife and son to the US, and give us a house and enough finances si that I would never have to work again,’’ he said. Azmath said the FBI showed him his flying li- cence and told him he was a pilot as well as a navi- gator. ‘‘They told me I was one of those who attacked the WTC, that I was from Egypt. They said they could do anything and also get my photographs and passport from that coun- try,’’he recalled. Detailing the mental tor- ture he faced, Azmath said the FBI told him that he could never see his family again. ‘‘They said my punish- ment for attacking the WTC would be death,” he said. “The prison lights used to be switched on 24 hours, I was not allowed to sleep and for a number of days I was kept in freezing tempera- tures,’’ he said. With the past behind him, Azmath said, ‘‘I will simply rest for a few days and begin all over again.’’
